Ex Taking Child to Live in EU Country: What Are My Rights?

Ask a Question
Ex Taking Child to Live in EU Country: What Are My Rights?
People are much more international now. It is not uncommon for people to spend periods of time working abroad or to have relationships with someone from another country. International families are now common, but the international element can cause problems if the relationship ends and there are children. What if one parent wants to take the children to live in another country?

If your ex partner is planning to relocate abroad with your children, you should understand your legal position by using our free Moving Away Rights Checker.

Thankfully most couples who separate are able to agree arrangements for their children between them, without the need for the help of solicitors, mediators or the court. Shared arrangements are becoming increasingly common, where the children spend similar amounts of time with their mother and father. Obviously this requires an element of cooperation between the parents and usually a close geographical proximity for it to work. The further apart the parents live the harder it is to make sure that the children have a full relationship with both parents, which is in their best interests in the vast majority of cases. This is particularly difficult to achieve if one of the parents decides that they would like to move to another country with the children. Given how easy it is to move within the EU, this is happening more and more. If this happens it is important that you know your legal position.

Do you have parental responsibility?

The first thing you must consider is do you have parental responsibility for your child? This allows you to have a say in the important decisions in your child's life, such as consenting to medical treatment, and more importantly, as in this case, a say in whether your child can move abroad permanently with your ex. As the law stands at present, all mothers automatically have parental responsibility for their child as soon as they are born. All father's married to the mother of their child also automatically have parental responsibility. Unmarried fathers whose child was born before 1st December 2003 do not have parental responsibility for their child unless it is formally granted by the court or a formal agreement is entered into with the child's mother in a prescribed form. Thankfully the law was changed in 2003, to take into account the fact that many unmarried couples now have children, and any father named on the birth certificate of a child born on or after 1st December 2003 automatically has parental responsibility for that child. If you are not named on your child's birth certificate as the father, you can obtain parental responsibility with the agreement of your child's mother or through the court.

If you have parental responsibility and your ex wants to take the child to live abroad, your ex needs your permission. If you are agreeable to this, it is always recommended that you obtain a court order confirming your agreement and also detailing your contact with the child once the child moves abroad. Once the English court order has been made, a "mirror" order should be obtained from a court in the EU country that the child is moving to, as once the child moves abroad, any issues regarding the child would be dealt with by a court in the country where the child lives and not by an English court. You will need a lawyer in the country that your child is moving to, to deal with this. Although this can be expensive and time consuming, if your ex later reneges on the agreement you will find it much easier to deal with this issue in the foreign court as there will be a formal record of the arrangements that were agreed.

What if you do not agree?

If you do not agree to your child moving abroad, your ex will need to apply to court and ask the court to make an order agreeing to her request. Every case of this nature is fact specific, so it is important that you obtain specialist legal advice so that you present your case in the best possible light to the judge. If the judge does agree to the child moving abroad, they will usually insist that the court order include details of the time that the child will spend with you. You will then be advised to obtain a "mirror" order in the country that the child is moving to.

If your ex takes the child abroad permanently without your consent, this is technically parental child abduction and there are international legal agreements between Britain and the other EU countries, which would hopefully facilitate the return of the child to this country. If this happens you must contact a specialist lawyer immediately as it is important that an application is made to court as soon as possible for the child's return. Once the child has been returned, the English court will have to decide if it is appropriate for the child to move abroad permanently with your ex.

If you are separated from your child's mother, there will inevitably be many issues that arise regarding your child. Hopefully you will be able to deal with these between you, but if not it is important that you obtain the advice of a specialist family lawyer, which will then enable you to consider the best way forward for you and your child.

I am living in NL and my ex partner became pregnant accidentally just before we broke up. She lives in the UK.

I don’t particularly want to spend time with her as I find her annoying but she says she won’t let me see the baby without her around.
She’s giving me a choice now: either withdraw all involvement or committ to spending a week per month with her and commit to not showing any other partner the baby . I am not sure she’s trying to manipulate me to not have another partner . Or if what she’s asking is reasonable? What do you think ?

I have a daughter with my ex from another country. My daughter is a uk citizen. As she wants to go back to her native country I’ve applied for residency of my daughter. I understand there will now be a Section 7 report conducted. My ex will need to supply evidence that she can provide for my daughter but I know this will be fictional. What can I do? Can I ask Cafcass to look into the legitimacy of her evidence

Hi, I’m English and having a Spanish baby girl. I’m currently discussing with my boyfriend if we should have the baby in the UK before moving to Spain. We are very happy and not planning on splitting up but it’s been brought to my attention that if the baby is born in Spain, I won’t be able to leave without his permission should anything happen to the relationship and I wanted to return to the UK. I just want some advice if anyone has experienced this and if you can offer me any advice to where I should have my baby. I don’t think anything will happen but you never know and I don’t want to be trapped should it fail.

Thank you
K

Hi did anyone move with the child to a different country without the child's father? How do your visitation schedules look like then? How old was the child at that time and did the visitation schedules change when they got older?

Thanks for the help!

Hi, my son have British passport and his father wants me out of his house , since I would never leave our son and can't find new home straight away, can I return back to my country without his consent? He is abusive and couldn't be less careless regarding our son
Mrcjs 10/11/2020 at 1:29 pm
Does this change if 3 people have PR.
So the 2 people that want to move away do not agree with the 3rd person, do they still have to go to court.

My son is still married to his wife and they have a 2 year older son. His wife doesn’t like me and she has refused to let him bring their son to visit me. We all live in the UK. To keep the peace at home, my son have gave in and visited me on two separate occasions without my grandchild. This is very upsetting for me and my son.
Does my daughter-in-law has the legal right to stop her husband from bringing their son to visit me?
Fluff 03/09/2020 at 10:58 pm
If both parents reside in UK (divorced) but the child lives abroad with another family member, does child support still have to be paid? Also if one of the parents are against the move can the other parent still agree for the child to live abroad?

My son has not seen his child in over 2yrs. He has tried to ask his ex girlfriend to bring his son over from when shes coming to England in August. She came near Christmas 2019 & never brought him with her. My sons name is on the birth certificate and his current child passport. He has put a block previously on his passport so if he returns to England he cant travel back to Spain without my sons say so. She is now blackmailing him by saying if you sign a form for him to live in Spain then she.ll bring him over to see his dad. We have given her a roof over her head with the baby when her own mother put her on the streets in the past. My son flew over last year to see him. Then when he got there she blocked him on his phone. My son woke up to spanish police knocking on his hotel door saying he had to appear at 10.00 that morning in theSpanish courts has he had so called been harassing her. So my son went to court & it was her who ended getting in trouble for wasting police time. So is there anything he could do to get his child back to this country UK as we have addressed every Avenue and we are struggling to make any progress. His son will be 5 next April 2021. What would happen over his passport would he have to sign or could she do his new passport with my son being on the passport or not. Thankyou. Regards

Lived in an EU country with my partner and she returned to Australia to give birth to our child. I went for the birth and they visited me a couple months later and I went there again recently. Bub is now 10 months old and since my Australian visa hasn’t been granted yet I want them back here. But she doesn’t want to settle there permanently and I will be working away forse month at a time. Is it parental child abduction if she leaves with our child when I’m not in the country? Would they force a 10 month old back?

I have recently left an abusive relationship with my partner who is currently pregnant and due in September. She had abused me physically and mentally the last year. After what I have been through I want full custody of my child and move back to Scotland where my family are. Now I am in England. A court date has been set to press charges against her for her abuse and I have been allocated a solicitor and funding. She has 2 young children at present which are with another man. However, I would like to know my rights and if I could get full custody due to her abuse and move to Scotland with my child.

My son and grandson arrived yesterday for a 2 week holiday and whilst they were travelling my son's ex partner (and mother to our grandson) announced on social media that she is moving back to the UK with our grandson permanently. Needless to say our son wasn't aware of this. We all live in Spain but my son and his ex work on Gibraltar and our grandson was born there. All three have British passports. Can she do this? My son does not want to lose his son, who, by the way, spends 50% of his time with each parent. Does my son have automatic PR even though baby was born on Gibraltar? He is on the Birth Certificate. We just don't know what to do legally and as they are only with us for 12 days time is of the essence.

Concerned, my brother lives with me and his children are staying with him at the moment but their mother wants to get them tomorrow however she is not living at home at the moment and is not saying where she is staying nor where she will be taking them when she comes to get them. Their dad (my brother) is concerned about her taking her somewhere he doesn’t know that could not be ideal for the children. Surely he has rights to know where she is taking them or rights to say no if he is concerned for their safety?

Hello all,
Me and my partner both live in Spain but of English nationality, he and his ex wife (not yet divorced just seperated) have a child together, who was born in Spain, she is English also.
Since their seperation she has threatened to move back to the UK various times with their child, regardless of what he says, only to back out last minute which is completely messing with his head. Now she is aware that me and him are together, she is saying if this continues she will move back to England, as she completely disagrees of me. He is stuck between a rock and hard place, obviously not wanting his son to move back to England without him, but on the other hand finds a way to try and keep him here with a miserable and resentful mother who will ultimatley take it out on both him and their son.
Has anyone been in a similar situation and found an 'easy' way out, or know of what my partner is entitled to legally? He wants to cause as little distress as possible to his son (age5).
Thankyou in advance

I'm a landlady at a pub which my tenancy is coming to an end, I've been offered a bar manager's job in Spain. I have a partner and 3 children (8,2 & 5 months). My 8 year old daughter is to my ex partner which is not agreeing with me to take our daughter to move. I've offered him countless different offers to still have contact between child and father but he just says no to everything. The job opportunity isn't going to be open for much longer so I'm running out of time. I've been to mediation but still says no. I can't afford court and was just wondering what would happen if i just went anyway with our daughter? I have an apartment sorted and a school where as here we have no house to move into once tenancy comes to the end. I believe it's an amazing opportunity and would be beneficial for all my children. I wouldn't just stop access for her father as I believe no matter what my daughter should be in contact with her father

I want to go and work at a family member's business in Spain. This family member is willing to pay for my daughter to attend a highly acclaimed international school where she would learn languages and all sorts of skills I could not afford to facilitate myself which open many doors for her.

She has a good relationship with her father but he has no fixed address and hasn't since late last year so she does not have overnight stays. He often works away for 2 or 3 weeks at a time so if I compromised by allowing him to visit and stay every other week or third week (and forfeit any child maintenance he owes me), would this be fair and likely to be allowed?

Hi,

I've separated from my husband due to domestic abuse and we have a trial coming up next month. However, due to fear of life and health issues I'm willing to move to a EU country next to my parents. Social Services discharged us stating that my children are in a safer environment (with me). Hence, i was wondering if i would still need my ex's permission when relocating with my kids? Also, he's on my sponsored visa that is due to expire next year. Would he be able to get this extended considering parental issues?

Hi, I've been divorced about a year now and have two young daughters all living in Spain. My daughters r Spanish. I recently went to issue their passport with my ex, so they could visit my family for vacation and also her family. She has taken them to see her family first while saying she will join me. She told me about this when she was in her way to the airport. So I was not to happy with that. Now she dose not want me to take them to my family and instead wants to take them somewhere again. Also she is taking about moving to another country, Switzerland. So I have joint custody and she can't do that, but is there any way for me to cancel or block my kids passport because she leaves without my knowledge and permission? Do I go to a police station where they issued the passports and they can put something on a flight system so if she tries to take them then they would stop them at the airport? Thanks

Hi,

My now ex-partner took our daughter from the UK and to Germany 3 years ago.I had, and still have, PR. At the time my partner made out that she wanted to continue the relationship and we would work things out over the next year or so. I was not able to move at this time but I believed we would all be together again in the near future. My ex did not initiate any conversations about the future and eventually I painfully conceded that she had no intention of doing so and probably never did. This promise of future discussion seems to have obscured what was in effect child abduction. They are now settled in Germany and my daughter has an established life which I do not wish to disrupt for her own sake.

I am wondering what my rights are now regards access and how the burden of travel costs to see my daughter is taken into account. They do not visit the UK.

Hi all, great website with great info. I live in the EU and the ex lives in another country in the EU with my 4 yold. She wants to move within that EU country to a place that will be much further and more difficult to get to from my EU country for purely economic reasons - lower cost of living. We have a legal agreement in place for custody and visitation and finance. Do I have a say in her decision to move my child further away from me and my family? Thanks for any info.

I am divorced from my wife and have an 11 yr old son with a joint custody order in place. My son lives with my ex during the week and comes to me at the weekends and 50% of his holidays.
My ex now wants to take my son to live in the Czech Republic as she has family there but I do not agree.
I already have a joint custody order, a prohibited steps order and a financial order.
My wife has a uk passport
What are my rights towards my son and if she moves do I still have to honour the financial order ?

Hi I was hoping you could advise me. my wife left me without permission to take my child to a European country I never agreed but I didn't think I would stand the chance in court. now I use to go there every month to see the children and now she's stopped me for no reason whatsoever. she said that if I come within 5 metres she's going to call the police. she has no reason to do this and I don't know where to start or what to do because I've heard so many horror stories of people spending lots of money and not getting anywhere can you advise me what the best thing to do is I've been nice and tried to reason with her but she has a Vendetta against me
SeparatedDads Editor 04/09/2018 at 11:18 am
You ex must get the permission of everyone with parental responsibility for a child or from a court before taking the child abroad, If you refuse, your children's other parent would have to apply to court. As in all cases, the court’s main concern is the welfare of the children in question. The court will always put the children’s best interests first and this main issue will determine the outcome of any application for an order.

I am a British mother (resident in England) and have an 11 year old son with a Polish father (resident in Poland). Dad recently gained parental responsibility through mutual agreement. After discussion with dad and a need for my son to have a male role model, dad and I have considered our son living in Poland for a 6 month period then in England for a 6 month period. Dad and I are friendly and there is no battle for residency, only concern for our son's best interest, mainly his need for a father figure. Is such an arrangement possible?

Hello, I have a question. I have a son in Luthuania. We never have been married with sons mothers. She was drug addicted, and eventually she was temporary restricted for her parental autority. Then shas has been jailed. Now I have my parental responsibilities. I brought my son to th UK, as Im living here. Mother now out from prison., and she applied for limitation of patental restriction. What shall I do? Thank you

If your ex wishes to move from the country with your children, then she has to request your permission, If you refuse, then she would have to apply to court. Unfortunately, your friend's only reocurse would be to seek legal advice in his home country as in order to apply for access, then matter would have to be heard in the international family court.

I would like to help a Turkish national still residing in Turkey to reunite with his children. He was married to an English woman for 10 years and they were married at the time of the children's birth although the wife came back to have the second child here. Since then she is refusing visitation full stop. What are the first steps to resolve this?

Hi, I have 2 daughter's 6 and 4 and my ex wants to move back to her country of origin , within EU, but I don't agree with that, what are my rights ? I also have PR I see them regularly, I pay CM , she moved like 50 miles away, she keep asking me to move closer, but I have work commitments, I can't move , she's basically blackmail me all the time. The girls don't want to move.
I just want to know about my rights , can I get some advice please!
SeparatedDads Editor 03/08/2018 at 11:54 am
By law you have to pay child maintenance in order to help support your child. Likewise, no court is going to force your ex to bring your child home to the UK now she is settled in another country. I presume if your ex is on benefits, then she both needs financial support towards your child and she cannot afford to help pay for you to come to Finland. Unfortunately, it means you are both in a limbo situation with no perceivable fault on either side. Child access and child maintenance have no bearing upon each other, meaning you still have to pay child maintenance regardless of whether you see your child or not and the mother of your child has every right to claim it. The only option you may have is to apply for a special expenses variation (you can see the UK version here .)

I am from Ireland, and I currently have a 4 and half year old with a girl from my area. We broke up 6 months after my son was born and ever since it has been a struggle with my ex over my son. Currently I get my son every 2nd weekend from 6 on Friday until 5 on Sunday. In between then I only see my son for 1hour 30 minutes for the remaining 2 weeks. I live 10 minutes from my son and I work closely to where he goes to crèche and lives currently. My ex does not allow me to bring him to crèche or does not let me get involved in anything else to do with my son and it gets me down. we have been to court for me to get the times mentioned above. Its 2 years on since we went to court and I want more access. I work 9-5 Monday to Friday and I want to be best dad I can be and not go back to court but in terms of communication and working on a parenting plan we are planets apart. I don't want to go back to court but I have suggested mediation and she will not attend. I Don't want to go back to court but I see no other option and I want more time and involvement I my sons life. I have tried talk to my ex face to face but the conversations are not productive and we just end up arguing rather then discussing the matter at hand. What do you think I should do or should I just leave things be. I want more time with my son but if I leave it go I wont get any more time

Hi,

My daughter moved to Finland almost 3 years ago, I was stupid and thought i was doing the right thing for her and letting her mother live her life and gave permission. However after realising all the promises were a lie of bringing her back regularly and the expenses of going over there and seeing how far behind she is compared to children her own age and on top the parenting of my ex. I want her to come home. She has also tried to seek child maintenance when I made it clear in order to maintain a proper relationship with my daughter i needed to come to Finland to see her, but its so expensive. She doesn't have a job over there and seems to have gone from one benefit system to another.
I am at a loss and I have a child at home who has been very sick and I am the sole provider in my household. My ex wife doesn't seem to care about the relationship with my daughter and just wants money for nothing regardless of anyone elses needs, but can afford to go on holiday whenever she wants. My holidays are not family ones, as at £600 a pop each time i go over, I am left paying the visit off each time. I have also assisted her family when they have come down the 2 times in 3 years, with finance so she can come over. Now Kela are chasing me again and potentially are going to cripple me and stop me from being able to see my daughter. Its a random one, but if anyone can help.
SeparatedDads Editor 31/07/2018 at 10:33 am
If you cannot agree between you, you would have to either resolve this through mediation and if mediation is not successful, then you can apply to court. As in all cases, the court’s main concern is the welfare of the children in question. The court will always put the children’s best interests first and this main issue will determine the outcome of any application for an order.

Hello. I am currently in a relationship with an American girl, we have a son together and plan to marry. I also have a son and a daughter with my ex wife. I have parental responsibility of them both, We have them at least 3 nights a week and in the school holidays they are with us more often than not. My question is, I have been offered a job in America, my partners family are there and it is my belief that we will enjoy a much better standard of life there. Ideally I want to take all three of my children but I understand that that is just unrealistic as their mother would never consent to it. I have asked her (my ex) if she would allow me to have them over there for extended periods at a time, to which she has also refused. In a nutshell she has essentially said that if I move and want to see my children I have to come back and spend time with them in England before leaving again, which in my view is totally unfair and actually detrimental to my relationship with my children which has always been good. I’d just like to know if she can impose those restrictions on me or if I do I fact have a realistic want. Thank you

Hi my wife and I been together for 10 years we have 4 children 8 years and under
My wife is polish and we are not getting along and we are separated. My question is she is going back to Poland on holiday with my kids what’ happens if she decide To not come back to uk ?
Will it be easy to bring them back as I have not agreed on this ?
Am I better off not allowing travel ?
SeparatedDads Editor 17/07/2018 at 2:00 pm
The other parent can't atttempt to stop this and your partner would need to request the other parent's permission to move if her ex has parental responsibility. In addition, if he wishes to apply to court, he can apply for a Prohibited Steps Order. A PSO is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. However, it doesn't mean the court will grant the order. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.

Hi my partner and I are moving to Northern Ireland next month. She has a child from another relationship and is currently pregnant with my child which is due next month. We are moving to Northern Ireland as I have family there and support as she doesn’t here. I have a job lined up over there which I start as soon as I get over and we have accomadation.
Can the dad (ex partner) stop this? At the end of the day he can still see the child when he wants he will just have to travel from England. We are putting the needs of the unborn baby and the child first as we have support over there and are doing it so we can can have a stable life.

My and my partner and daughter are both british but moved to spain 2 months ago. Things don't seem to be working out to well with our relationship and I am worried he will choose to return to the uk. Will he be able to enforce my daughters return to the uk? If I choose to stay
SeparatedDads Editor 26/06/2018 at 3:33 pm
Unfortunately, I have no knowledge of the Polish child maintenance system, but if you are not working, then you should be able to apply for a variation. However, you would have to deal with this through the Polish child maintenance agency directly and giving proof that you are no longer earning.

I live in the UK and my daughter lives in Poland with her mother. My daughter was born in England, but taken to Poland with my consent. The reason for my consent was I was told that the courts always favour the mother and there would be no point in fighting the case as this would just be costly and futile. However, I know have a new family here in the UK (Me and me Polish ex wife divorced 5 years ago) with 2 step children and baby boy. The Polish courts are imposing huge amounts of money for me to pay to my ex and child which I do not refuse but cannot afford. I have been a carer for my partner who suffers with psychosis and depression, and we currently receive Employment Support Allowance & Child Tax Credits. I need the courts to understand that they need to at least for the present reduce the amount I pay until I can go back to work to be able to pay the £250 a month they are requesting. I get at present £270 a week but this is just enough to cover food & bills for us here and the amount keeps rising and nobody can help me. I have always stated that I do not refuse to pay just that I really cannot afford it, and the English courts did not enforce this. Yet my bill is getting higher and we are struggling to pay even £70 a month. I don't know what to do, and just need them to give me a freeze or a reduction on the amount I pay until my situation gets better. What can I do?
SeparatedDads Editor 21/06/2018 at 3:19 pm
Unfortunately, your only recourse is to apply to court. As laws differ in every country and contain cross-border elements, then this will cost.

hi, my Daughter was born in spain and I'm registered on the birth certificate. we applied for a UK passport so our daughter is s UK citizen.
my daughter is now 3, unfortunately things have become difficult between her mother and me. we have only verbal agreements for me to see our daughter and she refuses to support this situation. I pay monthly support and always pay for flights for both of them. now her mother is refusing to bring our daughter to England.

what can I do to ensure access to my Daughter.

any support or help would be greatly welcomed.

thanks.
SeparatedDads Editor 19/06/2018 at 1:00 pm
Your partner would have to ask your permission (if you have PR) to leave the country with your ex, If you refuse, then your partner would have the opportunity to apply to court. The court would not rule out allowing your partner to return to her home country with your child, if she could justify a good reason for it i.e family support etc. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.
SeparatedDads Editor 19/06/2018 at 11:22 am
Your husband would need to seek permission to leave the country with your child either from you or the courts, If you refuse, and you are the usual day-to-day carer of your child, then your husband would have to apply to court. It is highly unlikely the court would allow your husband to uproot your child and take her to a different country; consistency and stability are considered the most important factors when making such a decision. As in all cases, the court’s main concern is the welfare of the child in question.

This is helpful but my situation is slightly different.

I am soon to be divorced with a young child. I am Engish and he is American. As a family, and before we were married and had our child, we have always lived in the UK. He may be moving to the US for work and wants to possibly take our daughter. I do not want this as it is not her home, her school is here, my side of the family and she has on-going medical concerns (not serious but enough that she has been an outpatient most of her life).

Is there a resource I can look at for what my rights are in this situation? Thanks in advance.
SeparatedDads Editor 14/06/2018 at 10:58 am
Unfortunately, the father has no rights to stop the mother moving home before the child is born. Once the child is born much depends upon whether the mother decides to register your friend as the father on the birth certificate. If she doesn't register him, then he has no rights until he takes the matter to court. Even if he takes the matter to court and is awarded Parental Responsibility, the mother can still apply to move home. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.

I am very sorry to hear this. It must be a very difficult time for you. Unfortunately, there is little you can do to have your children returned to the UK. If your ex has settled in Germany with your children, then no court would remove the children from the primary carer. Your only recourse would be to take the matter to court for regular access. However, as this would be through an international court it would be expensive. The EU freedom of movement has made this an increasingly frequent occurence when one parent decides to move back home with the children either through consent, court or via situations similar to your own. Only the courts can resolve such a situation and you would need to seek further legal advice to apply for access if your ex is not allowing it.

Hi there, after a severe stroke my ex German partner alleged stress and told me she needed time with her family, she flew to Germany and took our children with her, once there she advised she would not return and that my only option to be with them was to move to Germany to what I declined. I contacted a law firm who encouraged me to do a lot of things to then three different judges told me they have no jurisdiction over in Germany and my lawyer told me that the bird has flown out of the cage, I am desperate, I contacted CAFCASS, ICACU and they have all ignored me, they are growing up in Germany, language I don't speak. She is refusing any contact, I started making videos for them to hear voice and know who I am until I learned she was filtering them, my daughter doesn't know who I am at all, my 3 year old boy does remember me, we had a very close relationship. Can you help?

Hi I have permission for 3/of my children to move to Spain from UK with me, and the father's have said they will write me a letter stating so, is this OK as evidence do I still need to apply to a court? Also my eldest daughter was born 07 sep 2003 I don't have any contact with her father at all , do I need permission off him? As her date of birth is before the cut off date and we was not married and never have been.
If I need permission how would I get that if I don't have contact.

Many thanks

Dear Ms Fiona Wood,

Thank you for your article.

My ex-partner moved to Northern Ireland with my two boys. Court let her move, and Judge said hectically she has right to move within UK.
I want to apply to Child Arrangement Order.
1) Should I apply to Family Court in London, which let her move to Northern Ireland or should I apply at Northern Ireland?
2) I know that in Northern Ireland is different regulations, any information regarding that will be appreciated.

Many thanks in advance.

I currently live in Australia (Not Permenant - On Temporary Partner Visa) however me and my husband have ended our relationship. We have a 4 year old daughter who is dual citizen for both countries Australia and England (Born in England - where she was raised by me for 2yrs, husband was in Australia). I want to go back home and most likely will have to anyway due to the break up of our relationship. However my husband is refusing to let me go back home with our daughter or he says I can go back but she’s not leaving the country. I don’t know what to do, I think he is doing it to spite me because he takes no responsibility of his daughter. (He does work which provides financially) but other then that he doesn’t take care of her or help out. I’m left doing it 24/7. When I tell him I want to go home all I get are threats. I know he will lie and manipulate to get what he wants.i already feel defeated by him. All I want is to go back home, I have nothing and no one in Australia.

Hi, I’m the mother. My husband and I had our son in the USA, then when he was 2 we moved to Ireland (husbands home country) for 6 months, then my husband broke up with me. As I have no friends or family or job in Ireland I have just moved home to the UK (where I’m from) and brought my son. My husband was ignoring contact prior to us leaving and we had been living in a hotel for 2 weeks. What do I need to do to make sure everything is ok to keep my son here? How much access is reasonable to offer to dad? How much maintainence should I be asking for?
SeparatedDads Editor 01/03/2018 at 3:38 pm
If you are living in the US, we cannot advise you as US family-law is different to UK family law (this is a UK site). However, you would have to get authorisation via the court to take your child abroad if you husband will not authorise this. Otherwise you could be charged with abduction through the Hague Convention which seeks to protect children from abduction across international boundaries (even if it is a parent/child relationship). The court will decide upon what it thinks is in your child's best interests. Therefore, you may wish to seek legal advice in order to explore your options.

Me and my partner are Czech. I have been living in England for 8 years supporting my partner and child in Czech Republic until they both moved to live with me in this country 2 years ago. Now she wants to separate and move to live in Hungary and take our child with her. Of course i want our child to stay with me and she has been very happily at school in England for the last two years. She also wants to stay with me. Often my partner has behaved very unreasonably throughout our relationship and i have always worked very hard supporting my partner and child. My daughter is 7 years old and was born in Czech Republc. Can she just take my child to another country or can she stay in England and live with me?
Thank You

@Sad dad - This can happen a lot in intercontinental relationships. The situation may change at some point in the future and may not turn out as bad as you think. If you continue to tell your son you love him and will always be there for him and keep reinforcing your love, things may turn around, if not now, when your child reaches an age where he can make decisions for himself. It happened to a friend of mine - he had to wait until his child was 18 and then his son made the decision to come and live with him. They are now getting to know each other properly which is great and the mum can't interfere as her power is lost. Continue to be a good dad and the rewards may come your way later on. I hate that some women just go all out to keep their kids away from the dads. But it can pay off. It might be a case of just biding your time.
Sad dad 16/02/2018 at 6:55 pm
Thank you for your response. The unfortunate situation is I will be told nothing until the last minute and I fear at that stage I may be too late to have any say on the situation. I love my son dearly but feel I am gradually being pushed out of his life, us Dad's definitely have it tough at times.
SeparatedDads Editor 16/02/2018 at 11:09 am
I am sorry to hear this. However, all movement/relocation of your son would have to either be agreed by you or challenged by you. The only legal challenge you could make is via the courts, which would be costly given the international perspective. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. I can only suggest you seek legal advice when your ex makes her decision. Unfortunately, your questions are hypothetical at the moment and until your ex decides what her movements are, until then there is little you can do.

Hi my son is now 12 yrs old and lives in Germany with his mother. I met his mother when I was in the army and based in Germany. Our son was born in Germany and therefore has a German birth certificate, an Army birth certificate and a UK birth certificate. I am named as the father on both the UK and army birth certificates. I am a UK citizen and so is my ex-partner. My partner and I split when my son was 18 months old. When I finished the army a number of years later I had no option but to return to the UK. My ex-partner who worked for the army as a teacher remained out in Germany with our son. I try approximately 4-5 times a year to visit my son either out in Germany or bring him back to the UK. My ex-partner is now remarried and over the last number of years I have noticed a steady turn in my son's attitude towards me. There has never been a good relationship between myself and my ex and she has never encouraged a relationship between myself and my son but as I have continued to pay her £250 per month by my own agreement and also pay for all travel costs in relation to seeing my son, she has not as yet prevented me from seeing him. However, I am now becoming increasingly worried about my son's new attitude towards me and as the army are pulling out of Germany next year I am wondering what rights I will have in relation to where my ex chooses to live when the army leaves. My ex would now have an opportunity to either retire with a healthy financial package and therefore could chose to live anywhere or she may choose to stay on working within the SCE Schools and look to move to the likes of Cyprus if the opportunity arises. Cyprus is extremely difficult and expensive for me to get to as I live in Northern Ireland and also my fear is that if she chooses to take her retirement the world is basically her oyster. I would be grateful for any advise you can give regards my situations d what rights I may have. I wonder because everything is linked to the army is she still governed by British law and therefore I should be consulted in relation to where she may chose to live as I have legal responsibility for my son.

The best way to come to an arrangement is through mutual negotiation and agreement. Any other option, such as court will cost, especially internationally. Mediation is also an option to consider, if there is a Dutch equivalent.

Hi there,
I had my daughter who will be 4 next month with my partner in the uk. My partner is Dutch but had lived in the uk for 14 years. We had been together for 6 in the uk.
18 months after our daughter was born, my partner decided that we should go to Holland for the support of her parents. I lived there for 8 months but it didn’t work for me. We have tried to maintain a relation ship for the last 18 months but I fear it may not end well.
What are my rights to see my daughter I have tried to maintain every 4 weeks so I drive over.
Going forward is it my right to bring her back to the uk for visits? 1-2 weeks at a time when suits with her school holidays?
It’s nice to see her when I go over but I really want to be able to bring her back to the uk to visit my family
What are my options?
Regards
Chris
SeparatedDads Editor 09/01/2018 at 12:42 pm
If you have Parental Responsibility of your child, then your partner and you need to discuss the matter mutually. As specified in the article, your ex has to request your permission, If you refuse, then she will have the option to take the matter to court and the court will decide what it thinks is in the best interests of your child. If your partner is the day-to-day carer of your child, then the court will generally allow the child to continue to live with the primary carer and it will not attempt to stop people from getting on with their lives. Therefore, if your partner can justify why she thinks it is in the best interests of your child to move with her, then the court will allow this. If you are the primary carer of your child, there is a good reason to argue why your child should stay with you. However, court is always seen as a last resort as it can be emotionally fraught for all involved. If you can come to a mutual decision with your ex regarding what you both think is in the best interests of your daughter, then as difficult as it is this will serve you better long term as a family, then arguing it out in court will. Especially if you can make mutual arrangements for each parent to be an integral part of all the children's lives still.

Hi, my partner and I have recently had a baby boy. She is Australian and I am British, she is here on a two year work visa.
Before she fell pregnant we was splitting up, once we found out she was pregnant we decided to give it a go at making things work.
Things got better but now we are coming back to the position we was in when we almost broke up.
We have a holiday in 8 weeks time back to Australia.
My question is, if she decided to stay there and she did not want to come back to the UK, can she deny him coming back home? And if she did, would/could the British government get involved as he is British not Australian? Would I lose my son?

If your partner is living in the UK and wishes to take your child home, as specified in the article she would have to ask your consent (if you have parental responsibility of your child). If you refuse, and/or refuse to discuss the matter via mediation, then she would have the option to apply to court. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. As a rule, if your partner is the day-to-day primary carer of your child, it is more than likely a court would allow this if your partner can justify the reasons why she wishes to relocate home i.e help from family etc. You would have to attempt to justify the reason why you do not think it is in the best interests of your child to be taken out of the UK. You may wish to seek legal advice regarding this matter.
SeparatedDads Editor 14/12/2017 at 11:37 am
As we are a UK-based site, we know only about UK family law. You would have to seek advice in your home country. In the UK, if the other person has parental responsibility of the child (husband or unmarried partner registered on the birth certificate), then the mother of the child has to ask for consent to leave the country with their child, otherwise it will be considered abduction. If the other parent with PR refuses consent, then an application to the court would have to be made. I suggest you seek legal advice in order to explore your options.

Hello.
My partner and i (unmarried) are both Irish but living in the UK, our baby boy was born this year in the UK but holds an Irish passport.
His mother and i are unfortunately splitting up.
I own and run a business in the UK and am not in a position to visit Ireland more than one weekend a month.
She is talking about moving home and bringing our son with her.
If somebody could please offer me some advice as to my rights on this matter it would be greatly appreciated.

Thanks

My ex, my daughter and myself all live in the Caribbean. My daughter was granted a british citizenship by decent. I suspect my ex plans to move back to the UK with my 3 year old daughter, is there anything i can do to prevent this ?

Hi I am an Indian National, currently residing in the UK illegally. My partner and 18 month old daughter are Italian. Recently I got direct contact after a long court proceedings. Now I suspect my wife will move to Italy with my daughter without my consent. If she does what I could do?
SeparatedDads Editor 08/12/2017 at 12:45 pm
Unfortunately, there is little you can do in such circumstances if your children are now considered to be settled abroad. It is most unlikely a court would rule to uproot them and force them to move back to the UK. Whilst it is a criminal offence to remove a child from the UK without the permission of the other parent or order of the court, permission was given by you and it would be very difficult for this to be retracted now your children are living abroad. The best option you have is to attempt to negotiate with your ex directly about the payment of child maintenance and access arrangements. If you cannot negotiate directly, then an international court case will cost.

Hi
My ex partner to be is Slovak. We have 2 kids together, problem I have is she moved there in 2014 to be closer to her parents as she had no support on this side in the UK. So I moved them over there. I tried working there but money was not great, so I came back to the UK on the basis that once I got a great job I'll get them to move back here.... She has now filed for divorce this year 2017, and my question is to you do I have to pay child maintenance?? Secondly doesn't she need my permission to keep kids in a different country as it was only temporary? As they a British and recently just found out that she applied for Slovak birth certificate..... I want to see my kids but it will cost me more in flying over aswell as paying somewhere to stay. I need help???

As we are a UK-based site, we have no knowledge of German family law. But there will be an option to take this matter to court. I can only suggest you take legal advice.
Chandy 05/12/2017 at 10:58 am
Hello, I don't know if it is the apt section to ask and get some basic details. But let me.
We are an Indian family living in Germany since 5 years.Since years my wife had an opinion to settle in Germany and never wanted to go back India. Some months ago she filed a case to get complete children's custodial rights and court decided to give equal rights. Now she is separated(not divorced) from my family and kids are with me.Kids are with me after court investigations that she is not capable to take care of our kids as she is sick as well. She has no job and not willing to do any job and she wants money from my side that's all.
When asked she will never ever give permissions to go back to India with kids for the permanent settlements.I have no intentions to separate kids from their mother but she is not allowing to execute my & kids interests to settle in India.I believe EU has mostly same laws followed across. recently I came to read about unmarried couples father exclusive rights to get child custody rights. But nothing found for married couples.
My question is, Are there any laws or methods to approach court to get rights to relocate India along with kids? Thanks for any advice's, to move on...

I am sorry to hear this. If your child been taken or kept overseas by their other parent or a relative without your permission, or if you are worried this might happen, this leaflet will tell you what you can do and who to contact, A court can order a person to return your child to the country of residence, however, much will depends upon the Spanish courts in this instance (if the trial is due to be held in Spain). We can't advise what form this may take.
SeparatedDads Editor 04/12/2017 at 11:02 am
If your child's father is English and has parental responsibility, then you would need his permission to leave the country, As specified in the article, if your partner refuses, then you would have to apply to court. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. If you are the day-to-day carer of your child and if you can prove your child would have a better life in your home country, then the court would not try to stop you getting on with your life elsewhere. The court will want to hear that you are open to your partner having access on a regular basis, so he can continue to develop an ongiong relationship with his child.

OK, Complicated......

Me & my partner have a 4 year old Girl, she was born in the UK. We moved abroad to Spain when she was 1. we are not married. I bought us a house, and I work from Home and provide the income. My partner does not work. I supply all needs, such as food, water, electricity and bills ect.

However me and my partner had an argument one night, at which point she stormed out and went to the spanish Police, the case was dealt with the next day in court, where all charges where dropped. Our solicitor then agreed to start a mutal custody order 50/50 which we both agreed to, she said it could take upto 1 week. In the time, I moved back into our family home, and my partner moved in with my daughter & a friend. 2 days Later she returned to the UK, and messaged me once arrived. " sorry i am back in the UK " taking my little girl. My solicitor tells me she can not do this, as we are in the process of a shared custody trial....... What may happen ? I am so sad, and it kills me every day i do not see my little girl.

HI, I have 15months old daughter wanna go back to Poland with her. Her dad is English and looks like he won’t agree to take her with me. I can’t leave here anymore, have no support if move out and get a flat on my own it will be really hard for me to take my baby to the nursery (cause of the hours I work ) I have all my family in Poland. They want me to come back . My mom has a really big flat I would have my own room even my baby would have own bedroom . They would help with looking after her when I’m at work and in general i would get more support back in there than here. Plus my ex partner is aggressive and being racist towards me in front of our child (I don’t think he realises she’s half polish) he’s even trying to stop me from seeing my family I’m not aloud to go to Poland with Maja on holiday or Christmas this year he took my passport of me last year took our daughters passport...just to stop me from booking flights.

Hi, my ex partner it is not English, we had a child born in hers EU birth country, we never married and she never put me on the foreign birth certificate. She decided to leave UK and go back with the child. Both of them have not citizenship. What can I do to stop her?
SeparatedDads Editor 07/11/2017 at 2:37 pm
If the other parent has parental responsibility of your child, you would have to request written permission to relocate. However, if your son's other parent refuses this, then you would have to suggest mediation as a way of trying to resolve the issue outside court. If this is not successful, you would have to apply to court. If the other parent has had very little to do with your child, then there is more of a chance you will be granted permission if you can justify your reasons why you wish to relocate. Also, if you show willing to keep the options for contact open with his other parent, then this will also help. Your application must be deemed to be for a genuine reason and not because you wish to alienate the other parent from your child's life.
SeparatedDads Editor 07/11/2017 at 1:01 pm
If your husband will not agree, you would have to apply to court for permission to return home. However, if you can give a good reason why you need to return to your home country, family, job, money, stability etc, then the court will not attempt to try to keep you in the UK. If you are the day-to-day primary carer of your child, then it is more likely the court will allow this.

Hi, my ex has had very little to do with our son for almost 4 years, and nothing at all for almost a year, he was born in july 2003 so is now 14. Me and my partner are wanting to to immigrate to australia when he has finished his GCSES. What do we need to do? Do we need to go mediation and court? Or would we be able to just get a letter from his mum? We will be applying for permanent visas. Thank you

You don't say how you are paying. If you are paying directly via a family-based arrangement, then you can negotiate between you. If you are paying via an agency, then you may be able to request a variation, please see CAB which

Hi,
I am a UK resident who lives in the UK and work full time. I am devorsed to my ex wife and we have 2 children together. She moved to ibiza Spain 5 years ago with my permission with our children to live full time. They now have Spanish passports and have no intention of moving back to the uk.

My question is, I have been paying money to my ex wife for both the children each month to help with there upbringing. Due to the cost of flying out and seeing them it puts massive amount of financial strain on me with paying for my children as well. Do I legally still have to pay child support each month if they live in Ibiza, or can I stop paying it and spent the money on flying out to see them and spending more time with them?
Thanks

Im currently going through a divorce, my wife has said that she wants to take our 5 and 9 year old back to Russia where she original cam from. I obviously don't want this to happen, we have an agreement of 50/50 responsibility. I have them 2 days she has them 2 days and so on.

Is she able to take them out of the country? and if she does do the laws extend to Russia?

Thanks
SeparatedDads Editor 20/10/2017 at 12:39 pm
Your ex would have to get your consent to take your child out of the country, If he attempts to move her abroad without your consent, he could be charged with abduction. If you feel he may try without your consent, you can apply to court for a Prohibited Steps Order. A PSO, is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. There is no guarantee the courts would rule in your favour. However, if your daughter is in education, then it is highly unlikely a court would rule to disrupt her studies. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. I hope this helps.

Can an ex (child's father) take a 16 year old to live in Spain with him without mothers consent? She is in middle of education in UK. The daughter wants to live with ex for the reason she stated: she's allowed more freedom and can drink and go out til whenever she likes. He took her underhanded behind my back. And since being there only 2 weeks ago has allowed her a tattoo and to start seeing one of his friends who is 29? Aswell as drink and go out all night.

My ex wife has been offered a job in Qatar and wants to take my 13 year old son. I’m happy for him to go, I would just like to know that because she has decided to apply for the job and move over there. Does she have to make (pay) the arrangements for him to get back to see me.
SeparatedDads Editor 10/10/2017 at 12:14 pm
You would not be allowed to take your children from the country without your wife's consent. Therefore, if your wife does not agree, then your only option would be to apply to court. However, it is unlikely any court would allow you to uproot your children from their parent and country without very good reason.

Hi I’m still married have been for 14 years. Me and my wife decided to move to china as she is Chinese. We are both British. Anyways I lived in china for 7 years but as a foreigner in china it was very hard and could sometimes become very depressing. I am an Egyptian citizen with limited indefinite leave to remain in the uk. My ex is British as is my son. I have PR through marrying his mum, we are now divorced and I have remarried a relative in Egypt and had a child. There is a child contacts arrangement in place. My ex wants to relocate to Australia with my son and states that she has a job there. I do not give permission and my citizenship is in part due to my son. What can I do as my ex wants to relocate and i am worried about the expense of solicitors to prevent this. She is the resident parent, what can I do, whats rights do I have?
SeparatedDads Editor 05/10/2017 at 11:01 am
I am sorry to hear this. No, unless/until your name is on the birth certificate, then you have no rights. You might wish to seek legal advice on whether you may be able to request a Prohibited Steps Order, prior to birth which would be a request from the courts to prevent her from leaving the country. However, as in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. Plus, if your ex has family support etc abroad, then it is likely the court would give her permission to leave the country, especially if you are no longer in a relationship. If this was the case, then you would have to try for some kind of overseas access arrangment.

SeparatedDads Editor 02/10/2017 at 3:52 pm
I'm afraid that unless you want to take the matter to international court (which will be costly) there is little you can do except try to come to some sort of amicable agreement. It's not an ideal situation and it is one that many families are experiencing due to people migrating across the globe. Even if you took the matter to court, the court would not order your ex to return to live in the UK. You may wish to seek legal advice in order to explore your options.

Hi, My girlfriend is living in Sweden and has a child to her ex-husband, the child is 14 years old so I think is an exception to the 2003 law regarding parental consent. My girlfriend wants to move to England to be with me but suspects that the father would never agree to such a thing despite the fact she would be more than willing to let the daughter spend the holiday times with her father (if she wanted to). What rules/regulations are there against my girlfriend just jumping on a plane and coming over to live in England? Are there any? What recourse could the father take if she were to do so?

My son is 18 years old named father on birth certificate. His ex won't let him see his child at his own house no reason just being difficult it seems ex doesn't want the child to have a relationship with me the grandmother or my family it's very difficult but I'm keeping a level head we will see the child in parks etc just being difficult. What right has my son to see his child at his own home he wants the child to have a bond with me and our family would appreciate if you could help us and my sons rights he really wants a proper access to his daughter thsnks you
SeparatedDads Editor 11/09/2017 at 4:34 pm
Much depends upon whether your son's father agrees to allow him to return. You would need his consent to give permission for your child to leave the country. If he doesn't give his consent, then you would have to take the matter to court in order for the court to decide what it thinks is in yoru son's best interests. However, as your son is now 15, the court will take his opinion on board. Hopefully, your ex will make the same allowances you did when allowing your son to leave Spain for the UK.

I raised my 15 year old son In spain, his father left and remarried in the uk, 9 years ago.
This year my son decided to live with his father in the uk which I allowed without a court or lawyer being involved.
My son now wants to return. What are our rights. Can he simply get in a plane and come home?
SeparatedDads Editor 08/09/2017 at 10:07 am
I am sorry to hear this. If you are on a dependent visa and you decide to separate, you would have to let the Home Office know, However, as you have PR your wife has to request your consent to leave the country here. If you split up and you have to return to your home country, then this will have to be resolved between you both. You may wish to seek independent immigration advice to see what your options are regarding applying to extend your visa

I am on a EEA spouse visa. Our marriage is going from bad to worse.I am afraid my wife will try to leave with my kids to go live back in Poland. What are my rights? Can we separate? will I have to leave the country. I am the only bread winner and have a good job. My children are my life and I could not imagine a day without them in my life.
I would even be willing to carry on paying for our current home and moving out.

I'm afraid it is impossible to anticipate what a court may decide. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. However, if your ex refuses the request, then you would have to apply directly to court.

Hi I currently live in the UK with my son of 11 who is from a previous relationship. My son does see his father every other weekend at the moment. However, I am now in a new relationship and have another son who is 7months old and we are looking into moving to Australia. I know that my 11year olds father will say no to this move. I would be willing to FaceTime regularly and during school holidays I would be prepared to contribute towards flights for him to see his son. Would the courts grant me permission? Moving abroad with give us a better work life balance and financially we would be better off.

After divorce, the court granted me the parental responsibility, and it was taken away from my ex partner. Can I in this case immigrate to Germany with my 10 years old daughter? Or do I still need my ex partner's permission? If yes, is there a way go abroad without the permission of my ex partner? We were married and both our names are on the birth certificate.
SeparatedDads Editor 03/08/2017 at 12:29 pm
If the father has Parental Responsibility of your child, you would still need to ask for his consent. If he refuses, you would have to apply to court, , which will explain all you need to know.

Hi, my ex is Spanish and when she found out she was pregnant with my child, she moved back with her parents to Spain. My son was born 2 months ago, but she refused to name me as the father stating that she would be entitled to more benefits in Spain if she didn’t. I returned from Spain a few days ago and met my son for the first time. I would like to begin the fight for my rights as a father. Where is the best place to go for advice for a British citizen? I rang the Citizen’s Advice Bureau months ago but they weren’t able to help me. What is the name of the court where I should begin action? Thanks In Advance!
SeparatedDads Editor 17/07/2017 at 3:15 pm
If your ex will not give his permission for you to move, then you would have to apply to the courts. The court will always make a decision on what it thinks is in the best interests of your children. However, your older enough being age-16 would be allowed to voice her opinion regarding where she would prefer to reside.

Hi I am currently living in China with my wife we have changed from England to China a couple of times this is the China stint, we have hit problems where we both say we want divorce but we have two sons who were born in England so have British nationality and there visa for China is because I have visa. She wants to keep the children in China where I say she can share custody but she will have to move back to England to do that as there is no point for me to stay in this country for her. Does anyone know where I would stand and our marriage certificate is Chinese. Thanks

We are trying to work out with the children's dad two children 7 and 10 for them to come and live with us in the USA we are filing K1 visas which is on back log about six months. He does not pay child support he barely sees the kids we don't know if he's going to cause issues what the next step
SeparatedDads Editor 20/06/2017 at 3:34 pm
You would have to seek legal advice regarding this. If your ex wishes to move out of the country and you have parental responsibility, then by law she should request your permission. I can only suggest you seek legal advice about trying to get your children home, as effectively it is classed as child abduction. But, be prepared this may not be easy.

What can I do to prevent my kids moving to another country?

My husband and divorced 7 years ago, we have two children. He has since moved to Australia where he married again. Since then he has failed many times to pay maintenance, he tells our daughter that he doesn't like her, which upset her. She is 11. He calls our 10 year old son and grills him about me, his mum and puts me down. This then affects my children immensely. He hasn't visited them for 3 years and makes ridiculous excuses to why not. He legally has parental responsibility, but he doesn't live under British law. If I decided to move my children to Spain for a better life, would he still be able to block is? He currently does not adhere to his legal responsibilities, so should I?

I am an Indian national who used to live in Hungary with my girlfriend, we have a child born on 1st september 2016. On 18th November i went to meet one of my friend to the city centre in Budapest and wanted to go back to the house where we lived (her parents home), I tried to contacted her on phone to let me in the house but it was switched off, so i stayed at my friends home to spend the night. Next day when i tried to call her, her phone was off so i went directly to that building and i saw that my luggage is waiting for me outside the apartment..So i pleaded, cried, begged knocking on her door for more than an hour but of course no one came out and even responded, i just wanted to see my child who was hardly 3 and a half months old at that time. Eventually, I went back to India on 2nd of December and since then I have written her 1000 emails approximate where in most of the emails i requested her to share some pictures of my child, whom i havent seen growing up for last 7 months and the other thing was that whenever i would visit her city, she should let me meet my child whether she brings the baby or through a third party involvement, but my girlfriend never replies to those emails.
I think I dont need to mention the trauma, pain I am going through when someones baby is seperated in a snap. I havent even seen my child pics that i have with me because it send chills down my spine. This all pain is literally inexplicable. I have no words left. My child has Ventricular Septal defect and the doctors had advised to undergo a surgery if it doesnt fill up, i am so much worried about but of course i have no news about her health at all.

I am very sorry to hear this. You can appoint a guardian in your will, if you do not wish for your children to reside with their father, should anything untoward happen. If you do wish to appoint a guardian then your last will and testament should reflect this. You must include, in as much detail as you can, the reasons why you wish your designated guardian/s to take on the role of caring for your children. However, this does not mean your wishes will be granted. Much depends upon your children's father and whether he wishes to challenge your wishes in court. However, it does mean your wishes will be reflected in court. I can only suggest you seek legal advice, as much also depends upon your fiancee and his wishes regarding yours and his children. Both fathers have viable and valid rights and opinions with regards to caring for the children, should unfortunately the worst happen.

If you cannot negotiate a solution to the matter between you, you would have to take the matter to court for the court to decide. However, you may find because of your move your children are under Spanish jurisdiction as your country of habitual residence is no longer the UK.

Referring back to the rights about my partner moving to another country with our child. What if she is from the UK and I am from Madrid. And our child was born in Ibiza when we was living there together. Now she wants to move back to England because she can't afford to live in Ibiza?

I know this is an old thread but wondering if anyone could give me some advise.
I was with my ex partner back in 2002, we had our gorgeous son together but unfortunately the relationship broke down. We spilt when my son was 2.
I kept in contact with my son, even with the frosty relationship I had with his mother.
A year later she met her new partner, and then everything went to s**t for me.
My sons mother stopped contact and told me if I wanted to see my son I would have to go to court...no reason at all, but still wanted me to pay child maintence every month which I did.
I got myself a solicitor and done the only thing I could, fight her for access in court. This was a lengthy, stressful and expensive time let me tell you.
My sons mother represented herself so had no solicitors or court fees to pay, which she took to her full advantage.
Everytime we went to court she prolonged the case, turned up late, cried wanting to take breaks knowing it would be costing me more money.
She tried everything to stop me seeing my son, told the judge I was dangerous, she was afraid I was going to a kidnap my son and even stooped so low as to say I raped her (this claim she later admitted in court was not true)
I had to obtain doctors letters, attend classes to prove this was not the case. The whole court process went on for years.
Eventually the court said enough was enough and granted me access in a contact centre.
Because I hadn't seen him for so long this was the only and the best way they thought would build our relationship and bond between me and my son back together.
Another lengthy process with just two 2 hour visits a month, cafcass reports, some times his mother wouldn't show up and other times saying my son was ill. Obviously moving forward was taking a lot longer and I still wasn't seeing him very often.
After a year of contact centres I was allowed to take him out of the centre for a couple of hours....
To cut a long story short a year after that the court agreed I was not a danger, showed commitment and responsibility and was granted access to my son every other weekend.
Everything was going amazingly seeing my son. Myself and my partner had a child things couldn't of been any better....apart from still paying off the thousands of pounds of debt I racked up in court.
In 20011 my ex called me to her house for a meeting.
The worst thing that could every happen happened!
She told me she was emigrating to Australia with my son and her new family, I was literally crushed and devastated.
I went back to court to see what my options were only to be told my son is nearly 10 so able to stand up in court and make up his own mind where he wants to live. I couldn't put my son in that situation as to pick , as he resides with his mother and his two other brothers I knew he was going to end up moving.
He left in 2012, I had an agreement with his mother that I would not have to make any child maintence payments as I would use this m

i need an advice; my son is 6 yrs. old now and his mother don't let me see him, she is married now and has another child, she told me she will change my son last names and probably gave him the husband now...she is refusing to answer and advice me to get a legal advice or go to court...well, I have tried but she lives in Russia and my son was born there, and I live in the states....I dont know what to do to prevent her to change my kid last name...also she wants to travel with her new family, she knows that my permission is needed, but what about if she take him anyway without letting me know....what can I do to prevent this also?
I know it's a difficult situation, I need to find a legal advice, I will appreciate if someone here can provide any info. so I can be ready in case she makes any moves....any lawyer? thanks!

Hi,
My ex partner moved from Poland 3 years ago to live in England with our daughter who was 3 at that time. Since then my daughter has learnt English and have settled into school and is almost at the top of her class, she attends a private dance class and swimming club which I all pay for. I also forgot to mention that I have parental responsibility as my name is was placed on her birth certificate.
I have maintained her financially since birth until present. Now my ex partner spoke two days ago when she informed me that she was going to be returning back to Poland to be with her new partner and she will be taking my daughter. I spoke with her and tried to explain the importance of our daughter to have the best possible start in life by maintaining her education and development as it is because she is very happy.
Just also to mention here that my daughter is dual heritage and one of the reasons her mom came back to England was that she felt that her daughter would face difficulties growing up in Poland due to her ethnicity.
Also having spoken with her I quickly gather from her that she has been planning this for awhile now and have even purchased plane tickets for her return just after school breaks up in December.
I tried convincing her to leave my daughter here to continue her schooling and development and that because she was going off to be with her boyfriend that she could have her on all the holidays and national holidays but not to deny our daughter her education and stability she is experiencing at this point.
Also that she is not working and possibly will be depending on her new partner who I understand is living in a one bedroom apartment. I have asked her what she plans to do and she couldn't give me any answers.
This morning I received a text message to say that she has made the decision and that she will be taking our child back to live in Poland.
Is there anything I can do to stop this from happening?

Hello, advise is needed please. I'm going to give birth in January. Me and my partner live in London but we are not married. We are Eu citizens. My question is : will my son be able to take his father's name or he will be registered on my name ? Thank you! Ok
SeparatedDads Editor 10/11/2016 at 11:28 am
You would have to take the matter to court if your ex continues to deny you access. However, if you agree to her leaving the country and she stops access when abroad, then it will cost a lot more to have the access re-instated. I can only suggest you seek legal advice in order to explore your options, especially if your ex is considering leaving the UK (and has not yet), as you may be able to take steps to prevent this via a Prohibited Steps Order. A Prohibited Steps Order (PSO) is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area or country with their children. If your ex is already based abroad, then the situation is more difficult and you would have to get help through an international family law solicitor.

Hello my son is 14 months old and im expecting a baby next year with a filipina. We recently broke up. We havent been getting along well. She promised i would be able to see my son come to the uk but she now continues to deny me access to my son. She is very unstable as a person and can change her mind without even discussing things. Communication is broken so how can i apply for access to my son.
SeparatedDads Editor 18/10/2016 at 11:37 am
Yes, dependent upon the circumstances, your ex could be forced to give a DNA test if a court ordered it. However, to bring this to court internationally would cost and there is no guarantee the court would order this. You would need to seek legal advice.

If you wanted to return to Australia with your son it would be a matter for the courts. You would need to seek legal advice in order to explore your options and regarding whether you have a case.

Hello, advise is needed please. I have a 3 months old son with an Estonian girl who is threatening to take our child to live in Estonia. I have been with her for 5 years, but since the baby has been born she has changed towards me and our relationship is breaking down. She doesn't have a job and is completely financially dependent on me, as is our son. She has a mother in Estonia who she would move in with. I would be heart broken if she took my son away from me without my consent. What can i do? Where do i start?

You would have to seek legal advice in this case, as this is an international issue.

I'm afraid we can not answer your question as it will be up to the court to decide. However, the court will make a decision based upon human rights obligations imposed on the state by the European Convention on Human Rights and the Human Rights Act regarding an individual's right to a family life v the Government’s role in defining what it considers to be the public good. You can see more via the CAB link here which gives you a definition of what this means to you.

Hello There

I need urgent advise here. I am ecuadorian and I have been living in th UK for 6 years. I have been living on EEA residence permit due to my ex partner. we had achild in 2014 and due to her unreasonable behaviour with my child she decided to take my daughter to live in Spain where she is from. Now I stopped her by filing her a prohibited step order , after two months she delivered me in hands of imiigration as I was depending on the relationship we had. Now I have recieved a ltter from immigration that me and my son have to leave the country. however I can appeal and I have also received the child arragement order first hearing. What are my chances of staying her and keep seeing my daughter. my son would be destroyed if he is gets torn apart from his sister. would it be a vicious circle where immigration would say, we dont know yet what the judge will decide therefore i have not rights and the family court judge would say: your immigration status in this country is not stable so you have not rights to fight for you daughter . HELP PLEASE! thanks =(

She cannot take your son's child out of the country without consent. Your son would need to apply for a Prohibited Steps Order if he fears she may do this. A PSO is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. We have all heard the stories of a parent taking their child for the weekend and not returning them or going abroad with them and it becoming extremely difficult for the other parent to get their child back. Thankfully, this is one of the scenarios that a PSO seeks to prevent. As specified in the article, if your son's ex takes the child out of the country without his consent, then it will be classed as abduction.

She is slovak and Our daughter was born here in uk. My daughter have been to Slovakia so many times which I can't even count it but whenever I tell her that I would like to us to go and see my family in Africa she already refused and the first day I said I would like to take my daughter to visit my parent in Africa she tore her slovak passport infront of me. The second time I said it which is after almost 4years after she disagree d which cause and argument and she called police on me and I was arrested and charged for domestic violent crime. Everytin she said in her statement was a lies. In her statement to court, she said she want to be full custodian to the child . Am lost now and don't know what to do. Hallo, I am english, i moved to Holland many years ago with the intent to make a life here. I had a son with a Dutch man, and i gave him parental rights at the point of birth and his name is on our son's birth certificate. I unfortunately endured years of domestic violence from this man till i finally left in 2010. I spent the last 6 years getting out of debt (due to the bankruptcy we had together) and trying to built a new life with my son. In this last 6 years my ex partner has made no effort to have contact with our son except when i offered him contact at the point we broke up, which he refused. I have in the mean time had some issues traveling back to the UK for familiy visits and funerals and such because officially i need his permission to travel. I am too traumatised to contact him. I really want to move back to the UK to offer my child a better work and family life (because his father and his fathers family have had no contact for 6 years) and as i get older i the more i feel the need to be back "home" and with my own family instead of issolated in another country but i would need his permission officially to do so, and i know he would never agree to it even though he has no contact. Can i just move to the UK and apply for a UK passport for my son, or would i encounter deportation from the courts?

You would need to seek advice about applying for a Prohibited Steps Order through the courts. A PSO is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area or country with their children. Under British law, if you have Parental Responsibility you can also refuse permission (as the mother has to request your consent) as otherwise it may be classed as abduction if she leaves without it. However, it is always better to seek to prevent these steps rather than have to deal with them after the event, even though Zambia is a member country of the Hague Child Abduction Convention. I don't know where you stand legally with this if you are not a British citizen, therefore you will need to seek legal advice.

The father of my son wants to leave his wife, and bring his daughter to live with us, and my daughter, as a family. He and his wife are both Lithuanian nationals, living here in the UK for 10 years, their daughter was born in Lithuania.
His wife has told him that if he leaves her, to live with us (she knows about me and our son) that she will move back to Lithuania and take their daughter with her so that he can't see her again.
Due to current financial debts, he is unable to return to Lithuania until these are cleared.
Can you please provide any advice that could help us to move forward from this stalemate? Father and daughter have an extremely tight bond which is not shared with the mother. If he was to apply for a divorce, what chances would he have for custody? I appreciate that full custody is highly unlikely for a father, especially since the mothers unreasonable behaviour and controlling issues have not been brought to the attention of the law.
Any help would be very much appreciated.
Many thanks

If her ex will not give permission your daughter can apply to the courts move out of the country with her child. We cannot predict what the courts will decide, as it will decide what it thinks is in the best interests of your grandchild.

My daughter is not married to the father. His name is on the birth certificate and he was Bourne after 2003. Whilst they were living together he assaulted her a number of times. The last time was very serious and he got 15 months prison. Since then he has no contact then suddenly my daughter is taken to court for contact which then breaks down as he can't be bothered. The last time in court he said he was getting a flat from the council. He will need to prove that he has my grandson regularly. My daughter has been seeing another guy who is Austrailian. They are thinking of getting married. Can she apply for permission to remove? And what are her chances of success?

I am a married man with children all of which were born in the uk. My wife and I relocated a few years ago to Spain and have been living here since. I work in the army and spend the majority of the year in overseas countries meaning I am not classed as a Spanish or uk resident. My wife and I have broken up and she wants to go back to the uk. This is not what is best for our children. What rights do I have to keep them living a normal life in Spain?

Hi,

i am looking for help/ advise. My son is british subject, I am british and his mum Azeri. We live in Azerbaijan due to my work. We have recently split up. I am on the birth certificate as father and i am in possesion of his visa and passport.

My ex has moved into her parents apartment, which is one room, it has two single beds, mum and her in one bed and mentally ill granny in th other. the property has no hot water. I have asked her to live in outr current house in one room but she refuses and is keeping my son in cramped and bad conditions which concerns me a lot. I have asked her if i can take him to visit uk, to see granny but she refuses. I am at my wits end what to.

What would happen if i was just to take him for an evening and then get on a flight back to uk, what would the implecations be. As i would then refuse to allow him to leave the uk and return to Azerbaijan, due to the conditions where he lives, and the human rights experianced in the country.

Please help

My son's mother who is now married to this teacher for the past 2 years. She has been getting weird believing in the notions the our economy is going to suddenly collapse and new world order is going to happen. She been only listening to talk radio and never look at any of the national news networks. Well anyways, she now has an idea to relocate to Egypt because of this nonsense of our country's pending doom. My son will be 12 this year. He was born on Nov 9, 2003. She requested that I sign this Passport form and get it Notorized to give her the right to take my son out of the country. I was about to sign it, but then my common sense kicked in. It might be the last time I see my son. And why Egypt? No exactly a safe country for Americans. I'm thinking if I sign it, I could doom my son's future as well. Could someone give me their incite, or could I be a little paranoid for not letting my son out the country?
SeparatedDads Editor 25/08/2015 at 12:58 pm
I am sorry to hear this. You would really have to seek legal advice on this, as once a child moves out of the country it becomes an international family court matter and it becomes more complicated to resolve. However with the rise in international movement, there is a lot more legal help out there than formerly. I suggest you perhaps in the first instance speak to someone at your Citizens Advice Bureau who may be able to point you in the right direction.

My husband and his mistress conspired on waking me child away from him. My daughter who was 14 years old then had taking a liking towards her. She used me to bond with my child. My husband tells me that he wants his family back, but it was all his lie and his mistress. I believed him and I had giving this woman a letter of temporary guardianship knowing that she is like a sister to both my husband and I. The letter is submitted to the overseas government. When my daughter reaches overseas he breaks the news to her and this woman fleds and goes to marry him. My marriage is not finalized in our country as well. My husband had never sent court papers regarding permanency for her. She was across the world, adjusted well at her school abroad, and this woman had taken over my role as a mum now. My husband had never communicated with me since then. I have never signed any medical forms, etc from the time she has been abroad. She is 19 years old now. They have left me so empty and deprived me years I missed with my child. The bond we could have shared. I had sole custody of my child when she was 11 years old. He was abroad for 2 years and never cared about her. They took her away just to safe guard our money. My daughter did mention to my sister and mum that their are times where she just hates her dad. She has become this cold, angry child. I see her once a year. She tends to have an attitude with the male specie. She always wonders how is it so that all her friends have boyfriends in the country she lives in.. And she does not. Probably she had experienced all the hardships her dad had put us through. He used money against me and considering the lavish lifestyle we led.. She was taken by him. That is the reason he left me with nothing. My daughter is afraid of communicating with me, she is afraid of putting pictures up of both of us..from birth she was clingy to me, never left my side. I wish I knew the way my life life is going to turn now. Part of me has died now. I could never be in a relationship again and distance myself from everyone. I trust myself and live alone, I feel safe when I am all by myself..

Hi!!! I reside in the U.S and my husband in the UK. However, myself and my daughter will be joining him soon hopefully. I just need some clarification as my daughters father (not my now husband) is not on her birth certificate. Will I have any problems with the UK immigration in regards to me getting a court letter to state I have sole custody? Here in American I've never impose any difficulties as my name is the only name on it but I just want to make sure I won't have any problems when I start filing our paper work to move to the UK. I await your response. Thanks

Hi. I come from EU country and I live from 7 years in the UK. I have son with British citizen, we split up when I was pregnant. I lost job now and I just apply for job seeker allowance which I can receive only for 3 months. His dad pay £15 child maintenance a week, which is not enough for life. If I would back to my country can I take my son without his dad permission? Or do I have any rights to stay in UK with my son? Please for help.

Hi please advise me. I am a UK national married to an African man. We have a girl of 3 years old. I live in British Overseas Territory with my daughter and we plan to move to a neighbouring EU country for better living conditions. When we left the UK my husband came with us to the British Overseas Territory. Our relationship was over and within months and my husband chose to leave and returned to the UK. He has a spouse visa and lives there now though won't tell me exactly where. Anyway, he doesn't want us to live here and wants us to return to the UK despite barely contributing towards our daughter's maintainence or seeing her even when we are back in UK. He said he will get a lawyer as he does not consent to us living here and if I move as we plan he is not happy and firmly said he does not consent to any move. How much say does he actually have in where we live considering his lack of input up until recently?

I'm trying to find help for a lady from Thailand who had a child by an Irishhman. She cared for this childin Thailand for three years while the father sent her money every month for the child. He later went back to Thailand and persuaded the mother that she and the child would be better off in Ireland. She agreed to let him take the child to Ireland as he told her it would take about a year to get residency for her in Ireland. After getting the child he then stopped answering her calls. He is rich while she is poor. She has no way of getting her child back or even having any contact. While I can find plenty address for children being abducted from the EU to Thailand. I can't find any for children taken from Thailand to the EU. Please help this woman any comments or advice very welcome. Kind regards James

When a mother takes her child outside the United Kingdom, the British father is legally the only victim. This is because child custody has noting to do with children rights and any man that does not allow it considers his children personal property.

My wife has run off to Slovakia and is 20 weeks pregnant. She is refusing to come home. There was no physical violence involved. What are my rights as a father to be able to have a relationship with my child?
SeparatedDads Editor 22/04/2015 at 12:38 pm
@Li- if your ex has parental responsibility you would have to get his consent in order to be able to live in another country with your child. if your take your child abroad permanently without his consent, this is technically parental child abduction.

I need advice ! I suffered domestic violence and my husband has court on 29/03/2015 , I have a one month baby and I left house to be safe with baby and my mom that she is visiting me , ... I'm trying to do my baby passport and go to Brasil where I'm from to stay away a bit from here and my husband ...
Can he stop me to take my son with me ?
SeparatedDads Editor 22/04/2015 at 11:33 am
@loveinfather - As specified in the article, if you have parental responsibility and your ex wants to take the child to live abroad, she needs your permission. However, the fact that your ex is not settled here presents another complication and you may need to seek some legal advice on this. I hope this helps.

SeparatedDads Editor 21/04/2015 at 10:44 am
@lindy55 - you would have to get consent from both parents. If either objected, you would have to take it to court. However, it is a big ask through the courts as you would be asking to separate the child from both parents, whereas regardless of the situation, the courts will ideally want the child to have an ongoing stable relationship with them.

I have a question that i really need to get resolved ASAP. My ex wife and I have a 12 year old daughter. My ex-wife got remarried to a gentleman in England and plans on moving there with him within a few months (its been going on for years). Recently our daughter informed her mother that she wished to stay here in America and live with me. Her mother informed her that if she decided to stay with me then if she ever decided she wanted to live with her mother that she wont be able to live in england with her. I do understand there are visas and such in order for this process to happen. But is what i dont understand is that when it was explained to me is that once her mother became naturalized that means our daughter also became naturalized (duel citezenship) once that happens doesnt that mean that our daughter could move to england and live with her mother if she decided she liked it there? Any help on this matter would be greatly appreciated.

Hello, please can you give me an advice: I am divorced for more then 2 years. My ex-husband is from Albania and I am from the Czech Republic (EU country) and we live in the UK but separate and 200 km is our city distance...I know he is living in London but do not know where exactly and do not know where he is working if he does. He does not want to tell me but he knows where I am living, working..Why we divorced was that he did not want our baby, he blackmailed me, threatened me etc....When our child was born I went to live with my baby to the Czech republic for the maternity period and after I came back to the UK because my motherly ended and I went back to work when my mum was here with me and help me with my child. The father contacted us and wanted to see and be in touch with our child. His name is in birth certificate too and I told him that he can see our child any time..but unfortunately he did not see our child often...I can say 2-3 times a year in 2 hours, he did not pay for our child, he still owe me money too and I never report him..I did not want trouble with him and scared of him too...And now he told me that his visa was expired in half year ago and needs from me: the copy of our child passport ( was born in the UK but has Czech passport and my surname), birth certificate, my wage slips for the period we were spouses and prove he paid for our child...but it was not true and in couple moths ago he started to pay abd have a prove for home office...I did not want to give him those documents and wanted to go back with the child to my home country this year - permanently live. He told me I can go with our child but needs these document from us...I wanted to give him that but wanted from him if he can give me this permission by written and confirm in front of solicitor what he does not agree to do it and told me if I do not trust him he will start to fight for our child and wants join custody and stop me to go back with our child to my home country...He told me the court will stop me because he is father and has the same rights as I do...But it is unfair...He did not care before...just start now because he needs visa...Please can you give me an advice what I could to do and what is my rights? Thank you so much

@juvs - it may be that Jakarta where he now lives is outside the REMO countries where you can enforce child maintenance decisions. Was he living there when the order was enforced, or was he in one of the REMO countries? You can find out more about Reciprocal Enforcement of Maintenance Orders (REMO) orders whichI hope this helps.

SeparatedDads Editor 24/03/2015 at 11:06 am
@Jude - I am very sorry to hear this, as the world expands and we become more multi-cultural then this is invariably going to happen. If you wanted to fight it you could possibly apply for a Prohibited Steps order through the courts. But you would have to prove that it was not in the best interests for your children to leave the country, and as you say, you don't really want to ruin an amicable relationship with your ex. You may find our Separated Dads Facebook page useful as I'm sure there are many men who have been through the same issues, as it is becoming increasingly prevalent. I know it doesn't seem like much consolation, but international travel is much cheaper and often parents can agree a schedule of annual contact involving return trips to the UK in the school holidays and weekends and visits by the non-resident parent to the child's new home. Other forms of contact can be agreed upon such as Skype and Face time to make the separation less daunting. Trust me, you will make new friends and frequent trips abroad will take up your time. I know it is not ideal and it really is terribly heartbreaking for the parent left behind. I hope this helps a little way to making the transition easier.

Hi All

I'm in a situation where I married a scandinavian woman and had two children by her. We have lived in the UK for 8 years, our marriage has deteriorated. We have tried couples counselling but to no avail. She really wants to go home to her country and in fact a date has already been set for a months time.

I have no quarms about the ending of the relationship, it hasn't been very pleasant. However she is going to take our young children away with her who are both under 5 years old. I have been to a solicitor who has said unless I can prove she is an unfit mother and that the children will not be cared forI have no chance in keeping them in the country.

I could refuse that she takes them, but then it would sour our relationship, and cost money to go through the courts. We are quite amicable with each other at the moment.I have looked at the labour market in her country and I don't really stand a chance of getting a job which would give me a standard of living - I've been on blogs which says unless I speak the language fluently I do not have much choice and then they would prefer to choose a native speaker.

I'm just so upset that I'm going to lose my children and have to find the money for flights to see them once a month if I'm lucky. Again the mother gets it all her way again, there are hardly no rights for fathers. If it was 50/50 then I would go to court to fight for the children, but it's extremely unlikey and I have to realistic about the law.

My social life was mostly around the family and the friends we had together and the children would always be the link to gathering socially. Now nobody wants to know and are all involved in their own lives. So im in my 40s wondering what the hell to do next.

Would like to hear from somebody who has experienced a similar situation and how they coped.

Thanks for reading.

@emmaloo29 - I am sorry to hear this, it must be quite upsetting for you. However, the court will always decide what is in the best interest of your child and the fact that she is settled here will quite obviously go in your favour. If he is not paying child support, the UK has Reciprocal Enforcement of Maintenance Orders (REMO) with a number of other countries, which will tell you how to follow it up. I hope this helps.

He is now threatening to take me to court for custody for her to go to America. . And he also refuses to pay for her.. He left on his own accord as he missed his family but now thinks he can take my child.. advice please

@yaas - I'm sorry to hear of your dilemma. I'm afraid this is difficult to advise on this because I am not familiar with SA law and whether you would be allowed to leave with your children without taking it through the court process first. I suggest you try and get some legal advice where available in SA first.

i have been separated with my husband for 3 months now. I'm a citizen of the United Kingdom but currently live in Zimbabwe. My husband was very violent and I suffered from domestic violence.i reported to the police here and recently had a case in court. Due to not having a medical report, I lost the case and he has been discharged. I have 2 children 9 and 7 years old. He chased me out of the matrimonial home. I fought for custody of the children through the court of Zimbabwe. I have now the custody of my 2 children. He is only allowed to see the children every second weekend. The issue now is that he does not want to pay any maintenance towards my children and I. He only agreed to pay school fees which is not fair. We are fighting for maintenance in court still. He had forced me to stop working 6 months ago and now I'm finding it very difficult to find a job immediately. I need help with paying my rent and fuel and food for the children. He has got a very good job here and has showed fake wage slips to show low income and I have no way to prove that he is getting more money. He has a house in the uk and it is on rent. He has 3 cars and a boat and does not want to give me anything. He has taken my children's passports and is in possession of them. I'm now struggling and my dad is helping me with costs but he is also retired and soon I will not be able to afford everything. My question is that I have custody of the children and I have rights in the uk, can I request somebody or somewhere to help me go back to the uk with my children because education and all is very costly here where as in the uk I can get help. Am I allowed to go to the uk with my children as I'm struggling here if he doesn't pay the maintenance. Or is there a way to ask the uk government to assist me in telling him to pay the maintenance costs for the children.im a qualified teacher and I have worked in the uk. My children were born in the uk. I need help to go back to the uk as I have no help here as my husband is wealthy and does not want to help me in any way.. He has sent me divorce papers this week and is refusing to give me anything .i have been married to him for 10 years now. Please help me!!! Thank you
SeparatedDads Editor 27/02/2015 at 1:58 pm
@Bruss - you can apply for a Prohibited Steps order, if you are not in agreement. A Prohibited Steps Order (PSO) is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. The court will decide then what is in the best interests of your child. You will be expected to give reasons why you do not agree with the proposal on the basis that it will disrupt the stability of your child and your relationship. I hope this helps.

me and my ex girlfriend have 2 children together, we both currently live in Norfolk England , she's on about moving to wales which is 6 hours from where I live, my name is on both birth certificates, can she legally do this?
Georgie Editor 09/02/2015 at 2:47 pm
@Sj - I think this is an incredibly selfish approach and idea. Just because you have a well-paid job and her mother doesn't, doesn't give you the right to have your daughter. Think of your daughter, how would she feel if you just took her away from her mother and away to Australia? The courts would decide what is in your daughter's best interests and they are unlikely to grant you care to take her across the other side of the world, as despite whether you think it's right or not, it would not be in your child's best interests to take her away from a loving resident parent, regardless of her lack of salary. Georgie.

I am considering working in australia for 6 months. I have a 4 year old daughter who lives with her mum, and i wanted to know whether id be able to take her with me and what legal rights i have. My daughter spends mondays to fridays with her mum and i have her every weekend without fail and longer if i have time off work. I cant imagine her mother agreeing to let me take my daughter so wondered if i had enough legal rights to win via court. I also wondered if my personal situation effected the outcome. For example i pay her mother money every month without fail, and i have a well paid job whereas her mother doesnt have a job and her boyfriend has a low paid one. In other words i think my daughter would be better off and have a better quality of life living with me. Any advice would be appreciated, even if its just to say that id never win in any scenario, at least then i know. Thanks

Hi, I am Lithuanian and have nine year old son who was born in UK but has Lithuanian passport. I have residency given by UK Court. Me and father separated 6 years ago. Father was paying maintenance for few 5 years but then stopped and isn't paying any maintenance for a year. He declared personal bankruptcy few years ago, and from then everything house, cars, 3 businesses and etc are on his new partner's name. It would be a waste of time to take him to CSA. Father has contact every second weekend from school to school and half of holidays. He doesn't support my son financially at all neither clothing, after school clubs. My financial situation changed, I lost job and I am thinking to move back to Lithuania where me and my son will be closer to family and who will support us. Do I have to get father's consent to go to live back to our native country? Or will it be enough to give him a notice of moving and new suggestions of contact? Father has Lithuanian passport too but resides in UK. Could anyone please give me an advice. Thank you.

My ex partner and I have an 8 year old son together and have been separated for 7 years. I am named on the Birth Certificate and as he was born after 2003, I have parental responsibility. Since separating she has received regular monthly maintenance from me without fail via the CSA. There have been no major issues regarding access and he stays at mine at least 1-2 times per week. This has been agreed between the pair of us (albeit predominantly on her terms) and there has never been any legal involvement. I work full time and own my own house. She works part time (due to child care) and resides in privately rented accommodation.
My ex partner is a Jamaican National but has been living in the UK for approximately 15 years. She has family that permanently reside both in Jamaica and the USA. She has no other family in the UK and has recently expressed interest regarding leaving the UK and living elsewhere although she hasn't been specific as to whether that would be Jamaica or the USA. My son has a current UK passport. I also have a copy of his birth certificate. I obviously don't want my son to leave the UK. She has told me that if she wants to leave the UK, she will irrespective of how I feel about this.
How do I realistically stand from legal point of view

My ex and I have been split up for a few years. We have a child together who is 4 and I am now married and pregnant with my new husbands child. With opportunities that we have been given we have to be out of the USA (we are all americans) for at least 6 months. The child spends most of her time with me but I don't think the ex will ever agree to the child being out of the country cause he's just that type of person. Legally is there a way I can still win the case so I can have my child with me in our new home there for half of the year? This isn't a permanent location. Could be 1 or 2 years that we have to be out of the USA for a few months at a time. If the ex does not agree to this then I would be keeping my husbands child from him. Advice please!!

@Desperate Dad - Having parental responsibility will give you rights to say where your children live. I assume you have spoken to your ex and voiced your concerns - if you can't agree, is it perhaps something you can take to mediation first? If that doesn't get you anywhere then you may have to obtain specialist legal advice. I hope this helps.

I have been married for several years living in London, and my wife has left me taking my two very young children with her to Wales where she is originally from. She plans to file for divorce and live in Wales in order to be closer to her family. Can she legally do this without my consent? Do I have any rights in this matter? Thank you.
SeparatedDads Editor 15/07/2014 at 10:48 am
@Angica81, is your ex partner on the birth certificate? If so then he has parental responsibility and you will need his permission before you can move back home with your children. If he refuses to give you permission you can apply to the court for them to make an order for his agreement. However, just because you apply for the order doesn't mean the court will grant it.

I am an Indian lady married to a British Citizen of Indian origin. Our marriage happened in India and registered in India. I have stayed in UK for around 1.5 years on my husband's dependent visa after marriage. Our relationship was never good and there were fights, disagreements mainly over my job and my contribution to house's expenditure. There were even few instances of domestic violence on me. I have never reported this to any authorities. A few months back a baby boy was born and he is a British Citizen. My parents were in UK to help me with my delivery and new born. When they returned, I came to India with my baby. We applied for OCI (Overseas Citizen of India) visa for our baby. This was with my husbands consent and the agreement was to return back in 3 months time. Back in India, I discussed the issues in my marriage with my parents and in-laws. The in-laws didnt take it well and informed my husband. My husband is highly unhappy with me and I am scared and worried to come back. He said I need not be back on his spouse visa but he wants his baby back as the baby is a UK citizen. I do not want to separate my 7 months old baby from me. My husband is threatening me that he will file an abduction case in UK against me. Will it be valid? Please advise.

My ex just had my baby and she gave our baby her family name due to other problems I wasn't there for the birth of the child, and she has been saying the kid wouldn't had my last name even before the kid was born, and she and the family are planning to take my child out of the coutry saying I have no right over the child, but I want to be involved in my child live and I have been buying baby things before the birth of the child. Am lost so I don't know what to do.

Hi. I am currently pregnant with my ex's baby who is an Australian Citizen, I am an English citizen. She will be born in England. However my ex is threatening to take her to Australia. I am completely against that decision. I've always said he could go on her birth certificate as he is the father. But now I'm thinking twice about that choice and for her to take his last name.. I would like some advice on what to do and what routes might be taken if he isn't on the certificate but still fights for his rights. Please get back.

My 7, going on 8, year old daughter is coming to the UK from Hungary in the summer. She is resident with her mother (or rather grandparents as they rarely look after her) During the last year, she has been the subject of both mental and physical abuse from her mother and her mother's husband, partly due to alcohol and drug abuse, and partly because of personality issues. Wanting to avoid harm to my daughter, I would like to keep her safe in the UK and have her evaluated here in the UK (she has both British and Hungarian citizenship). I have followed the Hungarian legal route since 2011 and so far I have not had any co-operation or success with myself being attacked, my family and for the last year, access blocked by them but the Hungarian social services and child protection agency have done nothing. Are there any special laws which I can call on to protect her, as a British Citizen, and keep her from returning to Hungary? The law in Hungary does not consider the testimony of a child which possibly is different in the UK? Does her continuous abuse warrant any sort of special laws to help protect her?

It seems that Women still get their own way and the law is certainly unjust, I don’t want to put you off but save your money say goodbye to your daughter and make the best of this appalling situation, and corrupt money led legal system. I have been fighting for the last year to stop my ex wife taking my Daughter from Yorkshire to Wales, she has consistently lied to the court. But this seems to count for nothing. I have my daughter overnight 4 days a week and collect her from school 5 days a week, give her tea do homework and take her home at 8.oclock. There is nothing for her in Wales, no relatives, no friends, and she will be going into full time child care which she does not have at the moment. There is no abuse, and no violence I have equal responsibility. She will be leaving behind her Father, her Sister (who I have custody of already), her School, friends, Uncles, Aunts, Grandparents, clubs etc.Cafcass told the court that moving her away, will only be short term trauma and that the 8 hour round trip to collect her every other weekend will be of little upset for her, as thousands of Fathers transfer children at motorway service stations all over the country. My daughter who is 11 does not want to go and screamed at the Cafcass officer that if she was forced to go she would run away. I bet you can guess the outcome! I have spent £90k on my case will probably lose my house, all the way through the Solicitors and Barristers told me that I had a very good case, and should win. So good luck to you. find a way to settle.

I am experiencing some difficulty with my ex partner, I have recently been to court and sorted out contact and child support. My ex has moved to Toulouse in the South of France and as such my contacted has been limited to school holidays. The mother is always requesting that his medical care such Dentist etc I be the one to take care of it, given I live in Kent and he is 1200 miles away proves really impractical to manage. The mother did live in Lille and I arrange myself to cover the care by travelling to France from England and attending the treatments and appointments with him, which made him feel far more secure. Now she has moved she expects the same service. Please could anyone agree I would have grounds residency.

@ Sim just read this article, sorry to hear about your situation, and hope you have something worked out with your ex by now. However, the Lake District is not "out of the country", Wales is part of the UK too, not the other side of the world, only a 4 hour or so drive away & I have friends that have to fly half way across Europe every second weekend to spend time with their kids. it's something that can be worked around if you are willing to do it, I personally consider that a small thing to do if it means you have contact with your kids. Good luck anyway, hope you work something out that works for all.

Can someone please help me URGENTLY. My ex had been making plans behind my back to take my daughter to the Lake District without telling me. We live in South Wales, so it this legal for my ex to take my 3 year old daughter out of the country. I only found this out yesterday when I went round her house and everything was packed away. My daughter has been spending 3 or 4 days a week with us (I live with my mum and dad at the moment). She has only just become settled since me and my ex broke up. Now she is taking her away without my permission and nothing is in writing as to when I can next see her. We weren't married but I am on the birth certificate and my child's last name is mine. Is there anything I can do to stop her going? Can anyone give me any advice, I can't get my head around I could loose my daughter in 5 days. Help!
