Relationship Breakdown: 'Lies' About Behaviour

When accusations start flying

Separation and divorce can bring out the worst in people. When a relationship ends, particularly if it ends badly, one or both parties may start making claims about the other person's behaviour that stretch the truth or ignore it altogether.

This happens for different reasons. Some people are angry and want to hurt their former partner. Others believe that painting a negative picture will help their position in court proceedings or child arrangements. Sometimes it is a mix of both.

The strong feelings that once held a couple together can flip into something hostile. What should be a straightforward process of separating two lives can become adversarial. In reality, when a separation turns nasty, both people lose time, money and energy that could have gone towards building a new life.

Why false claims happen

Untrue or exaggerated accusations during relationship breakdown tend to fall into a few categories:

  • Revenge or causing upset, where someone makes claims simply to create problems for the other person
  • Attempting to gain an advantage in court or during mediation
  • Control, using accusations as a way to feel in charge of a situation that feels chaotic
  • Genuine but mistaken belief, where people convince themselves that something happened differently than it did

These accusations can cover almost anything. Common areas include claims about parenting ability, financial behaviour, infidelity, drinking or drug use, and emotional or physical abuse.

It is worth noting that UK family courts focus heavily on evidence. Unsupported claims without documentation are unlikely to determine outcomes in child arrangements or financial settlements. However, false claims can still cause real problems. They may influence how professionals initially view you, affect contact with your children while matters are investigated, and create stress that makes practical communication harder.

Your situation may be slightly different. ask a question below ↓ and our editorial team will reply with our advice.

How to respond

If your former partner makes untrue claims about your behaviour, try to stay calm. Reacting with anger or making counter accusations tends to make things worse.

Keep records of everything. Save messages, emails and any other communication that relates to the claims being made. Note down dates, times and what was said or done. This kind of evidence can be important if you need to challenge accusations later.

Get proper advice. A family solicitor can help you understand your options and what the claims might mean for your situation. Legal aid for family law cases is very limited and primarily available where there is evidence of domestic abuse or child abduction. For most separation disputes, you will need to pay privately or represent yourself. The GOV.UK website has current information on eligibility.

If the accusations relate to your children and the dispute reaches court, Cafcass (the Children and Family Court Advisory and Support Service) may become involved. Their role is specifically to safeguard children's interests in family court proceedings and help the court make decisions about welfare. Being honest and cooperative with Cafcass is important, though the outcome will depend on the specifics of your case.

Consider mediation if direct communication has broken down. A trained mediator can help both parties discuss issues more constructively. The Family Mediation Council website has information about finding a mediator in your area.

Looking after yourself

Facing false accusations is stressful. It can feel deeply unfair, especially when you know the claims are not true. Give yourself permission to feel frustrated, but try not to let those feelings control your actions.

Talk to someone you trust. This might be a friend, family member or counsellor. Organisations like Families Need Fathers offer support groups where you can talk to other people going through similar experiences. The Family Rights Group helpline also provides advice on children and family law matters.

Focus on what you can control. You cannot force your former partner to be honest, but you can control how you respond. Staying measured and factual tends to serve you better than emotional reactions, both in any legal proceedings and in your own wellbeing.

These situations are rarely resolved quickly, and the process can be draining. Getting the right support makes a significant difference.

@Mk That's a really tough situation, and it's lucky you had the video evidence to clear your name. The Home Office and the criminal courts work separately, so an indefinite visa decision often hinges on the child's circumstances rather than the parent's conduct, which feels deeply unfair when you've been the actual victim. It might be worth reporting the conviction directly to UKVI and asking them to review the grant, ideally through an immigration solicitor. Keep every bit of evidence safe in case it's needed again.

I have been a victims of international marriage scam and my daughter and me has been insulted by my x wife and her son . But
she accused me of domestic violence by breaking things in the house. Fortunately I had a video recorded when she attacked me and the police found out about her lie and arrested her for the crime of assaulting and beating me.but But to my disbelief, home office has gave them a indefinite visa( her and her son ) even though I have all the evidence to prove her lie.

We was together 10 years one child through IVF after 7 years . She had an affair with a girl from her work i was devastated as time went on i was ok and met somebody else and then things turned very spiteful - Non Mol orders - Phoning social services with false allegations - Claiming to be a victim of domestic violence - Parental alienation and in the mean while i was doing 50/50 with everything - having fantastic holidays abroad i couldn't do anymore but nothing mattered she was out to try and destoy me . Im in court on the 5th feb to get a legal parental agreement signed by the court to stop her dictatorship . Dont stop being good dads
In the end the kids will see for themselves x

I have had another false allegation made about me by my ex partner this is the 8th/9th time she has done this,i have never been charged with anything, but each time I get locked in a cell for up to 22hrs and it's costing me £20 each time to get home, please help

Keep the head up fellas. My ex broke up with me. Took my house, my car and wouldn’t let me see the kids by way of making false allegations to get non molestation order in place. Took four months of family courts (useless and corrupt) and fighting every false allegation under the sun. Now have shared custody of the kids. The more allegations they make the less credible it all becomes… if you know you’re innocent then keep fighting. Will be worth all the stress and £s in the end.

My ex and I split up last year and I left house as ex 'needed time to think'. Then after few weeks it became clear she didn't want to get back together so I asked if we can get something in writing for children. No response, asked again, no response, finally response and she wanted to go via courts. Contacted solicitor who contacted ex. Few days later police phoned me and allegations against me coming in left right and centre.

CPS charged me based on her words....no evidence. I have literally 100's of pieces of evidence to prove she is lying through her teeth as I kept all correspondence between her and me which proves I am loving decent and caring partner and literally every thing she has accused me off I have dozens of pieces of evidence to disprove her.

Family court postponed today, as justice system here is absolutely useless, totally not looking after what is best for children but what is best for mum.
I have to be patient and I know my time will come but it is very hard though. Haven't seen my children in more than a year after seeing them every day of their little lives. Sometimes I am seriously struggling thinking is it easier to let go, then angry and full of fighting spirit because I am innocent and I owe it to my children. I will not let my ex get away with this.

I can honestly and with hand on my heart say that I have always been a faithful, caring, loving father and partner and then to be falsely accused of so many things.....whoa...that landed hard.

Looking forward however to wipe that smirk off her face and be able to hold my children in my arms again.
Need to keep my cool though....it is tough.

Partner was having an affair. I asked her to leave (my house before we met) she took our 5 year old. Then refused access and made up a lot of false allegations to include gbh etc. Been interviewed by police and no action being taken (as no evidence as it never happened) am literally paying 1000,s in legal fees to try an get shared custody of our child and even get access.
Has anyone ever successfully sued their ex for slander, libel or defamation in this respect?

I’m worried for my son it has taken 15 months for him to see his kids after every accusation his ex could think of. Court order of visitation/contact overnights ect is making him walk on egg shells as she would be checking the kids questioning them the moment they got back, making more false accusations. He’s got body maps and a log book for photographs when they are there surely she can’t keep doing this now court has seen through and sorted everything

Ex has made many false accusations over the last year but finally last week I was called in for voluntary interview with the Police. Went for the interview on Friday, I think it went okay but all very stressful and upsetting, feel numb. Solicitor said he thought it would get thrown out but it is still a huge worry. From what I gather I doubt she will suffer any consequences.

I'm currently going through hell with my ex, iv been with my partner for 10 years and have 3 kids. she decided she was going to have an affair so I told her to leave. She came back and asked for my forgiveness I excepted and she had taken the kids while I was at work and rang the police and said I had assaulted her. She later dropped the charges because she wanted to worm her way back in I later found out. Caught her recently mixed messaging me so I told her to leave, she fell down the stairs because she was drunk now I have GBH allegation against me ! I'm exhausted

My ex husband tested my knickers for semon after an office day out and claims that they are had positive results which is untrue. We have divorced since then and he has destroyed my entire life and has convinced the children that I have destroyed theirs. How can I prove my innocence and win back my children?
Wozza 23/10/2020 at 1:09 pm
I've just been found innocent of some very serious false allegations from my ex and want yo know how I can protect myself from this ever happening again
Keith 22/09/2020 at 9:32 am
hi, people, my ex has taken out a non molestation order, I am fine with that but it states I can't have no contact with my 5 kids for 6 months, never ever hit them once, now I find out after the injunction my ex wants me to be a Co parent, but for 6 months she has sabotage my relationship with my kids telling them not to contact me, but been reading do n don'ts of Co parent and it says don't sabotage the kids relationship with the dad but doing an injunction does exactly that ????

I'm coming to an end of a bitter divorce. I've managed to get a court order against my ex to prevent her from relocating. The judge and cafcas 100% agreed with me. Even stipulated that she is not permitted to be in the while I have the kids.

She showed up unannounced the other night during bed time and decided to spend the night as well as the following day until hand over.

I was angry, but asked her to leave. I warned her that I would call the police, but notice her recording the conversation on the phone.

She now claim emotional abuse because I told her I will call the police and if she did it again I will get a order against her

My wife left our home 3 month ago without taking the children with her. She made very serious allegations against me. Rape domestic violence and a lot more. I would be a danger for my children and a monster. Fact is the children are with me and they are happy. She is constantly trying to damage my image on social media and by calling my relatives. She made a ABE now and I am waiting for the interview by the police. My wife is now trying to force me to give her the children by insulting me and by emotionally abuse me via social media and false statements. As a man you always need to prove your innocence. But she as a woman can destroy my live with her lies. She studied that the uk is not using lie detector test. She wants me to go to jail to get now full custody. Please tell me how can I get help or what can I do. This problem is making me nearly suicide

I left my ex 2 years ago, we have 2 children, and when she found out about me and my best friend being together who is now my wife, she began twisting everything in our relationship and made me out to be an aggressive abusive partner, which while our relationship was toxic it was her who had problems with aggression and project onto me, and for the most part we co parent well, but at the beginning she turned my whole family against me and continues to this day despite me trying to rebuild. Now whenever we argue she twists everything i say and manipulates me into traps for example saying i refused to leave when she followed me out the door still arguing and then texts me saying i cant see the kids this week because shes upset then when i reply tells me i refused to leave and that im harassing her, im scared of ths potential legal consequences she could use as a weapon to entrap me

@worriedmother.if your ex has (my condition) even restraining orders or even icu orders will not stop him he will think it’s just a (peace of paper and find it funny or like a badge of honour )and time is not important you could be happily married with other children and then one day you could find yourself looking down a (barrel of a gun and see hes face again it could be 20 years from now) .this is how serous my condition is .so be every careful don’t get complacent or your husband could stop him and get sloppy and think it’s just talk people with my condition are the real deal .i just have a understanding of my condition so take my advice very serous.and have yourself a wonderful day it could be your last .
C.laurie 21/05/2020 at 11:04 pm
@worriedmother.if your ex has my condition.there will be no stopping them if they feel wronged and if you have children together they will have zero feelings towards the children even there own flesh and blood they will see them as (pawns) .be very careful we are (master liars And very convincing )but we have( no morals)we will swear black and blue that we do have .but we stand for (number one ).i am glad the mother got my daughter and I hope my daughter doesn’t( date or marry someone like me ).and her mother made the right decision to keep the children from me gods truth and I do hope her step father adopted her and was a very influential father figure to her .in saying that it doesn’t mean that me and her mother are ok and she best keep her( distance forever ).all I am saying is they can (adopt the child I have zero issues with that) .but I still want to kill her mother gods truth I want to look in her eyes why she takes her last breath and say call me (f wit now slapper and my ugly face is the last thing you will see leaving this earth ).
C.laurie 21/05/2020 at 10:01 pm
@worriedmother.if your ex has my condition they are (not capable of love) it’s only a facade .we are only for( ourself )and see people as (pawns) we calculating manipulating And very dangerous and very capable of killing our own mother and even shed a tear at the funeral and play victim.i am not saying they will do it what I am saying is we have the right ingredients to do it and pushed the right way will do it .i am no psychiatrist this is what they explained to me about my condition.
C.laurie 21/05/2020 at 9:42 pm
@worriedmother.with my condition it can be very dangerous if I feel someone has wronged me I will manipulate twist things around and very capable of murder .because of my lower heart rate and the wiring in my brain my doctor explained this to me and showed me on the X-ray where my brain is different.so if your ex has my (condition).BE VERY CAREFUL BECAUSE WE ARE (WIRED DIFFERENTLY AND TO BE TAKING VERY SEROUS AND TIME MEANS NOTHING TO PEOPLE LIKE ME ) .What I have just explained is the (gods truth ).i give you this advice because I have been diagnosed and Thoroughly explained my condition bye professional psychologist.you ex may not even no there is something wrong it took me nearly 40 years to be diagnosed .just a heads up .
C.laurie 21/05/2020 at 8:57 pm
@worriedmother.after reading your post I myself have a psychotic disorder sociopath been (diagnosed) apparently it’s from my upbringing and genetics.i have a lower heartbeat then normal people that’s why I indulge in drugs And alcohol for stimulation and very antisocial and prone it fits of uncontrollable rage .i feel better now that I (understand my condition and have a name for it .for years I didn’t understand why I was like this ).its not easy having a (mental disorder) but I tools now to control it .there is no prescription drug or a cure it’s life sentence .
Worried Mother 21/05/2020 at 1:29 pm
Hi, I am so worried about my son and my Grandchildren. He split with his ex more than a year ago and she has stalked and harassed him and our family ever since.
I believe she has some kind of psychotic disorder and believe that there will be no limits to how far she will go.
A restraining order was placed on my son purely after her continued lies and false allegations against my son. She has abused in person and through telephone calls and social media my son and his immediate family. My Father died of cancer last year and she gained access to his property by deceit as he was vulnerable and stole money (My son was staying with him at the time nursing him and was out) She took some of my son's clothes and cut them up, sending him pictures. She has twice tried to run my son over with their children in the car! She stalks his social media by creating false accounts and then slanders him and his business.
I am aware that she smokes cannabis and is extremely volatile and is disliked by many people as she has such an aggressive personality.
I just do not understand how he continues to manipulate the system and make false allegations and they are followed through by the police-having my son arrested and interviewed but ending in NFA.
I worry about the safety of my Grandchildren. who we are all unable to see. I dread to think what sort of life they have with her (age 6 and 4)
She has a poor family background, her brother being convicted of murder at the age of 18.
I live in constant fear of what she will do next to my family. She tries continually to get my son to respond to her(restraining order in place from her lies) Some of the excuses being. She has cancer, the children have corona virus, the youngest child has fallen down the stairs, needs an MRI scan...
This is all very garbled and for that I apologise, There is just too much to right. I am so panicked and anxious. My son is now being treated for anxiety and depression following the loss of his Grandfather, not being able to see his children and this constant abuse and stalking. What can we do, and suggestions would be so gratefully received.

Hi, last year my wife of 4 years and I were in a bad place and we were going to break up, right away she started making comments about me not having my children overnight if we separate and that she will make sure in court that she will say I’m a violent drunk and it would be dangerous for the kids.. I’m living away from home and only have work colleagues that are not really friends. She has said she would use her mates to testify against me although I never see her friends... anyway I got scared about not seeing my kids and stayed.. one year later it’s happening again.. we have been together for 8 years and I’ve lived with my kids 6 years. I have two eldest is 6.
I’m gonna stay again for my kids, is there anything I can do now to protect myself from a future breakup... I only ever drink on special occasions or staff nights out, I actually train nearly every day I’m not the person she is saying and I feel it’s to scare me which works

hi so worried about my son. he and his ex partner have a 3 year old which my son has gone to mediation to have contact with. as he has not seen her for a few months although he is paying child support it was agreed at mediation that he could have access and then the following day she contacted my son to say he would never have access to his child. his ex partner has to told her new partner some months ago that my son raped her two years ago. this has never happened and she has been telling him other lies about my son. she has never reported this to the police and now my son has found out about this and wants to clear his name. what can he do?? go to the police to report the malicious rumour??? he is so worried that the police is going to turn up at his door and arrest him. he is going to go through court for access to his child. his ex is a classic narcissistic and makes everything believable. she cut me off from my grandchild 2 and a half years ago because I said I would get the other side of the story from my son. please can anyone suggest anything should he go to the police first or do nothing?? his head is scrambled at the moment with all of this.

My partner is a wonderful loving father to his 5 year old daughter Karen(Not real name) His ex wife put a false AVO on him in order to stop him seeing his daughter .This was when Karen was 3 .My partmer was not believed even tho it was his ex wife who was a danger to the child
Recently Karen had a large bruise on her back it lookef like she had been hit with a stick or wooden spoon when asked Karen clearly said to us and the police Mummy hit me Mummy hits me all the time.We couldnt believe it when the police believed the mothers lies that Karen had fallen off the couch. When we asked Karen if she had fallen off the couch she became very upset and yelled I didnt fall off the couch mummy hit me.
Because the police belived the mother we had to send her back it was heartbreaking. When we saw Karen again she was totally shut down and told us that Mummy was the best mummy in the world and never hits her .But you could see the fear in her eyes.
other things have happened like how Karen comes to us with mattered hair and ragged clothes also she she hasnt been fed
We disclosed this to child protection and they spoke to the mother and the next time we had visitation of Karen we asked if she had breakfast and she started saying very fast Mummy feeds me mummy always feeds me amd repeting it over again at lunch we tried to feed her and she was screaming that Mummy had turned and given her lunch and refused to eat.
Karen hides food in her room now and is to afraid to tell us about the abuse at home
Altho recently she told another child to Just die when we asked her why she said it she said Mummy says that to me all the time
My partner amd I were sobbing over this but we wont tell child protection or the police because they tell the mother and Karen is theatened and punished
My partner pays child support and the mother recently got his entire tax return money we were going to use for an eye operation Karen needs. After this money went to the mother Karen come to us with shoes to sizes to small and she couldnt walk properly in them
My partner than told me that his ex was wearing anew out fit and was bragging about a clothes shopping spree.
We are desperate to save our beautiful little girl and it kills us to hand her back to a abusive narssistic mother but the authorities that are meant to protect the child are protecting the lying mother.
What the hell can we do we would gladly take Karen and let the ex keep the child support payments and single mothers pension (Because thats all shes interested in) We want to give this beautiful child a happy childhood full of love but instead she is with someone who neglects and abuses Karen physically emotionally and mentally.
WHAT IS WRONG WITH THE WORLD

My wife is currently destroying me to everyone we both know especially to her work. At the same time she is abusing our joint account by spending all the monies I put in. So far I am paying for everything whilst she spends all her salary to herself. This is totally unfair. On other occasion, she also managed my son to now go against me as she also poisoned his mind by telling lies. I have never hit my wife but instead she always hit me. I am so fed up, destroyed, hurt and confused. The real truth is that she really is clinging on to me because she knows that I pay the bills and her other motive is a financial gain to the equity of our house. In the first place she got me to put her name in the mortgage by threatening me using my son as a weapon (when he was only 8 at the time, hes now coming to 24 years old). She has not contributed a penny once and accumulated debts, took a load without my knowledge and 2 credit cards, plus managed to still overdrawn our joint account. This is so damaging and I feel so down and so low right now. I wish this UK laws should go hard on people like these, they are abusing men for financial gain. I have not filed for divorce yet but I will be soon...

@sbowloc.after reading your story .mate you are a (different breed) you are the same us (my family ).gods truth i scarred the mother off my child’s face for life and gave her heaps off black eyes and gods truth I am (proud off it )I only regret not belting her more( gods truth ).you can hate on me but At least I’m honest .as for the system been flawed i wouldn’t no never been to court for visitation.i think the system is (good )they never got me in fact the police let me off ha ha .in fact I got away with it I love this new age stuff I used it and worked ha ha .
sbowloc 24/09/2019 at 11:06 pm
same for me, accused of abuse against my wife and children and no hope of ever clearing my name.. the current system is flawed without doubt and geared to ensure women get everything and us dad's get nothing..
Mikyboy 10/06/2019 at 9:43 am
A lot of woman are using the DV card, ( domestic violence) to make false allegations against their partners and that’s to get another place and free legal aid, god they know how to play the system, and the thing is you try clearing your name that she had lied about it assaulting her, there is nothing you can do, because that’s what my ex wife as done to me, made a call to the police to say I assaulted her to which I never, I only found this out after receiving her divorce papers and on it, it stated that a assault report was made to the police, I was never interviewed or charged by the police do all this was a shock to me, I telephoned the police and asked what all this is about? They said it was just a telephone log by your ex wife, I said but it’s untrue and I need to defend myself here, she said there is nothing to defend as no action was taken against you nor was you interviewed or charged, j said so you take a word of someone without asking the other person who. Ment to of assaulted her any questions because what she is saying is lies, he said it’s just a log and nothing else, how can people lie like that and get away with it?

I met my ex wife 8yrs ago. 2 1/2yrs of those 8yrs I spent lock up in the criminal justice system the charge? Criminal Domestic Violence of a high and aggravated nature. They were going for 15yrs with a 10yr plee. No criminal history, no arrest, no supporting evidence, no witness, no proof of any kind other then my own testimony of grabbing her as she became violent once she came home from "work " while I was packing my clothes finally ready to leave her after six years of living with (I didn't know then, but I know now) substance abuser. I loved, well still love my ex wife dearly. But the lies told and the consequences of the lies cause the loss of my business, home, reputation, and worse of all our marriage. She had been in a number of auto accidents prior to our meeting now I know related to substance abuse. One nearly fatal car crash that caused a multitude of cracked and broken bones. During our marriage while going through our off and on separation in late 2013-2014 due to her physical and verbal abuse she (supposedly) fractured her leg at work only later to find out (lying about the cause) that she was in yet another auto accident in late 2014. During such time she was under investigation for welfare fraud by the state, identity theft by the IRS, and child abuse by Child Protective Services. Oh yes and being sued for damages in which without my knowledge I was paying for. After finding out October 13, 2015 that my ex wife was in the hospital some 19hrs after accusations of domestic violence. Despite the fact that after I admittedly grab her to prevent any further violence against my person we talked from 2:15am until 9am when I dropped her off at work. After working her full 8hr shift she allegedly went to the hospital and nurses contacted police. When I arrived at the hospital (later to find out she went there for drugs) fearing she had done something to herself, it was then I learned the police had been called. And as I waited for them (volunteerary without restraint) it was then I was arrested, interrogated, and charged with the injures my ex wife had suffered through the years (based on court documents) she stated I did them. I charged 10yrs, 5yrs suspended, released from prison in 2 1/2yrs 4yrs probation. Gentlemen the criminal justice system is not a place that will not even care if you are innocent. There are men who treat, beat, and abuse there women and the courts cannot distinguish who is guilty or not. They should and they must look out for the best interests of battered and abused women and give hell to there abusers. However guys, any act of defence on your part from a physically abusive relationship. Don't try to figure it out. Don't feel like less than a man if you simply just walk away. You are not the one with the problem, she is. I love my ex wife in away only God would understand but without His love, there is no love. In closing remember, it's better to tell a woman your leaving her many hours after you leave, a

I have been falsely accused of domestic violence by my then partner, who is an alcoholic. The system always works in favour of the female. She hit me 3 times in public and I admitted to the police that I hit her back. This was happening in my home in which I took her in and looked after her. Drink turned her into a very nasty person and still does. Some females use allegations as a weapon and for some reason they do not get punished for it when the allegations are either proved false or the female withdraws the allegations. In my case, she withdrew the allegations. She ended up in a refuge! I could not believe what was happening and it all happened so quickly. It cost me 2 thousand pounds in legal fees when all she had to do was spent 100 odd quid to send a letter off to the CPS stating she didn't want to go ahead with it. Talk about trying to screw someone's life over. This similar thing had happened with one of her exes who did 4 years. I believed it at the time, but seeing as what I went through, I am now doubting it ever happened. When I was released on bail with conditions, she did everything in her power to entice me back to go and see her. I did but it wasn't her that dobbed me in for it. It was one of her family members. I spent a week on remand in prison because of it. Disgusting behaviour. also the lies she was spreading on social media playing the victim has tarnished my name and reputation in this town. If I were that was towards her, then why the hell was she asking me back all of the time. Unbelievable. I know that police have to act on reports by come on, this was clearly a waste of police resources. I still speak to her but live by myself now. Goodness knows why I still speak to her after what she did. She truly believes her own lies and that forms the basis for schizophrenia. I know more about her than what her own family know. Either that, or they choose to ignore everything about her. She's screwed me over good and proper. It's not her that's the victim. I have been the victim.

my wife went missing on the 25th of April 2018. The following day, i went to the local police station, where i saw your wife and son. my wife had submitted a report making an allegation of domestic violence against me. The police prevented me from approaching her or my son, and then i were detained and questioned. i were released after several hours pending investigation but with no charges being made. i have not seen or heard from my wife since this time. i believe that my wife and son are still in the Manchester area.
My partner made extremely serious but false domestic violence related allegations against me on 25/04/2018. This was done by her to achieve a certain ‘objective’. I was arrested by Police. I Released - Under Investigation im not allow to see my son and i don’t know where they are my wife she come to uk 30/11/2017 and she make false allegations I’m deny these allegations and believe outside forces and possible mental health issues are to blame for my wife fabricating this complaint it was plan apply for another visa to get benefit there is same one have advice her to do that she don’t know any thank abut the low in uk. and know it been more the 2 month i didn’t see my son I’m waiting for police decision

i have already contacted Manchester Free Legal Help and the Personal Support Unit at Manchester Civil Justice Centre and, following their advice, have issued an application for a Child Arrangements Order seeking a residence order and contact with my son. i submitted the C100 form, which could not be processed because i
do not know my wife’s current address, and therefore i were instructed to submit the C4 Form (application for disclosure of a child’s whereabouts) first. I successfully submitted the C4 Form to my local authority on 008/07 2018

Is it or has it made a difference to anyone now that family court is now not in private.

Hi my partner has been separated from his ex for 7 years she has constantly accused him of Domestic violence so much so that we have contact the police to advise that the police reports from the section 7 report are incorrect (he's taken her 2 court twice for access of the children). she has a DASH on her so when ever she rings it is treated as high priority, My partner has also advised that when they split she went into refuge to fast track her into getting a house. social service are again involved with the children and again she is making this extremely hard to deal with as refuses to sit in a room with me to discuss the children as she says she's scared of me! but she has no problems standing with me on the football pitch watching them play!!! I'm at a loss at what I can do to clear my name as its all hear say from her I have never been arrested, questioned, interviewed ect but she uses this excuses when ever authority's are involved.
SeparatedDads Editor 26/02/2018 at 10:40 am
Mediation is a process which aims to try and help parents to come to an amicable decision. While court is seen as the last resort in the process (where the court will make the decision on both parents' behalf and regarding what it thinks is in the best interests of your children), the court will not make a judgement on a parent if/where mediation has failed.
Luke 25/02/2018 at 4:38 pm
My ex girlfriend started making up that I was controlling her by stopping her going out and seeing friends and family so she told her family plus social services and I was arrested for assault on a child and controlling behavior which was dropped as there was no evidence to prove it but she was still put into a refuge which 2 weeks later she came back to the family home where we was getting on better as parents but behind my back she was still telling people that I was still controlling her and she asked social services to remove here and my 2 sons and know she has changed her number blocked me on social media and isn't allowing me to see my sons so now I have to attend a family mediation meeting to try and resolve it all and if my ex don't take part it will look bad on her and it will end up in court

I eventually had to take my ex to court for contact with my son. It transpired that she'd been plotting against me for months in advance. She did everything she could to try and cause me to react negatively or aggressively, but I kept my cool. I surrounded myself with family and friends to keep my spirits up and also they acted as witnesses. I also advised her I was recording our interactions. In the end she retracted her scott schedule accusations at court and now finally, we can deal with the matter at hand. My advice: Stay calm. Get a solicitor to protect you.or even better, a specialist barrister. Record interactions (after advising her you're doing this) or take along a family member or friend. Don't speak badly of your ex. Stay whiter than white and when things get to court it'll go in your favour. Think before you respond to texts or emails.how will your response be viewed in court.etc. I say again, stay calm! And remember this process is mentally, financially and physically very draining. Do things you enjoy and try to stay healthy. Eat well and keep positive. It will get better! Good luck!

My wife accused me for domestic violence, the she changed her statement at the police station, she told then firs i hit her then she said she hit herself accidentally, after that, the social workers became involved. However, i was released from the police station without charge. 2 months later she applied for disabilities based on fraud claims and she was awarded the standard rate of £300 a month for daily living and mobility allowance, she told me if you dont apply for carer you will be out and never see your children again. So i had to apply for it and i became her carer. This situation continue for over than 18 months. Until i decided to write to the job centre about her fraud claims. However, she continued receiving £300 a months until now because she claimed she is very depressed because of our relation and she was receiving anti depressant from her Gp and through it in the toilet, she told me this £300 is a big gift, and will cover lots of things that she likes , in addition to blue badge for free parking in any place and free bus tickets and free school meals for five children. My question; i have separated from her since three months. She gave me permission to see my children at any time and to take them out, 2 of my children age 11 and 13 told me she is hitting them very badly they told me that in writing by text messages and verbally when i saw them. When she accused me for domestic violence i was released without charge and she changed her statement on the next day and she told the police it was not my fault, however, she told the social workers i hit her but she forgave me to keep the family united . Now we are separated and she is moving forward to get divorce after 18 years of marriage. She is hitting my young children almost every day but i dont have proof except the text messages from my children can i get the right for custody based on this circumstances?? Thank you

My partners is a Bi-polar, and has had 2 episodes since December 2016. He was discharged from hospital 31 Dec 2016, but since that time his ex is refusing to permit him access to his 2 children. She was aware of the BP when they married and indeed when they had children together... She was permitting access twice weekly until the December episode (she insisted she was present for this contact), but since December 2016 she has not allowed visits, she has permitted phone calls and Skype contact. The 2nd BP episode was in May 2017 and she is now refusing any contact either face to face, phone, Skype, text etc.

She says she will not permit any contact with children until she knows exactly what happened in May 2017 around the BP hospital admission (voluntary).
We have started mediation/Court process but she is now threatening to tell the Courts the reason she left Mike was he was aggressive to the children... they divorced 6 years ago, if this was the case why had she allowed access up until Dec 2016???
She is saying children don't want to talk to their dad, will Courts take her word on this?

CAN SHE DO THIS !!!

Trump Brings Prestige to the Mail Order Bride Industry.

For years, International Marriage Services had to live with the stigma of being referred to as Mail Order Bride services. However, many consider the term "mail-order bride" derogatory and feel it demeans foreign women by comparing them to commodities for sale and falsely implying that (unlike local women), they exercise no judgment over the men they meet and would marry anyone from a relatively wealthy country. Even with the foreign women being labeled as mail order brides these companies have grown in popularity for the past two decades, largely due to the internet. The industry grew at such a fast pace it caught the attention of the US senator Maria Cantwell of Washington State, who in 2006 she pushed a bill through congress known as IMBRA or International Marriage Brokers Regulation Act. Although the intent of Senator Cantwell was clearly meant to put Foreign Bride Companies out of business by severely restricting how men communicate with foreign women. In the end, the companies flourished under the new regulations as these business quickly modified their business models.

Kenneth Agee, marketing Director for A Foreign Affair one of the largest so called Mail Order Bride Companies says, "We have always had to overcome this label. Since Trump announced his candidacy for president of the United States, the industry saw a significant increase in upscale business men looking for foreign brides. Once he became president, Trump made it the new status symbol of success to be married to an eastern European women. With First Lady Melanie Trump in the White House, opinions about foreign women have dramatically changed. Once men were scorned upon to be married to a women from Russian or the Ukraine, now is seen as prestigious. And we are seeing huge increase of men seeking foreign brides, our client base is up by more than 200% since Trump has taken office. This month alone we will be taking over 100 American men to the Ukraine, mostly very successful executives." Beside online matchmaking, the company arranges group tours for men that will travel to countries throughout the world. During these tours the men will meet hundreds of pre-screened women during what A Foreign Affair calls "Social Events" or what Kenneth calls speed dating on steroids.

Critics say these women are just used as arm trophies for business men in America. That men take advantage of the women's circumstances, both economical and geographical. Kenneth argues, "I would hardly say Melanie Trump has been taken advantage of or refer her to as a Mail Order Bride. Women choose just like the men choose, we are all adults and are responsible for our own choices. It is just that men in America have a good reputation for the way we treat women and how we take care of our families. This opens the door to the men to meet some of the most beautiful women in the world."

Trump is not the only high profile person to marry

Your partner's ex can forbid you from seeing his children. However, you can challenge this through the courts if you disagree and the courts will decide what it thinks is in the best interests of the children.

After almost 7 years of marriage I decided to end my relationship and moved separately from my wife that is the European national. I had EEA residence card at the time and still valid when divorce got done around 1 year after separation. After that I stayed around 1 extra year and decided to leave UK by my own decision, still with valid visa during all my stay which was lawfully and true. And I DID NOT try to apply for "retained rights of residence" and I just left the country spontaneously.

Because the end of my relationship was not friendly my ex wife keeps on threatening that she accused me to the Home Office of fraudulent visa application and to have married her to get visa.

My question is about how much she can prejudice me with these false allegations???

Because soon I will get married with another European national and we are planning to go to the UK.

Is it possible for the Home Office or UK border control refuse me entry visa to the UK even after married to another European national because of those false allegations?

If so, what should I do to defend myself?

I don't want to have problems to return to UK with my new wife.

my sons ex is constantly up and down making big arguements out of nothing,an example being he was concerned about his sons diet because of the stools he was leaving in the potty where constantly hard and he had trouble passing them,so my son asked her when he returned his son,he asked in a polite manner and was told he will only eat pizza, cheese sandwich or toast and shut the door, later that evening she is ranting down the phone and texting basically how dare you question my parenting, and goes on to say "you are making me wonder if you should have contact with our son as you and your parents think i am a bad mother and trying to interfere "and on and on another occassion we noticed he smelt of smoke and we had the same outcome, the period of denying access are getting longer and also she will not tell the child maintance that we have him for more than the one day,it's normally 2 on school time plus a half day after pre school, holidays can be 3 to 5 days.Ihave looked up her behaviour patterns and it points towards Narciccisiam, this is only a snip of her she constantly lies ,saying schools and other assosiations are advising her to withdraw contact out of the blue,so my son contacts these people and is told no defiinatly we did not say this and would not say this, then the abuse starts from her again ,it as now resulted in her being to embarresed to take him to school as she did'nt expect to be caught out, access denied for this at the present time until she decides what is going to happen, please advise us of what can be done and is there anyway she can be assested mentally as the effects can be seen on our grandson.

@H - thanks for this positive advice - this has come just when I need it and when can't currently see a way through this hell that is not allowing me to see my kids. Jake.
H 14/03/2017 at 9:21 am
re the comment about being fausly accused of DV i went through the same i had a non molestation order against me, i fought it in court and the judge dimmised it. i know exactly how you feel as a father you are 2 steps behind the mother from the start., i now have full custody of my son and he sees his mum 16 hours a week. you can prove the truth it takes time and a lot of frustration but it can be done. the first thing i advise is to go to court to get a contact order, the rest will follow and good luck to all fathers in the same boat. Always remember Judges are honest and see thru lies, they will never stop a dad from seeing his child unless there is a very serious reason.

Turning up at a school disco is probably not the best idea, unless you and your ex have arranged this between you. You always have to think about what is in the best interests of the kids and if you are caught up in slanging matches and arguments, then this will not help your case should it have to go to court. I know this is a very tough time for you, but the courts are not interested in you, your ex, or who has lied etc, the court is only interested in the welfare of the kids and it puts this first and foremost. Any attempt for a parent to cause disruption and distress will not be looked upon sympathetically in court. You may find our Separated Dads forum useful as there are dads who have been through simlar that can advise your best course of action. In answer to your last question, the school cannot intervene. If your ex feels it is in the best interests of your kids not to see you, you have to prove to the courts that it is otherwise.

Just as a post script...................last time she did a similar thing and she told them I didnt want to see them. Can I do ANYTHING so I can tell them that it is NOT ME STOPPING THEM...........because they will believe her...........they did once before.
Also they are going to a school disco..........am I allowed to turn up at an event like this or will that cause trouble?
She has no official order saying I cannot see them but it seems to me she is just allowed to say anything and do anything she likes and i cannot do A SINGLE THING about this?

Is this actually true? Can she just make up stories and DECIDE they are FACTS and stop me seeing my kids on the strength of these lies ?

Is it really THAT easy for her to do this? Can the school help me?

My ex has decided out of the blue..................I have mental health issues............and I am not in admittance of this.
Because of this..................and after yesterday having the time of my life with them becoming secret agents at a place we visited......................she has told me that I cannot be trusted with the kids and that I am not seeing them or speaking to them EVER again.
She says I will have to go to court..........I know this is after screaming at me in the street yesterday and me saying "I know what you did to them".
She hurts them................including "throwing the oldest off the sofa while the youngest watched. They BOTH swear this is true........the youngest (aged 6) saying "I was sat there daddy i watched mummy do it. I said I may tell the police...............so now she has said "I will not see the kids again"
PLEASE HELP ME SOMEONE!! I have no money but will do anything for help on this matter. Should I phone the police or social services........................I KNOW MY KIDS WONT LIE WHEN I SAY TO THEM HOW SERIOUS THIS IS....................I believe them..........what do i need to do...........she has hurt them many times now yet IT IS ME who is being punished as well AS THEM..........she is punished us all mentally........but the boys PHYSICALLY..........Please ANYONE........what can I do?

Hi
My ex wife have spilt up 6 months and she is filling for divorce even though she committed adultery but as the marriage is over I have no reason to contest
One thing that bothers me it I have evidence she stole items from her last employer 2 laptops, 3 mobile phones, lcd projector transfered business air miles to her account and gift vouchers worth over £300 along with 2 pairs of shoes from a colleague she worked with do I inform police or the employer as she left some of these items at my house and I do not want to be held reasonable for these items

Hi guys I need some help on my issues with my ex partner.
We jointly applied CTC which got delayed about an year. When we got paid, it was £6000 altogether in my account. Which we spent together (of which i have no proof). My partner is accusing me that I never spent that money and now she want me to pay her that money. (As she was working and I wasnt).
Can this case be brought into court against me? Or can this be case even. Do I have to prove where that money spent etc?

Social Services are involved with my partner's children owing to difficult access issues and false allegations by his ex (proved to be false).

Social Services told me in an interview that they were extremely concerned for my safety as my partner was a very violent man but there is absolutely no evidence for this apart from another false allegation from his ex. They said they had spoken to lots of people as part of a report but none are listed. He has no police record and I have never seen a scrap on indication that he would be violent in nearly three years we have been together.

Can they do this?

My son complained to me on several occasions that my ex girlfriend son who has ADHD is attacking him verbally and physically and he doesn't like being with him in one house. I spoke to my ex about it but he dismissed me and said my son is sugar coating this and he is the one picking the fights. Which I found to be lie as my son doesn't like me arguing. I fear my ex selfishness will put my son in harm ways and I am considering involving social services. My son has respect for my ex and I think he trained him not tell me everything. He goes there every weekend but I am beginning to think we should limit the time with my ex because of his lack of judgment about this issue. He is protecting the boy with ADHD more than my son. I wonder what would be the best thing to do. Any ideas?

I have been with my partner for around 6months, we have recently found out we are expecting... when we first got together she told him she was pregnant (but has since admitted she isnt) .. since finding out we are expecting, my partners ex has made allegations against my partner around domestic abuse when they were together, she has reported this to the police, social services and the school which my older children attend along with her child (who is not my partners). She has verbally abused me in the school playground. My partner has pictures of the marks she left on him after attacking him, and other partners of her's have been through the same.. we have now been told that due to me only being 7weeks pregnant he will not aloud to be around my other children and no assessment will be done until towards the end of my pregnancy.. the police arrested my partner the other day for harassment against his ex claiming he verbally abused her and over an electronic device so they have also taken his phone. We are unsure of how to deal with this as it is ruining our lives!
SeparatedDads Editor 05/07/2016 at 2:56 pm
These are very common accusations from mothers who wish to control the situation and the courts are aware of the lies some resident parents will fabricate in order to get their way. If your partner's police records are clean and there was no record of domestic abuse from his ex at the time, then this will go in his favour. As long as his evidence is honest, consistent and clear, then his ex's lies should become clear when parties are cross-examined. Remember, it's a different thing when lying to a Cafcass officer than lying to a judge who are trained to see through such pretence. Likewise, if his ex has no valid reason or evidence that she can back up regarding stopping the child seeing either your partner's parents or you, then this will be exposed in court too. As emotionally difficult as it is for your partner, sometimes it really is worth taking the matter to court in order to get the resolution the non-resident parent needs. Best of luck.

Hi guys. I'm desperately seeking someone who has been in the same position. Looking for advice or a little bit of light. I have been with my partner for 2 years. I have a little boy from a previous partner and my boyfriend is amazing with him. Would do anything for me and my son.he would do anything for anyone's kids. Has all the time in the world for us both. Together we are stronger than ever. However my partner also has a little boy the same age 4. But unfortunately his soon to be ex wife will not allow it. She has thrown all these nasty accusations against him. Drink abuse you name it. We received nasty solictors letters from her and the worst thing is, she has been taking their son to the doctors claiming his dad has had a dramatic impact on his behavior. Emotional etc. We have asked for his medical records which she has been unable to provide. They have been through mediation and agreed every Saturday my partner can pick up and drop off his little one. And would gradually build up to overnight stays. 2 days after the mediation she then told my partner that she was not going to increase the 4 hours he spent with his son. He still picked him up and had him even though feeling disheartened . The following week she then told my partner that his son does not want to see him and she has to convince him to go and reassure him that he will be going home to see mommy again. At this point my partner said he thought best that the courts should decide. She then stated that he wouldn't be seeing his son at all then. We now have a court date however yesterday another disgusting letter had been posted where she has stated that my partner had beat her over and over. We have had the telephone interview with cafcass. Police records are clean etc as these allegations are not true. I'm dreading that the courts will believe her wicked lies. My partner feels guilt every time we take my son out somewhere nice as his little boy should be enjoying then too. The best of it is she works every Saturday so the little one is left at home with his disabled nan. Me and my son have never met his child because she wouldn't allow it. She is very controlling. Has anyone else had these nasty lies said about them just to try and prevent access?? What was the outcome ?? Please help?

Hi,
Last year my eldest daughter accused my Brother of historical sexual abuse.. At the time I was living near her and I said things that I later very much regretted. I apologised a number of times to her but she would not accept my apologies and began to throw in my face things I said to her as a child and teenager which we had previously talked through and laid to rest. I told I accepted that she has done the right thing reporting my brother to the Police and I made a statement about the two occasions she pointed out in support of her. I told her I am standing by her 100%. However, she has told my son lies about me and even lied to my face about things I said to her, she insisted last year I needed to be supervised with her children when I met them which I took offence at because since September 6th 2014 when I moved near her I had been looking after them unsupervised when she needed me to. I moved away from her because I have health problems and needed physical support which she and her husband withdrew from me very shortly after our argument. I am living near my younger daughter who like myself cannot fathom out why she has treated me so badly. A few months ago after having a rude text from my Grandson I got in touch with her to ask her if she could speak to him for me as she had recently said that she doesn't want me disciplining him and ruining his life like I apparently ruined hers. She was very abusive on the phone to me so I thought maybe her husband would see reason but he told me never to call or get in touch again or he would report me for harassment. I answered his email as politely as I could to respond to his threat as politely as I could but he or my daughter phoned the DS who is dealing with her case and told her I was harassing her. The DS just said to give her a wide berth for the time being and asked me how I was. I had a lovely talk to her but my younger daughter then received a text from my son saying that I had been "formerly warned by the Police to never again get in touch with my daughter or face the consequences of my actions". This is so far from the truth and I could not put my son right as my younger daughter (who they have now also cut off) was frightened of their recriminations.

I have sent a large parcel to my Granddaughter this morning for her birthday and with some expensive items inside and decided to to text my daughter to ask her if she would look out for the parcel and let me know when it arrived as the items would be costly to replace. Also this morning she invited me to be her friend on Facebook which I felt must have been a mistake so I messaged her saying, "you have asked me to join you on Facebook, Is this a mistake?" She answered me yes so I said I would unfriend her which I did.

I have just had a threatening email from her husband and indeed it was abusive. I am now expecting because of his words another phone call from the DS even though I answered politely and gave my reasons and apologise

I am very sorry to hear this, it must be very upsetting for you. As you know an autistic child can have very definite ideas when they get a specific thought in their head and it becomes impossible to move them from that thought pattern. It is difficult to speculate, but this could be one of the reasons behind your ex asking you to leave the matter for six months. That said, it is easier said than done when the parent is in the receiving end of such a decision and where that parent's emotions are concerned. The NAS can offer direct support and advice, I also suggest you seek some legal advice regarding your options. I hope this helps.

Please see CAB article; Relationship breakdown and housing – rights if you rent your home jointly with your partner, here which will outline your tenancy rights. Please also see article: Being Falsely Accused of Domestic Violence, here which should be able to give you some helpful advice.

I can only advise that he keeps records of all texts and correspondence of this nature, so that if it goes to court he can defend his case. However, this goes both ways, so he really needs to avoid getting into any verbal spats with his ex too. With regards to harassment, the only option he has would be to report it to the police. Please see Ask the Police link here which outlines what can be construed as harassment. Regarding child maintenance, if the amount is agreed in a family-based arrangement then paying by direct debit on a specified date every month will reduce the need for this type of communication. Also asking his ex to contact him via email rather than phone, may also get around this issue. There are ways of avoiding this type of general harassment, but you may need to think around the situation in order to put these practices into place.

This is a tricky question to answer as this is not about the children, but seemingly more so about a parents' dispute and the court is really not interested in that, it is only interested in what is in the best interests of the children. Parenting is about sharing the responsibilities of having children, both the pleasurable times, but also the grind (which more often than not falls to mothers rather than fathers). It's not about proving whether the mother is in work or not, it is about their father taking on the share of the picking up and dropping off. Flexible working is an option for all parents to discuss with their employers; has your husband approached this? As the courts may wish to know this as part of the process if the matter goes to court. However, hopefully the matter won't go to court and both sets of parents can settle the matter in a mutually shared, logical and rational way.

Hi, my partner ex wife recently forced us to collect my husbund's kids( 6 and 9) from school because her solicitor says that she is working until 5pm when they finish after clubs. I have to leave work every Wednesday early to collect them as for my husband is inposible due to the nature of his job... I drove for the past 4 Wednesday's through her house at 15.30 and she is always at home. And now she says that she will take me court because I am stalking her. Can she do that? How can we prove that she doesn't work until 5pm? Regards

I have been divorced for some time now from my ex-wife, she was abusive during our relationship and it went as far as lying to get a metal health diagnosis, which she then used to file for a divorce. Things improved and I had good access to my children. Unfortunately, one of my sons made a false allegation to a teacher and no my ex-wife is using this to stop my children from seeing me. I’m highly suspicious of the situation as I’m getting remarried and the children were due come to the wedding which is to take place outside of the UK. This would not be the first time she has manipulated the children to try set me up, and the time frame around the allegation is very odd. This is the sequence of events: My Son alleged I hit him in the bath on a Saturday night because he refused to have his hair washed, this is absolutely untrue, though he did start screaming when I was going to wash his hair. He was told off for this and asked to leave the play time in the bath. All was well in the morning and we took the children to church, the children helped with the sermon and neither priest or seventy members off the church saw anything unusual. The children were returned to their mother at 3pm on the Sunday and my son did not make the allegation to her but waited till 12 o’clock to tell a lunch time French club teacher. The school were unable to contact their mother till Wednesday. My contact details having been removed from the system for some reason prior to this. My son never told his mother, and she claims the first she knew of it was when she picked the children up on Wednesday and the teacher spoke to her. Then she took the children for ice-cream instead of calling me, waited till the Thursday and texted my mother. I then contacted her with some difficulty. We calmly discussed the issue and I felt it resolved till I got a solicitors letter the following week with everything I had said twisted against me. I cannot help but feel set up as to stop the children coming to my wedding and to enjoy the time they spend with me and their step mother to be.

We appreciate that lying etc can work both ways. Our site is aimed at dads because dads are in most cases the NRP, while as mothers still remain the primary carers of the children. However, we always make sure we do not discriminate and are happy to answer and respond to comments from mothers as well and many women do come to our sites for advice. Obviously NetMums is aimed specifically at mothers and has forums on similar topics which should be able to help if you need.

Just to be clear on behaviour it is not just mums that might lie about dads I have been subjected to a years worth of lies from my ex the father of my child never kept him from our child yet was subjected to lies that I stopped him seeing her. At the time he was having a mental breakdown caused by financial issues and self esteem issues not caused by me. He failed to mention that he stopped coming to see our child and I would wait in for him to come and see our child. He never once asked for overnights or full weekends or discussed it with me - he then took me to court for contact claiming he'd had none. We were subjected to tears of mental abuse but I dealt with it because of his issues and tried to help. I kept all of this to myself and have continued to do so despite lies by my ex in court and continually pleads of having no money yet goes out every weekend and has a personal trainer whilst living at home with his parents. I remain with my dignity intact and more respect from my child who has heard him and his family bad mouth and try to justify they're behaviour towards me. I realise now I perhaps have been too kind and people close say I was too accommodating. So you see not all us mums are as you portray us to be - there are many mums subjected to horrific alienation even she we've remained impartial. I would suspect this won't get added as its from the other perspective but it would be nice to think the views could be a little more balanced - there is very little help for mothers subjected to this behaviour and to date I have found none.

Just split with my ex after a 5 year relationship, was refered to social services after various police call outs in which I called them due to her being extremely aggressive around the children. I made the social aware around a year ago of neglect and abuse by the mother only to feel as if this was brushed under the carpet, they never seemed interested in what I had to say. I was told on two seperate occasions by the social worker that he does not think a bond between father and child will ever be as strong as father and child. I was also told he does not think my ex partner was abusing the children even though I have proof and made various allegations they never wanted to hear it. My ex has made up lies about me being apparently suicidal when I've said no such a thing meaning I'm now not able to see my child until I'm assessed by my GP as stable. I feel social services have not dealt with this correctly at all and will hold them personally responsible if something happens to my son whilst in mothers care. My ex who actually IS suicidal and severely depressed which shows on medical records is allowed custody yet lie after lie she tells they constantly believe. I am spoken to by social workers like scum and feel I have no say on nothing

My son's gf left him and took their 9 week old baby with her. She is very young, and wasn't really prepared for parent hood. For the first 3 weeks , he stayed at home and did everything for her and the baby. He was thrilled at the thought of being a dad, and never missed a antenatal appointment. When he met his gf , Her mother had recently kicked her out of the house, put all her belongings in bin liners, simply for smoking. She was living with a cousin and they met at work. Very soon they became a couple and started living together.
U fortunately she accidentally became pregnant and decided to keep the baby, . After telling her mother, the mother wanted to be involved in the girls life again, having not spoken to her fo a considerable time, even telling her father, that under no circumstances was he allowed to visit her. My son loved and cared for her, but her mother took an instant dislike to him. Which caused him a lot of problems. After the birth, the girl didn't want to do a lot, not interested in getting dressed, doing her hair etc. She wouldn't cook, clean or do the washing and was only happy when my son was home doing all the chores and looking after baby while she slept. Then after a big row, got her parents to pick her up and has since claimed he emotionally abused and tried to control her, also apparently kept her as a prisoner and made her feel bad about seeing her family, which she wanted to do most days of the week, which invalved her being collected and returned. She wouldn't cook or clean and rarely did any washing
My son adores their little baby , and knows everything there is to know about looking after her, but his ex , after letting him have baby twice, is now saying she's been advised to stop the contact. If he wants to see his daughter he must go to the home she shares with her parents. With emotions running high , he's not ready for her parents, his ex won't be there. The mother is controlling, outspoken and criticises everything he says and does, like she did in the labour room. This ruined his experience of the birth. We are a family with little money and can't pay for him to go to court for a contact order. He is on a low income and without her , will lose their home. He wants to spend time on a regular basis with his dear little baby. He loves looking after her, albeit the girl lied to her parents, telling them he'd had little input, he was better with baby than she was. He's distraught, and I don't know how to help him. Unfortunately both smoke canibbis, which concerned me especially when i found out the gf had smoked during pregnancy and when trying to be. Her parents didn't have that worry. She also had a one night stand only 4 days after they separated , with her supplier. Her parents won't know thar either. And although the mother keeps saying how awful my son is, I've never told her what I know about her daughter.
Does the girl have a right to stop him having their baby. I can be in attendan

my daughters husband came into the uk on a 5 year family visa. She was pregnant at the time. After only being in the country for a month he started seeing someone else which she didn't know about. She had her boy and after 10 months of being in the country he left her (that was when she found out about the other woman) He never asked to see his son only when she filed for divorce. When he did eventually ask to see him she let him, even when he was abusive towards her. He put nasty messages on face book and bullying txts, even though she had not denied him access. He had his son over night, even on xmas day this can be backed up by photos. Even when he was getting all his own way he kept threatening with court. Then one evening when she was picking him up from nursery he snatched the baby and ran off with him, got into his girlfriends car and drove off to his house, this was witnessed. He refused to give back the baby as their was no court order in place and he had parental responsibility. My daughter took out an emergency court order and he was made to hand back the child to her care. Today she had to go to court so he could have his say, before going to court he told her solicitor that he snatched the baby so he had a court order to see his child so he could stay in the country. In court he told the judge that my daughter was not of sine mind and that the baby should live with him and that he had not seen or had access to the baby. At the moment he has supervised visits and in 4 weeks they go back to court to see how it can go forward. He hasn't put the babies interest first only his. So far its cost her £3000 pounds in court costs he doesn't have to pay any of this as it was my daughter who took him to court to get her son back. When it goes back into court and she can prove he had access, and knowingly took the baby for the benefit of himself. I know that both parents have joint responsibility and that he has a right to see his child, can a court not give him the court order knowing he has taken this action for him to stay in the country. He also hasn't paid any child maintenance, my daughter is working part time and hasn't the money for court fees, we have had to help her out.

My son separated from his partner some time ago. They are both in new relationships. Their daughter is now living with my son as her mother has left her with a childminder while she went out and did not return for some days. This has happened not once but 3 times. His x has admitted she could not cope with the little girl and a custody case is now ongoing. It was supposed to be the final hearing today but she has now falsely accused him of violent bahaviour and sexual abuse. She has never reported any of this to the police or social services or any one else.

I am sorry to hear this. It is rare that the courts will take a contented child from a resident-parent. The courts will always decide what is in the child's best interests, and stability and consistency are of paramount importance.

Hi,
I had to change the locks on my flat as instructed by the police to get my wife out due to her bad behaviour. The flat is in my name only on the tenancy, there were arguments verbally and the police were called and I was arrested but released without charge but I never hit or touched her. They gave me advice to change the locks otherwise it would be me always being taken away. she has a child with me and 2 others that are not mine,my one decided to stay with me the others left with her.She then went to the social services and made up allegations of domestic violence which are untrue because I have my son who is 9 it was investigated by them but the threshold was not met as I am meeting his needs, and got a letter of apology from them for the way I was treated as I put in a complaint. allegations have continued by her which I have evidence which proves she is lying. She attacked me on the street at work 4 years ago and I used this to get a molestation order out on her and there was a fact finding case and she was called a perpatrator. She has contact with my son now and I only stopped it because his passport and birth certificate was removed from my mother's house without permission, and she wouldn't tell me where she lived so as any person or parent would want to know where their child was going especially if they are the one looking after them or in their care. I offered mediation 3 times for contact with my son and she refused. She has tried everything to get legal aid with her lying but can't get it or it has always been withdrawn because of no evidence she is now using probono for this recent case. my son was interviewed by caffcass and he has made it clear he wanted to stay with his father but on the other side I was named a perpatrator! My ex wife is very good at lying and cries to get people on her side and again this is what has happened caffcass did not look at everything.Anyway the way it stands now is the contact order which was made by caffcass I agreed on and so did she.we went back to court and she is refusing the report as she wants full custody and a fact finding case.I have evidence for allegations as I said and she has been found to be a perpatrator in the previous case, plus my son is happy, he is doing well at school and doesn't want to live with her.I have had my son for near 2 years now and my barrister said there is no way they would uproot him. I think my ex wife is bitter! I have moved on I have a new partner, new job and I believe she is doing this for spite to make my legal bill go up as she is not paying for hers! The thing she can't see is what I'm spending in court costs my son loses out on and with this final hearing coming up its now going to be around £18,000!!
I will prove she is lying again! this really should not be happening and if she's found guilty again especially now for lying the courts should come down on her it's purgery! The thing is she's got no money so if I win which I'm very con

If your wife is accusing you of bigamy and you are innocent, then she can be charged for wasting police time. If you can't afford the legal fees, you can self-litigate, please see article: Legal Aid Withdrawal: How to Represent Yourself, here. I hope this helps.
SeparatedDads Editor 19/11/2015 at 9:51 am
I'm afraid this is a difficult situation because when lies and falsities are spread, it opens a whole can of worms, that can be very difficult to extricate yourselves from. The only advice I can give is not to get drawn into any arguments and to distance yourself as far away from this person as possible, this includes text messages, phone calls etc. At least the children are of an age that should Cafcass get involved, then they will be able to voice their own opinions. I can't advise what will happen regarding the SS and whether you will be able to pursue a court case until the investigations have completed. However, if it is dropped, then if you can't afford the hefty legal fees of a court case, you can self-litigate, please see article: Legal Aid Withdrawal: How to Represent Yourself, here. Plus the Bar Council - Guide to Representing Yourself, here which is very informative. However, one area the court does not tolerate is accusations and mud-slinging, so the best advice I can give here is to prepare your case rationally, gather as much evidence as you can to prove your innocence and get as much free legal advice as you can with the help of the likes of McKenzie Friends.

My partner has been split from his ex wife for 3 years now, is been nothing but trouble eve since we got together.over 2 years. We have a cold together and because I've had social services involvement in the past the ex is paying on it now
She made false allegations about us before eating his son and daughter was witnessing domestic violence in the house whilst they were here which was a lie and after months of socials involvement and assessment it was found to be untrue and they close the case. Now just 19 days between the date she advised us last year she's gone to social again dating were force feeding his child which has opened up a new case with the ss. Were so sick of it now, we cannot get on with our life and our children in this household without some sick accusation being made about us and having to go through more assessments woth them. We've had enough. The ex has got drug problems and drink problems but because she's never been for help there is no proof she's on anything only people's statements
Her neighbour is on anti depressants because of her hthere is constant trouble at her house. Which my partners kids to her live in, she's giving the kids drugs and drink (ages 10,14,17) and the social don't want to do anything about it only harass us. What can we do about it we've been to see a solicitor but iya all cost and will cost over £200 to take her to court for custody. We've told the social all this hit they don't seem interested at all about hee, just the accusations being made about us, any help please?
SeparatedDads Editor 05/11/2015 at 2:13 pm
I am sorry to hear this. You will need to seek the advice of a solicitor, as if you are legally married, then she will have a claim on your estate. Also, beware of trying to contact her too much, as she may be able to accuse you of harassment. The best advice is to make sure your communication with your ex is formal and preferably official i.e through your solicitor.

I purchased my house 8 years ago with a mortgage , 5 years ago I was a victim of an accident. Since then I have difficulty. I married a lady from Russia 3 year ago, I arranged the visa and kept her until she could find legally a job. After she started her full employment she feld indipandent, and all her saving were sent to Russia, nothing was paid toward my standing mortgage, I used all my saving to stay afloat and pay the majority of bills.
4 months ago my injury compensation was finalized and I paid off my house So I had no more a mortgage to pay. Very quickly our relation deteriorated , as she was pressing her disire for some of the shares of my injury compensation. One evening we had a discussion , for which was the excuse for her to run away from my house , I do not know were she has gone, she wants make look that I have verbal abused her and victimized her, And this is not true at all. I also have legal document of my injury and affidavit that she signed in regard my medical disability and incapacity and times of depression due to chronic pain.
Her behave now its totally out of order, as I wish to try to discuss a proper separation or finalize our position , she just don wish to reply to any communication, Even my sons have been trying . We were married just over 3 years.
I fell used and been abused , but also relived that she has gone, she made me feel like I was an AIDS sufferer, her rejections toward me over the months was appalling I lost self selfes'estem, Humiliated and treated with total neglect .

I very much suspect now that she indeed wish to claim part of my house , and creating all sort of false allegations toward me,

she was well aware of my disability and health due to my injury sustained and my medical treatments still ongoing.
I would like to know if she can be able to place a stop on my property so that I will not be able to sell it if I wish too , And what she can be entitle in the Court if this turns nasty . She has full employment and me nothing,My only capital is my house .

Hi, I have filed for divorce after nearly 2 years of psychological torment at the hands of my wife.I had strong suspicions that she was cheating that whole time and in the end found that to be true. Iam now in the joint home with my 16 & 11 year old who no longer want her here. As I was packing her stuff I found tax credit letters belonging to her. She had been claiming them for r nearly 2 years and putting the money in to her separate account. Should I report her for fraud ?

I am going through a separation with my girlfriend and we have a 4 year old daughter. My gf has severe anger issues and I have several recordings over the past few years of her going crazy among others threatening me that I am not her dad and she swears she will do everything possible to keep her away from me until she is 18...

Now, as we go through the separation I have found out that she is planning to move to the US which will mean that I am going to have problems visiting my daughter and her she is trying to realise her threat. Do you think my audio recordings (I have 7 in which she also clearly shows to be absolutely mental) are useful as a legal proof in court?

Thank you.

my ex daughter in law is accusing my son of rape and violence from when they split in 2010/2011! These hang over him still, there has been no formal charges made! She brings these allegations out every time he try's to get access to see his son. How can this get sorted, he doesn't get legal aid as he works, but she does and she just keeps going round and round. Which cost my son more and more in legal fees! Any advice??

@Beckync, this is info i found, hope it helps:-

Every year Cafcass helps over 140,000 children and young people who are going through care or adoption proceedings, or whose parents have separated and are unable to agree about future arrangements for their children. Cafcass is the voice of children in the family courts and helps to ensure that children’s welfare is put first during proceedings.
Cafcass is asked by the court to become involved in cases once an application has been made to the court. How reasonable have people found the CAFCASS reports. My brother and his ex shared custody of 6 yr old nephew for 4 years and now he has a new partner shes gone crackers. She seems to be systematically destroying a really loving happy bond they have. She is hugely restricting contact between them but insists its my nephew. She turns phones off etc, supervises conversations and picks and chooses which texts to reply to. She insists its him writing these very adult messages but he's 6! Which is also apparently old enough for him to decide not to see his Dad?! Do these CAFCASS officers honestly see through these types of parents? It's heartbreaking to watch. They are so lovely when they see each other but I need to reassure my brother that the courts won't be hoodwinked by her. Any thoughts from anyone who has experienced it?
( I've read books on parental alienation and its like reading about her behaviour)

@SeparatedDads

Is it illegal for me to record conversations between me and my ex partner because of previous allegations of Domestic Abuse?????

I called the cops on my husband. He was VERY drunk. We were both screaming at each other and he lunged at me several times. He time he lunged at me I hit him. Eventually our 7 year old daughter was caught in the middle - He stopped me from leaving the house physically standing in the way so I could not make it to the door. My daughter was begging for the madness to stop. (I do not drink at all) I eventually broke down and called the police hoping for someone....ANYONE to help. I told the dispatch person what was going on....and I also said if the cops could not legally remove him then to not bother sending someone. The cops showed up. (State police because I have no township) and the one cop just lost his mind ... screaming that the two of us needed to grow up and act like adults and that he was going to charge us both with disorderly conduct. - Knowing that it was illegal to be charged with disorderly conduct in ones own home I told him to "go ahead" thinking that it was a way to get my husband to calm down. (They would not remove him from the home because he did not hit me) I however admitted to hitting him when he lunged at me. The cops left and 2 weeks later we both received a citation for "harassment" - The details are the same on both and they are each for $464!!! - How do I make this stop ?? I called the cops for help and now I'm being fined ?? Two weeks after this blow up my goal is to get him rehab help or at the very least marriage counseling but I can't get him to get past this citation of $900+ that we have to pay .... He is Furious and blames it all on me for calling the cops.

@Hedgehog - the fact that is was she who was arrested for assaulting you will be on the police record, so this will work in your favour. Unfortunately, there is no anticipating what she may say. The only recourse you have is to stay well clear of her, so that you do not put yourself in a position that could be misconstrued or spiral out of control. I should also take some legal advice - you do not have to agree to anything in any statement that you feel is untruthful. Should you wish to discuss anything with her regarding arrangements for the children etc, you could go through a mediator - see article: Mediation: What is it and is it For Me? whichI hope this helps.

My wife and I have not been getting on for about a year. In January I said I wanted to get a divorce and she told me to get out of our rented home which we share with our 3 children. The tenancy is solely in my name so I said I would not leave and so she made my life as difficult as possible while asking me to change my mind about the divorce. After a month of her saying she would change etc. I said I loved her and would try again. After about a week she then said she now wanted a divorce and told me to get out and put all my clothes and belongings in bin liners and put them in the garage. She refused to let me back in the house for 10 days and did nothing with the kids while they were on half term. In the end my children sent me text messages begging me to return home, do I did. My wife was furious and wouldn't speak to me for 3 weeks! One day she returned home with shopping and I was helping her out it away, when she said she felt very strange and weird. I suggested nicely that she should maybe see her doctor as she might be suffering from a hormone problem. She then suddenly went mad and shouted that the problem was me and I had to get out of the house forever! She started jumping up and down, lost control and physical attacked me, kicking and punching me! She stopped for a minute and then did it again after which she announced she was calling the police! Fearing how it would look, I called the police myself to report being assaulted. She admitted hitting me to the police and was made to leave without the kids! She returned 2 days later and was very quiet and I hoped she had realised how she had a problem, but within hours she was being threatening to be again. Now she has started to divorce me and I think she is going to say it's on the grounds of unreasonable behaviour from me! What should I do - as I am worried she will lie and say I was violent and controlling towards her, as she has done this on previous occasions when she has attacked me in public?

@Chez, you are entitled to half the business as far as thsat is concerned unless you signed something agreeing you have no interests in it, as for your daughter, she needs to request confirmation from their solicitor regarding what you mentioned otherwise in my opinion, if there is no injunction stating you are not allowed contact your daughter could go to his home or place of work.... Im not a legal advisor of any sort but i do read up alot if it concerns matters for me or my son.....

My husband and I have been together 36 years . 2 years ago he started an affair. I found out and asked him to leave . He lived with her for 2 months and then we got back together. He wanted to get married so we did . She posted comments on facebook how some men will get married just to get their name on house title deeds. (The house is in my name) he said she was just being spiteful . I found out shortly after marriage that he had still been seeing her but he said he had just been talking to her in hopes she would get fed up and leave him alone. On our 1st wedding anniversary I found a mobile phone that he eventually admitted she had bought for him. It was full of sexual comments and pictures and times and dates of when they had been together. He broke down and told me she had been blackmailing him after he had 'been weak' . I forgave him and I started going to work with him on a daily basis( his suggestion, he has his own business) we have been very happy and it a lot of time into smart ending the place up ( I paid for most of it with my pension pay ) as time has gone on I have had odd days off of left early. In March I found out he was seeing her again. I took him to her house in order to sort things once and for all. Since that day he has turned vile. He has reported me to the police on 5 occasions which have resulted in me being given an harassment notice. He has told them complete lies . I saw a solicitor regarding divorce for adultery but couldn't afford solicitors fees as I only receive a state pension and have my 19 year old daughter living with me who only receives low income as she is so apprentice . He then filed for divorce for unreasonable behavior and has again lied . My daughter tried to ring him recently and was told by his girlfriend that she is only allowed contact through his solicitor. I cannot afford a solicitor and I am terrified that he will continue to lie in order to get whatever he wants( including financial settlement) I know he and his girlfriend are living the high life ( holiday abroad, tattoos , already ordered wedding rings etc .) but has told his solicitor he is struggling financially so couldn't afford solicitors fees for me. I think he is asking that I pay the divorce costs and will be going for the house. His girlfriend has packed up work and guards him 24/7 and he has a thriving business but doesn't keep any accounts. If I have to sell the house and give him half I won't be able to afford to buy anything else . This is all worrying me sick. What can i do?

@AWCS - it is a tricky one as recording conversations without the other person's knowledge is essentially considered a breach of that person’s right to privacy and they can therefore claim for breach of the Data Protection Act. The likes of texts and emails are allowed in court as evidence.
SeparatedDads Editor 02/07/2015 at 1:03 pm
@AWCS - you are not doing anything illegal by keeping texts and voicemails. They are a common form of evidence in courts, with parties using text messages and emails sometimes going back several years in order show evidence of verbal abuse, or other admissions that can be used against them. Therefore, it is important for you to continue to log and keep them.

When me and my ex were in the process of splitting up, she was able to get legal aid due to the false accusation of Domestic Abuse so, since then I've kept all of her txt messages & voicemails + recorded our conversations on the phone due to the Domestic Abuse accusation, am i breaking the law doing so as I've done this to protect myself from the accusations as, they have started back up again due to her splitting up from her new partner from what I can see....

wow it's shocking how people are prepared to hurt each other. While all the while the poor children suffer at the web of lies. I know through personal experience my husband turned everyone against me. However I really did suffer abuse on every level I told social services but I was treated like I was lieing. Then I found out why my husband faked a breakdown and told everyone I faked my illness and make illness up. When I found out I was so shocked and hurt because he knew what I'd been through with my spinal cord damage and taking so may prescription drugs just allow me to walk. He told everyone that I should not be left with our son because I wasn't a fit mother. The social services agreed with my husband and took my son away from me.even though it was all lies. My dr told the court that my condition was serious I needed serious medication to live a semi normal live due to nerve damage. But it made no difference.
one week later I went to vist my son at our family home. While I was there my husband lost it with my son over home work. he throw a massive book at our son missing him by cm. my son ran to me and bagged me not to leave him. I told him I'd never leave him again. I moved back to the family home 6 months later. I was going to do my best for my son and protect him even if it means me been unhappy for another 10years. My son never asked to be born when we become parents you should always put their needs above your own. But I told my husband if I was to stay if he ever raised his hand to me again I would go. He knows I mean it too. So please don't think its only men that get treated badly. That day I walked away from the house I didn't want a penny from him or the house. I was prepared to start again after 22years of marriage with nothing. He had everything including our son in the end all because my spinal injury was used against me. How unfair is that and wrong. Me and my son are so close he tried to shield me to stop his dad hitting me that's the day I knew I had to leave my son put him self in danger for me. I knew I had to do something.but yet I was treated like a lier and a cheat. I know one day the truth will be told I'm waiting.not all woman make domestic abuse up but maybe the ones who it's truly happening to don't get the help. I know I didnt . My husband was surrounded by everyone helping him. I had me!!! I was put in a awful dirty flat surround by drug dealers and ladies of the night. I used to sleep with the radio on so I wouldn't hear. Within a week saw a stabbing it was awful£249 per week I had to pay the council. Trust me it was a awful time. I'd much rather put up with my home life any day then go through that again been without my child. Please don't judge all women the same we are not. A child needs both parents no matter what.

My ex partner contacted my employer stating I had groomed her over social media and tried raping her. She didn't make this complaint to the police and her aim was to have me fired. Thankfully my employers contacted the police to find out of there was any truth to the allegations before talking to me.

An accusation of grooming somebody and attempting to rape someone is devestating and plays on your emotions - particularly when its made by someone you were close with.

I recently learned her motives though - we were getting to know one another for marriage over a period of 8 months but she decided to marry her cousin. She told me she was being forced into a marriage - my cousin found out it was untrue so did the courtesy of telling her family how she was playing me whilst getting to know her cousin. Obviously her new hubby wasn't impressed with her behaviour so she needed a cover story to keep her dignity intact.

Women pffft!

My life stopped on in march my wife took my to kids and went to her sisters when I finished work I went over and there were two police cars police officer arrested me for two counts of common assault I was devasted. Why was she making these false vindictive allegations? I was kept in police custody for 18 hours when I was interviewed by the inspector he re arrested me for multiple rape I crumbled and felt sick. I was kept in custody for a further 4 hours and released on conditional police bail until June where I have to report to police station.

Since that day the social services are treating me like a convicted criminal and are not letting me see my two young kids I feel sick and devasted. All I've ever done is provide for my family and care for them and my wife does this to me. Fathers are treated like rubbish absolute disgrace

@sam - it sounds to me like you'd be better off keeping away from Facebook. For people who are splitting or have spilt up it can just prolong the heartbreak. But if you have split up, it is not really right for you to be putting things on it about you and her together, especially if she has moved on. I would leave Facebook where it is and try to get on with your life by moving on.

Hi, a year ago, my wife made some serious accusation against me to the police and this ended up at the court. And I have found not guilty. However, after all those dirty things, I still love my wife!!! And I started talking with her to come back and sometimes she seems NO, and other time she seems Ok with her illogical and impractical conditions. Last week, I had put one of our wedding picture on my second facebook account cos of our engagement day! Later, she rang me and shouted at me and I also shouted at her because she made me so. She then rang police and told them that I accused her socially and police blocked my facebook account. I do not know how to deal with it. Should I ask police about why they have blocked my account?

It is probably time for the system to change to allow couples to ask for a no fault divorce. The current system of having to claim unreasonable behavior leads to this kind of mud slinging.

Jazz, i hear your stress, i was left in a wordt situation in May 2014 when my wife just disapeered in the morning with my 2 yr old daughter and 5 yr old boy. After 7 years of marriage. My sons school teacher phoned me and said my son hasnt turned up to school in the morning, i phoned my wife she didnt answer. I went home and all there belongings were gone. I phoned the police and after 3 days they were located AT THE TIME the police promised to bring my family home to me and at the time i was totally unaware where they was and why they was gone. Once police located them, there attidude switched on me and they just informed me that my wife and children were safe and well. I questioned the seargents previous promise of bringing my fanily home but they just ignored me and advised me to seek legal family law advice. I went straight to the best family law barristers and got legal help costing ££££'s.... I got into the court the same week to get the wherabouts of my children and the judge in my city sent an order to my wife via the police to attend court instantly, she did not attend court 2 times on the judges request. THEN suddenly i received a order from her side in LEEDS COURT TO ATTEND because she had put life threatning violence allegations against me towards her over the last couple of years, i was shocked, i have never ever been known to the police and i was never suspecting this to ever happen in my life. I went to that court hearing without hesitation and i was stunned to see my wife sitting there infront of me with free legal help and protection, the judge ordered a non molestation order against me, i contested it on the spot, hearing was adjourned for further statements to be provided from me and her and evidence, obviously she had no evidence of all this, since may until now i have been court about 4-5 times and still not seen my children, each court hearing costs me £600 to pay my solicitor. It has now been listed for a fair trial called fact finding trial and she will be proven wrong and i will finally have contact with my kids i hope to god. All you can do is pray for the best in this situation. The truth will always come out, be patient and it will be sorted, ive waited 7 months imagine that. Some ppl in london hav to wait 18 months to get a court date. My trial is in december and it is a 4 day trial all tto do with MONEY MAKING SCAM FROM SOLICITORS AND COURTS AND SOCIAL SERVICES. My trial will cost me £6,000 and already ive spent £4,000 to get here. She has got free legal aid and her solicitors have probably made a big massive invoice for the tax payers! Worst that daylight robbery. Anyway good luck.
JAZZ 08/11/2014 at 12:22 pm
hi, I have been falsely accused of domestic violence by my wife and at the recent fact finding hearing somehow my wife's barrister managed to convince the judge that I did so. in a nut shell my wife's barrister annihilated me and my barrister!

the truth is I never did anything like that at all and it's really frustrating that something has been proved in the court which is totally un-true. so far I never had such involvement with any court or police at all and I am unable to decide if I can/should go back and challenge the court!

there are further hearings happening in the next few months because she's not letting me see my baby.

any advice would be much appreciated.

My ex decided she wanted out and to take the kids and move away to be with her boyfriend. I took her to court for residency and actually won without a solicitor (she had one). Now it's time to deal with her accusations of emotional abuse. She's stated this to her friends (who are mothers at the school I take my kids to), to the mediators, and to my friends. She said she had a domestic abuse support worker and she actually called the police when I dared to stay in the house to which I was named on the tenancy. Now I was going to let it all lie yet I've had it mentioned to me at school that I'm a control freak plus I don't want the kids to get older and her to say to them that she had to leave the area because of me when it's clear to all she left to be with her boyfriend and that was of greater priority than her kids. So I'm about to proceed with taking forward a case of defamation and wondered if anybody had any advice?

My husband has accused me of a false affair. He is the jealous type and I have a long term friend that I have had even had before I met my husband. We would still keep in touch through facebook only which my husband knew about it and said that he did not have a problem with it. Now out of no where he is accusing me of having an affair. That is a lie! I showed him all the messages I have ever sent him. He still does not believe me and decided to pack his things and leave. Now I wonder if he can get custody of our 3 year old son. I do not have a job because he would not let me work the whole time I was with him. Is it possible for an illegal to get custody anyways? I am afraid he will try to take y son away all because he thinks I cheated on him.

Does anyone have any advice on how to defend allegations of abuse and violence? My husband is in court soon and no one is telling him anything. I think his solicitor was thinking that he was going to pead guilty to the charges brought by his ex and her son? We have proof that she has lied about a significant amount of what she has told the police. I keep thinking surely someone will spot these deliberate lies? I am writing a letter of support to his solicitor but I have no idea if it will do any good?

.....When i tried to tell the judge about her behaviour and how i am not a heavy drug user whatsoever, he did not seem to want to listen. He was very much on the mothers side as on the surface she appears to be very sweet and genuine. I can not afford a solicitor and i am desperate for someone with authority to just listen to what Lauren is doing to me and how she is using our son to get to me. I have done everything by the book and everything that the police has told me to do; I have kept all her text messages, facebook messages and recorded phone calls from her to PROVE that she is using our son as a means of being able to talk to me. She wants me to get into a relationship with her but after the horrible things she has done to me this will never happen.

What do you advise I do when no one out there with authority wants to listen to what i have to say or give me the time of day. I adore my son so much it is killing me when i do not get to see him. I can't sleep and i just feel completely lost and no one wants to help me. Please can anybody help me?

After a brief encounter with the mother of my child back in december of 2013, we now have a beautiful 5 month old baby together. I am not in a relationship with the mother nor have i ever been. Her volatile behaviour began shortly after we hooked up for the first time after I told her that i did not want to continue meeting her. She then harassed me constantly and became extremely abusive to me and my family. About a month later i found out she was pregnant. We went to the scan together but she continued with the harassment. She would text me and if i did not reply quickly she would get extremely abusive. She was making my life absolute hell and i could not cope with her in my life. So i decided to cut contact with her and then get back in touch nearer to the time when she was due to have our baby. 2 months prior to my son (Leo)'s birth, i had a serious motorcycle accident where i was hospitalised for a month. I was in a coma for 2 of those days and sustained permanent injuries. The mother continued with the abuse whilst i was in hospital by sending messages. She was also ringing the hospital constantly so much to the point the hospital staff decided only give out information to people who knew a secret password. My family called the police.

After Leo's birth, harassment continued and the police gave the mother a formal warning. The mother refused to let me see my son unless i break up with my girlfriend. I advised her that I will not be breaking up with my girlfriend in order to see my son so i will have to go through the courts. She said if i take her to court, she will tell the judge that i physically abuse her. She then sent me a photo of her face where she had marked herself causing red scratches and a small bruise, and said she will show this is the court. I told her i will be showing the judge her message clearly showing her blackmailing tactic.

When we went to court she did not mention anything regarding me attacking her. She did however tell the judge and the cafcass officer that i am a heavy drug user and therefore am a danger to our son. I said i am more than happy to do a drugs test which will prove i do not take drugs. The judge said if i take a test i will have to pay for it which could be in excess of £1000. Since my motorbike crash i have been off work on leave for 7 months, therefore i do not have the money to do this. However, the judge did grant me the contact order that i wanted.

The police told me to change my phone number, so i did but i bought an additional phone to carry with me also and gave her the number of this one, for her to call IN CASE THERE IS AN EMERGENCY WITH LEO. She went crazy that i changed my number and refused to give her my personal one, so once again she is taking my son away from me and is continuing to lie about my so called drug use.

I am sinking i just do not know what to do. When i tried to tell the judge about her behaviour and how i am not a heavy drug user whatsoever, he did not se

My life stopped on Friday 30th. My wife used the 'mental abuse' card. She took my 3 kids. Two didn't have a choice. Another stayed with me. With the help of the social she now gets more money than I earn, a house and the children. No contact has been allowed by her. She doesn't have to prove anything. While I have lost my kids, my reputation and have a son who's not allowed to see his brothers or sister. My last word is.social services!. I can't think of anything suitable to say about them except they know how to lie!

When I daughter was 2 my ex and I split up as she was unfaithfull but within a week off us splitting up dissapeared and I didnt know where she was she then changed my daughters surename (i only found out 3 weeks ago after 15 years) her mother also moved and I was told to not contact any other family members other wise I will get done for harrasment. I was very depressed over the whole situation and had to go live with family away from the are untill I was better. I have recently found out my daughters new surname so have been able to find her via the cenus. I wrote my ex and my daughter a letter as my daughter I now 16. but a few days later I had a letter from a solicitor to keep away if I contact them again I will be arrested for harrasment and my daughter doesnt want anything to do with me. I dont know if my daughter ever read the letter or even if she know about me and I dont know what to do now. I only work part time and I carnt afford the extorsionate prices some solicitor want to charge me. I dont know where I can go from here. I just want to know that me daughter knows who I am and that I love her and never forgot about her and im always here for her.

My ex-wife made up a false allegation about me that led to my arrest as she was planning to move out and live with her Mother who was staying nearby at the time with her friends. Arrested: no charges. The second allegation occured on our way to contact handover. She claimed I pulled her hair. I demanded the Police check the CCTV evidence. She then text shortly afterwards to say there would be no charges and we could meet as normal! Recently she blocked me entering the contact handover venue by standing in front of the pushchair, then standing alongside me and barging me, whilst snatching the pushchair and storming off. Once again, after the event, the Police were called. Arrested and let off again. My friends joke that perhaps I should move nearer to the police station etc etc. She has stopped all contact again. I hope when contact is restored she pays all the court's "reserved costs" otherwise I feel they should let her see the inside of a police cell.

I agree in principle, from my own recent experiences:

Firstly, I feel I ought to say that as an adopted person, and the father of my only child, my 6 year old son is HIGHLY loved and prized by myself, simply because I have no other blood relations to my knowledge.
My ex unwittingly (we're currently separated after my leaving her), gave me HIV just after we were married, which became 'exposed' in my then workplace some years later, and working in a highly specialised field, I found fewer and fewer jobs to ZERO (until now, even 5 years later), just after my son was born....
She's maintained fortunately enough a job, has the flat I found, comes from a very wealthy family, and I had to move back to my parents home here in London - at 48 years old, unemployed.
She has always begrudgingly allowed me access to their flat, but being unemployed has meant I've only managed this on average once weekly. It gets worse - I WAS receiving benefits (ESA), but I was cut-off from that recently as I received ZERO points despite my condition, and also by my receiving treatment for (very minor) depression expected a 'reasonable amount' of those.
This has meant as of the last month she has not been even answering the phone to me so as I may talk to my son (imagine how such a shy and sensitive child must feel), and neither would answer any of my emails during this period.
I let slip: I said (I believe fairly) in email - twice - how disgustingly badly she's behaving, in an evil manner, in fact, as doubtless, our son is missing me terribly, and probably has no real clue why I'm not there for him.
NOW, she's attempting to use those messages against me as a weapon - describing me as abusive, and 'harassing her'!
Anybody who knows me would (I believe) testify readily that (A) I'm a very quiet gentle person, and B) wouldn't bother harassing anyone. In fact, in TRUTH (though she would very admit it), she has smacked our child, and I've hardly ever had to even raise my voice to him!

I could easily bore you all with more details here - suffice to say for now, my poverty has put me in a dreadful position regarding the above, and I fear that as I'd doubtless have to represent myself against here in court (and her father is a the High-Court judge of a large african country) , I fear the worst through all of this.

Thank you for bearing with me, and I fully appreciate that advice on such problems will be 'hard to come by'....

i was accused of mental abuse by my ex and have not seen my daughter for 2yrs and have been suffering from deppersion due to the situation. the reason for her to do this was to force me to leave the house i had bought and had no mortgage on when i left took a duvet and a couple of essentials nothing of any real value , she reported it stolen and i was arrested she also accused me of criminal damage because i threw out some old forms n paperwork such car tax reminders old car insurance certs etc all out of date and no longer valid but apparently that dosnt matter its still her property and i was found guilty of criminal damage. you might be thinking she knows the law inside n out , well all i can say is she works with the retired head of domestic violence for my local police force and yes she is a woman . one more thing i was allowed a supervised visit at a contact center with my daughter, this was the most horrific experience as i was treated like a peadofile by the volunteer women at the contact center who all had been in abusive relationships i discovered so guys ive ended up never leaving my room in the flat i rent and i was turned down by the social for any benefit coz i didnt pass the medical for my deperission because i was to ashamed to admit to the dr how sad my life had become

Well I think that there aren't many places for men to turn in these situations, even when you go to court for help, the mother still has the benefit of the doubt, so if writing a comment about his ordeal helped him get it off his chest then good for him, and it also helps to know someone else is going through the same thing, ever heard the expression if you've got nothing nice to say don't say anything! Anyway my partner is applying for a contact order as his ex is refusing contact unless she supervises it, which is antagonistic at the best of times, now we are progressing in our claim she is writing letters every other week with lies like we intimidated her and forced her to let us in to her house, and that my partner upset his 12yr old coz he told him it was all her doing, when actually he was trying explain how the court proceedings worked, and because the 12 yr old realised she was lying and was caught out, she now records and puts all calls on speakerphone, the kids don't want to talk to their dad like that its awful, we're worried that her lies are going to be listened to it's all heresay no evidence! And we live 70 miles away so staying contact is essential, there obviously alot more to it but if anyone can advise we'd very much appriciate it!

I have just been to my first directions hearing where my ex partner began by accusing me of domestic violence she also used this to remove my two children from school, she has since disapeared with them and refused any form of contact. At the hearing it was shown that no violence took place so my ex started on mental abuse and now I have to have a psycological assessment before I can do anything else, problem is it is going to take three months aleast for it all to come through and in the mean time she still has my children. I can disprove every single allegation she has made with evidence she only did this because I found out about the affair she was having so when it gets back to court she will be the one who has been abusing the children by removing them from their home, schools, friends and there father for no valid reason but I have to wait for the courts while she carries on doing this to my girls.

Sorry, but this article is just not helpful - it acknowledges that these things happen, but doesnt really give any advice as to what to do about it. My husband has been accused by his ex of domestic violence 8 years ago - how is he supposed to prove innocence of that? And I'm afraid its guilty until proven innocent with the current system of family law. An article with some practical advice, please.
