C100? Specific issue? Prohibited steps? Which order to make?

The above is the background.

Partner just rang family court to ask what kind of application he should make given there has already been a breach, and now mum is taking child away with 2 weeks notice and no discussion or consent from dad, breaching the order again. They refused to help and said here's a number for legal advice but they aren't open today. Helpful....!

Courts can be helpful over information on filing documents and other court matters but won't give legal advice. You could get a free half hour's advice with a Solicitor but they are likely to say the same as we did. Did the ex agree to any additional contact time in lieu of the missed time over the holiday?

No. She wouldn't agree to anything.

He's filled in a c100 for a fresh application. A prohibited steps regarding the holiday. And an enforcement order for the breaches.

It takes 4 weeks for evidence from the police for his legal aid. So he has had to just had to put them in with no advice given she could go away as early as next Monday.

The Legal Aid can be done faster that then, where there is a need to get it in court before normal timescales.
Posts made by me are my opinion and any factual information should be checked out. If you do not have a Solicitor, often your local CAB can get you some initial advice.

The solictor explained that, but also said that if he didn't get proof (his proof doesn't fit any of the tick boxes on the form) that he would be landed with the bill. He's on nil income at present, so didn't want to take that chance. He is still applying so he can get representation for the further c100 hearings.
