I'm not on my son's birth certificate and his mother and I are separated. I'm now in a new relationship and have another child and one on the way.
The thing is my son is only five and no longer wants to live with his mother. My ex contacted me and told me to collect my son as she didn't want him anymore. She said all this in front of him and he was very upset and says he wants to live with me forever.
I'd just like to know how I stand as I'm not on his birth certificate.
What does it mean if you're not on the birth certificate?
If your name is not on your child's birth certificate, you do not automatically have parental responsibility. This is the legal term for the rights and duties a parent has towards their child, including making decisions about their education, medical treatment and where they live.
However, if you were married to the mother at the time of birth, you have parental responsibility automatically, whether or not your name appears on the certificate. For unmarried fathers, being named on the birth certificate after 1 December 2003 also grants automatic parental responsibility.
Without parental responsibility, the child's mother can make all major decisions without consulting you. She could allow your child to spend time with you, but she would also have the right to ask for them back at any point. You would have no legal standing to refuse.

There are several ways to gain parental responsibility if you are not named on the birth certificate:
- Re-register the birth to add your name (you will need the mother's cooperation, and this applies only if the original registration did not include the father's details)

If you are on good terms with the mother, a Parental Responsibility Agreement may be the most straightforward option. What if the mother will not agree?
If the mother refuses to sign a Parental Responsibility Agreement, you can apply to the Family Court for a Parental Responsibility Order. Before making a court application, consider whether mediation might help resolve the dispute. Many courts expect parents to have attempted mediation first.
The court will look at factors such as your commitment to the child, your relationship with them, and whether granting the order is in the child's best interests. Courts often grant parental responsibility to fathers who can demonstrate genuine involvement and a positive relationship with their child, though outcomes depend on individual circumstances.
If paternity is disputed, DNA testing may be required to establish that you are the biological father before the court considers your application.
You do not need a solicitor to make the application, though many fathers find legal advice helpful. Citizens Advice and some local law centres offer free initial guidance. The Family Court has its own forms and guidance notes available through GOV.UK.
Why this matters
Parental responsibility is not the same as having your child live with you, and it does not automatically give you contact rights. But it does mean you have a legal stake in your child's life. Schools, doctors and other authorities must recognise your role as a parent.
It is worth noting that fathers without parental responsibility may still have financial obligations for child maintenance. If you are unsure about your current legal position, getting clear on parental responsibility is a sensible first step.
After a few months she informed me she was pregnant
Prior to this I knew she had mental issues but cared for her

At present
She wouldn't put me on birth certificate
Is being very difficult in allowing me to see and bond with my son

He's paid £200 every month since the child was born and had contact for the 1st year. There has never been a relationship between him and the baby's mother.
The mother suffers from irrational behaviour and thoughts and has caused great anguish to my son, posting horrible comments about him on social media and sending hundreds of irrational and vile texts. All of which have been lodged with the police. Due to this, he had to stop the contact 6mths ago because of what she was implying.
He has recently contacted her to set up mediation to try and see his son. He would like to have him 50% of the time, so I suppose that would be joint custody.
But is now worried about what effect involving the police will have on his chances of seeing his son.
Should he forget about involving the police and go for mediation and if this doesn't work go for a Court order. Or carry on with the police investigation and then apply for a Court order for joint custody.
I have a 5 year old. Who very rarely sees her biological father. At a push she will see him once every 3 months for a weekend. Without any communication in-between.

As all these stories go, Ex and I split up. Turns out she's pregnant, She gives birth to a boy. Kept me in the quiet. Registers the boy with no father. She "meets" someone new. Falls pregnant. Baby 2 is born. Both Ex and new partner register baby 2 with both Mother and fathers name. Re-Registers Baby 1 with new Partners names as Dad on the birth certificate. (Roughly a year after baby 1 was born). Fast forward 10-11 years. Ex pops up from out of nowhere. Saying that she has told baby 1 that I am his Dad and that I am now allowed to see him. I go through courts for access and Parental rights. I was given access. Two years of hard work and she then again disappears with "My Son". Fast forward another two years. Ex's new partner (Partner number 3 i think ??), Is at my front door with "My son", Saying he is now your responsibility. Then leaves him with me with nothing but PJ's. So I do what any other Dad would do and take him in and help rebuild his life. So, I go to get his birth certificate to find out that Partner 2's name is on the birth certificate. Also that I have no legal responsibility for "My Son" as I was only granted access. Mentioned this in a heated conversation and the next thing I know is that they have taken "My Son" to Ex's Aunties. Now I find out that the poor lad is going to be kicked out of his Aunt's and they want me to take him in. At this point, I have no idea who the Original father is, If it is me, Well it goes without saying. If it's Partner number 2 who has been paying CSA for all of this time (Well when he is not inside). Or if it's a random person's kid and we are all being played. Also, can she force the lad to stay here ?. I know that if he does, she can call the police and say that I have kidnapped him. :/

He was disgusting to me via text when I told him I was pregnant I’ve saved the messages.
He’s never tried to contact me then shows up at my mums house 2.5 years later demanding he sees his daughter.
Before he left he was talking about his violent past that he has never been caught for no record etc which is why I obviously stopped seeing him back then but not actually knowing I was already pregnant.

Things then became more hostile when she was at her mother’s but I continued to support her financially. Around this period she suggested I may not be the father of her child and she stopped contact with me and everyone involved from my side.
Around when the child would have been around 1 and a half years, I accidentally met my ex’s mother at an event and after a heated exchange over how they’d cut me off, my friends exchanged contact details with her and sometimes afterward we went to the Midlands to see her and my ex. Mother has now called CSA demanding that he is to pay for the child. She wants additional 500£ for DNA. It's been planned for one to be done found via the GOV website at a fraction of the cost. However this isn't suited. She is allowing contact via web and phone but not in person. Just keeps asking for money. Now payments will be starting with immediate affect.
The friend isn't sure if he or his brother is the father. Also he has a wife and 2 kids who had to find this out via social media

I'm thinking of calling social services because making him feel like this at the age of 11 years old, and I'm not able to have a word in edge ways, is the only way i think of making sure is emotional well being is being protected.

He saw his daughter the other day for her birthday and his ex caused an argument, resulting in her breaking his finger in a door and him breaking her car door. They are both at fault. His ex has reported him for criminal damage for breaking the door and was taken down to make a statement at the police station.

To have any rights. When she passed away I asked her mother (my child's grandmother) if I could see her numerous times and she told me to back off while she is grieving. I have waited untill she is ready as requested but now she tells me she is applying for a parental guardianship order. This hasn't been discussed with me and I haven't been given a fair chance do I have any right to dispute this
He and the mother have never been a couple although she hoped that they could be. It one of those situations where they met on a night out and 9 months later he found out that he's a father. Of course it was hard for him to accept this especially that he didn't know the girl but he carried on seeing him but everything was on her terms whatever he did she had to be there..

My partner has a child from a previous relationship. I have a new born daughter (5 weeks) - I was denied access to the birth, not involved in the naming process and asked to leave the house I was sharing with the ex (possible narcissistic personality disorder on the mum's part) as far as I'm aware, I'm not on the birth certificate but have recently been allowed some visits. I've had my mediation appointment but she was late to hers and it is now rearranged. The snag here is I am currently retraining on a none payed work placement and living with my parents until I have qualified- so if it goes to court, what are my chances? I was married with my former wife (we are from both different countries) 9 years and we have 8 yrs old boy. I was a great family man with renunciant and good manners. In addition to that, my son was so close to me and I was his biggest hero, biggest role model.
We had a perfect marriage first 5-6 years, then she started to change because of her friends. She used to be such a down-to-earth person. But, she became such a snob and show-off person last 2 years. We had some issues beginning of 2015 but we were never in divorce matter. In November 2015, she suddenly said "she wants to divorce". I was in abroad at that time and working hard and away from her about 1 month. Her reason was "I didn't provide her luxurious life, she is beautiful, she is successful, therefore she needs a better life". Shortly after, I came back and tried to fix our marriage. But, she played some games and I had to leave from our family house with my suitcases only in December 2015. I left everything to her and started to stay in my friend's house temporarily. In Jan 2016, I wanted to go back to house, but she changed the locks even if I was on tenancy agreement. Afterwards, she stopped contact with my son and I tried to meet with my son and her to talk about our marriage. She was keep refusing me to meet with my son and also meet with her.
During this time; I regularly had panic attacks (first time in my life), I lost about 20kg, I had sleeping and talking problems. I had to leave from my work because of all these problems as well.
In March 2016, she reported me to the police that "I was harassing her". I was only emailing and texting to her to save our marriage. Police interviewed me and obviously they were from her side. She basically wanted me to stop contacting to her and my son. In the mean time, she took my son away without my knowledge and permission. In June 2016, she took me to the court "to take my all parental responsibilities" from my son. She said so many lies and slanders on her statement. I was totally shocked, speechless..!
In August 2016, I found out that, her new boyfriend moved to our former flat with his son from his previous marriage/relationship while we are still married and on the court process.
In Aug 2016, we had a hearing the judges rejected her order and sent us to SPIP. The judges also told her to show my son to me. I had a lawyer and he was doing his best to get contact with my son. But, she was keep looking for reasons not to show my son to me such as i would kidnap him, I would hit him, I would make him against to her, I shouldn't talk to him in our native language etc. In Nov 2016, we had 2nd hearing and she presented her statement late just to get more time. This postponed our hearing to January 2017. The judges strictly told her to show my son, at least next to the our mutual friends. She said "yes", however she didn't with similar reasons. I did not see my son till January 2017 which was 8 months..!

My wife moved to Hawaii from California to get away from him during to his abusive nature. We just want to move on with our lives, and changing her daughter's last name is part of us moving on. I'd greatly appreciate any info on how to go about this correctly.
What are my options if she decides I can't see her or if I have her and she decides out of the blue she wants her back at hers?

Ive had a son with a guy I was never officially in a relationship with. I gave him several opportunities to get involved with the pregnancy and he never showed to any appointments or scans. My son is now 16..and we split when he was 5 into separate houses...Boy went with her and I paid a transfer every month until my son came and lived with me from 2008-2013....I have had no money off his mother during but she claimed the benefit and tax credits I wasn't bothered etc.
He went to live with here 2014 and she went straight to the csa and I had no choice to pay the agreed transfer of 200 per month or get bent over by them.
I'm a fare guy and fell ripped off by my ex because I paid for all his keep/did all the health and welfare and schooling etc during the time he lived with me..
Q, Can I make a claim on her for that time she gave nothing and claimed and what's the best process? Can I report her?
she refused to let me anywhere near since our relationship fell apart and tells me to take her to court.
would all this be used against me? can I get any parent responsibility?
She said I am "registered" as the father in UK .

About 6 wks . in this time he slept with someone who then announced after my partner

By her a day after the birth. He has visited to see thre baby. She says that my partner is the father . he is going to have a DNA
Test done to be 100% sure the baby is his , the mother has registered the baby with her surname and as far as we have been told no fathers name was put on B/C . where does this leave my partner via contact and paying maintenance ? If the DNA tests proves he is the father he wants to be part of the babies life as much as the mother allows and as he is from another country and has certain culture believes he would like her to be aware of and his family background. However, it might be possible to add your details in agreement with the mother and by completing an application for the re-registration of a child's birth.
If the mother is not in agreement and you want full parental responsibility then you will have to take action to acquire those rights by getting a parental responsibility order from a court
However, if you gain parental responsibility for a child you don't live with, you don't necessarily have a right to contact with them (but the other parent still needs to keep you updated about their well-being and progress). You would also have to ensure that your child is supported financially, whether you have parental responsibility or not.

If you want a new birth certificate you’ll have to order one separately as you don’t get one automatically when you re-register the birth. Hope this helps.
What can i do?!
I have split up from my girlfriend, we have been together about 2 years. We have a young son 17 months and I have been a very active. Dad. My ex girlfriend did not put me on the birth certificate although she said she would. Every time I suggested going to the Registrars Office she made excuses why she could not go.
She keeps making excuses why my son cannot come and sleep over at my parents house, saying that it is better for him to sleep in his own cot/bed, but I have heard that she let our son stay overnight at her friends house. She is being awkward about access and how long I can spend with my son. I really would like to be listed on the birth certificate, how do I go about getting this done? Can I take her to court to enforce this? I am definitely the father!!
What are my rights? I wanted to see my son as much as possible.

Ii just had a baby and me and the father are not together, when I register the birth I didn't put his details on the birth certificate but I use his surname for the child.

I gained parental responsibility through a court after she left, as it was early stages she was cooperative and even pleasant enough to come with me to allow parental responsibility, after all, what could go wrong?
Believe me, once hooked up with another partner anything can happen, and mine met a foreigner and she took the kids out the country to settle telling me in a hand posted letter, but courts made her return them 7 weeks later, relationship only lasted 8 months.
12 years later and our kids are grown up now, both of us married our partners and had other kids and all because I had a responsibility in the children's future.
I was lucky, some women marry Muslim men from countries where the Hague convention is not law and not returned.

Hi My new partner has a little one with his ex partner he is 2 and half years old she is not allowing my partner to see his child, only problem we are having is he is not on the birth certificate. What can we do to allow him to see him as this is really upsetting for him and wants to provide for his son but the ex will not allow it. Who can we contact to get this sorted? Regards Sophie

After this was proven she then told me I wasn’t going on the birth certificate and wasn’t allowed contact, because she was in a relationship and her new partner was going to bring him up.... I have asked her several times to let me she him and after 3 years of contact she has changed her number and address and the only contact I have had is via Facebook saying she is getting him adopted. I told her not to do this but she never got back in contact with me. I went to see a solicitor who send her letters and court dates and she never showed so I left it for several months because could not afford this anymore. I have now had contact from the CSA saying I have to pay £213 a month but still not allowed to have no rights to see my son.
I am now 2 years married and have another child and there is no way we can afford that amount per month on top of all our other out goings. we have been saving £150 per month in a bank for my son because believe I should support him and that money will be there for when we do finally meet, but this £150 was the only money we have to give out (we don’t even have our own savings). Is there no way I can 1, get the payments down and 2, get contact with my son
Can the General Registrar keep refusing to re-register my child's birth?
Both me and the father wants this re-registration done. It's the two of us against the Registrar. At the moment I live in Italy and my child used (and still uses) everywhere her correct Asian surname (the wrong details are only on the British Birth Certificate).
Does our child has the right to preserve her true identity, paternity and surname in uk?
In Italy she has this right that's why they registered her with correct details and ignored the mistakes in the English Birth Certificate.
Can someone help us? (An MP tried his best, but the registrar couldn't care less).
