I feel let down buy all the people I contact. My solicitor won't go any further until she gets legal aid and I haven't seen my children for nearly two months. I have been told it could be another month before she can apply for the aid.

Where does a father go from here? We should be able to have responsibility for our children - we are not here JUST to bring them into the world and then leave. We want to play an active role in their development.

I would like to go to college and gain some qualifications that will enable me to help fathers in distress, as we all suffer from being on our own. What are the best steps I can take to help myself and other dads in this situation? Is there something I could learn about in college that would be useful? I really need to get help with my problem with my ex so I can help others in a similar situation and reassure them that they are not alone.

As a father you are setting a good example by wanting to fix problems with your ex and be able to see your children regularly. Unfortunately, the legal system can be slow to sort things out and this can be very frustrating for you, especially when you are unable to see your children in the meantime.

Ultimately, it is still the best route to go down in order to secure your Rights To Visitation and to play an active part in your children’s upbringings, but there are other steps you can take. The legal system is there for good reason and does play an important role in securing fathers’ rights, but is not the only solution.

You do not say what your relationship with your ex is like but you may want to consider asking her to attend some Mediation Sessions with you. You both need to work hard to put your children first and Find A Way To Communicate With Each Other. By agreeing to visit a mediator it gives you both a chance to express your feelings and opinions and to try to understand each other a bit better. You are always going to have a relationship because of your children so the smoother this can be, the better.

This may also be the best route for you to go down in order to help other fathers. Most men who are dealing with this kind of situation have a lot of emotions to deal with and could really do with someone to talk to. As someone who has experienced it, you would be in a great position to help them. There are many counselling and mediation courses available, either through your local college, private classes or distance learning that would be a great start.

Another thing to consider would be for you to visit a support group or talk to other men who are dealing with Visitation issues. There are a number of Internet forums and also groups that meet in person. As well as helping other men, you need to feel that you are not alone and it would probably help you to talk to other fathers who have dealt with the same thing. My wife, got me arrested on 27th June 2019,for false allegations of DV. My wife did the same to me in 2012,after I caught her having an affair. We went to councilling for some months, but things were never the same.. I decided to work on our marriage, and we had 2 more children.. We have 4 beautiful children in total.. Anyway we moved on, sort of, although I couldn't really get over her false allegations to the police and the deceiving behaviour of her. She became very friendly with a mum at the school, who I thought was OK.. How wrong I was.. In May she was sending nude pics of herself on Instagram to some bloke. She only came clean when he started to demand money from her... We went back in councilling and then I was arrested on 27th June, ager 3 days of rows. Again I was arrested for false allegations of DV. Only this time she took out a non molestation order against me. She stole 18 thousand pounds from our account and left me homeless.. Im disabled, and was placed in a elderly dementia care home, to keep me off the streets. She's stopped me seeing or talking to my children. She's been having an affair with another married guy and his marriage is over. Last week I was stopped by the police to say she had alledged I had breached the non mol. When it was her that followeded me whilst I was sat having a smoke in my car outside my Doctors.. Now I've got to be interviewed by the police again.. All I want is to be able to see my children.. I'm so lost, and feel So alone...

I am afraid if your ex doesn’t want you to see your kids there’s nothing you can do except move on yes it hurts messes with your head...but if you want to live a normal life then you have to move on...I have a son in Russia visited him from London to Khabarovsk in east Russia every 3 months....I was in court the judge told me to pay £650 pound per month I was paying her £350 every month up when we got divorced she thought I wanted custody...so she lied in court after this I never payed her 1 penny on visits I just spend money on clothes and toys and £1000 every 3 months my ex hated this and she hated me even more after I married a younger Russian women 6 months after divorce from the same city..she got the federal bailiff service on me stopped me leaving Russia lost me my job..in the end I left Russia anyway but the point is if you have a nasty ex and as much as you love your kids there is absolutely nothing you can do your ex has all the power in her hands for the sake of sanity just walk away start a new family and hope you can start the relationship with your kids when the reach 16 I know it’s hard to forget but there alive going to school just walk away

I am having major issues regarding my ex wife, I am paying the amount required by the government each week without fail. Unfortunately everytime its my day she insists I give more money or I cannot see my girls, it's getting to a point where I feel its becoming a national wage. I have no issue in supporting my beautiful girls at all and will continue to do so, but is there something I can do to stop this bribery and what feels like financial abuse, I'm lost now and sick of it. Any advice would help

To all the men here asking about getting to see your children.... There is no hope. If your ex means it then you will not see them. I am sure you have all realised a woman is immune to prosecution for perjury. They perjure themselves to obtain a non molestation order. Even when the judge is shown that her accusations were lies there is no consequence.
After the initial NMO your ex will then repeatedly contact the police with lies. The police will come to your home and arrest you. You will be released because these things never happened. However, your ex will face no consequences. During this time she will not hand over the children. She will continue to use the police and courts to harass you. Eventually you will snap (which i did by text) and you will be arrested and charged.
In family court the judge will make a song and dance about fathers seeing the children. You will get court orders saying you are allowed to see your children. However, your ex will not hand them over as there is no consequence to her. If you show up at her door to demand to see the kids your ex will ring the police. You will be arrested for harassment. You will be in and out of court for months listening to ridiculous allegations made by your ex. In most cases you will have to pay for this privilege whilst your ex receives legal aid.
Also if you are a man being abused by your wife DO NOT report this if you have children. In my case i was able to prove my ex partner had split my head. I was able to show photos. However, a woman just has to claim you were the violent person. She does not need evidence.
I have not saw my children for almost 2 years. In court I have proved her NMO was fabricated. I have proved that her subsequent allegations were fabricated. Through her own text messages she admitted that she told lies to court. That her solicitor told lies. That her solicitor made up lies to simply obtain legal aid. Neither faced a consequence to their actions. And here is another fact. A judge on a colossal wage has no time to learn about the facts of your case or read the facts of your case. However, he will go through every allegation made by your ex with a fine tooth comb.
I am choosing the court route so I can show my kids in later years that i fought tooth and nail to see them.
However, I understand now that there is no hope of seeing the children again. Courts cannot and will not enforce their own orders. Men have no chance from the outset in family court simply because they are men.

hi all,
I'm currently looking for advice on how to get some form of access to see my son,
my ex partner split up with me when my son was a month old she called the police and got me arrested on many false allegations to which I have been proven innocent, I've been to mediation to get the c100 form but looking at solicitors but they all seem really costly! I wouldn't mind the price its the fact I can't afford it due to losing everything, my little boy is one this month and I really want him back in my arms. if anyone could point me in the right direction it would be really appreciated!

I am writing to you because I don't know where to turn and I am desperate to know about my children. My name is Jose Simoes and currently live in Ipswich, I have a full time job as a registered care home manager.
I used to live in south Wales more precisely in merthyr tydfil and I have 2 children with my ex wife. When we first separeted (now divorced) she allowed me to see my children, and I always paid and still paying child maintenance every month without fail. Now that I remarried she wont allow me to see or talk with my children, I don't even know where my children is, and this has been going on for too long now.
I am a completely desperate to see my children but unfortunately no one has been able to help me. There is no reason in the world why I shouldn't see my children. PLEASE HELP ME

I was separated with my ex-wife in 2018, she and the 2 children continued stay in the home for 8 more years while I paid for the full monthly mortgage during these 8 years. The original agreement was that I can see the children every other Saturday and Sunday and no stay overnight; I live close by so that was not an issue.

My ex then practice alternative life style that is meat free; chemical free and pretty much technology free too. She moved to France with her boyfriend after the home was sold. So seeing the children were no longer easy as before; restricted technology used meant I did not even have regular contact with my children via messaging apps or even just normal phone call. I ended up seeing the children 2 times a years by going to France to bring them back to UK for a week each time.

Recently my ex have refused children to visit during the summer time and also for Christmas time; labeling my house is “Toxic” for the children because we have WIFI on 24X7; using laundry detergent like every other house; wash ourselves with shampoo and shower gel like everyone else; having meat on dinner table; watch TV; play games; buying clothes and eating chocolate. I see my house is a typical British house; following typical life style but unfortunately my ex see these thing poisoning the children.

My ex want to lay down conditions when the children visit that I cannot agree; she always had the upper hands using the children to get what she wanted because she knew how much I love my children. So I can no longer give in and there should be no conditions for father to see their children.

I wanted to take her to court buy stopped by my wife concern how my children might be affected and angry at me instead.

My children are 15 and 13; are children allow to make their own decision which parent to stay with when they turn 16?

Hi,
Someone I used to work with is going through a rough time, he is now unemployed and hasn't seen his daughter this year as his ex has just cut him out of her life.
I know he is also in debt so says he has no money to get a solicitor etc.
Is there any free legal aid available to him please?

Hi there. I'm really in need of some help/advice as I'm having alot of issues regarding access to my daughter and housing. My wife told me to leave the joint family home roughly 2 years ago after an argument and changed the locks a couple of days later. I have had to re house myself and basically start again with nothing and caused me alot of financial issues. She wont/can't take me off joint mortgage, excluding me from the home, won't give me keys etc. Regarding my daughter the last 2 years it's been on and off and when convenient for my wife. She has stopped my family from seeing her, stopped me from picking her up from school and won't involve me in any activities at all. I have tried mediation and she refused, then to offer me contact 2 hours a week through a solicitor. It's not working seeing my daughter at the family home as my wife and me are always in confrontation and she just stops contact when she feels like it. I have my own home but my wife won't tell her anything. I've been cut from everything and at my wits end. My wife has also told me she doesn't want a divorce or a separation!!!! Please help.

Hi Im stuck in a horrible situation, my ex partner and I have 2 daughters 12&10, the oldest lives with me and the youngest has just recently moved in with him since this has happened he has refused me any visitation at all, I also have a son 3 with my current partner, my oldest has refused to see her dad any more for fear he won't let her return to me but also my little boy who absolutely adores both of his sisters is missing the younger sister terribly they had an extremely close relationship he keeps asking for her constantly, my ex is completely refusing any kind of visits until he secures a court order for residency. Both of my girls have lived with me full time since our relationship broke down over 8 years ago and I've always allowed contact with their dad and always on his terms.

I’m looking for some advice for my partner. We have been together for over a year and his ex has continually controlled him, what he does with his children when in his care and us. She has harassed me to the point I have involved the police. She has a partner who is a part of their children’s life’s. She has told him over her dead body will she allow him to introduce me. We have plans to live together next year. I am pregnant with his child. I have other children. His mother had a conversation with her and asked why he isn’t allowed to take his children on holiday to France which then turned into the usual over my dead body will Hannah ever meet my children. His mum is as timid as him and replied that after court I will be allowed to see them and that we will be living together. She called him and accused his mother of making a threat. She has now told him she is withholding contact. He usually has them 5 days a week. 4 after school until bedtime and from fri after school until Saturday 7pm. He is obviously devistated. Can she do this? Will court say we can’t live together if she demands that? If it is the only way he can see his children obviously we will just have to adjust our plans and stay living separated. He is not on a high wage. Had very regular contact. Always pays maintenance. It all seems so unfair for him. Please advise waiting 4-6 months for a contact order is too long for his children 7 and 4 to not see him after years of spending more time with him. Is there a court order that can reinstate contact much sooner until the contact order is in place?

Much depends upon how old your daughter is, your daughter's father has no obligation to continue supporting his child once she leaves full-time education and you stop being eleigible to claim child benefit. If your daughter is disabled, your only recourse would be to seek legal advice to see whether you could apply to court for further financial support.

What do I do..? He has promised a car, money to have lessons, help with uni, etc. He has now met a lady, has a mortgage, a new daughter, a new ‘wife’. They are very demanding, he even pays for their friends to go on holiday with them!
The needs of his daughter have gone, as a disabled person she has achieved a lot. He Bragg’s about her but he didn’t help one jot. She sees him, the whole time I get text about what he and her are doing.! The last text text says, “ he has bought her a car, a mini, that was for me wasn’t it”? Yes, in 2017 that’s what he promised and help with everything else, now the door is shut. He is so desperate for company in his life, What do I do? Not my business.......but my daughter is so defeated?

I've not seen my daughter for over 3 months with my ex saying "my daughter doesn't want to see me and she wasn't going to make her see me. She's 14 and I put it down to a phase but now after 3 months we are meant to go on holiday in 3 days and my ex says my daughter doesn't want to go. We haven't had a argument or any kind of issue between us. I've put in for a court order but i'm deemed as un urgent. Is there anything that I can do as I know if we spent time together it'd put me and my daughter back on track.

Hi, Ok so my partner of 3 years has 3 children with his ex one now being a working adult and 2 who is 10 and 13. Me and my partner have 1 child and second due in 4 weeks. We will be going solicitor because she wants to much for nothing. The 2 children in question, have always stayed with us 2-3 nights a week that's because they or we ask them if theyd like too. They came here every day after school anf was being picked up by her once she finished work, I would collect the youngest one from school every day and oldest would get a bus here. This is their home too so would eat any food rink any drink play in their rooms on xbox etc. We pay for the boys uniforms and eldest bus pass and of course clothes that stay here and anything they want within reason. My partner was with her for 18 years, they split because he found out she was going behind his back with several men for several years, me and him got together pretty quickly after they split and all I had was abuse and threats etc, well they had a mortgage together she wasn't working nor paying for the mortgage/bills only until they split well he was paying it all for couple months when we was together and stopped. She believes he is not entitled to the house or any monies from the house, she believes its her right to keep the house and he gets nothing from it basically, she even had the nerve to say because his mum and dad also his nan and grandad have houses worth £500k that he doesn't deserve the house he originally paid for because she wont get anything from her parents/family when they die! Well me and her had a row about something she said about my children and few other things now because of that she has stopped us seeing them now only once in the week and every other weekend. But since doing this, she has contacted cms said we have the boys less 1 night a week and their is no other children involved etc. She has threatened in the past to take him through cms but believe she used the calculator and see that what we was paying for was correct & even my partner rang and asked the question and they said yes keep paying what you pay. She has always wanted Dans money and now has stopped us seeing the children and told cms and now they want more money. We have asked several times were have them 50/50 but she has always said no and I so many words said she wants the money as she has bills to pay. When they was together she got him in debt by claiming benefits, credit cards and various other things which he is still paying back now. She is also pregnant with her new fella who has 12 other children to which he doesn't see or pay for and has social services involved, she rang us to say they may want to speak to us about the boys and for us to tell them her boyfriend is fine and basically lie about him, we don't know much about their relationship but have been told by other people who know him and women who have children with him that he's basically scum, he is living their and If im right my pa

Hi i have 2 children to an unamarried woman. She has said i cannot have members of my family around thec2 children. I have been seeing the children on her terms which change when see feels like. She has written her own agreements in which i have no say. I am now sick to death of her and her tantrums. Only today she said to the children in front of me who are 1 and 2 say goodbye to your dad as you will not see him anymore. I have no option but to go to court. Can you help

Hi i was wondering if any one can guide me in the right direction the mother of my children has being using my children as weapons for a while now only allowing me to see them on her terms with no regular contact, I am not allowed to call them unless she decides I can I have had verbal abuse also family members of here have broken into my property with intent to harm me over her silly behaviour. I am currently unemployed as I suffer with ptsd and had a brake down because of stress. I am having to move home as I feel unsafe and receive regular threats I am not sure it I can get help with legal aid or how to afford the cost but I really need something in place so I can see my children if any one can offer advice please do.

Yes, you can apply at any time to see your children, You would also have to apply for a C4 form which is an application for an order for disclosure of a child’s whereabouts. This means the courts can put a trace on your children to allow you to bring the matter to court to apply for access. Or you may wish to use a PI (which may be quicker). As in all cases, the court’s main concern is the welfare of the children in question. The court will always put the children’s best interests first and this main issue will determine the outcome of any application for an order.

Hi i hava a daughter whos 7 now i was seperated from me ex due to she cheated on me, so my daughter hasnt seen me for 2 years and my head was everywhere with what happened i feel the need i shoukd be in her life but the ex is being complicated and wont let me see her unless it goes through proper channels and i dont want that.. what can i do? My husband has always seen his 7yo son and paid for him , at the start of the year he broke his hand and has been off work only getting £89 a week , he spoke to his x and they agreed when he went back to work he would pay what he owed, now 8 weeks on because he refuses to pay what he owes in 1-2 lumps sums she has stopped him from seeing him till it’s all paid , we just don’t have the money I have 2 children of my own to support , it’s gonna take weeks to pay off as I only work part time as my son is disabled, she doesn’t care what she tells her son she is actually blaming his dad , he has never refused to pay and I will make sure everything is payed what is owed , my question is what’s the best way to stop her from stopping him from seeing him again when she feels like it , he is on the birth certificate they was not married but when they split they had a verbal agreement and that’s all ,

I had a phone call off my ex partner saying social services have been in contact with her as they have had 2 allegations from someone that im a frequent drug user? (Which im not) and social services have advised my ex not to let me see my daughter? What happens next? How do i get to see my daughter again? And what will social services say/do about these allegations?

Hi I was a full time dad to my 2 yo son and 2 step children after a disagreement about sorting the boy's bedroom I was locked out of the house and told that she thinks we need a break, were do I stand about getting access or 50/50 custody, surely she don't have the right to just lock me out and not talking to arrange contact. It can't be right from being the person raising the child from day 1 to this. Please help. Thank you

I need help! I want to see my 4 year old daughter but my ex wont let me! Been apart for over a year and ive met someone else, shes now 12 and half weeks pregnant and now my ex wont let me see my daughter unless i get a dna test on my unborn child! Or if i sign a agreement saying i wont ever let my daughter near my unborn child or tell her about her ?!

I am sorry to hear of your circumstances. However, could you please refrain from posting lots of posts to this site as many of them don't make sense. I have had to delete several today alone. In your circumstances, if you cannot let go of the separation and you are finding life difficult being without your kids, I suggest you go to visit your GP who will be able to offer some counselling so you can talk through your problems. Likewise, you may wish to seek help from the likes of Families Need Fathers or another group that can help support you through these difficult times. By bombarding this page with your comments, you are taking up space and stopping others who may wish to also ask some valid questions.

Hello ,my name is Cecil Thompson.when I (young )I had a family 2plus kiddies dog living the dream .well it was my x dream not mine .i longed for excitement dreamed of money and wanted it so bad I was prepared to sell my soul( literally).well the money came quick and fast but with the money came lies and I mean life changing lies and all the people who new me don’t no me anymore they say it’s the drugs it’s mental disorder it’s because he lost the love of his life and kids .but know one understands or ever will .i have new friends and family now and that’s the way it is and I can’t change that I tried big mistake I am owned I am (committed to my new life .)i guess My child from my first wife will grow to learn the truth about me in time and she will hate me forever be ashamed to have a biofather like me .all I can say is sorry and that I did (love you ).and if you went through any pain with my absence and have harbouring hate for me .rest a sure I will a (lonely sad death) with not a single soul at my funeral .i told my x to live (sleeping dogs lie)don’t go digging for bones because you won’t like what you find.wink wink.

My ex's mum has said social services have said I ain't aloud see my girls but i haven't had anything in writing or been told or contacted in anyway so is she lying my youngest girl isn't biologicly mine and uses this as a weapon against me but in her eyes i am her daddy and in mine she is my daughter

If you cannot get in touch with yoru ex because you do not know where she is living, then you can fill in a C100 contact order and a C4 form (which is an application to disclose the whereabouts of a child). This will allow the courts to put a trace on your child, to allow you to bring the matter to court and apply for access. There are tracing agencies that can also try to find where your child is, but this will cost. The former suggestion is more official as bringing the matter to court will make access compulsary (within the terms of the court order) if you are awarded it.

Hi, just some help or advise really needed.
So me and my girlfriend have recently split up say a few weeks now. She has my 3yr old daughter that she is giving me real limited access too? The reason I am looking for advise on the situation is I have a 10yr old girl too from a previous relationship and she obviously loves her sister and they are both crazy for each other. I have my eldest daughter every other weekend where she will stay with me from Friday to Monday morning when I take her to school. But the only access my ex is giving us is a couple of hours on a sat morning. And it’s at her home witch happens to be the flat that I am still paying for while I am sleeping In my parents spare room with my 10year old. I am trying to get access and I am constantly asking how she is and when we can see her and she purposefully does not reply. I understand she is hurting and upset with me because I left her. But I think she is damaging the relationship between the two girls and between me as well. I just really don’t know what to do with any of it at the moment? I want to go mental at the woman but obviously I have kept calm and not used bad language or anything towards her. To that though she has been the reverse calling me dumb and a f*##ing sh*t dad. I really need help as to what I can do to get this woman to realise she is damaging two sisters relationship.

You may be able to apply through the courts. If you have had a consistent relationship with your non-biological child, the courts can order the relationship continues, especially if your have access to your biological child also. You may wish to seek legal advice.

Here we go.... if been seperated with my ex for 2 years. Everything was ok until she got a new man. She wouldnt tell me where my kids were going to school and was being an arse. She the said she wants half of the uniform money which i declined until i know where they are going to school. Faur enough i thought. Next thing, csa letter through the door. Divorced 12 years and still no sign of letting up.
At 11 she refused to see or speak to me.
I call every day. He has messages go directly to his cell. If I go there he threatens police and causes a scene. I'm blocked from all his phones.

Unless your ex agrees to mediation to sort out your financial issues, then your only recourse is family arbitration or court. Family arbitration is a method of dispute resolution in which a third party makes a decision about your finances when your relationship has ended. You may wish to consider arbitration if you have been unable to come to a mutual decision through discussions with your ex or through collaborative law, mediation or negotiations between lawyers. Similar to a judge in court, a family arbitrator ensures relevant facts and pieces of evidence are collected in order to make a decision based on this evidence. The arbitrator will also consider your views on what the outcome should be, as well as those of your ex. The arbitrator’s final decision is a binding ruling. The comment was about how if 'both' of you bury your head in the sand by avoiding trying to sort such issues, this is where such issues can spiral out of control. The comment was not aimed at your personally - but as general advice for you to seek some professional guidance regarding how you can try to get the matter under control, especially if you think your ex is taking advantage of the situation.

Just one further point you have also failed to see that the reason wife my former spouse unlawfully evicted me from my own home was so that she could become the "receiving parent" and I would be the "paying parent" i don't know how you could not see the link. That is why I would never pay a penny in relation to this matter as i have always paid for my children's wants and needs and for you to say that she is correct to apply for the order is tantamount to agreeing with some women of who exploit the CMS for their own ends as a means of extortion. The CMS hate fathers period and the sooner it is exposed the better, the CMS is not about the child or the children it's solely about money billions of it.

Thank you for your advice on the above, whilst I appreciate your comments i should have said that it is not me that has been harassing her it's the other way round. Also I had forgotten to say that she did not need to contact the Child Maintenance Service as she receives over £1000.00 per month of rental income from a property which I should be receiving half of that sum namely £500.00 therefore being as she has kept my share for herself she should have spent the matter on my child, therefore I am perfectly justified to state that she should never have contacted the CMS unless it's a matter of revenge and no I have never buried my head in the sand, try understanding a dramatic change of live which has been foisted upon you suddenly then you'd have been more understanding with your comment. I have tried for the last 13 years with my kids my ex wife didn't take the split all that well,and she surely poisend there little minds me and my daughter has a baby of her own now I asked my daughter through Facebook and she said you chose drink over them I drank on a Saturday at home I was working 70/80 hours a week to give my kids what they wanted nice house and so on my wife was always accusing me of cheating all the time which wasn't true I woke one Sunday with her roaring and shouting at the kids again I got up out if bed an started to pack after texting my boss as he was renting flats so I took one went down the stairs while she was still roaring she saw the case and she said what do you think your doing I turned and said I have had enough of your arrogant manner so I'm leaving both kids were crying saying dad don't go I said I love yous so much my daughter begged me I want to come with you are mother said let him go he will be back I cuddle both kids and I will love you for ever I can't go on with writing any thing else folk as would you turn the clocks back with a different women and still have cracking kids

My fiancé lost contact with his son when he was 2 months old do to not qualifying for legal aid and his ex taking his son away. His son is now 8 and we have just had a son and believe he has the right to know his brother. Both the boys do. Is there anything we can do?

If your father is stopping access of your brother, your mother would have to apply to attend mediation to try to resolve the issue. Or, if he refuses to attend mediation, apply take the matter to court to gain access of your brother via a court order.

You can set up a guardianship order in your will. A guardian is an individual who is charged with the responsibility of looking after your child/children in the event of your death. Any adult of your choosing can be a guardian to your child/children. This can be a close family friend with whom the child/children already have a bond with, or a family member not already directly involved in their care, such as parents or an aunt or uncle. It is important to take into account beforehand the relationship the child/children has with the person or persons you intend to appoint as their guardian. should any unforeseen circumstances occur - it is obviously important to inform the person/s you wish to be guardian/s. It is something that requires a lot of contemplation and discussion before a decision is reached. If you do wish to appoint guardians then your last will and testament should reflect this. You must include, in as much detail as you can, the reasons why you wish your designated guardian/s to take on the role of caring for your children. It is important to ensure that you clarify your reasons for making this choice so that there can be no confusion over your mental and emotional state at the time of making the will. You must also ensure that once the last will and testament has been drafted or redrafted depending on the circumstances that the person or persons you have chosen to be your children’s legal guardian/s do not sign the will as a witness. This is what is known as a ‘conflict of interest’ and as such can lead to the will being contested. You should be aware that if a will with details of guardianship is contested then Social Services are legally obliged to step in and either; (a) make a recommendation for guardianship themselves or (b) remove your children into foster care until such times as the conditions of the will have been clarified. If you are in any doubt as to how to go about making these provisions in your will you should speak to a solicitor who specialises in family law and they will be able to give you all the help and advice you need. With regards to your ex, if he has parental responsibility he will also have a say in your children's upbringing. What rights does my partner have to see my children if I was to pass away?

Recently, I have found out I have high blood pressure and a few other health issues. Nothing major, but enough to get the conversation going of 'what would happen to the kids if I passed away?"

Their dad has them 2 nights and 3 days a week, but we are about to have talks to reduce and change this as his severe physical disability-muscular dystrophy-and mental health issues (psychosis and personality disorders) and the side effects of the medications for those are making it likely that he will be more and more unable to care for the boys in the years to come, and it is likely he will pass away early, too.

My partner has been in our lives and lived with us for the past 5 years, and we are a family of our own. The kids have a different but important relationship to the ones they have with me or their dad with him. Mix of uncle, big brother, and teacher. While I'm here, he is a step parent that has stepped up. If their dad were to pass away, or become too ill to see them one on one, just for short visits etc, then my partner is there to fill in that role of support that they will need. He'll never be dad, but he is a big someone looking out for them.

If I were to pass away, they could not safely live with their dad now, let alone in the future. My family would step up and take my boys in to live with them. As it is a real reality, my mum has purposefully bought herself a house the boys can live in if they needed to.

I would want them to keep the relationship with their dad if I were not to be here. If my family were to object - grief does do funny things to people, and discrimination against mental and physical health is not uncommon in the world - he can at least pursue a legal challenge to continue access as their dad. It might be accompanied access or something rubbish, but he'd still have them in his life.

I was wondering though, would my partner have any right whatsoever to see them again? He is a big part of their lives, and they are a big part of his. If I were to pass away, would he lose his whole family? Would they lose him?

we ended the call. Her mother then calls me saying i had told her partner "a pack of lies" i told her it was the truth but she is just as irrational as her daughter. They were both very abusive to me on the phone. I do not know what my ex has said to them but they have informed me that upon advice from social services, they have been instructed not to let the children stay at my house, and that i can only see the kids at their house with their supervision??? i have contacted social services only to be told that they can't give me any information other than to seek legal advice for access to my kids. I don't know what to do with my ex, i live in constant fear of her and its making my life unbearable? What dod i do? i just want to be there for my kids.

Me and my ex have broken up to her being a junkie.did I know .no was I aware no .I was always told it was the vallium the doctor perscribed that was causing her to be unstable .falling asleep in her food etc.I made a complaint to social services so I could seek advice .eventually they intervened and started proceeding for help .that was 3 yrs ago .nothing changed as they are clueless to what really goes on my eyes have been opened to all the tricks they pull.even urine samples. Which she got from her son and her daughter. .January 2017 mother was taken to hospital after drug overdose.they asked were the father was she told them she had no idea. But yet i was only 10 doors away on the same street !hey the social services believe everything she says to them .and yet i have no record of theft drugs violence .nothing but yet she has a huge history of all .and she has contact still with my son. She recently went to court again for shoplifting using my son in his pram to do her dirty deeds .so she could buy more smack .were do I stand .well let me tell .I stand on the sidelines hoping and praying that nothing happens to my son .while these so called teams of experts .carry on in this pity full game of there's to get paid every month.

Hi, i need any help that anyone can give, I have 3 children with my ex wife, boys aged 17, 13 and 8. we share joint custody and I pay on time every week maintenance into her bank account. MY ex wife considers the 8 year old boy to still be the baby, she constantly calls him this and I feel she also mollycoddles him. Myself and my wife bought bikes for the 2 youngest and my stepson who's 14 for Christmas, we let my stepson and 13 year old son go where they wish on their bikes, however we let my 8 year old, under our supervision, ride his bike along a cycle path to the sea front near our house. After a few occasions where he knew we were watching him, he asked to go out on his own along the route that he had taken, we allowed him to and told him that we would trust him to go on his own, what he didn't know was that we would be keeping a eye on him out of his sight so that he thought he was alone, yet all the time we could see him. it was 1pm, he had on a helmet on, a bright jacket and his bike had lights on, we watched him across the one road he would have to cross to get to the cycle path. This cycle path is not anywhere near any roads. after dropping the boys back to their mum, she has refused to allow the 8 year old to come near me as she feels that I have put his safety at risk by allowing him to go out on his mountain bike, yet she is allowing my 13 year old to come over as normal, when I picked them up on Friday, she locked her front door and would not let me even speak to my 8 year old and this evening when I dropped my 13 year back, she again refused me access to my 8 year son. What I need to know is does she have any legal right to stop access when I have not done anything wrong, I have joint custody, have never missed any child maintenance payments and also have never missed any of my weekends that I am due to have the children.

Firstly, child maintenance and whether your fiancè can see his child are not connected (meaning his ex cannot use the fact your partner is not paying child maintenance to stop access). If this is the case, your fiancè can apply for a C100 contact order through the courts. With regards to whether your fiancè should be paying child maintenance; if he was paying child maintenance through Child Maintenance Services, then the answer would be no, as child maintenance is based upon the non-resident parent's earnings and if he is no longer earning, then he would be seen as exempt. However, if he has a family-based arrangement then it would be up to your fiancè and his ex to decide between them. When your fiancè was earning and if he paid through the CMS, then your second child would be taken into consideration and payments adjusted accordingly. The best way to see what your fiancè should be paying (or should be paying if he was earning) is via the CMS calculator here. I hope this helps.

Advise needed please. We have a constant battle with my fiancè ex girlfriend. They have a son together and we see him 1 to 2 nights a week. When she allows us. He pays his maintenance every week. However he recently became redundant and therefore didn have the income to pay his maintenance let alone bills. She is saying he needs to back date it but how can he when he wasnt earning an income. We ourselves have 2 children and have been on the Gov website which states now our second child is here her maintenance will go down. Is this correct? They made a maintenance agreement between themselves and he has never broken it only when he wasnt working and paid her £1 a week to keep her bank details for when he was working again. She is abusive and a nasty person in general. She stops us seeing him all the time more so when my fiancè is ou of work because she doesnt get money. Do we have any rights to have him stay with us longer periods of time as my fiance is on the birth certificate?

You would have to apply to the courts for a C100 contact order, If you cannot trace your children, you can also fill in a C4 form which is an application for an order for disclosure of a child's whereabouts and the courts will put a trace on your children, so you can apply for access.

My partner has 2 girls from his relationship prior to me, she hates me as blames me for relationship breakdown even though it was over before we got together, my partner initially could see his kids whenever he wanted, now she us stopping him unless he ends it with me or very least I am kept away from his kids, which will be difficult soon as moving in together as he currently stays with his mum and dad, I am good person, good job with a child of my own, she is also harassing me at work and spreading gossip about me around the town I work in which is where she stays, my partner is withholding the £100 plus he normally gives her per month and putting aside until he gets to see his kids again.
Any advice on how we go forward would be great?

I'm afraid a court will take the opinion of an 11-year-old on board if his daughter says she does not wish to see your husband. Also, child access and child maintenance have no bearing on each other, meaning your husband may not have access but he is still legally responsible for supporting his child until she finishes education.

Hi, I'm looking for a little advice please. My husband has an 11 year old daughter from a previous relationship who he has not seen or spoke to for almost 3 years. Due to financial difficulties (his daughter living a distance away) he was only able to see his daughter approx 10 times during 2012-2013. Previous to this, following their split when the child was 1, he had contact with his daughter every other weekend. At this time he was financially stable with a car. In early 2014 he got a car and tried to make arrangements to have regular contact with his daughter. Unfortunately he was advised his daughter doesnt want to see him and refused to speak to him on the phone. We tried mediation in October 2014 but this was unsuccessful as his daughter did not want to attend. Almost 3 years since he last spoke to her she is still adamant she doesn't want him, our 6 year old son or any of his family in her life. His ex partner always made contact as difficult as she could, especially as she would refuse to bring their daughter to her father (even offering to pay fuel) or bring her to our house on the train. Obviously their relationship was deteriorating and he hoped this would all change when he had transport. She doesn't respond to emails or letters and he isn't allowed any photos of her. She makes sure she still takes £180 a month in maintenance though! Please please can anyone help. If we take her to court will they deny his access if his daughter says she doesn't want to see him?

If you are based in the UK, then if the agreement was made through mediation, then you would have to suggest mediation again, or apply through the courts for extra access to your daughter. However, this can be emotionally stressful and might possibly upset the current arrangement, until the matter was decided in court. If your original access arrangement was decided through a court order, you would have to give specific reasons in order to take the matter back to court to apply for a variation. If this is a route you may wish to pursue, I suggest you seek legal advice. Once your daughter reaches the age of 11, her own opinion will be considered more seriously, if the matter goes to court. However, the access you have currently is considered the 'norm' - so court may be too extreme a leap, especially as it could backfire. If you are based outside the UK, then family law is different in each country and we only have knowledge of UK-based family law. I'm afraid, I haven't really given you much of an answer, but there isn't really one - as although you feel the access isn't enough, it is not as though your ex is denying you reasonable contact. Therefore, you would have to weigh up whether it is worth the possible emotional upset, yourself.

I am sorry to hear this. However, we can give you no real answer as every person reacts and responds to situations differently. While I can understand your frustration, it may be that he is sitting back and waiting until you calm down a little as if he approaches you he doesn't know which side of your personality he may get. Bombarding him with messages is never a good idea, and neither is game-playing and strategising in order to affect a response. Being honest, open and rational and trying not to accuse, blame or blackmail is the best approach. Some time out for both of you will help you realise what it is you really want. You could suggest a weekly/fortnightly meeting where you both try and sort out the practical side, plus access to the children. This may help and in turn you may both slowly begin to talk about yourselves and the effects of the separation. In between that communication should be limited/or non-existant to allow you both time to reflect and think. I hope this helps.

Hi all I'd love some advice please. I'm currently fighting with my ex to get him to actually see our children. He broke up with me 4 months ago completely out of the blue, I've been through all the motions, crying frantic texts begging pleading etc. He still hasn't seen out children every time I ask there is some different excuse, got plans work ect. He thinks it's perfectly acceptable to send 1 message a week to ask how they are (he lives 5mins away) I sometimes may go a little crazy when he sends these messages but seriously who can blame me, I had this perfect life with my partner and 3 children then boom he's gone. I'm certain there is no one else involved. He does have some health worried which he is getting treatment for. Please help I don't know what to do. I would love to resolve this whole situation with him and be a family again because despite all he has put me and my kids through I love him. Half of the time he ignores the messages I send to him. Do I start treating him the same and ignor him and let him really see what he's missing, what's he's likely to loose? I know that may come across as childish but I'm honestly at my wits end. I've tried been nice, been mean I've even told him to bog off and he can't see the kids to which he responded that he wants to see the kids and will start seeing them, that's was 3 weeks ago and he's still not seen them or made any arrangements to see them. Would love a fathers advice on this one.

Did you ever have to sit and watch the father of your child threaten directly to your child they would never see their mother again? Did you have to be homeless due to father sitting in your house refusing to move out because he needed it "in the best interests of the child" despite him never paying a single penny towards it. These are the minor points too....I'm nine years down the line faced daily nightmares on all of this. Have you ever considered why should a mother have to go thru an expensive slow process thru court to "see" and "have contact" with their own child. No you haven't. I have been separated from my wife now for only a couple of months. I have been battling with depression and thoughts of self harming as I never wanted the separation. My wife feels we have 'grown apart.' She is now saying that I'm only aloud to see our four girls for an hour every other week. I want more than that and feel not only do I need more than that in order to 'sort my head out' as my wife puts it, but they too need to be seeing their dad more often. is she able to limit me seeing my girls to only an hour every two weeks?

However, if your feelings have developed into chronic depression then you really need to seek help. I suggest speaking to your GP, and/or any helpline you may feel is applicable to you personally. With regards to your daughter, you can apply for access, but it seems you may need to help galvanise your emotional and physical self in order to begin to fight for your rights to see your child.

Hi mediation have just got back to me and my ex has refused mediation, but now they have told me I've got to pay £65 for them to sign a page of v100 form then I have to pay £215 for the rest of the form and I'm not entitled to legal aid even tho I'm on jsa now
Is that right because I thought I could self litigate so would I still have to pay for the court order any help would be appreciated.

Hi I could really do with some help/advice if anyone can help, completely out the blue one morning my ex told me she has been seeing another man and I've got to go, we have a four year old daughter together with special needs so as much as it hurt I told my ex if that's what she wants I'll go but I want days and times of when I can see daughter first she told me it's already been arranged through our family support worker, it was so out the blue everything seemed fine between us so I was in shock the doctor told me after, also told I had to leave without any belongings it had all been arranged, so I left when it sunk in what had happened I managed to track down family support worker she didn't know what I was talking about so I tried to phone my ex no answer tried texting numerous times no reply so I asked some of our mutual friends to try and find out what's happening she answered to them and said she can never see me again because she loves me so much? and if I want to see my daughter I've got to take her to court, i signed up for mediation but she's not replying and the mediator has said they have to wait three weeks at least for a reply, but I already haven't seen her for two weeks I've missed her forth birthday because she wouldn't let me it's really hard for me and I know it must be really hard for my daughter because I've been her sole carer because my ex partner has really bad epilepsy and can't look after herself has to have a carer, since the day my daughter was I've done everything for her all night-time feeds, medication everything, in all the messages I've sent her I've made it clear I just want to see my daughter nothing else but still no reply, yesterday two weeks after she txt my cousin and said I can go down to get my stuff and when we got their my shed had been broke into and also tried to break into my safe entered my car without my permission and filled it up with most of my stuff, and through the rest of my stuff out the back garden then when I started taking it txt and said I want you and crap out of my garden in a hour an half make sure you get it all your never coming back here again and Im throwing away what's left, I couldn't take it all I've only got my car to move stuff in and lived their for six years so had alot of stuff and couldn't take it all in a hour an half a lot of my stuff is still their even logbooks to my vehicles which I'm not aloud to go back and get. Is their anything I can do to see my daughter quicker it's heartbreaking I don't even know if she's ok and anything I can do about my stuff.
Any help would be very appreciated.

I don't know what to do,ive searched the internet,looked in phone books, my ex just took my son , to make a long story short, I didn't know that I had a son until he was 10 years old, ex took me to court for child support and she won , I pay my child support ,but after the court hearing she took him and disappeared, I've been trying to find her but, it seems like they've just vanished right after the court hearing, he's about 22 years old now , I don't know what to do,

I could do with some advice/support. I am in the process of divorcing my wife. First part completed and awaiting settlement of financials. We have two children aged 10 and 7. I moved out and still pay the mortgage (£1,900 per month) to ensure the children are comfortable and they have stability. This will need to be addressed in order for me and my ex to move on and we had agreed to sell and split equity (split being decided as part of the divorce). I am staying with family and have had an on going understanding that I have kids every other weekend Saturday morning to Sunday evening. Due to space and reliance on other I am unable to offer more overnight stays. I had previously also seen them for a couple of hours twice during the week. My ex has cancelled that citing I can only see them if I pick them up from school and with my working hours that is not possible. She works part time as she wanted to do this. She has now stopped me seeing them at all and taken the kids phone off them so I am not even able to talk to them. She is happy for me to take them away for holidays throughout the year and we have always been so close and I am a very hands on father. It suits her when I take them away but that is now in doubt. I am in turmoil and want to get my own place (with equity from home)
in order to see them on a properly agreed basis. In the interim, what can/should I do?

I understand she will get a new bloke and to be frank i don't care I'm just worried the children would get confused.. You would need to seek legal advice about applying for a child arrangement order which will determine who your children should live with. As you have been more of less the primary carer and have stayed in the family home, plus you have full-time care of your daughter, then you stand a good chance of being awarded residency of both your children through the courts. The courts will always decide on what is in your children's best interests and stability and consistency is of the upmost importance.

Me and my ex-wife split in September 2012 we decided to share kids 50/50 in which I've never missed a day in 3 1/2 years, I stayed in the family home whilst she rented, she's had various other partners and having a child with one but quit her job which led her into money difficulties eventually going into bankruptcy and then evicted from her rented accommodation and now lives with her mum n dad, me on the other hand has kept the family home afloat paid all bills and mortgage.
My ex and our daughter (12)have allways clashed resulting her living with me more or less full time also I was awarded both child benefits and tax credits as both were spending more and more time with me but the last couple of weeks my ex has been trying to convince our son (8) to live with her and now is saying that I can't have him on his days. Today (01.06.16) is supposed to be my day of having him until Monday this has kept me up all night and is breaking my heart. PLEASE could you give me some advice of who to contact before this gets out of hand. Thank you

I advise in the first instance to pay to seek some legal advice and arrange for a letter to be sent out saying that if your ex does not resume access or consider Mediation to sort the issue out then you will take the matter to court. After that you can either choose to pay to have a solicitor represent you, or you can self-litigate, Many parents are taking this approach and having a good amount of success if they prepare their cases well and it will save on hefty legal fees. Reading and researching your rights will help you and our Separated Dads forum and Facebook page may help with further advice from dads who have been through similar situations before. I split from My ex girlfriend in December (6months ago) and since then I have had my child every Friday Saturday and Sunday during the day because she works these days and overnight 1 night every 3 weeks. However recently she has decided that I am not allowed to see my son atall. I have tried to contact her via phone calls texts etc but she will not answer. I went to her door in a bid to try and sort things out but her mother answered the door and pushed me away started shouting and swearing at me telling me to leave but refusing to let me see my son or to speak to my ex. This has been going on for weeks now and I'm still no closer to seeing my son. I work 12 hour night shifts and look forward to seeing my son at weekends, I hardly ever see friends and very rarely go out at weekends because I spend all my time with my son. But because of my ex's dislike of me getting on with my life and refusing to get back with her she has refused to let me see or look after my son. I don't know where to go from here. I have a good job but don't want to push myself further into debt by lengthily lawyers meetings and court proceedings. But if that is the only way I will be able to see my son again then of course I will do it. Any advice would be great thanks

If your boyfriend has parental responsibility then his ex should ask for his consent to move away. If he can't track the children, he can apply for access through the courts and at the same time apply via a C4 form which is an application for an order for disclosure of a child's whereabouts. This will allow the courts to serve the papers on your boyfriend's ex. I hope this helps.

If your ex is denying you access and using your children as weapons, bribes or tools then there comes a point when you may have to consider taking the matter to court in order to apply for an arrangement that your ex will have to stick to. My boyfriend is still married because we don't have the funds to get the divorce at the moment. We've been together almost 2 years, and his babies mother has only let him see him about 4 times in that time spans. We had tried doing things without the court and was giving her money every week and got the kids one weekend and then and stopped. At this point, she was putting child support on him (which is fine) but missed both appointments they had. Now she is not responding to any of or messages and calls. The last time we saw the kids we had to track her and the kids down at her boyfriends house and she said she was moving but wouldn't say where, not even a city. It's worrying both me and my boyfriend because all we want is to see the kids. I want to know if she can get in trouble since they are still legally married. Any advice on what to do or how to find her?

Why is if a man chooses not to it makes no effort to see their children they are brandished a bad father. As a woman this really annoys me. We talk about equality between men and women but attitudes towards absent parents are always directed towards the men: I am now a proud step mum to an amazing 15 year old young lady and like me when I was her age she has lived with his father just as I did. The behaviour of her mother mirrored my own mother who basically walked away and only sees her when it suits her. In my case it was 30 years without seeing my Mum and over a year for my step daughter. She copes amazingly and me and my partner are probably more upset than she is. Her bological mother and society seem to make excuses for her behaviour such as a painful divorce and women not been able to accept the separation: I totally understand that and for both her and I and out mums that was a contributing factor to their behaviour. Man suffered the same emotions then he would be demonised. I believe society in applying equality need to apply the same principles to both men and women. My partner does an amazing job of bringing his daughter up and has always encouraged a relationship with his daughters mothe and know there are thousands of men out there who are the same but get treated unfairly. If your son has Parental Responsibility, then your son's ex should ask his consent to move the children from the area. If he does not wish them to leave he can apply for a Prohibited Steps Order through the courts. A Prohibited Steps Order (PSO) is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. We have all heard the stories of a parent taking their child for the weekend and not returning them or going abroad with them and it becoming extremely difficult for the other parent to get their child back. Thankfully, this is one of the scenarios that a PSO seeks to prevent. It does not mean the order will be granted in your son's favour if he applies through the court, but if he can prove to the courts the move is not in the best interests of his children (family ties, schools, established friendships etc) , then the courts do have the power to prevent his ex from making such a move.

Firstly I am a woman, writing this on behalf of my partner and would appreciate all the help I can get on this one. Its quite a long one so here goes...

My partners Ex wife is extremely difficult, long story short: she left him for another man, after a couple of months of them being separated I met my partner and we began seeing each other. She saw how happy we were and wanted that for herself, so she left the guy who she left him for and started trying to get back with my partner. Now because he hasn't gone back she has tried every trick in the book to hurt him.

She stopped him seeing the children because they had been introduced to me, so he went straight to a solicitor and got a court date for 3.5 months later. During that period he was only allowed to take the children out if she went with them etc everything had to have her involved. She would then tell him he could have the children over night or for tea and then just cancel at the last minute. It was an extremely difficult time for us all.

Court day - so it came to the big day and the solicitors ask you to meet an hour before the scheduled hearing to try and make some ground work beforehand. So they were back and forth for the hour and seemed to be making progress, they had agreed he could have them 1 night on the weekend and 2 evening after school (collect from school and return at 6:30), the agreement concerning me was after 3 months the children would be allowed to be introduced to me and I would be allowed around them.... so all this was agreed out of the court room, between the solicitors. It started off fine, drop off and pick ups went smoothly, stuck to days and times etc. Then she started asking if he could keep them later on the evenings and longer on the stay over nights, sometimes extra nights. So on paper he is down to have the children 1 night per week (so she can claim more maintenance from him), when in actual fact he has had them for 2 nights and 3 evenings for the last 3/4 weeks.

So the 3 month period is almost up and she has really upped the ante. One minute she is saying that they are as much responsibility as hers (when she is wanting him to have them more nights, extra time etc) but then will arrange for the children to be going to friends houses for tea on the days he has planned to have them. She is still dictating when he can and cant have them even though this court order states days and times. Also its getting nearer to the time I am allowed to be introduced to the children, and she is now trying to dictate when I am allowed to be there and what we can do with them. I am the constant topic of conversation.

Please bear in mind that this woman has bad mouthed me since day 1 to these children, all lies, telling them things that children should not hear and know about. We are going to have problems with the eldest all from what her mother has said to her. She has tried turning them against their dad too, again more lies and actions of an extre

Unfortunately, unless you agree between you and your ex, you can't dictate to her over what she spends the money on as the money could be attributed to taking care of your son's day-to-day needs for such things like heating and water etc. Unless your ex will agree to Mediation, then your only other option is to take the matter of access to court.

My dilemma is this. i give my son's mother money to see my son and she just uses it for herself. I buy him clothes, shoes, whatever he needs, and she gives them to her other son. She has even told me that since her other son's father is not in his life then I can't see my son. I am now in a new relationship about to get married and my fiance is doing everything in her power to help me get to my son but his mother is bitter about the hand that has been dealt in her life. She is almost 15 years older than me, doesn't work, and keeps threatening me with child support because I am marrying someone else. I don't know what else to do. I also believe that has has a drug problem but I don't want to get DFACS involved. What can I do??

He's a great father but his ex refuses to let him see his kids or talk to them on the phone.she wants him to get therapy for what I have no clue.She said if he don't go he can't see his kids..she wants to make all the rules and have my brother as her puppet..he been to court and nothing was done ..can you please help cause my brother is sadden and deeply hurt .

I am sorry to hear this. Yes, firstly you should keep all records of what his ex has said about access and take the matter directly to court. If she should move again, your husband can apply through the court on a C4 form which is an application for an order for disclosure of a child's whereabouts, along with a child arrangement order and parental responsibility. If he cannot afford the legal fees your husband can self-litigate, many parents are having good results in this way, even in what seems like the most difficult of cases, and here. He may also be able to get help with paying for the court forms, if he is on a low income. I hope this helps.

Unfortunately, there is little I can advise here apart from applying through the courts. However, if you are eligible to pay child support, then you will accrue arrears if you don't. As fathers have to support children they may not see, then likewise mothers also have to pay child support towards the upkeep of their child, if they are not the resident-parent. If you took your son from his father and took him out of the country, then yes, this would be classed as abduction. This is not any slight on you not being English, but because you are taking the child out of the country without consent from the father (who I assume has parental responsibility). I am sorry to hear your relationship with the father has deteriorated to this extent and you cannot get to see your child, but your only option is to apply through the courts, at least for specified contact to see your son.

So this is a bit of a different situation. In my case I'm the mother and my ex won't let me see my child. In the begging it was fine we continued friends and as I worked and he didn't we agreed that he would stay with our child and I could see him as much as I wanted. I even slept over on my days off and we were fine. He asked me to go on holiday to my country for the whole summer with our child and I said of course that it would be good for them and I handed him the keys of my house. We had furnished it together with money his mother had gave us once cuz it needed new stuff and we agreed I would pay off that and my phone slowly over the years. Everything was good and we had an awesome relationship as friends. So he went to my country and I would call once a week to see how they were doing and we would also exchange messages by Facebook. Then around the end of the summer in September he stopped answering my calls. After much insisting he finally answered only to tell me to stop bothering him and called horrible stuff. I didn't understand what was going on and from then on it wasn't able to talk or see my son again. I went back to my country in holidays and the whole house was completely wrecked. He pooed and peed in the bed! Of course I stopped sending him money as soon as I realised I wasn't going to be able to see my son. My ex doesn't even let my older daughter see her little brother and she is devastated. No one is able to help me. He is in lawyers to try and get me to pay child support but I refuse while I don't see my son. I haven't seen him for almost 3years now. Mediation won't work for me as he refuses and also I'm out of England now and even my ex being on benefits they say I still have to pay a ridiculous amount that I cannot afford. Everyone I have talked to say they can't do anything without court, but then they also say if I get my hands on my son I'll be arrested for kidnapping. This is ridiculous since then I can also accuse my ex of kidnapping but they said it doesn't work like that. Is it because I'm not English and he is? This is absurd myou daughter missed her brother and she also has the right to see him but my ex also refuses that. He also refuses to work even tho our son is 5 years old and on school, instead he lives off benefits and is still trying to get 10%of my wages plus I don't know what. Is there anything realistic I can do? We have to go through European Court since I live inside EU but out of UK.

If you are not happy with the mediation progress, or arrangement, then you should consider taking the matter further. There are many fathers that decide that letting the court decide what access a parent should have is better than being continually controlled or held to ransom regarding their child/children. Whereas a Mediation agreement is not official and your ex can renege on the agreement at any point without recourse, if a court awards you regular access (although please keep in mind this is never guaranteed), then if your ex withdraws access, she will be in breach of the court order. I had a very brief relationship a little while ago which resulted in me having a son, who is now 23 months old. Just after split from my ex I was able to see my son as much as I wanted, a few months later I met a new partner who is very supportive and wants the best for me and my son. Since meeting her my ex had completely changed her tune, she now doesn't trust me, she tells me I have alcohol problems (not true) she says I have to be supervised by her everytime I see my son. Went to mediation and spent the suggested hour with her and my son, majority of the hour she spent verbally abusing me, then going back to mediation she said she is still not happy with me having a relationship with my son without her supervision and when I asked her how many more times until she felt comfortable she quoted "how long is a piece of string".. She says this is nothing to do with my new girlfriend but there's no other reason! I am unhappy to continue mediation when I just want a happy relationship with my son without her controlling our every move and accusing me of so many things I have never done. I Am currently thinking about court but I really need some advice on what I should do? Or what I legally can do.. Please help

If your ex is in breach of the Mediation agreement, then I suggest you take the matter to court in order to gain official access that your ex cannot legally breach. If you cannot afford legal fees, you can self-litigate, It may seem that your time with your daughter is very little currently, but hopefully if you pursue it and keep to agreements, then you may be awarded more as time progresses and your daughter grows up. The courts want fathers to have contact with their children and it will do all it can to help you maintain a relationship with your child. Many fathers are self-litigating and having a good amount of success. Our Separated Dads Facebook page may also give you some good advice, as many postings are similar to your own.

So basically my ex me left me 24hr after her and my daughter came home, I was told by my exs mother that she needed her family not me (been told her mother cried to my exs brother she had lost her daughter). After 2-3 months of being pushed away and my parents not being allowed to see my daughter I split with my ex but maintained seeing my daughter twice a week. I've been to mediation after being physically and verbally abused at my exs house and was told by the mediation I was only allowed 3 hrs access a week and was to be at my exs mums were I've been assaulted and threatend. The mediator also said that as soon as my exs has her own house I'm to see my daughter there with a friend present as her mother has on more that one occasion made life difficult when visiting my daughter. So here we are. She has her own place but I've only visited my daughter a handful of times in the last 6 months at her house. What can I do, I'm not allowed to take her out, I get told I cant see her at very short notice I.e 20mins before I'm ment to go over and I have no decent quality time with my daughter. I can't afford court and my exs has total control. What can I do to?

She wont let me see him at anytime and anywhere,, its keep unfair to me,,, she keep my son away from me,,,she so selfish....Now at present CSA post letter n I reveice n open letter read it,,,, I owe £829 ish to CSA,,,, I say NO WAY.....its not any my faultly I never walk away from them,, I didnt,,,,, She start plan and dump me and want me leave from house via letter her soiltor ,,,,,,, its blackmail against me.... I think CSA put mistake to me after I tell 100% truth....

You say the CAB has told you you have no rights, but you don't say why. If you have Parental Responsibility then you have rights. If you don't, you can apply for PR through the courts. Looks like not got leg too stand on not seen my 3 kids in 2yrs I use too see them every other week and I'd pick them up drop them off kids where always in dirty clothing and full of nits so after 4mths of putting up with it told my ex can she make sure she de-nits them has fresh clothing her word was you can't deal with it your not having them she stop me seeing them ask and ask her to let me see them she won't my mum and dad see them I don't go there when they are there as don't want to mess there contact up been told this week social services are involved by the school as my kids been turning up in dirty school clothes are full of nits am so worried about them iv try to phone social services they said there dealing with this matter but unfortunately can't tell me anything this hurt me so much as don't no what's going on in my kids life's so iv been too c.a.b they told me got no rights all said is all i do go solicitors but no legal aid so don't no what am going to do ?

I am sorry to hear this. You may be able to understand his reluctance to get into a relationship where this kind of pattern could repeat itself, should you both in the future decide to have any more children between you. There may be a multitude of reasons why he has psychologically pulled away and it is perhaps something you should try and talk with him about. Or you may just have to give him a bit of time to regain the trust. Many mothers use their children as weapons or tools and do not realise the impact that this has on a loving father. If he has been hurt by this in the past, it may make it difficult to get close to someone else while he is still affected by the repercussions. Helping him try to regain access to his own children may help bridge the void you feel has developed between you.

I think in situations such as this, it is best to keep well away and out of it and if any arrangements are to be made, they should be via a third party. I can only suggest that if she will not agree to mediation in order to sort the problem out, you partner should take it to court. My boyfriend and i have kids with different partners.Mother of his kids denies him access to see his kids.One day i had a fight with the father of my kids and i told my boyfriend about it then i said i wont allow the father of my kids to see the kids anymore.i spoke out of anger and did not mean that but he took it too serious and he was hurt because he is in that situation.He then pulled back of the relationship a bit,we do talk but things changed.it is no longer like before.he cant even call me love or baby anymore.he doesnt even tell me he loves me anymore but he says he loves me a lot .i really dont know how to tell him that i did not mean what i said.

God where do I start. I got with my partner 20 months ago, I have a son from a previous relationship and we have a daughter together. My partner ex has made my life hell. She stops him seeing his son and when she found out I was pregnant she put all over social media that she had slept with him behind my back. She has had her friends ringing his phone saying he's been sleeping with them and she rang his mum and said there was a man with a gun outside her house threatening to kidnap her son. They have been to court but she tries to twist everything, she accused him of being violent to her but the judge dismissed it because she had no proof, my partner has not got a violent bone in his body. Last year she got a new boyfriend and she seemed to settle down so I said to my partner we need to all act like adults and arrange to pick him up (because his mum was doing all the mediating) so she agreed and it went ok for a few weeks and then when I was eight and a half month pregnant, she started an argument and attacked me while I was pregnant. My partner was in the middle so she never managed to get to me but I couldn't believe it, to make things worse she rang the police and accused me of attacking her, I had to attend the police station while my 2 day old baby and give a statement. It got dropped because again she had no proof . She never does because she is a liar. Other things have happened since then, I even agreed to put it begind me and pick his son up again but she started again and now he's not seen his son for 5 weeks. It's destroying me. Can't understand how someone can be so twisted! Feel like I'm at breaking point ??

In my eyes it's parental alienation which is a form of child abuse. He is unable to comfort his children as she has poisoned them that much that he is unable to spend any time with them as they don't want to see him. All of this is out of the blue. This woman rang the dad of her kids at the weekend asking if he would go out looking for his daughter as it was 930 pm and she hadn't been seen since 8pm. All while she was in a pub consuming alcohol. This child has only just turned 11. If that's not wrong then I dunno what is.

I'm afraid a lot of people have the same issues as this, but it cannot be considered 'child abuse', it sounds more like one parent having a power-trip over the other. He really is best keeping his distance from his ex and continuing to re-assure his children that he has their best interests at heart. His best approach is to always keep neutral and calm when his ex plays these games, that way, she can't get the reaction it seems she is looking for.

Thanks for your advice. We have been together for a year and a half now and are getting married next year. His ex has poisoned my name in the area in which we live. She has taken him to CMS and continues to cause hassle for us. She at one point even took his name off the girls school records and doesn't inform him of xmas plays etc then goes to grounds with him when he hasn't turned up. He isn't psychic. He goes round every week to see his kids and he's greeted with the same answers with no reasons. She stands there saying she doesn't know what's going on when clearly she does. She phoned the kids dad asking him to help with their eldest daughters behaviour and he did. He was told she was grounded etc then he goes round the following day and there's a hot tub in their garden and the child is having friends over for a sleepover. She is buying her children. I take this as child abuse. Please help.

It's always a difficult situation, as it is very difficult to prove. You do not need a high price appointed person to be with you at court,infact its so simple it all happens for you in the room,grab the bull by the horns,send in the paper work and i gaurentee you wont look back,it will cost around £150 for ghe court to process the paper work and get back to you with a hearing date

Hi. My fiancé split from his ex partner a year and a half ago and they have three girls together. His ex partner has caused nothing but trouble for him resulting in him having to get the police involved and social services. She is jealous. She used to let the kids spend time with their dad three times a week and alternate weekend sleepover. All of a sudden she has poisoned the children's minds and they won't spend any time with him. He has been to mediation and she refused to attend. He has all the relevant forms to apply to court but it's down to money. Any ideas what he can do? He loves his kids very much but she has refused him access on many occasions also. Please could someone help us?

Wow, I totally agree, My ex partner recently has stopped me from seeing my girls, They are my world and i love every minute we get together.I would love to have them fulltime but i understand that they love their Mum to.
I used to have them over night at my parents of a weekend, Where they had their own room and everything was alright and it worked for them, I would take them to dancing every Saturday and Rollerskating every Sunday, But they are no longer allowed, And they loved it.
I dont earn a great deal of money and my family have helped me buy essentials like uniforms for schools and dinner money etc, I work away from where they live, but travel to be with them every weekend, Well i did until, recently her and her new partner took them on holiday during school time, and wanted Me,my Mum whom works at the school and the girls to lie and say they had to go to Devon because of a family emergency, I explained to them that I would not lie and thought it was not right morally to expect the girls to lie in order to prevent them from getting a fine. Do we not teach children not to lie. To cut along story short the welfare officer rang and asked me if I knew where the girls were, So i told them the truth, They have now received a fine, Bless the girls they actually said to friends and teachers that they went on holiday and she is blaming me, Which i dont mind, because i dont want to put the girls in an awkward position with their Mum. But surely they only have theirselves to blame.
She called me a few choice names contacted the CSA who are now on my case asking for £194.50 a month, Which i have know problem paying but feel a little hard done by as it feels like im now paying their fine but this really restricts me when paying for things like their dancing, which their mum wont take them to or pay for.
I still go round every weekend, and see if they are allowed to come with me, and sometimes they are playing outside the front, so i will just stay with them outside, anytime is better than none. She constantly says they dont mind that they are not coming with me, but i know they want to, I have asked them.
I just think its so unfair on all of us, I would not mind so much but just today her partner rang me and said why has he got a fine, so i explained because he went on holiday, he then went onto say that its not a problem because he is raking it in and how does it feel that he has paid for the girls stuff, taken them on holiday and that i havent, I have not contributed at all to weekly shopping etc, I explained that if the girls lived with me then of course i would and i do contribute to the girls and yes i do get help from my loving parents but alot of the things i do do go unnoticed to them because i have not taken them on a £4000 holiday, I would love to but more so now that will not happen as the money i was trying to save to take them to a caravan is going to CSA. I can only suggest you research what the options are for low earners in cases of family law. I imagine this is only stating the obvious, but without knowing the US system, there isn't really any more advice I can give. I hope you manage to sort out these issues and regain contact with your daughter soon.

You would have to apply for the court for C4, which is an application for an order for disclosure of a child's whereabouts, which is put in place to allow a trace to be put on your children in order for you to apply through the courts for contact/access. While the courts may not specifically give you the actual address, it will help you be able to legally apply. If your ex refuses mediation, it will mean you can apply straight to the court.

I haven't seen my two children for a year now. The last time I saw them my ex accused me of assaulting her and I was arrested. I have not been allowed direct or indirect contact with my ex for the past year. Therefore have not seen my children as any third party involvement would mean I breached the order and I would be arrested. This is now lapsed but I can't find out where they are residing to be able to make any contact. I have to go through mediation to be able to apply to court to have access to my children. Due to the fact Social Services and a solicitor are already involved, I'm afraid I can't tell you anything more than you already have been advised. You may be able to make an official complaint to Social Services, if you feel you have been treated unfairly. You would have to go through the correct channels and ask what its official complaints procedure is. However, you will need to keep in mind that the Social Services assessment is ongiong and regardless of whether your ex wants the safeguarding contract removed, if Social Services feels it needs to stay in place for the sake and safety of your child, then the liklihood is it will be able to justify its reasons for doing so.

Me and my ex spilt up when she was pregnant and now the baby is born. We have been talking about letting me see my son who is only 3 months old but there is a safeguarding contract by social services that was put in place when my son wasnt even born that is stopping me from now seeing him. My ex has called and said she would like it removed so i can be a part of my sons life and i have even spoken to soliciters to see if its possible to remove it. Social services said they cant remove it unless both parents are assessed and even then they probably still wont remove it we have been told. What do we do as i want to be in my sons life and the only thing stopping me is a piece of paper.the safeguarding contract was only ment to be while the child was unborn

I on the other hand went through a really hard time, I constantly have problems with my ex, jealousy, anger, etc etc, this time she has gone to far and really hurt me, she came to collect our child on Tuesday and she came early, I was round the corner with my child and my ex walked in where there was my mother, and a female friend, apparently her face dropped, my mam ushered her out and my ex asked who is that woman, I then came round the corner with our child, my ex asked if she was my girlfriend I said no, then she stormed off, stopped at the top of the street and shouted ( YOU HAD ONE CHANCE AND YOU HAVE BLOWN IT YOUR NEVER SEEING YOUR DAUGHTER AGAIN ) I just came in the house, then she rung my phone and asked, who is this woman? is it your friend or your mams friend, I said my mams friend but I know her, then she called me from a pig to a dog, said I did not care about my daughter and hung up, two days later she changed her Facebook profile picture to her, and him with my daughter, he is holding my daughter ( IT HAS KILLED ME ) I never contacted her but really felt like it as the pain is unbearable, I messaged her today asking if I am still seeing my daughter this week she said ( what after some strange woman has been around her, I don't think so ) this really knocked me off my feet, then I am told she is posting pictures of her boyfriend with our daughter on Facebook and tagging him with ( our little family ) I feel empty, she left me for this guy, I am civil still, she has a new boyfriend and he lives with her, could someone please tell me why she is being so cruel, I have never felt so emotionally destroyed in my entire life, my daughter is all I have, I am a great dad, please help me understand her, i dont have enough money to go to court, so this is not an option

What has been suggested here as per the legal system and even mediation is a COP_OUT ! The legal system aids mothers all over the western world in behaving the way they do by supporting them with Inequalities such as Time Sharing. Therefore, the person writing the solution above is either extremely naive or a Lawyer! Many Dads go through what is worse than a RAPE except that it isn't physical. Yet, all most women will do is say, "oh the kids OH THE KID" sighting how they will suffer however NOT sharing how raped fathers are emotionally and financially but expected to remain free of "anger management", cool, calm, and collective. It is the biggest SIN of our modern world that this has been occurring since we left the 60s since many bad family and otherwise cultural changes accelerated in the 1970s. It so getting so that truly and factually, in the work place and at home, "Mom" reigns! Also in Pop Culture too like TV ads, movies, and just LISTEN to the Top 40 music of recent years where perverted female singers don't come close to music from (ie. Abba), Neil Diamond, etc. How long has it been wherein Hollywood show male heroic figures like Ben Cartwright or Charles Ingalls? Or, do you come across many wives like Karen Grassle his wife in Little House? The sure tell-tail of a falling culture that is doomed like the Romans plus other cultures of history, is the decline in Family Life. England's family has been largely decimated compared to not too long ago when divorce was a taboo. According to stats, when a couple separate, ~ 85% of the time it is the female leaving the relationship knowing well that they have less to lose in corrupted Family Courts lining their pockets. This has caused many middle aged and more so younger males to avoid living together and especially having children because the Laws are orchestrated in favour of "Moms". My own mother saw this coming in the 80s stating that our Family culture will be slowly destroyed and THAT is exactly what is happening. My best advice since a pre-nuptual agreement will not be accepted by most women or courts is, look to non_Western females who were not raised with much affluence. The only thing is, be prepared to include her family too. Lastly, until fathers come together in a unified massive force including any females who wish to join without ALTERING the goals of Equal treatment, nothing will change. I've been through nearly 9 1/2 years of losing everything accept my sanity and faith, yet, without enough money GOOD luck at getting your child(ren) back. For those females who say, "oh, when he/she grows up they'll come to you"...that is CRUEL and devoid of any compassion.

Truthfully I can see why separated fathers do end up doing things they wouldn't normally do and resulting in a criminal offence due to the ex's behaviour. I am going through courts to see my child and it is a slow process. The ex has stopped all contact, refused mediation and stopped my mam contacting my daughter. I am trying not to lose the plot as it is so frustrating when no matter how good of a father we are it seems like the mothers have the right to everything over fathers. How can us fathers stay out of trouble when were there to protect our child and it's the mother who is denying this. I have never done anything or got arrested but seriously starting to think about going to the door to see my child but know that we can get arrested. We never can do right. The government needs to get a grip of all these situations before all us fathers go rogue.

my child still isnt born yet, only 4 weeks to go and my ex and i have just started talking, shes had her family at her ear constantly seeing as we are only 17, she left me out of all scans, hospital visits, emergencies, and everything else, my mum offered her out to a meal this weekend just me her and my mum and i, but she decided she would be 'more comfortable' if her elder sister comes along, fair enough you all may think but her sister is the reason we have all fallen out because she started calling my mum names over facebook then our families started arguing, i staye dout of it all for opur sons benefit so she has nothing to hold agaoinst me yet im still the bad one? im worried im not going to be able to see my child and i have already been informed i wont be at the birth, i wanted to be the firsyt person to hold our baby boy and i wanted to cut the cord and io know im not going to get that experience because shes being so stubborn, i drank alot at the beginning of her pregnancy which she doesxnt know to this day and its killing me and tearing me apart inside, all i do is try then i still end up the bad one, i wish there was some way this could be resolved, i left my most recent partner of 4 months with hopes of getting back together with my babys mum, i gave up such a lovley woman to try and better myself with my ex so i could have a family and be normal, but its all just going downhill and i need some help, i feel as if my child is being used as a weapon for me to not be able to be happy, i was happy with my ex and as soon as my babys mum found out, she started talking to me until, i split up with her then she gave me false hope, and then am right back to square one, i need help!!!

I have been stopped from seeing my daughter because I wanted things set in stone as my ex was not involving me in anything and changed her number ive had to deal with her partner to see my daughter for the past four month we only split 6 months ago and I have seen my daughter every week. I do have another son with someone else but we have a good relationship and work with each other she has ignored my solicitors letter and also knocked back mediation this has hit me really hard i don't know what to do and I know I can't afford fight her it has put a hole in my heart and I don't know if I can cope with it all

Two weeks after my ex girlfriend found out she was pregnant she split up with me, it was new years night and as i work in a bar and a busy night i had a few drinks went home and fell asleep and forgot to txt her the next day she went crazy. This lasted a couple hour then everything was fine then four days later she txt me to say its over and thats it, she then blocked me from phoning her also messaging her. So i went to her house we had an argument and i left. I met her in the street and asked if we could try and be friends for the childs sake, she then started shouting and telling me that i will never see my child so to save causing a bigger scence i left. I went to her work the next day to see if we could just try and be friend as for the child has done nothing wrong we had another argument so i left. One week later at work the police came in and arrested me for stalking my ex. She had lied and made some horrible things up. I was charged with stalking and bailed on special conditions. I plead not guilty and trial was set. A week before the trial social services sent me a letter to meet with them went and met them. They wanted to know if i was a danger to my child when born and if i am putting my child first. The meeting went well they said they could see i am putting the needs of my child first and suggested that i should plead guilty as not to place ex in stress that would harm our child. So must to my destress i plead guilty as at the end off the day my first priority is the safety and well being of my child. I never broke the special bail conditions and left my ex as not to cause any stress. Two days ago i got a writ my ex is placing a interdict on me. The statement she gave was rubbish saying i had a history of violence and drug abuse and she fears for her and the childs safety and so did social services. She has two months befors the child is born and because i plead guilty to stalking her after social services suggestion i fear she will get her interdict and i wont get to see my child and start to build a bond with my child. I have no history of violence or drug abuse. I am the person now fearing that our child is being used as a weapon and she is trying to alienate me from the child. I am going through this alone and dont think i can take much more its the most hurtful thing ive ever went through.

@Mikey - I am sorry to hear about your situation. I assume you are from the US, and this site deals with UK law, otherwise I may be able to give you some advice on the best way forward legally. However, I can only say that things will get better, it may not seem like it now, but as your children get older they will hopefully develop their own opinions on the situation and things may resolve themselves. The best advice I can give is not to use alcohol as a release ( as it will only make issues worse) and try to join a father-based organisation that may help you get through this tough time through the help and support it can offer.

Man do I feel your pain. My ex lets me see my son and daughter for about 2 months and then she cuts off all ties. This is her way of getting me to start drinking again. I cry atleast 3 times a week over it. On top of getting financially decimated over a divorce, my mother in law moved into my house which I still co-own. I can't even go to my own home due to an unnecessary protective filed by my wifes female attorney who happened to be going through a divorce at the same time. I will say a prayer for you.

I we'll go up there and and visit them when I can and she diceded to give me another shot so I came back to Washington gave my 2 weeks notice and rented my house to go up there before 2 days of moving up there she started asking questions and wanted to know if I have cheated on her again so I got affended after everything I done and me going up there she came up with all this so we fought a couple days pass I try calling her and nothing so after a week I took the courage to move to Texas but she doesn't want noting to do with me and doesn't let me see my daughters at all I try calling her . Emailing her an texting her . I don't know what should I do need some advise I'm going crazy not knowing about my daughters anything we'll help thank you .

@George - you can apply to take it to court to try and get an arranged contact order, please see article: When Your Ex-Partner Denies You Access, whichIf you do not know your ex's address you can apply through the courts for a C4 form which is an application for an order for disclosure of a child's whereabouts, which will enable to serve the papers to take your ex through the courts. Your ex does not have to disclose her address, but it will help you to apply for the contact order. I hope this helps.

Hi, I found out I have a beautiful daughter through one of the monthers friends when she was 6th months old and done the DNS test which I paid for and wanted to be prt of her life. I constantly get threats and abuse over txt from her family, demanding more money and dictate everything I do. Even down to onlymy a select few of my family are allowed to meet her even my friends are not allowed. I haven't seen her now for almost a year as I can't handle the abuse and stress from everything. but after my mother passing I don't want to stop anything from seeing her but have been struggling on where to start. Everything is based on it being a separation. Not finding out after. I don't no if I'm on the birth certificate or her address. So as there's no such thing as fathers rights as such I feel as if I'm left in the dark. If someone could point me in the right direction I would be most greatful.

Why is the system is so broken like this in 2014 i am going to see a solicitor on Friday to get some advice first 30min free after that £150per hour criminal. Women who use children against the father is downright pure evil they should NOT be allowed to have children. I am going through the same thing my ex wife believe it or not is a social worker well that's what she like's to call herself she's a care worker controlling and manipulating don;t they know that they are hurting the children my ex divorced me in 2009 leaving me with nothing used me to get what she wanted. For the last couple of weeks she stopped me from seeing my boy who's 8 who's been having a lot of trouble at school so i went and sorted it myself at the school she said i went behind her back, I also cut his hair she went mad you see its all about her Narssistic or what all i was doing was looking out for him as a father it's not a power thing now i cannot see him we used to have overnight's days out etc, I am still getting back on my feet. @dd2 - as this is such a very long comment it really is difficult to know where to start to give advice on. Firstly, you need to get your own health in order, so if you are having panic attacks and are feeling stressed it is not going to help the situation, so I suggest a visit to your GP. I also think it would be much better for you to speak to someone directly about your problems given they are so complex. I suggest you give Family Lives a call via whichFamily Lives provides free professional, non-judgemental support and advice through its 24 hour helpline. I hope this helps.

am the trouble maker. i fancy my ex and she is married. Hum, no i don't. I am their for my son, just like i am here for yours. No comment from her.

Many occasions her mother keeps disliking me, told that my recent partner is taking children to stay on benefits, reason i can not have relationship with this woman is partly because she has a disabled child older, [not mine.

The mother sates she is a full time carer for this child. She also sates and said this in front of me, when i went on a visit to the house, if that her daughter would date me again or move in my home her mother would put her child in care and disowned her daughter. Blimey i just wanted to get out the house. tension, i was feeling it.

In the little time i engaged with this woman, she seem to have some kind of disorder, stressing her views and not even really interested that i am a dad to her children. uncertain what's wrong with mothers health, which i really don't have any idea sitting on dvla benefits, , their is issues at the mothers home and i seen proof of it,

Recently my ex told me recently, I am made certainly not welcome at her home, brushed off and not to go near the daughter and threaten to stay away. Hum, could be lies to palm me off ?

My ex is so horrible to me, i am an unlucky guy who is faithfully and kind, loving guy. many of my family and friends say to keep well away, told they all have mental heath issues ?,

Am i feeling i am being victimize in a way and very bulled off, been slander to such a high level, it feels like it. i not certain what to do here, 1 child and one on the way and a 4 year old, im gutted and sad, promised so much. It takes a lot to man up and want to be with children, i do, i cart help getting this empty feeling inside me.

I do already have a court order from my previous ex, contact with my over disabled son is good. I like to see my new born child, I have allready been and went 3 years already in court.

Hi i am new here and i have got quite a long msg to post,

I need expert advice, very troubling situation. I have so much on my mind and recently breaking down, panic attacks , light head, sick, over tired, stressed out. I need some release.

My story follows.

iv,e been dating a woman on and off for about 5 years,apparently i have a son nearly 4,

I did see this child and had only slight little engagement with him.
After a recurring relationship with this woman for sometime,
I did get constant abuse, threats and stupid lies from her, half the time i couldn't even make any sense of what was happening.
Got very fed up, so i asked for dna of this child, told lies, given abuse time after time over a long period,

I gave up the chase for a great time, i did try many of times to find the building blocks and new ways, means, but allays pushed back, time after time. after about 3 years, and the last year gone, we recently buried the hatch and made up last year. she moved in my home, last year for half a year, shortly after came the son to move in, We decided to have a child and have our own family,

Then suddenly she became pregnant of 26 weeks. before i asked to register the over son him in my name, put off, more stories shortly just to find out this son i had never really new that well, had some kind of adhd. or behaviour issues.

She quickly took the child back to her mothers, when i spotted the kid swearing and playing up so much. well last seen the child since in 5 months.

Soon then after she walked out on me and no answers to why? blanked me off and refused contact, very similar to the same as when we first dated each over. However I did find a way around to make some responding with this woman for the new unborn baby sake. hard work: on many exempts to resolve issues,

Ihad got given constant threats and abuse, lies from her, some say this is normal from woman who is pregnant, but not the kind she gave me in txts to drop dead and kill myself, over disturbing msg,

I put myself to one side, what is making her like this, bipolar disorder ? i ask her. said no i have not issues, then she would back fire on me and make me out to be mental myself. i ask the question, i must be mental to had be with you. Not how i like to see this as i am caring and fun loving. times she showed me.

She said, she knows never hurt her, that i am pre found in many ways.
So what's with all the bad ?

I did loved this woman.

i was willing to help as much i could do for her, but she states her family do not like me (same stories and she turns into a nasty piece of work. Is her family playing her off ? or is it just her ?

Well another stories, i got back stabbed by this woman recently, she made all fully remarks, about me to my ex partner as jealous of my over child and tried to spoil my relationship with my disabled boy.

@chad - just because you have been unsucessful before, it doesn't mean you will be unsuccessful again if you re-start the whole process. I suggest you read our partner article When Your Ex-Partner Denies You Access, link hereand apply for a contact order. If you do not have the funds which many men do not because of the withdrawal of legal aid, you can represent yourself, We also have a Separated Dads Facebook page which offers lots of helpful advice from other dads in the same situation. I suggest you look at one of the postings around Xmas, when a father was going through a similar situation and was representing himself. There were some very good responses and advice giving from fathers who had done the same and won their cases through self-litigation. The courts are much more giving to fathers now and much less tolerant of mothers playing games than they were a few years ago. I recommend that if you do your research and make a good case for yourself re-iterating all what you have said here, then you stand a very good chance of regaining the contact with your son that you should be having now. I hope this helps and good luck.

Hi I'm hoping someone can give me some advice, I split with my ex in February 2011 for 18months I had regular contact with my son which all times and dates were made up by my ex, in June 2012 I was to have my son from Friday afternoon till Sunday evening my ex then decided that when I got to the door to pick my son up she wanted my son back on Saturday ( keep in mind times and dates were made by her I signed and agreed a letter she sent to her solicitor to make it a solid agreement ) I disagreed to bring him back on the Saturday, the weekend after she phoned me 1hour before I went to collect my son and said due to a dispute over contact I cannot see him, we went to court which dragged for round about 2 years maybe a little less, I had no solicitor die to having no money to pay for one but my ex did..she lied in court saying I hit her when I never ever touched her but I couldn't prove her to be lieing, the court offered me unsupervised visits but she objected to that and it ended with me getting indirect access which broke my heart to be told I wasn't allowed to see my boy, I have stuck to everything that was asked of me, I pay for my son as whether I see him or not he is my responsibility. During this time she would not let any of my family members see my son too...in January 2014 my mother was diagnosed terminally ill and passed away in may 2014 I tryed to go through other people to get my ex to let my son see his nana before she died but sadly my ex ignored all messages..in June 2014 2 weeks after my mum passed my ex contacted my father and he has been allowed to see my son since then around about the last eight months I have given him, money gifts and pictures for my son which my ex was ok with only because it was stated in the court order that I was allowed to do that..at the beginning of February 2015 my dad asked if I could see my son to which she brushed it of with no thought of our son just of herself, I have no orders against me at all now but didn't want to go to court so we was hoping now my dad is seeing my son that she would finally let my dad facilitate contact with myself and other family members but 5 days ago my dad asked if he could take my son to see my sister and my 1 year old nephew to which she said no, I have not seen my son for nearly 3 years and I am only guilty of leaving my ex it has been the worst and hardest time of my life and it kills me to think how my son feels, I really want contact and would appreciate any advice of what I can do..I really do believe she is using our son as a emotional weapon and has no intention of let me and my son have any connection at all till he's old enough to think for hiself my son is 7 years and 23 days old now, please what can I am my family do? Id like to share my story. One that is true, one that will break your heart, one that maybe I can get some help on. One that when you read, you will realize your situation isnt so tough.
I understand it stinks being away from our kids. What i don't understand is how a broken system allows men who want access to their kids, consistently denies and honors the "mother" who in this day and age is probably the worst place for them based on the manipulation of/by them as stated here.
I am divorced and at the end of 2012, when the marriage was over, the day i moved out the "boyfriend" moved in. No problem, I wanted to meet the man living with my children. "That's never going to happen" was the response, which was devastating, but I could live with it. When my financial circumstances changed, I was forced to readjust the support i was paying and return to court and was granted relief. Much as i suspected, said "boyfriend" when the money was gone, so was he. As a result, my ex has some very powerful influences in the legal system in my state since she works for very powerful attorneys. She obtained and "Order of protection" against me, unwarranted and without justification, since she has some pretty close ties to the system. There is no history of abuse, no physical violence etc. I returned to Family court and obtained an order to call my kids each day, even went so far as bought them cell phones to reach them to which their mother and friends hid them, shut them off or they were "lost". Since my only alternative to communicate via the court order was to call her, she refused to answer the phone and i was charged with multiple misdemeanors and 2 felonies in violation of the order. I had valid proof in my cell phone of her meeting with police officers she had "personal" relationships with and once discovered by them by monitoring my phone, my phone was taken without a warrant, and I was arrested and rotted in jail for almost a year. While in jail, I was served to "pay back child support" to which upon my release, I went to a hearing and was told by a judge I could not see my kids until I paid back support. I appealed the decision but was told it was not appeal-able and have not seen my children in over a year, any contact with them will result in a violation of the order and I am sad and need help. The legal system is faulty and has failed me based on some other circumstances and mitigating factors. I have since been reassessed a support payment equal to 93% of my wages, back support based on an income I made some 7-8 years ago, have tried to appeal and was denied a hearing and surly again face jail time here for it if i don't get it under control. Tomorrow I am headed to CPS, but, this is ridiculous. The system allowed this woman to lie, cheat, use her influence, and my life is in turmoil as a result. Recently, she lied in a court order stating "I didn't learn my lesson" while in jail for a year. I haven't been within a thousand feet (1000 ft) nor

My heart seriously goes out to any man wanting to see there child and not aloud! My story basically is me and my ex split up around March. February last year as she was seeing some body else at the same time il admit the relationship wasn't going great. As I left she wanted me back and promised it wouldn't happen again. I tried for my daughters sake but had no trust towards my ex and this left me unhappy. I then got quite depressed and my father took me to his house I then realised that I couldn't be with her no more. Then all of the using the child as a weapon started and I was stopped seeing my daughter without been with her mother I wasn't aloud a realationship with my daughter. So I went through proper procedures mediation she didn't turn up. Then court wev been to court 3 times the first time I got contact in a contact centre to rebuild a bond with my daughter. My ex didn't once turn up. The second time again contact centre first two sessions went great she came dropped little one off and left but then the third and fourth session again didn't turn up. We are back at court in 3 weeks and I'm ment to have two more sessions. But all my ex seems interested in is arguing and I strongly believe that becayse in the first to sessions me and my daughter started to build a bond she will stop my daughter isn't great around men as she hasn't had any in her life for a long time untill now does anyone have any advice on how to help my 2.5 year old daughter feel more at ease? All I want is for my little girl to be happy but it seems like her mother is set on making sure she turns my daughter against me.

@sobes - 12 is usually considered an age when a child begins to have the maturity to make decisions which may take seriously in the courts. However, there are other factors that will be taken into consideration such as the child's level of maturity, what influence the parents might have on the decision and whether the parent awarded residency is meeting the needs of the child. @rose - yes, petitions are always useful and many have worked regarding fathers' rights, which is why the legislation has improved, but we're still not there yet. People have to really get behind a petition and galvanising people to that extent is not always easy, but it is a very good point.

My ex was violent, never made my 2 boys dinner for over 6 years never spent 1 penny on food for over a year not bought any gifts for birthdays or Christmas for 5 years even when left 1000's by her father in 2012 and has sat on facebook playing games for 4 years straight, after the last time she attacked me Jun this year, I went to the police to see if I could lock the doors on her which I was told no then if I could take my kids to my dads house and told no again I asked for any kind of help and only told to phone a lawyer, I was told if it goes to court I would win by a lawyer as the evidence was in my favour, then all of a sudden her and my kids are gone with no warning and I find out after 3 weeks she is in a womans aid shelter for battered wives, so she has lied, no evidence no proof just her voice whereas I have photos of the cuts to my face and neck and now all of a sudden I am being treated like a #### by my neighbours my friends and by anyone who she has spoken too, its a nightmare, my life has been turned on its head because of her lies I have heard nothing from my sons for months supposedly for their own protection, my oldest son is 13 and is autistic has no real friends except me and my youngest is 6 and he called me his best friend every day, the system is an absolute joke that a woman will be believed helped rehomed no matter what at the drop of a hat yet a man gets looked at like he punched a kitten when asking for the very same help months prior. I'm at my wits end!

I feel for all you dads and feel that all the mothers who are doing this to dads aren't good moms as they are hurting their children too. I am single mom and my kids see their dad and its other way round for me. He pays little money for a month for his 2 kids as he claims 16 hours work. But he has business and runs it. he drinks every night and have been banned drink driving, yet again he doesn't pay. Is it moms fault or is it dads fault? Simple its Law fault. law is unreliable. How out all you dads put a petition and forward that to Prime minister. Shame whatever you do its kids who suffer and the other parent.

I love my son and thought I was married to a bright caring woman. Yet she uses all the tactics that everyone else is mentioning here when we separated. I do not recognize this person that she has become. I have not seen my son in months and the frustration of of not seeing him is killing me.
Seems if you have done nothing wrong you get no support.

Well me and my daughter mum broke up a year ago when she was 6 months pregnant, my daughter is 9 months old and I still haven't seen her once. A bit of background, the mother has Aspergers, lives on benefits and has a 5-6 year old son with Autism. When I first meet the girl, me and my family had been told how her family take advantage of her (financial) to the point that she had said she would never lend them money again as she never gets it back. During the relationship her family (I believe her mother and gran) would get her son to stay with them for longer periods claiming he didn't want to come back. I can remember asking him if he wanted to live me or back in his families town. He had told me he wanted to love with me (so it looked like they had been trying to make her think he wasn't happy being away from them). We got into some arguments about money and she told me over facebook that her aunti was staying in her flat back in her town while not paying her any money towards. It had reached the point that she was concerned she would get done for benefits fraud. Now after we broke up, it all changed. apparently I was taking advantage of her (I had a job and she was living in my home rent and bill free). Things got nasty (I'm partly to blame for that).

I have been wondering if this is a case to take to social services, it looks to me and other that people back in her home town have been trying to take control of the situation. Everytime I speak to her, one minute she will get back to me about contact, next day I'm told I have to got o court. I tried a mediator which she refused to attend but then the next minute she agrees to meet with a family member present (as they are more neutral than solicitor??).

I don't really want to take her daughter away from her brother (which is what I will pursue if I go to court), If social/safe guarding can't help, I might have to (which just makes me into the villain).

My ex partner (girlfriend for 4 years) has decided I am not allowed any access to our daughter. Our daughter is just over 4, but, we separated over a year ago. When we separated my ex partner moved out our joint house. After our separation I had regular access to my daughter. We agreed her buying me out the house, so, she could move back in with my daughter and I would move out. I would have my own rented property and we would co-parent. The very day I signed the house over I got a phone call from the CSA, and, I am not allowed to see my daughter. My ex partner says 1 hour, supervised at a drop of center is all I will get.The nursery my daughter goes to are happy for me to see her, and, for the past 3 months I have been seeing my daughter on a regular basis, unsupervised, maybe upto 4 days a week, upto 6-7 hours a day.I am seeking legal aid for court action, but, the latest letter from her solicitors have said she was unaware I was seeing my daughter and it has left my daughter upset and distressed. Also, her parents had went to collect my daughter from nursery and she wasn't there, and they were upset.After speaking with the nursery, my ex was fully aware of the fact I was collecting my daughter, then dropping her back off. Her parents have never came to collect my daughter. Everything she has told her solicitor is lies. My solicitor now has this in black and white on a letter. The nursery have said here accusations make them look bad, and, are happy to give a statement in court.Yet, I have been asked by her solicitors again to stop seeing my daughter.They claim my daughter is upset and distressed in seeing me, yet, my daughter came and met my solicitor in a neutral enviroment and was fine! She loves me and it breaks my heart that my ex lies and holds all the cards. What can I do?

Having big issues with the ex, separated nearly 3 years ago, but because I work shifts on a rotating pattern over 7 days, a conventional contact arrangement does not work, ie fri and sat night every other week etc, we agreed initially I would have one of the children one weekend and the other the next, in order to spend quality time with each in turn, otherwise they argue and I don't want to spend time épée rating them, when it should be a time to be enjoyed.
Due to my current shifts which are 5 days on and 3 days off, I realistically only get 2 weekends off in every 7, the first being fri, sat,sun, the next being sat, sun, mon.
My ex has access to my shift planner via one of the boys iPads which is lied to my iTunes account and my iPad, so knows what. I am doing at any given point in time. However, when I have mentioned about having them on my 3 down days during the school hols, they are doing something.
It has come to a head now, as I'm having my youngest this weekend fri, sat, sun, but have been told cannot have the eldest next weekend as she (my ex) has got something planned.
What can I do about this, I don't want to be heavy handed or resort to law, but am getting to whits end now.

I find it outrageous that I like many others should have to go to court and fork out thousands to see my own child that the mother has ripped away from me, if anything, she should pay. I am increasingly suicidal and have suffered 2 breakdowns and severe depression since my ex left taking my son to be with another man. On December 1st 2013, I found out that she was leavin me and had found another man, I was devastated and ofcourse didtraught, my son was 1 and 2 months at the time. After that she stopped contact, she blocked me on Facebook, changed her number and told her family a pack of lies to justify her actions. It took me untill April to get in contact with her, she promised me I could have my boy for Easter, I jumped at the chance, bought him new clothes, toys and had my heart set on it. I was having him on the Saturday, out if nowhere, she called me on the Friday and cancelled because she didn't think I was able to look after him. I was gobsmacked, this happens numerous times. June 2nd, she called me after a month of silence and told me that after just 6 months with this guy, she was pregnant and engaged to be married. This hit me so hard that I broke, I was lost. I had no idea what wa going on or what had I done so wrong. This time last year my girlfriend and my son were happily at home with me and now she's engaged, pregnant and living with another man 66 miles away. She agreed for me to see my son and to my surprise she followed through, I had him 2 Sundays in a row and it was great, I was ready to move on with my life and was happy. I took him to the beach and to a fun house, everything went perfectly on both occasions.

I was meant to have him in 2 weekends time, I went to call her the day before I was due to have my son as normal and planned and it went to voicemail, unfased i left it a couple of hours assuming she was on the phone, I tried all day, the phone wouldn't ring, I rung her mum, same thing happened, I messaged her on Facebook, she had blocked me instantly after.
And now I am back to square one again with no clue what I have done or what to do next. All I want is my son and I will be driven to hurting somebody if I do not get him back in my life. I'm at the bottom and I can't afford the court fees. So what do I do? Nothing, she gets away with it because she's not breaking any laws.

In 2014, how is this legal and allowed to happen, this is so unfair on my son and myself. I find it a disgrace that I have to pay for court and she gets away laughing at this. Something needs to be done to mothers like this.

looking for a bit of advice if poss. Ive just split from my wife. We have 2 kids at 8 & 5. At first we agreed i could have the kids every tuesday night and every second weekend. She then retracted it and said i can have them for a few hours on a tuesday night and 1 night a weekend which ive politely refused. Ive now told her im going to court to seek joint residence. The kids have a good life with me. i have a good, stable well paid job and they both have everything they need in my new home. Shes refusing to budge at all so court is my only option. I would happily settle for 2-3 nights per week but she wont even consider it as " she cant bear to be apart from them that long" which in itself is quite ironic considering shes always moaning shes not got time to do anything herself. Does anyone have any advice or experience of a simialr situation??

The systems is tough going my ex is solely driven by money so use the kids as a tool to extract the money from me. We have just sold the house now and I haven't seen the kids since Feb 2014.

Also a friend of mind got accused of assaulting his ex wife when returning his kids to a public place in manchester. What his ex didn't bank on was he always met here in a public place where there was CCTV and unsurpsingly when the police check thed CCTV she was found to be lying. he got locked up for 1 night while they check and she got off scot free even thou he was falsely imprisoned and she was lying and wasting police time.

Not all ex are bad but the few that are are horrid

My son who lives in Canada but is paying maintenance for his son who lives with his mother in Scotland. My son has remarried and has another son and also a boy from his second wife's marriage. The boy in Scotland was 17 in January of this year (so was already 16 when the new law came into effect). He is intending to leave school this summer hopefully with the exams he has set being good and to go on to study at a local college. What I would like to know is:- How does my son stand bearing in mind that the child was already 16 when the new law came into effect and could have left school that year. Can my son stop the payments in September which was the agreement he signed up to. The boy will be 18 the following January 2015. I would appreciate any help you can give. Also they (his ex wife and his son could tell him anything) he would not know if his son was working or going to college as my son lives in Canada and does not know what goes on

My ex stopped my contact after losing my job 18 month ago. I struggled with going through a bad time for a while but am in a great new relationship and want to regain my contact but the ex is blocking every attempt. She's cruel and angry, sending horrid texts all the time trying to put me down. I feel I cant cope with the abuse. I dont know what to do.

Won in the courts to have access to my children and guess what I have seen him 3 times this year!!!!
The feed back I am getting is that she is laughing at the system and declares they will be cut out of my life.
It took me 2 years of fighting through the courts and now legal aid has gone she is laughing that I can not afford to see my kids.
Great she had the affair and left me for another bloke yet the system favours her all the way with no avenue left for me to get to see my kids.
Mediation what a laugh and yet if I tried anything the police would descend on me like a ton of bricks.
If your ex is twisted you are truly stuffed believe me.

I have a son who is 10 years old. who moved to bedford .with his mother.(ex.wife ) the only way get to see him is if pick him up from bedford travel back to norwich and then then do the same on the return journey,which I have to finance myself and as I am at present receiving ESA I find nearly imposiable to finance this,so is there any responsabilty on the mother to meet me half way on the expenses? any comments please!

I have not seen my three children since January 12th. My ex partner has been very difficult with letting me see my kids since we split up in August 2012 after I found out she had been cheating on me for the hole of are realationship with a number of different men. At the start I saw the kids every other weekend and had them to stay. A year ago I ment another women and started a realationship with her and for a few months my ex never had a problem with it. She started to say that she didn't want my new girlfriend to not have no contact with the children and I couldn't see why she was being like that cuz she had got a new boyfriend and he was stopping in the house with my kids everyday! She then split up with him and started to ring me at stupid hours at night saying the kids and her wanted me bk but I said that I didn't love her anymore and that I just wanted to c the kids on a regular basis. She didn't like that and said that I had made my choice n that she wouldn't let the kids see me anymore and telling the kids I didn't love them anymore and I was having a new family with my new partner!! Witch is a load of rubbish. I have been to a solicitor and had a letter sent to her witch she has egnored plus I set up a mediation session witch she went to but said she wasn't willing to mediate. I have just applied to the courts for contact but am afraid that Iam not going to be able to afford all the cost. And to top it all off I received a letter from a solicitor that is working on behalf of my ex yesterday and the stuff she has said about me has made me look like the bad person in all this. I need help if there is anyone out there who can help me because Iam at rock bottom now without my kids in my life and it's made me very depressed. Thanks

I have 3 children who live in the south my ex will not allow me to see them or talk to them .I have a court order allowing me accsess .but that was when I was living in the south .my ex stopped all contact when she found out I was moving back north .anyone who reads this I would begreatfull for any pointers as I am at my wits end .I do not want to go through the legal system again if I can help it

hi I live in Glasgow I have been separated from my ex for four years now, I have had shared custody all this time getting my son 3/4 days a week and the days I didn't have him I called to speak to him now my ex has up and left with my son to Liverpool without telling me and wont even let me speak to my son on the phone I haven't spoke to my son in two months.
I am waiting for court on 1st of august for a residence order and contact order, but I want to be able to speak to my son before then is there any way I could get to speak to him on phone or anything before I go to court?

hi been separated for a year now have 3 boys 16,12 and 8.
The oldest is old enough to make up his own mind now whether to visit me or not.
My 12 year old comes over on a regular basis the problem is my youngest he refuses to come over I have had no contact with him for a year my ex says she is not stopping him coming over but if he says no then she won't force him to see me.
Where do I stand in all of this I've tried saying my ex that contact between father and son is important to both parties but it falls on deaf ears.
Lawyers fees is something I could not afford even if I could get money for that is it guaranteed I would still see my 8 yr old son

not a comment but a question I have an 8 year old son and I have not seen him in 5 months every time I ask my ex if he wants to come over he says no and she leaves it at that she does not try to persuade him to visit I am not welcome in her home so can't see him there.
I have another son from the same marriage who comes over regularly which I love but it is breaking me that my youngest refuses what can I do .
any info would be helpful

My 17 year old daughter has decided to leave school and has got herself an apprenticeship in a local hairdressers. She is attending college once a week and earning £140 per week. I paid my ex a voluntary monthly amount over the past 4 years. Do I have to continue to pay my ex. I am still willing to support my daughter but resent having to give my ex any money. Where do I stand please.

I went through a torrid divorce over a period of two 3 year, my ex-wife would not agree to anything. The courts are too slow!! and as I will explain bias towards mothers, I will explain:-

(Background) My ex-wife stopped me seeing my daughter a year and a half ago (she is now 12), she was annoyed I would NOT sign mortgage papers ( I did this to force a sale as my job was not secure, to compound this I was made redundant and YES I've always paid my CSS payments and was back working 3 months later).

I paid £200 to go through the courts ! What a waste of money !
A year and a half later, I attended the last hearing (had two before) and was informed that the judge was powerless to make an order for me to see my daughter (even 1 hour so I could tell her I loved and missed her)!. I feel my daughter has been stolen from me with the help of the courts. During the 1 and a half years Cafcass came to my home assured me it would be all ok. They let me down! they never responded to my letter, no support, the case worker i found out at the last hearing had left Cafcass and when she was called to court she had no notes or handle of the case.

Anyway, did everything correctly and that was the end conclusion, waste of time and money.

Hi all I was just after some advice I split from my x about 8 year ago and was making contact with my 2 children she then moved her new boyfriend and was pregnant within 2 months and I was shut out and hit the bottle hard .That really messed up my life , I lost my job and ended up in hospital for 4 months with brain damage after years of rehab learning to walk and talk ect I want to build a bond with my children who are aged 9 and 10 . But my x has refused mediation and we are having to go to court I really want them to meet my 2 kids who live with me . there brother and sister and I haven't had a drink in 6yr

hey guys i know how hard it is for all of you right now as i have twin daughters from one relationship and a son in another relationship. dont get me wrong i have made mistakes in my life i had a few problems in my own life which i now have control over but i havent seen my daughters for 4 years now i have been put in jail twice for breaching a restraining order this ex partner is intent on ruining my life and i nearly let it ruin my life. i couldnt speak to anyone as i thought everyone just didnt want me to see my daughters i still fell like that now i speak to solicitors but no solicitor seems positive enough to tell me i have a chance an most say it could take alot of time. i tried to go for mediation with her through solicitor but ishe just rejected it i work full time so it hard for me to even pay a solicitor as i do not qualify for legal aid this is causing me a problem. at the moment i dont see any of my 3 children. the mother of my son treats me like rubbish and i mean proper rubbish. she thinks its okay to just contact my mother not speak to me and let me see my son once every 12 weeks seriously how is there any justice and how hard does anyone think this has been for me. im lucky to still be here but 2013 i know we all have to stay strong keep believing and i just hope somewhere along the line justice is finally done for us all and we can spend quality bonding time with our children

Like I have the same problem with my ex I have had to go through so much to see my child just be cause he told the judge at tile that I walk around town picking up cigaret butt's bring them back home and bake them in the oven and feed the cigaret's to my kids that was 4 years ago an ever since then I have had to go through hell I have filed to regain custody 3 time like im not eligible enough I have a daughter with Soto syndrome and take care of her all day so my ex has been with holding my daughter since September 22 2012 it is now nov 24 2012 I have filed in the court for a modification and the judge just sent it to a nother court cus she don't know what to do is the like some sort of case worker out there that I can speek to to get to see her I sewer cents he married this chick there trying to dissolve me in to thin air and out of my daughters life

My son has left school hes 16 n got a aprenticeship in bricklaying he goes to college one day a week n works on a building site the rest of the week,he will earn 100 pound a week n his child benefits stops in sep 12 do I still need to pay for him

I don't know what to say Dave, I am going through the exact same thing with my 2 kids, I have been punched by my wife I got a black eye! but I got arrested and charged for pushing her in self defense, She is using the kids by telling them I want nothing to do with them all this is going on because she fell in love with another man and had an affair. All I can say is get a solicitor and try to bide your time, I am not coping at the moment but thats all I can advise really mate.

Being able to help others is a great idea. There are a number of organisations that exist to help fathers with visitation and child support rights. Joining one of these is a start. That will allow you to become involved immediately, and they'll also be able to advise you on other things you can do, and the qualifications needed for different careers. It will take plenty of work, though, and won't happen overnight, so you'll need to be dedicated.

I was made redundant December 2009 but secured a job in Dubai January 2010, I came to Dubai and as I always have my youngest daughter Boxing day thru New Year I asked and got permission to bring my daughter with me for 2 weeks. My plan then was to see her every 6 - 8 weeks which would have worked out with half term, easter, may bank holidays. However when I asked my Ex if I could have my daughter end of February 2010 for a weeks half term I was advised she wouldn't let her come to Dubai!! I went home in the August and saw her for 2 weeks and since then my only contact is by Facebook, Email, Mobile phone. I stopped my voluntary payments to my Ex in the May due to my Ex's attitude. She has now relented and said I can have my daughter if I fly back to collect her and fly back to drop her off!!!! Does anyone have any experience of going to court to gain access when living abroad?

Hi i split from my ex on 1st sept 2010, our daughter is now 2 1/2 yrs old. about 6 months ago she decided to up sticks and move to plymouth which is about 5 hours away from me. Do i have any rights in this matter? as the usual contact i had which was at least once a week, i will not be able to have as she doesnt drive or have a job. And to top it all off she has been seeing another guy in plymouth now for about 3 months and is pregnant again. Is there anything i can do?

I just got a letter from the csa (Dated 25th August 2011) saying,

"We previously worked out an amount of child maintenance for your case and sent you a letter to let you know how we worked this out. I'm writing today to let you know how and when you must make your child maintenance payments"

following a review of your case, the amounts you need to pay has changed
to £26.82 a week from 16-09-2005
to £17.88 a week from 17-09-2004
to £8.94 a week from 19-09-2003
to £88.50 a week from 14-09-2007
to £88.50 a week from 14-09-2007
to £23.46 a week from 15-09-2006

This review found that you were not paying enough child maintenance in the past. We have therefore added £2,941.20 to your child maintenance arrears. Amounts to pay for your arrears are included in the table below. If you want to know the total amount of arrears you owe please call us on the number at the top of this letter.

The table below shows the amounts you are legally required to pay over the next 12 months

Total £1.23 weekly Payments 1 from 26-08-2011

The children relating to these payments both left school last year (2010) and from what I hear never went onto further education.
I have always complied with the csa in accesments, this is the first letter I have had since they accessed me taking into account my current family situation. I now have 3 daughters ages 4, 11 & 12
Surely they cant just throw this at me when I should have finished paying last year. (I am still paying from my wage.

I am way too familiar with the hurt and terrible angish you are going through, It has been a very long and tediouse battle for me to have access to my son. It is heading towards four years since I started my fight to gain quallity time with my son and I am still having a great amount of difficulties in the fight. I thought I was on my own until recently, and yes no matter how many solicitor letters there have been sent and a order of contact too, nothing seems to be sticking the ex justs laughs it of and continues playing the system withouut any ethics or morals. I am yet to see this so called order to be enforced like that would make any differance!!!So yeah you go for it and goodluck with your goal, I am not that confident yet but maybe when things go right I can follow in your footsteps.
