Enforcing Court Order for Contact - Advice Needed
#1
Hi All,

I separated from my wife nearly a year ago and we have 2 children who are 6 & 7. The separation is not what you would call amicable with my wife having made several allegations against me for assault, harassment etc all of which have been proven to have no substance. I also have a section 7 report which recommends the kids spend weekends with me and my new partner as well as part of their school holidays.

In January I got a Court Order granting me access every other Saturday from 1030-430 (I know it’s not a lot but it’s all she’d agree to at the time). Since then I’ve seen my daughter 4 times and my son only once.

My wife hasn’t turned up on several occasions to the meeting point and on other occasions has started an argument then stormed off with the kids.

Other than spending another small fortune on solicitors to get the Court order enforced is there anything else I can do? Am I better just representing myself if it just becomes the same exercise on repeat?

I’d appreciate any advice any of you might have.

Thanks,

Rob.

File a C79 Application for Enforcement, and also in the application, claim back your costs of the failed contact.
Posts made by me are my opinion and any factual information should be checked out. If you do not have a Solicitor, often your local CAB can get you some initial advice.
