Can Ex Apply for Kids' Passports Without My Permission?

When you split up from your partner it is easy to feel very helpless and as though you lack influence on your children’s lives. When you have gone from being involved daily to seeing her making decisions without your consent, it can seem unfair. It is natural to question whether she is legally able to take these steps without consulting you.

You do not say whether you have parental responsibility for your children. Parental responsibility is automatically granted if you were married to the children’s mother at the time of birth or if you jointly registered the birth. If neither of these apply, you are still able to apply for parental responsibility through the courts to make sure that you are involved in their upbringing. Here's some more information about your children's passports when you are separated:

Who can apply for a passport?

Either parent can apply for a passport for their child, unless an objection has been lodged at a United Kingdom Identity and Passport Service office.

A child under the age of 16 must have permission from a person with PR for them.

If you are separated but still married, either parent can give permission for a child to have a passport.

If you are divorced, but were married at the time of or after the child's birth, either parent can give permission for a child to have a passport, unless there is a court order about PR or preventing the child from having a passport. If this is the case, you should send a copy of the relevant court order with your application.

If you are not and were never married to the mother of your child, only she can give permission for the child to have a passport, unless:

  1. You have PR, either through a Parental Responsibility Agreement or by order of the court
  2. You are named as the father on the birth certificate and your child was born after 01 December 2003

Can I get a passport for my child if I don't have parental responsibility?

If you do not have PR, you will need the consent and cooperation of the child's mother if you are to obtain a passport for your child.

If the child's mother does not consent, she can lodge an objection of her own volition and if the child has already had a passport issued in his or her name, it will be recovered by order of the court and not returned unless or until the court considers it appropriate.

In what circumstances can the passport office refuse to issue my child with a passport?

An objector can ask the passport office not to issue a child with a passport if:

  1. A Prohibited Steps Order has been made
  2. The objector has had a residence order made in their favour
  3. A court order has been made stating that in order for another party to remove the child from England and Wales, the objector's consent is required
  4. There is an order requiring that the passport is surrendered to the court
  5. There is a court order preventing the passport office from issuing or re-issuing the child with a passport
  6. There is an order preventing the child from being taken outside of the jurisdiction (England and Wales)

I have parental responsibility - what do I need to do next?

If you have PR for your child and no objection has been lodged at court regarding your passport application, you must send any court order dealing with your PR alongside your application form.

If your child is currently registered on another passport, i.e. your passport or his/her mother's passport, their details will need to be officially removed from them.

You should also note that if the child's mother has already applied for a passport for your child, and it has in fact been issued, even if you have PR, you will not be able to apply for another passport for your child.

Sam just stop posting (,I have zero interest in you or your adult daughter ).you where lucky I signed the (passport papers years ago God’s truth) .you should have legally changed her surname like you where going to do I would have gave my (parental rights up in a heart beat) .because I never wanted (kids ).people can say I’m a (deadbeat dad or the wrong father is on the birth certificate ) .I will agree with them that’s why I never fought for (bree I never wanted her in the first place) .and she is way better off without me .if the shoe was on the other foot and I had her when she was little I would off put her up for (adoption gods truth )so she could be raised my (parents that wanted kids ).so if people want to call me a deadbeat dad go for it At least I’m honest with myself and know I’m not cut out for been a parent .

Hi I'm trying to apply for a passport and I've been though domestic violence and I've not seen her dad since she was 18months old and she's 10 year old I got an injection on him so he can't come near us. Hi. My ex partner managed to get our kids passports and take them abroad earlier this year without me knowing. I don't know how she managed to get the passports without my consent as I am on the birth certificates of both my children and have a court order to say that I PR and it also say that she has to let me know 3 months in advance if she is taking them on holiday anywhere . Hi I went and got (and paid for) my 2 boys passports about 3-4 years ago to go on holiday with them. Earlier this year my ex asked to “borrow” the passports to open a bank account. I was happy to let her use them but asked her to confirm via text that she would return them to me after. I didn’t want her to keep them and risk her using them as a lever/weapon if I needed them again (she has history of doing this) She agreed via text so I thought I was safe to let her use them. 4 months on she is now refusing to return them. Can I contact the police as she has stolen them? Or do I have to use solicitors/courts to get her to return them, that will be costly so can I recover the cost of getting them back from her?

I have never been married to mother of my child but I am on the birth certificate, so we both have PR. I have been kicked out from the house when our daughter was 1. After 7 years I started cooperating with social services due to domestic abuse at my child's home. I have been safeguarding my daughter (at her own wish) since. This meant removing from mother's care and allow her contact only via Contact Centre, which she has never used and refused to seek help with alcohol issues. Not even once in past two and half year she asked how daughter is doing, is she healthy, not even wishes for Christmas nor birthday. Pretty much abandoned the child. recently I have started the process of applying for British citizenship, and want to take same steps for my daughter. Knowing how petty this person is, even before asking I know what will be the answer if I ask for consent to issue the passport for our little one (10yo now). I don't know much about the legal side of things, but I would like to avoid any contact with that person at all cost due to her abusive past towards us. We just started feeling safe and free from that harpy, I really would like to keep it that way. What would be the best course of action in such case? I cant really afford a lawyer, saving for both citizenship applications takes about a year for me, but I don't qualify legal aid either.

I have PR as I am registered on my daughters birth certificate. The mother has always kept hold of our daughters passport. I had a final hearing through the family courts last September and part of the order is that the father (me) apply for the UK passport and mother will apply for an Irish Passport for our daughter as the UK passport was close to expiring. Our daughter was registered at the address where we lived and mother still does and I want to know do I put my address on her new passport or mothers? daughters has live with both parents order. Hi. There is some slight incorrect information on this page. It says an unmarried father has parental responsibility if he is on the child's birth certificate and the child was born after 01/12/2003. This is slightly incorrect as the law states it is the registering of the birth on or after 01/12/2003 (so after 30/11/2003) which would give the named father parental responsibility, not when the child was born. So a child could be born before 01/12/2003 but the birth registered (or re-registered) either on or after 01/12/2003 and the named father would automatically gain parental responsibility.

I got my 5years residence from my eu partner, my ex the father of my 3 children do not have residence in the UK, our child is now 10 years I have applied for her first British passport, included the father's name on the form, but I do not write in section 8 that we have divorced. The passport office sent an email to my countersigned person who happened to be my Pastor who named the child 10 years ago who also knows my ex. The countersigned clergy was contacted by HM passport office to confirm if he knows the child, the mother and the father. I must confess I have been panicking since then because I don't want the home office to think my relationship is not genuine with my new partner, he also hot my 3 children 5 years residence. My 5 years will expired 2021, and he's willing and ready to do my permanent residence for me. Can anyone please advise me. I don't want to deny my ex from getting his resident as well because he has been involved in his children lives as well.

My daughter is her full time guardian. She wants to get an Irish passport for my grandaughter but the child's father has refused to sign the form. Hi, me and my partner want to take his kids to Disneyland Paris for a weekend but we don’t have their passports and she is refusing to give us it. They’ve never been to court but have an arrangement about access, he has them 5 days 1 week, 2 the next so on so on, my point being that she is happy for them to be with him any other time. One of this kids doesn’t have a passport can he just apply for first one her as her father and have it sent to our house?. and how do we get the other one?, can he apply for a new one or get her existing one cancelled and get a new one?. She is completely unreasonable and we don’t have lots of money to spend on going to court and we want to go away at end of August. Any help would be great. Thanks

Hi, my partner's ex wife keeps with holding his son's passport despite it being written in a court order that she is not allowed to do so. Every time we try and go abroad it is a battle to get it from her, she uses it as leverage e.g' if you don't have him an extra night you can't have it'. It is due for renewal as it has expired, she said only she could apply so naively my partner has given her the money to renew it and for the photos and she is still refusing to do it despite agreeing initially for us to take him on holiday. Who has the right to hold the passport? If we do manage to get her to renew it and give it us to go away do we have to give it back? What is the process of having it being held at solicitors if she objects when we refuse to return it?

Much depends upon why you are holding the passport. If you are holding the passport in order to prevent your child's mother from taking her outside the country (i.e for a holiday), then your ex can apply to court to have the passport released. The child can only have one passport and if you are holding it, then you are preventing the other parent from leaving the country, in which case who holds the passport would be up to the court to decide (if you both cannot decide through mediation which should be your next consideration if you as parents cannot agree).

Hi, my stepdaughter has an Irish passport but circumstances meant that my partner was forced to placed a notice on the passport requiring that he be notified should they attempt to leave the country. As she has dual nationality my stepdaughter is also eligible for a british passport which we believe her mother has applied for and obtained without telling us. How can we find out if my step daughter does in fact have this passport? The child is 9 so we can only rely on her word and her mother will not answer whether she has obtained the second passport or not. My step daughter indicted she travelled to Spain recently without our knowledge and without any flags being raised at passport control.

Long story but will try to keep it brief. My son has been living with me for a while now and has no contact with his mom At all. At the time social services were involved and they were happy, taking into account my son's age, that he wanted to stay with me. The problem I now have is that I have booked a holiday but his mom has his passport and I can't get it back. I have tried to cancel his passport to get a replacement but am hit by a brick wall. The passport office have advised I need to go to court. Does anyone know if this is true? I find it ridiculous that I now have to fork out God knows how much and go through the court when I have several pieces of evidence to show that he now lives with me. Can anyone advise? Is court the only way?

Don't believe everything that is said here, I unfortunately because of the mother was not their for the birth nor at the signing of the birth certificate as was not told of admission to hospital after separation from the mother, this on its own causes a huge problem for a dad, fast forward 1 day/1 second and you become nobody to that child. YOU now have the task of proving in court at your expense that you are the child's father and that your not a criminal and you don't want to harm or abduct the child, or anything else the mother may say. I understand that separation is/can be different and difficult in so many ways, but I find it wrong that the mother gets all the rights from day one, in my opinion right or wrong leaves the gap for many hard to prove wrong..... lies. In my experience the mother has full rights from the start for everything and the system does not work. Although I had a DNA test and issued PR through the courts the mother applied and got a passport for my daughter when she was around 5, my daughter is now 11..... not once was I ever contacted or asked if this was ok even though I have full PR and DNA proving I am the dad again through the courts........... do they not tell the relevant people???? Equal rights..... if your willing to pay the cost. No wonder dads don't try or aren't there, its not the trying its the cost... Make women pay the cost for proven wrong accusation and lies and give the real dads a chance.

My daughter has separated from her partner and they have a 2year old child. He is from another country and we fear that despite my daughter holding the child's passport her ex partner may forge a renewal application and abduct her. How can she prevent another passport being issued? Can she have it recorded that she does not authorise it and concerns over forgery? They were not married and both names are on the birth certificate. He has said his family want him to move back home abroad and we know he would not go without his child.

Your ex must get the permission of everyone with parental responsibility for a child or from a court before taking the child abroad, which will tell you your ex does need your permission. You may wish to contact the passport office directly in order to follow this up.

Hi, Everyone. Don't know if this helps, I'm a mother and main carer of my two children, I'm divorced, my ex sees the kids a couple of nights a week. My ex applied for a passport for my daughter without my consent. I don't know if there was any forgery of my signature or anything etc (My ex insists not) but it's clearly possible to process an application without their mother's permission.

I applied for a passport for him around 5-6 years ago, and this has now expired, and we want to renew. The Passport office are now asking for her written permission for me to apply for the passport although I have parental responsibility. Is this right!?

The father of my children is taking the children away abroad this year. The children's passports had to be renewed last year and the year before but he refused to pay towards them. I am taking the children away when he gets back and need use of the passports however I am worried that I will not receive them back. Can I ask for a solicitors letter from him for the passports giving dates when he will return. I am led to believe that the passports are my property until the children reach 16. I do not trust him in returning them. Last year his bit on the side decided to write all his contact details in them without my permission. Thanks

The fact your circumstances have changed and the terms of your 'custody order' are no longer in effect renders the effectively order redundant. If you are now living abroad and the arrangements laid out in the order have changed, it means there has been an agreed bi-lateral variation between you and your ex to the order. Any changes to a contact order must be agreed by both parties. This means if you wish to try to enforce part of the original order and your ex is refusing this (for reasons of her own based on the agreed variation) you would have to take the matter back to court.

Hi I have a shared custody order which means I get to have the children overnight 1 time per week and every other weekend plus 2 weeks holiday per year. With my job I now work in Shanghai China and I am trying to organise for the boys holiday to Hong Kong and Shanghai for 10 days. My ex is saying they are not coming to China, can she do this ? How biased is the law. I am a dad separated from my 2 children's mother. I asked to take them to Euro Disney to which I was told I would not get a passport for them unless she agreed . She has refused and now informed me that she is taking the kids to Portugal. How can the law allow her to apply for passports and take them abroad without my consent??

Hi my brother in law is a single dad and has been for the past 3 years his daughter is 4, her mother walked away from her had very little contact over the first 2 years (maybe 2 visits a yeat) and has not had any contact for at least a year. he is named in her birth certificate as her father from what I have been reading he has parental responsibility over his daughter without having to go to court because he is on that birth certificate is that correct? also he is currently trying to apply for her passport to be able to take his daughter on holiday does he need permission from her mother to get the passport? please help planning in going on holiday in the next 10 weeks!!

Hi My fiancé's ex partner and mother of his 11 year old son has just informed him that she has applied for a passport for their son and put father - unknown on the application form even though my fiancé is on the birth certificate and has joint PR. Can she legally do this? This is the latest in a long line of abusive and emotionally threatening acts on her behalf. I have not seen my daughters father for 6 years and lost her expired passport. I applied for a new passport but received a letter from the passport office stating that I would need 'written consent' from her father to prove the passport is lost because he had signed the previous application form for her previous passport. Wil there be any way around this as I have no way of contacting him.

@Ali - you would need the approval of both parents with parental responsibility. You can't take a child out of the country without this.

I am sorry to hear this. By law, if you have parental responsibility of your child your girlfriend has to request your written consent. However, if you fear your girlfriend may leave the country with your child without your consent then you can apply for a Prohibited Steps Order through the courts. A Prohibited Steps Order (PSO) is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. We have all heard the stories of a parent taking their child for the weekend and not returning them or going abroad with them and it becoming extremely difficult for the other parent to get their child back. Thankfully, this (child abduction) is one of the scenarios that a PSO seeks to prevent. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. This means there is no guarantee the order will be granted. Both you and your girlfriend would have to attempt to justify to the court why it isn't and why it is in your child's best interests to leave the country, respectively.

I have looked after my son alone for 9 years. His mother walked out at 9 months old and has never shown up to any arranged visits in the year after that. I have never received any support financial or otherwise and have not had any communication from her since that time. I am named on the birth certificate. My Fiancee has a 5 year old boy with her ex. He applied for his passport a while back and now will not hand it over so we can go on holiday. All the passport office say is we need legal advice which costs a lot in the end. Is there anything to stop us applying for a new one saying the old one is lost? will he be informed in any way and be able to stop it? The granparents have to have your authority to take your child out of the country. You do not have to consent to this. The option the grandparents have will be to take the matter to court and the court will decide whether it thinks it is in your child's best interests.

Hello all, I am in need of some advice regarding passport for my son. I have had sole custody of my son for 3 years that was set up by a mutual agreement and not through court. He was born in April of 2003 so I don't have PR because we wasn't married. I was there when his birth was registered but his Mother won't sign anything to allow me to have PR. Is there any other document I can apply for which will enable her to travel to france with me? As I understand it I can not apply for a passport while her mother still a has a valid one. Continued: They promised me that once I got my life back together we would share my son once again but this never happened. My ex managed to convince his new wife that I had done some unspeakable terrible things and as she was a social worker she (obviously) didn't trust me or want me looking after Charlie. Then I became very sick and could not walk. It took nearly 3 years and 14 MRI scans to finally diagnose me with having severe spinal arthritis and several slipped discs (happening constantly as it was a deck generative condition). I became severely depressed and I was in agony every day, needing carers twice a day and one 3 hour cleaning and shopping session. However at the time I lived in a building full of drug addicts and young violent thugs. I feared for my life every day and had to beg honest that it did not feel safe for my son so I went to the council and told them my fears, I had things stolen and was pushed down the stairs, worsening my condition. Eventually, approx 4 years after losing my child I was rehomed in a lovely brand new two bed roomed house, however because I got no money for Charlie at all it meant again I had to pay bedroom tax making paying my rent a struggle and my family had to help me a couple of times. Anyway I have now had private counselling (paid for by my eldest son James (he is now 24 and a very well brought up young man, something I did as a single parent for over ten years). My youngest son is now 9 years old. They finally got my medication correct and I have become so much better than I was. I have even bought myself a treadmill to strengthen my legs so that I won't need to use my wheelchair except for very Long distances. My ex is now panicking because my son has Been verbally and physically abused by his step mother and he has told social services about what has been happening (they are now thinking of separating but my questions are threefold, first of all to get proper weekly contact with my son how can I do this and also make people aware of the illegal things my ex has done? How can I beat a system that is protecting a social worker who abuses my son and is it fair that since that all came out my ex now will not bring and collect my son (as a way of punishing me for making the authorities aware! Which is also punishing his son too as every week I have to try and get Charlie in a taxi which costs an absolute minimum of £10 because they moved out of the town he was living in to a village with no public transport and I can neither drive, nor do I have a car or the money to buy one. I wanted to start paying them some maintenance towards Charlie this year instead of just asking me for money for school clothes, shoes, bags, pocket money, educational toys and much much more but now I have to pay out £10-25 (sometimes more) each week I am unable to offer anything which I suspect is one of his reasons for doing it, along with making me look bad if a taxi is late or I am unable to get one at all!!! My ex and I were still not married when my son Charlie was born, I wanted him to have my surname but I was being verbally and mentally abused by my partner so I did not dare to say no to him when he wanted his name on my sons birth certificate. I also had his birth certificate after we split up and my ex partner wrote out that as we had two houses, I was signing one over to him. I later realised that he had used this signature to get another birth certificate and on top of this he also forged my signature on a passport for my child and threatened me that he was going to take my child out of the country where I would never find him. After we split up he did some of the most evil things to me and I ended up having a nervous breakdown, I was even suicidal but could not even think about killing myself because of my children. At the time all of this happened I had custody of my little boy but allowed him to see him for half of the time. I was in receipt of Working Tax Credit and Child Tax Credit but did not ask for any maintenance from my ex partner as I felt it was fair that we shared him. However, after he had got hold of a birth certificate and passport for my son, he and his wife applied for the working tax credit and child benefit and child tax credit. Due to my son having their surname and him having a passport (which I did NOT give permission for as he was acting very strangely and was worried he would leave the country with my son). Soon after this I had an accident in the flat I was living in, there was no overflow in the bath and the ceiling fell into the living room. My landlord would not fix it as he was obsessed with me and even took a video of me in my bedroom in my nightie. As all this was happening my ex managed to convince child tax credits and child benefit that they were now entitled to the money for my son, stating he was living there. This was untrue, he just stayed a few more days whilst I waited for the landlord to mend the ceiling. When it didn't happen and I found out that all my money had been stopped and given to them instead I had a nervous breakdown and they didn't let me see my son for 3 months whilst an old laptop was searched for child pornography (it belonged to my ex but turned out that it had a virus and wouldn't even turn on!!!) then my partner convinced social services I was unstable and crazy, I had no money so when it came to going to court as they had applied for a residence order (the landlord still hadn't fixed the ceiling because I wouldn't go into business with him again as he had ripped me off the first time.). I was so stressed out, scared out of my wits and terrified of losing my little boy that on the morning of the court case I was throwing up and couldn't leave the flat. I let them know I couldn't make it and why but they took no notice and the court ruled against me. hard one here for you. my daugther was born in a gulf state( expats). I'm british, my ex wife is SE asian. I applied for a passport for my daugther at birth( legal requirement that all foreigner had to have passport) and because she was not entilted to her mothers country passport( this changed two year later) i applied via the british embassy via the nationalisation act(?) that was a few years ago, and the passport has recently lapsed, but I have no idea if the passport was renewed.My wife details onthe applicationform were crossed out as not relevent other than name and DOB. can my ex wife renew my daughter british passport given that is was issued via me, that it is in our family name- father and daughter has same surname (my wifes legal surname is not the same as mine and her country does not allow their women to take husbands name, but keep their fathers name and has a non british passport). we both have PR, but as she obtained custody/divorce through sharia court in a a ruling that is not legal inthe uk, I'm not sure if she can do it or not. there is the added complication that my ex was really pushing to get a settlement visa for herself inthe UK and I suspect she will use my daughters citizenship to move to the UK. sorry its long winded

Hi, I had this situation thus summer. She can apply for a passport without your permission, she maybe gracious enough to ask you for your passport details which makes it easier for you to use them too. What she might not realise is that unless there is a signed and official child arrangements order then she needs to seek your written permission to take them out of that country if you have parental responsibility. This is where I got steamrolled again by her as she didn't do this despite saying that she had to and presenting her with the government and legal paperwork stating such. I didn't pursue it because I read about the child arrangement order and thought that was the same as the statement of arrangements - the very document that she has ignored and tossed aside from day one believing that she is running the show - this document isn't really a solid agreement and doesn't constitute an order which negates the need for your parental permission. Unless there is an official order she needs your permission to take them out of the country. If she doesn't then it is abduction. I was all for going to the airport with the police to prevent her or at least make a point but my partner told me not to as it wouldn't be fair on my daughters. Also my ex was determined to keep they're going away a secret until the very last minute but that's her arrogance all over. She needs your permission.

I need to know if my wife can independently apply for British passport for my kid without my consent and my ILR details ? If yes, can she also get ILR through my kid once he has got British passport?

My daughter sadly passed away and left 2 children I was her next of kin she had a partner who was named onthe Childs birth certificate, but they have told him he would have to see a solicitor, as the next of kin would I be able to get there passport

@Debz63 - You can take your grandchild abroad for 28 days without the permission of anyone with parental responsibility, if you have a child arrangements order. Technically, as long as your grandson has his own passport, you are able to take him out of the country without consent. However, legally it is always encouraged that you to seek written consent. Not knowing your circumstances, that decision will be up to you and whether you think the parents will wish to be kept in the loop. @saddy - according to Chapter 55: deprivation (section 40) and nullity (nationality instructions), if the person acquired their citizenship status through naturalisation or registration, and it was obtained by means of fraud, false representation or concealment of any material fact, then citizenship can be withdrawn. However, you would have to seek professional immigration advice about this. I hope this helps.

I am taking my child on holiday, of which my ex partner has consented. He has however just approached me with the idea of taking my child abroad also. I know it sounds very selfish of me but my heart sank with fear what ifs rushed thru my mind of the worst circumstances and I know my ex must feel the same when I take my child abroad but honestly the fear of my child not coming home bein hurt when I am not there aswell as the fact I imagine that my ex might keep their passport on return causes a stress around my heart like I've never felt. I'm a British national currently residing in Hong Kong. I'm in the middle of trying to apply for a British Passport for my 18 month old son, who was born in Bangkok. The hold up is that I need my Thai wife's birth certificate, which she has lost, so she needs to apply for a new one in Bangkok, Thailand. She hasn't done this yet, and to make matter worse, we are now in the process of separating. I have 2 questions please: 1) do I have to wait for the separation to be legally endorsed before I can apply for his passport without the need for his mothers's birth certificate ? I will have sole custody of my son. 2) Is it acceptable for me to apply for a tourist visa for my son and return home to England with him and apply for a British passport for my son from England instead of Hong Kong ? @Rudi - She can acquire a passport as she has PR. Do you have a good reason for applying? A Prohibited Steps Order (PSO) is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. It is used more commonly when there is suspicion that one parent may leave the area with their children. There has to be an specific concern for the welfare of the child to apply, i.e you can't apply merely to stop her taking your child on holiday. I hope this helps.

A Prohibited Steps Order (PSO) is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children and not return i.e in cases of child abduction. However, your ex will need to have good reason, such as this, why he doesn't want you to take your child on holiday. If he doesn't have any justification for the order and is merely being awkward and the court is reassured that you are taking him on holiday with the full intention of returning and can prove that, then the court will rule in your favour. It might be your ex is making idle threats, as this will obviously cost him financially. I hope it works out for you and your child gets the holiday he wants.

@Alfie - there may be reasons why the the Passport Office is asking for your mother's birth certificate, but as I am aware, he would be asked for either his mother’s or father’s UK birth certificate, and a British passport belonging to one of his parents that was valid when he was born or a British passport number for either parent. The gov.uk site says that if he sends documents relating to his father, then he must also send his parents’ marriage certificate. There really must be a way around this, so he really needs to make an appointment and see/talk someone directly, as this is at the eleventh hour.

We need help my daughters boyfriend who is 19 would like to come on holiday with us he lives with his dad and has not seen his mother and has no contact with her since he was 4 the passport office keeps asking for his mothers birth certificate of his mother which he can't obtain as he doesn't know where she is. He has written a cover letter but they still keep sending the forms back. They have now said he only has till 4 th April to complete and there will be no refund. Any help appreciated as he was born in England and is no longer a child he should be able to get a passport in his own right surely. We have tried to contact his mother to no avail. Advice please

@eug - as specified in the article, if you are separated but still married, either parent can give permission for a child to have a passport. If you are divorced, but were married at the time of or after the child's birth, either parent can give permission for a child to have a passport, unless there is a court order about PR or preventing the child from having a passport. If this is the case, you should send a copy of the relevant court order with your application. Should you not wish your ex to apply for a passport for you child for a specific reason, for instance if you think she may move your son abroad permanently, then you can apply for a Prohibited Steps Order to try to prevent this. My ex is thinking of getting a passport for my 8 year old son.however I am named on his birth certificate and we where married when he was born so therefore I have parental rights over him (as he was also born after 2003 ). @jax - it's a tricky one as you can keep the passports, but if he wanted to take them away then he could go to court to get a specific issue order which would mean the court would decide whether they were allowed to go on holiday. You would then have to hand over the passports to allow him and your daughters to travel.

I have just discovered that my 3 yr old son has just spent the week in France. I was told that they were visiting London and not even aware that my son had a passport. My ex-wife now lives in France with my two children (12 and 10). She says that passports are nearly out of date, I suspect though it's more because she wants to have passport with their change of names (a double-barrelled surname). She is asking for half the cost of the passports, which if I should pay then fine. However, it is yet another thing that says I should pay for on top of the CSA which I pay monthly. My argument so far has been that as I'm paying a large sum of CSA every month then any costs such as new passports should be paid from that. Is that correct? Or do I have pay half the cost as extra?

I have both my children of the marriage living with me, divorced no orders made ,wife has limited contact for various reasons wanted to renew my daughters expired passport for a school trip was told by passport office as her origional passport had been applied by her mother only the mother could renew this, after a long and interesting dispute which kept being passed up the food chain they could find no legal basis for this and grudgingly issued the passport. I t would appear they think that any man applying for a passport must be intending to run off with the child. In general the concept of the working father having the children seems to trigger a revulsion on the part of many agencies.

I have completed the full court procedures after divorce where I was granted a full residence order. I thought that was it , but , my ex wife is in possession of all my daughters belongings including passport, birth certificates etc. question ... How do I get these back or renew them ( as a child is only allowed one passport ) when the courts have said hand them over she has refused saying they are lost. No crime numbers though. She has PR but NO residence order or contact order ?...

to Concerned Nan! My son had the same problem, we contacted a solicitor and passport office for advice, as long as the father is on the Birth Certificate and has parental responsibilities which are automatic if child born after 1st December 2003! fill in the passport form as follows Childs name on front with fathers address and contact details, page 2 mothers name dob etc ignoring the Mothers Passport number! Fill in Fathers info page 3 where it says More Information you write (not sure if your son was married to ex if so do not write the first bit) NOT MARRIED! MOTHER HAS A PASSPORT DON'T KNOW NUMBER, FATHER HAS PARENTAL RESPONSIBILITIES Father signs the declaration Then you find a person that knows your son and his son to complete counter signature part ( I asked a friend that had their own business) YOU WILL NEED TO OBTAIN COPY OF THE EX's BIRTH CERTIFICATE and a COPY OF HER MOTHERS BIRTH CERTIFICATE! You can get these from Registration office usual cost £10 each I got mothers first as this gave me information I needed to get her Mothers, I also paid £3 to do an on line search on an ancestry site so easy. The passport arrived 4 weeks later at my sons address. Hope this helps you not fair that these mothers have the upper hand all the time. Abused Nan

My son wants to take his little boy on holiday to Cyprus next year. He is on the birth certificate and has automatic parental responsibility. He has asked his ex for her passport number etc. to complete the application form but she is currently refusing. Also because his son resides with his mother the passport would be sent to her address and she is likely to refuse to give it to him. how can he apply for the passport?

I divorced my wife 6 years ago and we have a contact order for our two boys aged 8 and 6 years. I have joint custody and Parental responsibility. I wish to take my boys abroad for a weekend on my contact time. I am happy to give her dates addresses etc but she will not let me have their passports. I have never failed to return the boys and I believe they are old enough to travel. What action can I take to resolve this? If I book a holiday and don't get the passports can she be forced to pay the money I lose through family court or small claims court??

My son went to live with his dad for a year to see if he liked it there during this time his passport ran out and his dad got a new one. He has since returned home and my ex husband refuses to give me my sons passport, does the passport have to be where the child resides, any advice would be great. Thank you

Hi there! Can i apply for my childrens passport without my ex husbands consent? As he didnt want contact with are two children after he was arrested for dv and given a 5 year court order to stay away from me. As i want to take them on holiday but dont know if i can get their passports.

Hi my son has recently split from his partner. They have a little boy aged nearly 17 months and they are trying to share PR at present. My son is on his birth certificate.Before they split up we had booked a family holiday with great grandmother, grandparents and auntie and now my sons ex partner has refused to let my son take their son on this holiday or to get him a passport. Does my son have the right to apply for his sons passport without his ex partners consent? I would be very grateful for your advice.Anxious nan.

I split with my ex over a year ago I have my children exactly the same amount of time she does. I've booked a holiday, and my ex partner has told me that I cannot take my 2 kids aged 3 and 5 away for a two week holiday although I'd told her months ago this was the plan and she had no objection to this, although now she has changed her mind and said I have no chance of getting a passport without her concent and if I take the kids out of the country its kidnap! I have Both kids birth certificates with my name on!! no court orders we have between us either it's just shared time between us.

if I put the father of my child name on the birth certificate, does that mean he can stop me from taking my child abroad and does it stop me from getting a passport without his consent?

Am a father of three wonderful kids, who live with their mother, (yes was married to when they were born, so i'ave got PR) but divorced now, but have a joint custody, but they do reside with her! she said she need my info off my passport to renew theirs, cuss theirs ran out. I asked why now?? she said cuss, she just getting them done as an when she can, (but has told my son not to talk about why she needs it, as I asked him when he came over) I said, well there no really rush then is there, she said i'll sort it any other time. Am not stupid, so went over with my son to talk to her an shes all defenses! then lets slip that they were talking about it but nothing def, lol (that what they said about the holiday her an a m8 went on) so I throw it out there about her new boyfriend going away with them too, an she went all cagey on me!Am not against my kids going away an have a holiday, I just want to know what my rights are, being as the kids have my surname, an she gone back to hers,so how can she apply for one in her name as i've read above, as the aren't that on their BC?? isn't that fraud. plus the fact that she used her married name to travel abroad this year, when she has been back using her unmarried name for 7 years now, isn't that fraud.??

My husband as recently discovered that his son was issued a passport in his ex wife's new married surname in 2003. We have never been allowed to take his overseas on holiday and now we know why. My husband has full PR for his son and has never given consent. The Pasport office have just given my husband all the details showing where his exwife wrote a letter giving consen supposedly from my husband and with his forged signature on the bottom. Amazingly the passport office did no checks at all and issued the passport. In 2007 his ex wife tried to change it back (she must have panicked as a court refused to give her permission to change it in 2007-even though she had already done so-she still asked a court 4 years later?). The passport office refused to change it back without my husband's consent-(their rules were a lot tighter i 2007 than in 2003. My husband has nothing to prove he is his son's father as his birth cert is in a different name to the one his son now uses. The schools have ignored my husband for years even though my husband has had regular contact and paid maintenance every month. We cannt believe it is so easy to remove all links from a child to a father....the IPS are investigating but we have lost many years of not being able to take my stepson on holiday and being denied we even exist.

Life can be hard and you can make it harder. You only need to do one thing, your best. Your children will soon be adults and will know what you did. The only battle to have is to do the best by your children. Never lose contact never give up, ever. I have been through it with my daughter. And every thing I have done is for her. I lost everything and gave up but I didnt I kept going and always made sure she knew me who I was. I spent twenty minutes with her on her first birthday. That killed me and on her second birthday I didn't even see her> But I kept going kept fighting. She has just turned three and now lives with me full time, her mother has no contact anymore, her choice, all iam saying isdon give up,choose he battles and remember the most important people in any mess are the little ones, they deserve you, they need you to take the right fights and they will remember it when they are adults dealing with their own lives. Be there and never give up.

@ FRUSTRATED. Would be a great idea. I Have been waiting for 10 weeks for a letter from the social services deptartment that came out to see us. I have phoned them 21 times. I have logged every person I have spoken to. All of them said, oh yes we have your case notes will get the caseworker to call you. Now I am being told that the caseworker no longer works there and they will pass the request on to someone else. Marvellous. I feel like at the age of 49 I have ended up somewhere I didn't want to live, living on generosity of my family. Without my partner whom I had lived and worked with everyday for 3 years and now noone in authority wants to know. I have seen a solicitor for a free consultation, she says I need a court order. How long does this take??? She also says the fee will be £160 per hour there after - what do I pay with??? Buttons???? I gave all my savings and my half of our owned property to my ex when we split. I really do feel so frustrated and angry and sad. It seems know one can help me. I thought I was doing the right thing by my daughter and I know I am, I also know that although it seems like forever this is a relatively short period of time, but I also feel like I am in a bubble, plucked from a life and placed in an alien land. I know it sounds selfish, just all seems so hopeless. Sorry, thanks.

@ Pablo66 I don't have any answers to you but it might be worth your while speaking with the case worker from the social work department or CAFCASS or Citizens Advice Beaurea as I am sure someone should be able to sign of your ex's behalf considering the circumstances.Good Luck!!

Hi, ( I have already posted this but under a different heading and have no response) This is my second time of posting thanks for all help so far. What is the situatioon with my daughters passport. When we seperated both my ex wife myself and our 4 children lived in france. This continued until my ex abducted our 2 youngest in september of last year and returned to England. I have been fighting this in the meantime but anyway, during a contact visit to my 2 children against the wishes of their mother (who is an alcoholic and has been violent to myself during our relationship) cane to stay with me at my families hose in England for the weekend. On the day I was due to return to France I had a distrught phone call from my daughter saying her mother had punched her in the face and split her lip. We ended up at the police station, social services were called etc. My ex (in the initial interview was too drunk for the police to interview her was sent home) in the second interview denied the allegations and said our daughter had fallen down the stairs. the police said it was one word against the other and wouldnt persue charge, our daughter is 14. I obviously ended up staying in England. Social services then came out to interview me, my daughter and the family etc and placed her in my care, saying that 14 year olds talk with their feet and if she didn't wish to have contact or make resolution with her mother then that was down to her and that she should stay with me. Her mother refused to give me her passport, even to allow a short vist to allow me to sort out all the obvious things that are necessary, I have lived there for 9 years non stop and obviously it is like just dropping your life, including my partner of 3 years. The police agreed my exwife is nuts and advised me to apply for a lost/stolen passport which I have done. IPS say they need a court order or a letter from my ex confirming that this is the case. She will not give that obviously. In the meantime I have urgent business I must attend to there, my family had my daughter briefly for a couple of days but this is not enough to tie everything up. Apart from this few days I have been in England for 2.5 months, the cogs seem to turn really slowly. I have noone here to have my daughter in the meantime and can't get her to France without her passport. By the way yes I was married to the mother before during and after our daughters birth and I do have parental responsibility. Our divorce is still ongoing and is all tied up in the french courts along with access and all the other peripherals. What can I do about the passport ? My daughter never sees nor wants to see her mother now and I want to go so it can all be tied up during the school summer holidays. Some advice please. thanks.

I'm a single parent wif 2 kids my eldest daughters dad got pr through the courts and I want 2 no if I need permission 2 take her on hols he pays no child support 4 3yrs now and dosnt. Anything to. Do wif her either has had no contact in 3yrs!

I am the non resident of a 5 yr old. I have PR was married to mother and I am on BC. I have maintained child support for 4 yrs and I have had regular contact although like most fathers limited due reasons down to the mother. Where do I stand ref my ex having reservations about me taking my daughter to Spain for a week (my time with her in summer) ie she's worried about the climate. Basically I think she sees our daughter as her possession and I would be the first to take her abroad. I have her asked her and willing to give details where I would be taking her. I don't want to leave it to the last minute. I have offered to pay for passport. Can she stop me? What are my next steps if she refuses to apply/give me passport?

Hi, I have a 7 month old daughter, I have never lived with the father or been in a relationship with him since I found out I was pregnant, his name is on the birth certificate but she has my surname and he has a copy of the birth cert, hes always to n from america every couple of month to see his fiancee who is from us, I am worried that he will get our daughter a passport n take her with him, can he do that???
