Court Timetable - Is the date set?

Hi

I'm about to apply to Court using the C100 form. When I do how long before a court date and is there any flexibility  when they send me a date as I am out of the country at the beginning of June?

Hi,

As a guide it should not take any longer than 2-3 weeks until you hear back from court after you made your application.

Once the court has reviewed and accepted your case they should also list a first hearing (FMDRH-First Meeting Dispute Resolution Hearing) within 2-3 weeks.

So, if you were to apply before Easter I would think you will be listed before June.

You can not pick dates, although once in the court arena the judge will do case management in front of you saying what is going to happen next and when. You then have a chance to say that you are not available for the next hearing and you may suggest an alternative. This is how my judge had done it all the way through.

At the end of every hearing she suggested a date and time for the next hearing and asked if we were available.

Strictly speaking once a date is set you would need consent from the other party and ultimately from the judge to move it.

Usually it is not a problem to move a hearing 1-2 times before it will affect your credibility.

If your hearing is in June you must immediately write to the court and inform them about it.

You may also make a note on your availability on your initial c100 application and ask for a hearing in May.

It depends on local court avalaiblity, but normally you hear in 14 days, for a date in about 10-14 days.

Phone your local County Court, as some you can only bring in applicaitons by appointment. Make them aware of the dates your out of the UK, and they should take that into account when listing it.

Thanks looks like the application will go in this week. Where on the C100 form would you indicate not available, or in the country, beginning June?

Hi,

There is no dedicated section for such but I would make a comment in section 3 where you have been asked what you want the court to do. You could say here that you want a hearing before June as you are away between xy and xyz.

You would need a bit delicate here as the court will regard this as your application and would expect that you will make everything possible to attend the hearing.

Hopefully you will be listed before June anyway if you apply next week.
