Legal Aid Withdrawal: How to Represent Yourself

Legal Aid Withdrawal: How to Represent Yourself
A few changes in family law have recently taken place or are imminent. We thought you'd like to know the details so we've asked Celia Conrad a former specialist family solicitor and author of Fathers Matter - the essential guide to contact on separation and divorce - to cover it in a guest blog for us.

Before heading to court, it's essential to know which forms you need to file, which is where our free Court Form Finder.

The term LIP or should I say litigant in person is used to describe an individual who exercises his/her right to conduct legal proceedings on his/her own behalf. In other words self-representation, although (according to Lord Dyson's Practice Direction of March 2013) the correct terminology continues to be litigant in person rather than self-represented litigant!

Withdrawal of Public Funding for Children Applications

Many parties, particularly fathers, have had no choice other than to become litigants in person after the withdrawal of public funding for the majority of private law children applications. This is a direct consequence of:

(1) The controversial Legal Aid, Sentencing and Punishment of Offenders Act 2012 which came into force on 1 April 2013

(2) The ever-increasing cost of legal fees, many parties start off with legal representation but end up as litigants in person due to prohibitive legal costs

The emphasis is to keep parties out of the courts and, since the Family Justice Review in 2011, the Government has been focusing on funding dispute resolution services such as mediation. The aim is to direct parties in private law cases to mediation rather than funding them to proceed to court. Despite all the funding for mediation however, there is no guarantee that it will work. So if a case does proceed to court, the likelihood is that at least one of the parties will be a litigant in person whom the courts will have to accommodate.

Of course with the abundance of free information on the Internet and websites such as this one, more and more parties have made a conscious decision to act as litigants in person.

Using a McKenzie Friend

Sometimes parties act alone and sometimes with the 'right to reasonable assistance' of a McKenzie Friend. There is a presumption in favour of allowing a McKenzie friend to sit in on court proceedings so as to be able to provide that reasonable assistance. This ties in with Article 6 of the European Convention on Human Rights, which directs that "those who need assistance with the presentation of their case" should receive it.

Assistance means offering moral support, taking notes, helping with case papers and quietly giving advice on any aspect of the conduct of the case. But assistance does not extend to conducting litigation or acting as an advocate - and McKenzie Friends do not have a right to audience in court, unlike solicitors and barristers.

In exceptional cases, where a litigant in person is inarticulate or has severe health problems and is unable to present the case, some judges have allowed McKenzie Friends to address the court directly. The latest guidance in relation to McKenzie Friends is set out in a 2010 Practice Direction.

Equal Treatment is an Entitlement

The fact is that litigants in person often feel overwhelmed by the court process especially where the other party has legal representation. Litigants in person MUST be treated equally before the law and have equal access to justice. Judges have a duty to ensure a fair trial by giving them due assistance to achieve this. But that duty does not extend to giving legal advice. Nor can a judge be seen to favour one party over another, even if that party is a litigant in person.

Litigants in person should bear in mind that a judge's role is to determine both the facts of the case and the law applicable to those facts and presenting a case involving difficult points of law is no easy task for lawyers with many years experience, let alone a litigant in person. Which is why it is expected that with the increasing numbers of litigants in person, judges will need to be exceptionally proactive in managing cases where litigants in person are involved, particularly where the other party has legal representation, to ensure that the litigant in person is not disadvantaged in the proceedings.

There are some significant and imminent changes to family law with which litigants in person will need to familiarise themselves:

(1) Single Family Court for England & Wales

The 22nd April 2014 was a key date in the family law calendar. On that date there a new Single Family Court for England & Wales came in to being. There are actually two tiers of court:

  1. The Family Court
  2. The High Court
It was recognised that it was necessary to preserve the High Court's status in relation to its international work and inherent jurisdiction (which includes matter such as wardship) - but there will be four levels of judges:
  • Lay bench
  • District Judge
  • Circuit Judge
  • High Court Judge
The idea is that the creation of a single family court will facilitate the wider reforms being implemented to enable the more efficient use of court resources, and more effective administration of proceedings.

Your situation may be slightly different. ask a question below ↓ and our editorial team will reply with our advice.

(2)The revised Public Law Outline (PLO)

The revised Public Law Outline will also come into force. In terms of changes it is not significantly different from the PLO from July 2013 but it clearly defines how care applications will be dealt with in the future.

(3)The Child Arrangements Programme

The Private Law Programme, which essentially sets out and governs the procedure in relation to private law applications under the Children Act 1989, will be replaced by the Child Arrangements Programme. The emphasis here is on the needs of the children and ties in with the amendments to the 1989 Act by the Children and Families Act, which received Royal Assent on 13 March 2014 and which among other things:

  • Makes it a requirement for separating couples (with certain exceptions such as where there has been domestic violence, for example) to attend a meeting to find out about mediation before being permitted to apply to court
  • Makes it clear to separated parents that the court will take account of the principle that both parents should continue to be involved in their children's lives, the caveat being that it has to be safe and consistent with the child's welfare for that involvement to continue. The presumption that so many parents were seeking did not make it into the statute book!
  • Ensures that any expert evidence in family proceedings concerning children is to be permitted only when necessary to resolve the case fairly and taking into consideration factors which include the impact on the welfare of the child.

Amended Court Form C100

There will also be an amended Form C100 - this is the form currently used to make an application under the Children Act for a residence, contact, prohibited steps or specific issue section 8 order or to vary or discharge a section 8 order. The Form is to be amended to incorporate the introduction of the new child arrangement order (CAO), which replaces both a residence and contact order and is to be the standard post-separation order. A CAO is defined as an order regulating with whom a child is to live, spend time with or otherwise have contact with. Form C100 will also be amended to incorporate FM1, which is the Family Mediation & Assessment Form.

The crucial question is whether family mediation will divert parties from the courts given the requirement that an applicant will have to meet with a family mediator before filing a court application.

What impact this new reform will have? On the basis that it has already been a requirement since 6 April 2011 that applicants have - needed to 'assess' whether mediation would be a better way of resolving their disputes instead of going to court and have been expected to attend a Mediation & Assessment Meeting (MIAM) to find out if mediation would be right for them - it remains to be seen

What is clear though is that there has been a dramatic increase in the number of litigants in person since public funding dropped off in April 2013 and there are now more litigants in person who represent themselves in private law Children Act applications than in any other area of family law, if my reading of data from the Ministry of Justice (MoJ) is correct!

My daughter found out she was pregnant after only two months of seeing her bf. They split 7p and few weeks later she found she was pregnant. She had broken off the relationship because she didn5cwant to becwith her bf. He on several occasions told herxhavecan abortion. Baby was born in April and she invited her ex to see the baby with his mother, and he has been to the house at least once a week to see baby. He was also put on the birth cert, since then he has been saying he wants the baby over night and to have him 3 days a week.. my daughter is very upset as she went ahead with the pregnancy, gave up her career for the RAF, and decided to raise her child as a single parent... The lad is only 18 and very immature for his age and the baby still isn't comfortable with him.. he is threatening courts etc and being very unreasonable although he is visiting to see his son... where does my daughter stand??

My ex husband has a longstanding alcohol, opiate and prescription amphetamine addiction. He has been admitted to hospital with drug induced psychosis and rehab before. He can be extremely aggressive and I left because of domestic violence, He has a history of drink-driving, but no convictions.

The intensity of his addictions waxes and wanes.

I am the kids primary carer. He sees them every Wednesday for a few hours after school and alternate weekends. He lives with new partner who is supportive of him.

Our kids primary school had concerns that he was intoxicated having driven in one morning, for drop off. The school phoned first response, who couldn't take it any further as he just denied being drunk.
The hospital wouldn't allow our kid to be discharged home to his care after an overnight episode last week, because they had concerns he had been drinking, but because the child came home with me, they have not followed it up with a first response referral.

I am fearful for my children's safety when in his care as I think he is spiralling out of control again with his drinking.

He loves his children and they love him. I want to normalise my kids life as much as possible and I want them to continue to spend time with him, but how do I proceed so that they are safe??

So far I did not allow contact yesterday afternoon with him, against court order instructions.

What forms do I need and where do I apply to represent myself (due to costs) in order to fight for access to my daughter when her mother is stopping me from seeing her?
Brod 06/01/2019 at 11:50 am
My wife has left family home with my daughter the house is solely in my name I have paid all bills even though she earned more than me she is forcing me to sell house which will make me homeless even though she has another house which she rents I am on a low income
Chris 02/01/2019 at 11:50 pm
@annoyeddad.mate I haven’t seen my daughter sence she was 5 .so her calling her step father dad (doesn’t bother me one bit and if she wanted to change her name to her mothers new name they have my blessing ).to be honest it’s probably the (right thing to do after the amount off time gone bye) .and it was( my choice )not to go legal and the mother off my child and myself are not on the( same page mentally) her thinking and my thinking are completely different we come from (two different worlds )gods truth .i respect the mother for not wanting child support it’s was the right thing to do because for two years why she lived in my house she was in a relationship with my uncle and others .so if she has settled down and got married that’s great good for her and her kids .after all these years I made the right choice and I am sticking to it .

I have been separated from my son's mother for 5yrs and entered a new relationship...i had an extreme amount of access to my boy for a long time til then.
But since my new relationship I have been scrutinised and insulted aswell as threatened by my child's mother and her family...my access in the week has been stopped and now recently all access until she gets her day in court...my son has been continuously used as a pawn to hurt me as it is well known how much of a bond me and my son have with each other...
His school and support worker have both supported the fact there is no reason for me not to have contact.
I have made my application to court and have received my court date for 1st hearing
I will be representing myself and would like some advice on how to present myself and case in court aswell as what the usual out come for father's is please.
Zadr90 21/09/2018 at 2:19 am
I'm still waiting for you to get back to me 14 months later. I've made it quite clear that I can't represent myself due to disability, nor can I go through mediation due to that reason, and I can't afford a solicitor, an di can't contact my ex. SO WHAT DO I DO????
RobC Editor 31/07/2018 at 2:16 pm
@AOC123 - You can't personally take an injunction out against an individual because that is up to the courts to decide. If the person who is in your ex's life has not committed any chargeable crime then you cannot apply for one. Otherwise everyone would be applying for injunctions against people they didn't like. Reading between the lines it sounds as though you don't want a man to be around your kids..... but what your ex does and who she chooses to see now you are separated is completely up to her. In other words you can't make judgements on who she chooses to have in her life.
AOC123 31/07/2018 at 1:26 am
Hi
My ex had blocked my number for no reason tonight as I found out when trying to contact her regarding my kids. I then called her several times on private number & left 3 voicemails with no reply which is strange for her even when she's telling me I can't see my kids she will still lreply. I know she suffers from depression & has a split personality at the best of times. She has previously told me on numerous occasions that she wants to kill herself. I obviously thought there was something not quite right so I went to the house to see if everything was ok when I found that there was another man there & he starts to threaten me so I have to leave as I do not want that around my kids. He then gets on his moped & chases me whilst I'm driving my car & threatening me through the window. He is obviously not fit enough to be around my kids as he is clearly violent & that is the exact reason why I have pleaded with my ex not to let men around my kids. I called the police to report it & asked them to go to the house to make sure my kids are ok but they refused to so I asked if I can get an injunction against him to prevent him from being around my kids but they didn't really seem interested. Is there a way to get an injunction against him?
Dwbubble 18/06/2018 at 11:36 pm
I am applying for contact threw the court and my ex is totally lying threw her back teeth to portray me as aggressive when in fact she has been just as bad with her shouting etc there is no domestic violence but she has somehow got legal aid I have to represent myself but how can a court listen to her lies spoken to court by her solicitor how do they determine the truth I think I am going to have a rough ride and an unfair hearing

Hi
It’s Christmas! My daughter is now a month and a half old and I’ve seen her for 45 minutes. The finally divorce absolute came through a month after her birth and my ex is being difficult. I’m not on birth certificate and I’m worried in future it’ll be difficult to see my daughter. Domestic violence was given as her reason but it’s just not true. She wants me to see her on her terms but I need something more legally binding. Any suggestions guys?
Parmo 28/09/2017 at 4:48 pm
I cannon get legal aid and cannot afford legal costs so after some advice please.

My wife in August 2015, left abandoned the family home and left me with my 7 year old son. She has not seen him since and some 2 years later. He's now 9 Turned up at his school as she has found out me and him Are moving 45 miles away. Advice please

Thanks
Roadrunner 15/09/2017 at 9:08 pm
I'm going through a divorce and my ex is determined to turn the kids against me my eldest 2 want nothing to do with me. My ten year old has supervised phone calls. He is told what he can and can't answer, and if I ask a question that she doesn't like or say something she doesn't like she puts the phone down. This has been as simple as mentioning my new partners name or asking where he went on holiday.

My only crime was that I had a nervous breakdown and made an attempt on my life. I have never hurt any of my family and she has not got any violence or restraining orders. I work with children in a private school. I live with my partner and her 3 children, but she demands that I can see my son but only if her and her father supervise me. Her father has threatened me multiple times and now lives with his daughter in the house I fully paid for and which they changed the locks on.

I'm running out of money. I work part time and I can't afford a barrister. If there is anyone who can assist with my circumstances, or have been unwell and tried to get access to their children please help.

I have a letter off my psychologist to say I am no threat to my son, I have a report from a social worker to say that I am a good dad to my partners kids and I had my home and my parenting assessed.

I am about to go to court and I want to know do I need a barrister, or can I get away with stating my facts myself. I could maybe afford one a couple of times depending on the time frame but I don't think I can manage one for every hearing....when is the best time. She will fight it to the end and I don't think even once through the courts she will comply , but I love my son and he loves me and I have to keep trying
Zdr90 13/09/2017 at 9:39 am
Then it sounds like there is nothing i can do about it, due to my aforementioned issues. Just have to accept that i cant do anything about it and try to move on (easier said then done).
Bina9 31/08/2017 at 5:28 pm
Hi my partner and his ex separated over 6 years ago (lived together but not married) and she has stopped him having access to his daughter for the last 3 years. He has paid CSA from day one. He took her to court 3 years ago but they dismissed his case saying they needed to go through mediation. He paid for 3 sessions of mediation but she never showed up. He paid nearly £5000 for the first court case so didn't have the money to try again. We are both now trying to get financially stable and get our own house but he can't afford to do this as well as save up to take her to court again. Is there any advice out there about the best option for him to try and get his daughter back. His ex refuses all contact with him so making an arrangement with her is out of the question (for background she ran off with my partners best friend and subsequently got married to him and they have their own child together so she wants to play happy families and doesn't want my partner in the picture)
Zdr90 25/08/2017 at 4:41 pm
I appreciate you getting back to me and the work that PSU do; but unfortunately that's not going to work, due to my condition. I legitimately cannot talk in front of a courtroom of people due to my condition. So I need proper legal representation from a proper solicitor who's gonna talk for me. Thank you.
SeparatedDads Editor 22/08/2017 at 2:29 pm
If you're attending court without legal representation, you may be able to get some practical non-legal help from the Personal Support Unit (PSU). For example, they help with your paperwork, take you to the right office and sit with you in court
Zdr90 18/08/2017 at 5:44 pm
Can you at least get back to me please? Even just to give me bad news!
Zrd90 10/08/2017 at 7:28 pm
I need a family law socilitor, but unfortunately can't afford one due to me not working due to me being disabled, and thanks to legal aid cuts. The only advise I've really received is to go through mediation or represent myself. Unfortunately, both of these options are out of the question due to me suffering from social anxiety disorder, bi polar and thus not having relavant confidence or social skills to self represent. I mean please someone explain if there is anything that can be done, or if I'm going to spend the rest of my life never seeing my child again.
Steph 29/07/2017 at 4:25 pm
Hi
Need some advice I've a contact order agreed by myself for my daughters grandmother to see my child at her house once a month for 6 hours I agreed this in February 2017 on the grounds that my daughter who is 9 said she wants to see her so I agreed to the order , but now my daughter has said she doesn't want to because she doesn't like her house and she mean so I stopped her from going as she expressed a few times that she doesn't want to attend her house anymore , her Nan has sent out a warning letter from solicitor saying I'm breaching the order that I agreed willingly , I need advice as to do I have to go back to court for caffcass to speak to my child about going her house no more or do I wait for her solicitor to apply to court and I know. She has no parental responsibility so she got no legal rights to my child how successful would she be if my child still says no to going her house can they force her even though it just her Nan thanks please help some advice would be nice as can't afford solicitor myself . I also let you know my husband is adopting my daughter but this hasn't gone through yet till court date on September 6th 2017 and caffcass are already coming out to speak to her about her dad and her Nan for that hearing .

My ex and I are going through a divorce he has our oldest daughter who has special needs and I have our youngest daughter who is autistic. He has not allowed us to see my oldest since before Christmas "over 6 months now" the judge said he had to go over the evidence and we still have to wait to see her. Is there anything I can do to see my baby?
Ash 03/06/2017 at 12:27 pm
My ex partner stops me from seeing my daughter every now and then. The contact is 2h every other week in a contact centre as she has an injunction against me.

I can't contact her, and whenever she doesn't show up the only way to get her back to contact is to stop the money.

I've been told she does drugs while with looking after the kid(there is proof of this) that the state of the house is disgusting, and she is back with an ex partner that is been convicted for beating her up before... they live together and my kid lives with him too.

I don't know what to do, I don't want her to use the injunction against me, but I am tired of the intermittent contact and not be able to do anything about it. I have been from a few weeks to 5-6 months without seeing my daughter. It's worse since she found out I'm woth my new partner.

Also I want to take the contact out the contact centre, we only do the exchange there and then I can take her on my own, but it limitates my time with my daughter and my parents hasn't see her for a long time. I want proper access, overnights included with time.

There is any way around this without expending a fortune and taking her to court?
Bneca 26/05/2017 at 7:34 am
Hi. My children have been removed from the family homem in unsual circumstances. I came home from work to find my house had been trashed. I traced their mother to a far away town. The Police have told me to wait for the social worker get involved. I have left several messages with the social worker offices and have been told to contact a solicitor. I am very worried about the state of their mother's mental health. Their mother has threatened to make the children disappear. Its been two weeks and I do not know anything about my children and no really from social worker or the police. I believe she made some false accusations against me. She already moved my children from school without my consent. The Police and the social worker are not listening to me she for mental issues and I have paperwork to prove. I am really worried with my children safety and wellbeing.
SeparatedDads Editor 24/05/2017 at 1:56 pm
If the mother of your children does not agree to access or mediation in order to try to resolve these issues, you can apply to court. If you want the parentage of your children to be officially recognised you can apply for parental responsibility and to be registered through the courts (despite the fact another man is registered as the father of your son). In this case, your ex can be asked to help to provide a DNA test to prove paternity
Mo 24/05/2017 at 10:49 am
Hi,l have got two children a boy and a girl, but the thing is there mother is married to another man, which l never knew because she would always come to be with me,have a child than leave him,but the kids know am there father.the last time she left me is when l founds that l was not the one on the birth certificate of the boy and it was her husband who was.when l found out that she left with the kids and went back to her husband and she has not let me see the children, it's now one year.so what can do.the fact that am also not on the birth certificate of the children.
SeparatedDads Editor 10/05/2017 at 11:43 am
A parent can usually access Legal Aid if they have been a victim of domestic abuse of violence, This means the 'criminal damage' your ex may have had you arrested for has allowed her to claim for Legal Aid.
Lasaint 09/05/2017 at 9:23 pm
My partner and I split up a few months ago and I have not Seen my daughter since
My ex had me arrested for criminal damage
And now is taken me to court for a child arrangement order
How dose she manage to get legal aid when I can't and I am unemployed
Haz 31/03/2017 at 12:30 pm
Hi I am not married to my children's mother however I am on their birth certificate. Me and the children split up sometime ago and even when we were together she would not allow me to take the children out on their own unless she was there so really I only saw them when I went to her house. We are not together anymore and I would like to pick my children up take them shopping to the park spend time with them and then bring them back home to there mother when I have spent time with them. But because I am not with her anymore she won't let me be a dad and see them she will not even answer my phone calls or voice message I heard that she wants me to deliberately spend lots of money to fight her legally to see my kids and I don't have that type of money I don't want to go through mediation because she has been so evil to me it has stressed me out and we will not get anywhere with that can I skip mediation and apply directly to the courts so I can see my children if so how much is that and what form do I need?
SeparatedDads Editor 03/03/2017 at 12:39 pm
Your wife would have to request consent from the biological father and much depends upon whether he refuses or not. If he does, you would have to follow this issue up in court. It is highly unlikely he will be granted legal aid, as most legal aid has been withdrawn except in cases of domestic abuse. We can't predict what a court may decide - you can see more which

If you have not seen your daughter for two years, then there is no likelihood a court would opt to take your child from her resident parent and hand her over to you. The best you can hope for if you apply to court is initial supervised contact to start with (while you build up a relationship with your child) leading to unsupervised contact after a period of time. I'm afraid there is no easy answer to your question, the court will want to know why you did not apply two years ago when access was first stopped. If you would have applied then and been awarded contact to your child, you would be in a much better position to go for increased access now.

Hi I have been with my wife and married for 5 years, and been in my step daughters life for 7 years and , my daughters biological father has been in and out of prison, as of 2014 he had seen her twice in a contact centre and we were in court for a contact order but then for some reason he withdraw his legal aid and contact order and has not been in touch since. I am now going for a step parent adoption but was wondering he has legal representation would this be legal aid again or has all legal aid been withdrawn? what is the likelihood he could stop this adoption going through he hasn't seen her in 3 years or paid any money towards her upbringing.

My daughter split up from her baby's father when the baby was six weeks old . My daughter and her baby moved back home to live for the first year of my granddaughters life . She then moved out and went to live with a new boyfriend for about eight months . That didn't work out so she moved back home again with my granddaughter . After about three or four months we got my daughter and granddaughter a place of there own to live . To which she moved another boyfriend in and got pregnant with in a couple of months . Drawing all this time my granddaughter would spend most of the time at my house or her natural fathers house . My granddaughter is four years old now and still spends two to four nights a week at mine and the same at her fathers most weeks she only spends one night at her mothers house . Her father and myself have great difficulty getting my granddaughter to go with her mother . She will say she doesn't want to go her house because she just gets sent to her room and shouted at . There has also been time when she has said her mother and her mothers new husband had smacked her . This obviously upsets her father and myself but we are both to scared to say anything to my daughter in case she stops us from seeing my granddaughter. My granddaughters father has always paid maintenance through the CSA and between the two of us we buy all my granddaughters cloths and anything else she may need . It's getting harder and harder each time my granddaughter has to leave one of us . If her father was to say to her mother that his daughter is going to stay with him and my daughter called the police would they take my daughters side or would they say they are not getting involved as it hasn't gone to court and I know for a fact that my granddaughter would be saying she wanted to stay with her father or myself . As we are scarred to do this if the police will take my granddaughter away and give her back to my daughter as we don't know what she will be like to her

You will be assessed on your present parenting skills, not your past. Your past may be brought up in court by your great aunt's defence - however, if you have been assessed as having changed your ways this will go in your favour. The court will never remove a child from the resident parent/primary carer unless the situation warrants it and it is absolutely necessary for the child's safeguarding welfare.

If you have not abandoned your kids and have previously had regular contact, then it is highly unlikely a court will remove your name from the birth certificate.
Darren 26/02/2017 at 3:28 pm
My children are in my name and my ex is taking me too court to remove me from the birth certificate under abandonment rules I pay every week which is about to change to monthly as she is taking me to the csa, and up until recently I've see them every Sunday but she is now refusing to allow me to see them. Hi I was seeing 3 of my five children three nights a week (the other two are older and would rather play with there friends) of which I did not mind,I'd collect them after I finished work on a weds and drop them back on a Thursday morning, then I would collect them on a saturday when I finished work and have them until Monday morning and drop them back before school. This would happen twice a month, then from the Sunday till the monday the other two weeks of the month. This was all goin good I gave her money each weekend when I collected them and she was happy for them to meet and stay with my new partner on Saturday night as I worked the door, up until my new partner became pregnant! she stopped all contact for me, saying some nasty things about our new child, she had police at my door sayin I said threatening things to her and was unproven by the police. She got a non molestation order off the back of that and said a lot of untrue things of which I could not disprove as I didn't have the £5000 solicitors fees and she got her for free claiming domestic violence! (unproven) so I went to court and said I'm not bothered about the molestation order as I didn't want to be around her, it's my kids I want to see and they kept the non molestation order in place and my ex said no to direct or indirect access. so it's now a yr on I have seen one of my kids in the street a couple of times and sat a talked played with him for an hour I have been to mediation of which she ignored along with my messages and letters for amicable discussion and time for me to see my kids I have made an application to the courts at a cost of £215 of which I have not got! And just wanted a bit of advice on where I go from here I can't afford a solicitor and she gets hers for free on the back of some wild allegations that have never been proven so I'm guilty until I prove myself innocent! I thought it was the other way round in this country. Please a little advice

Hi
I have recently divorced. I have contiued to pay the mortgage and a loan since separating two years ago. My ex is refusing to contribute towards making any payments. Where would l stand in a court of law if applying for her to make a contribution.
SeparatedDads Editor 05/12/2016 at 12:49 pm
It is highly unlikely the court would force your ex to sell the house, as a court will always opt for what is in the best interests of your child, which is as minimum disruption as possible. As a rule, the court would allow the resident-parent to stay in the house with your child, until your child leaves home, or full-time education (around aged 18). The court may then request the house is then sold and the equity split between you. However, this is pure supposition and I cannot predict what a court may decide, as other factors may be considered. Much also depends upon who is paying the mortgage, if your wife has continued to pay the mortgage since you have left and will continue to in the future, the court will invariably take this into consideration when deciding any future financial split.

Hi,
I have a 6 years old daughter live with her mother when we spilit up April 2015. She used to stay with me every week end and all bank holidays. I used to pay for her everything and some money to my ex as well every week. My name is on her birth certificate. Suddenly 3 weeks ago she telling me that my daughter don't want to see me or want anything to do with me but she went to Child maintenance Agency for child maintenance. I am happy to pay for my daughter no problem here but she is refusing to let me see her. As she is seeing another man he is advising her to get my money but not to keep any contact with my daughter.
Please could you kindly tell me what rights I do have. While she used to spend every single week end and bank holidays now she is keeping her away from me but want full money. I am not sure what can I do?
Thanks in advance.

Hi, I have recently lost a court case regarding my 2 babies I have to my ex partner. She ran off with someone else with my babies, and somebody tipped her off that I was looking for them. She then made a false allegation of domestic violence, thus getting me arrested and locked up for 23/half hours. No further action was the result of that. I applied through the courts, to have access to my two babies. Anyhow got to court and when I was in the courtroom it was all going OK for the first few minutes, then cafcass opened their mouth and stated that I was arrested for dv. Even though nfa became of it, they ripped me to shreds and then the judge became one sided away from my half of the field. The social services then got involved and told me I can't go anywhere near my other children until this is sorted. I was disgusted by that. My other ex (who has my oldest son with who is 10) was appalled by this, she flipped out and said that she doesn't believe that I was any risk to anyone and that she knows me best. They didn't listen. I was really upset by this all over one false allegation. I went inot srevere depression over this. Went to see my doctor to get help. When It went back to court, cafcass said that I was restricted now by the local authority and I now have a mental illness which made things a whole lot worse. At this point I was feeling suicidal and knowing I didn't have a leg to stand on. Then there was a final hearing 2 weeks later.. in that time my ex applied for a non molestation order to boost her chance more and was granted it. Temporary ones are given out like retail flyers. Then she had me arrested 3 times all in case where I was proven innocent, and then one more the night before our final hearing. In which I was taken 20 miles away to a police station in the town where she lived and kept in. I was still locked up when the final hearing was due and I missed it. I did stress to the police that this was all occurring and for them to contact the court. They tried but it was too late. The officers felt really sorry for me and they voluntary sat with me in my cell and gave me advice. Because I had been there 3 times before and they knew what was going on that it was a stunt. They even gave me a lift home after I was released for another nfa. I got home and I found out I lost the court case and any custody of my babies due to social services recommendations. A few weeks went by and I was reading through the statements. And I noticed a lot of errors on my exs where it all contradicts itself, the court failed to see this. I applied to the courts again and stressed this but was rejected. I also shown that there was hard evidence that there was no domestic violence within the statement. This was also rejected. I shown the police the evidence and they said they can't do anything to her, as it may put her off contacting them again. The social services had lifted the restrictions on me seeing my oldest son after seeing that. But it is still on

Hello. My boyfriend is currently in prison. He has a son with his ex partner. He wants to be able to see his son and has tried to call her, sent her letters and also have friends talk to her. She said she will not let him see the baby. She will not take him to prison nor send him with friends. What can he do to be able to see his son? He is one year old.
Thanks.

Considering that these legal aid cuts are totally corrupt and unfair, I was just wondering when they are going to be revearsed? I will lose all faith in humanity if they are not reversed considering how unfair they are? Seriously it makes me wonder how stupid people are to vote in these Neo Darwinist.

The article: Mediation: What is it and is it For Me? here may be able to answer your question more fully regarding how the mediation process works. Once an agreement is reached it is sent to the court and when approved by the court both parties are given a copy of the agreement. The agreement is what the parents are advised to keep to once the mediation process has finished.
Princess 12/05/2016 at 8:51 pm
Thanks you so much for the time taken to answer my questions.

But I needed to clarify this point you made in my last posting, as in the previous posting you included a link which I have a look at the various pages.

You did mention..." While this is not legally binding, it is on record and signed off by the courts"

When you say "...this is recorded on record" is this ONLY with the solicitors office or will the solicitor send a copy of the Agreement to the courts to get it signed off?

If so, is it at this point that the Agreement will be signed off by the courts and a copy be kept, but a signed off copy by the courts sent back to my friend and his ex?

If not, how or what is the process of the agreement been sent to the courts and signed off by the courts?
SeparatedDads Editor 12/05/2016 at 2:26 pm
Court is only ever usually used as a last resort and when the two parties cannot agree. If your friend is on good terms with his ex, they can write up a mutual agreement between them, either through mediation or through a solicitor. While this is not legally binding, it is on record and signed off by the courts. Therefore, this will show the amount of input he has into his children's lives and this would stand up well in court should anything go awry. Plus, it will cost a lot less than taking the matter to court. It also means that if mediation does break down, he will then be able to take the matter directly to court. The court hopes that couples can decide between themselves and work through any issues through mutual negotiation. If your friend still feels he would rather the issue went to court then he would need to seek legal advice.
Princess 12/05/2016 at 12:09 am
Hi, thank you for your response. But I'll like to clarify the issue about getting a binding contact order as this cannot be done through the Mediation centre.

Does it mean that because my friend and the mother of his children are on good terms and he currently sees and has contact with his now children, they wouldn't be able to apply for a contact order? Or if they apple the courts would reject it? Or reject their application? Is this correct?

Because the purpose why my friend want to get it legalling bind, is because him and the mother of the children are not married and this is unlikely to happen. But he does fear that if something happens like him meeting someone new or decides to get married, then she may at that point start making it very hard for him to see the children, or may just not allow him to get involved with the children any more.

So now that things are good, even though they have never lived together, he just wants ti put something in place that is legalling bind, preadvanture, things change.

So what may be his best option?
SeparatedDads Editor 11/05/2016 at 2:19 pm
Your friend can arrange contact through Mediation, but while this is approved by the courts, the arrangement is not legally binding. The courts want parents to organise access through Mediation first and only if this falls through and as a last resort will your friend be allowed to apply to court. With regards to Parental Responsibility; if he is named on the birth certificate then he naturally has PR. If he isn't on the birth certificate he can apply through the court for PR, but this doesn not give him shared-care of the child, it merely gives him 'some' rights, He does not need to involve Social Services unless there is safeguarding issues. I hope this helps.
Princess 10/05/2016 at 9:47 pm
I've been heping a friend has he has children, but is not married to the mums children. But both are on good terms, but though it best to have a Parent Responsility Agreement legalling binding, which includes the fact that the mother and father will share equal responsibility for the children amongst other things. They have already seen a mediation, but wanted to take out a contact order so it can be legalling binding, as the mediator adviser did inform my friend that the document they have received from the mediator center is not legalling binding. In order for my friend to get a legalling binding contact order. This is also to safe guard seeing his children if things change between him and the mothers children, as they are not married. Can he apply directly to the courts using the form C100 for a contact order? Also does he need to get the social services involved?
SeparatedDads Editor 10/05/2016 at 12:19 pm
Your ex's solicitor is obviously working for what is in the best interests of your ex, so has no right to inform you what you can and can't to with regards to access to your son. If you disagree with your ex and her solicitor then your only other options are to either suggest mediation and/or take the matter to court. You don't say how old your son is, but if he is aged over 11, then his opinion and preferences will be taken into consideration by Cafcass, should the matter go to court. I suggest in the first instance you take legal advice in order to find out what your options are. Any court order made through the court will be official and your ex would not be able to chop and change.

Hi, I am looking for some advice,
My ex partner of 9 years and I have been split for 2 years now. I was working 160+ miles away and after the split decided to move where I worked, recently my ex went to see a solicitor as our son had told me he wanted to live with me and didn't want to stay there as he was being bullied by her new partners child that is older. when I had told his mother what was said and stated we needed as parents to come to a conclusion she stopped me seeing him and lied to her solicitor on various things, when I had responded rather well to her solicitor I was granted my access back. however this is where it turns sour, I saw my son 3 out of 4 weekends a month Friday evening to Sunday lunch time. totalling less than 48hours per weekend, I am now being told that I'm being further restricted to just every other weekend so that's just less than 48hours a fortnight. is there anything that will allow me to have my contact as previous as she says her solicitor has told her but not told me, only thing I was told was to complete and respond to allegations made and provide address proof which I had done then access would commence as per normal. so I'm getting different stories from both her solicitor and my ex herself.
Anyone with a bit of advice on this matter. as I do all the travelling both to and from visitation I wouldn't see there would be an issue.
Thanks in advance.

well first of all this is about my son in February he was told by his ex that she was pregnet and that he was going to be a father she was almost 5 months she came over to visit and looked at all the stuff we had for the baby and she seemed really happy then after she left that day she called my son and started telling him that she was not going to give the baby his last name and that he wasnt going to be able to sign the birth certificate and just giving him a hard time and then she would tell him that shes not sure if he is the father now he just doesnt know what to do he is afraid of the way shes acting what if he is the father and she doesnt let him see the baby what should he do and what could he do my son is a really nice kid hes 20 and he was excited to be a father but now he is devastated the way hes being treated he doesnt want to hurt her in anyway and take her to court if he doesnt have to he would rather solve the issue out of court but he does want to be able to see his son any suggestions on what he could do

So I am dad thats had full care of my 2 children 2yr old and a 5year old for the past 9 months

I have always allowed contact but due to my ex partner living 160miles away and the risk factors invoved if she was to just take them

I have had to have a level of supervised contact which ive lowered to unsupervised but she has to stay within a play center and i stand outside

I have just had my famliy group conffrance meeting and my ex is still saying she wants full residancey...

They is no safe guarding issues on either side

Could she get it?

Also does it matter who takes it to court

Do both partys need to put in a application in as such?

And does it make any diffrance who does first at all?
SeparatedDads Editor 12/04/2016 at 11:14 am
In order to apply for PR your partner needs to be connected to the child, eg as their father, step-parent or 2nd female parent, Please also see: Changing Your Child's Surname, here for more advice on the procedure that has to be undertaken.

It's a sensible approach and I don't think you are being unreasonable. If your ex hasn't supplied one clean test then the courts will take this into account. If you are concerned about your son's welfare because of your ex's habit and unreliability as a consequence, then Cafcass and the courts will take this on board and the court will uphold what it thinks is in your child's best interests. The judge will always err on the side of caution regarding access in such circumstances and should request a series of clean tests before unsupervised access will be granted.
Sil 07/03/2016 at 1:55 pm
Hi,
Split up with 3 year old child's dad when 3 months old due to the fathers ongoing heroin addiction. Since then it's been a whirlwind of lies, turning up high, not turning up. Not being responsible etc. I now have had enough and have said if he can supply regular negative drug tests then we can think about supervised access until he is 100% clean and then happy to do unsupervised access. His family have all turned against me like I am the bad one and I am waiting for this to go to court for the judge to decide. As with most addicts he doesn't think he has a problem but hasn't supplied one clean test. I desperately want my son to have a healthy relationship with his father so it's not a case of I don't want him to see him but he is refusing all contact centres etc. I am happy to lit ( self represent ) but wondered if judge will see past his lies and do what is best for my son and demand clean drugs tests or just let him have him unsupervised?
Thanks in advance

I am sorry to here this. I'm afraid we can't comment on Spanish law. However, if you are married, in English law theoretically you should be able to claim up to half of his estate. If you can prove the amount you have spent on his home, then this will work in your favour. Unfortunately, the rest, such as supporting his 'lavish' lifestyle may be put down to your own choice and discretion.

I met my future husband in spain. I owned my own house. I was diagnosed with cancer. He asked me to move in with him and sell my home. I did. My partners house was in a bad state and in need of repair, painting, also on his suggestion my previous builder made two extensions. I paid over 60,000 euros out of my house sale money. I also kept my partner in clothes, food etc I was told I may have at least a few years to live. I told my partner that I had 4 private pensions as well as the full state pension, I worked full time all my life. He asked me to marry him. I said I would, but what guarantee would I have on the home in case things went wrong. He wrote a note stating if he died before me, I could stay in his home until my death. We went to America on holiday and married in Las Vegas. All paid for by me. Unbeknown to me, he had been seeing another woman. I suffered abuse, cruelty and he tried to get me to leave, saying why didn't I just die!!! I have had a few operations and survived. I now have heart trouble. Apparently he can get me out of the home I made lovely and comfortable for him. He offered me only 40,000 euros. He owes me money for a car he wanted, said at the time, he would pay me back. All in all I have spent every penny I had on his high lifestyle, holidays, kept house, cooked for him. I finally took a denuncia out on him when he hit me while I was ill in bed. I have to go to court on 24th feb, the denuncia sentence is finished. He is living with the same woman he has been having an affair with all along. I cannot afford to buy another home, I only have my pension to live on. I am at my wits end. I am 69 in March and count myself lucky to be alive still, thanks to my local hospital, torrevieja. Can any one give me some advice. I can't afford a solicitor anymore. Thank you.

Some months ago my son & partner separated, and he returned here to live with us as he couldn't afford a place of his own. They had a baby boy 10 months after meeting and we all love him dearly. When baby was 3 weeks old, mother demanded that my son had a DNA test to prove he was the father. He was gutted about this as he never had any doubts that the baby was his, but went along with her and had the test, which showed that he was the father. He stayed with her for ssome months, during which time she constantly accused him of having affairs, even deleting the phone numbers on his phone. Eventually he returned here, since which time we have had contact with Evan every Wednesday from 11am to 7pm, and every other Saturday from 11am, to sleepover till Sunday lunchtime. This has been wonderful, though has been a struggle as hubby and I are both in our 70s and in poor health, and living in a very small 2 bedroom house. 2 days before Xmas she decided to change this arrangement, so that my son would see Evan every other weekend from Friday morning to Sunday. I explained that, due to our age and helth conditions my hubby & I could not cope without some in between to recover from the disruption of a 15month old in the house, that such concentrated visits were impossible for us to cope with. I suggested that we have him, as now, every other Saturday/ Sunday and on Fridays on the weeks in between. She initially agreed to this and we were delighted. But by the evening she had changed her mind and said that if we did not agree her terms we'd never see Evan again. She is blaming me for this situation and has returned the last Maintenance payment from my son, posting unpleasant remarks on Facebook. My son is looking for his own flat, but finance is a problem, without the cost of any Court action. We are all distraught , as all attempts at contact are met with abuse. Any advice? We are concerned too about his welfare, as Mum is on anti-depressants, her other 2 children have chosen to live with their own father and there is an uncle who is a registered paedophile. What do we do?

Me and my ex split up 4 weeks ago. We have a 5 week old son together. She has a 4 year old daughter who I love to pieces as if she was my own and I have a 8 year old son from a previous marriage who I see all the time and pay for every week. My ex decided to end the relationship over txt not giving me any reason just saying dont come back. I didnt and stayed with family. Since then she has allowed me supervised visitation at her convenience. She has left my name off the birth certificate and expects me to pay every week which I do. She has never let me take him out and refuses to let me have him overnight. Then last week she stopped me having any contact with either child I havnt seen them in 6 days but txt everyday asking to see them. I either get No or ignored. I wasnt allowed to see them on xmas day. Im not a bad person I spend every spare minute with my 8 year old and me and his mam get on well. All I want is to be allowed to be a dad and to bond with my 5 week old son. Its killing me not seeing my kids. Ive got an appointment with solicitor nxt month and will go to court to sort all this out but cant face not seeing my kids for months until its sorted. Ive been nice as possible to my ex and she just keeps being horrible and using the kids to hurt me.

My freind has a daughter from a previous relationship. He has paid an agreed maintenance amount monthly to his ex.
Recently he lost his job and therefore couldn't pay maintainance for 2 months. In that time the ex has been hell. Not being available to answer the phone etc, and making things extremely difficult for the collection / drop off that happens 1 weekend, fort nightly.
She is now talking about moving further away (she has already moved an hour away so that her new partner is "away" from the "nasties" he was ganging around with. He's done time and they now have a child together.)
She is jobless, claiming benefits and isn't looking after the children...the new partner is.
Most recently she has threatened not to let my freind see his child over the Xmas period,
Usually he sees her Boxing Day for a few days.
My freind is married, has a very good job, owns his own house, car, is reliable etc but sadly once a fortnight he is having to deal with his nasty ex.
Is it worth him going for custody? (Ex sleeps all day suffering from depression)
Is it worth him going through the courts just to get it all official so that she doesn't mess him about every time he sees his child?
Any advice would be great.
Thank you.

Please see article: When Your Ex-Partner Denies You Access, whichYou have a right to see your daughter and if your ex will not say yes to mediation to sort it out, see link: Mediation: What is it and is it For Me? here, then you have no option than to take it to court. I hope this helps.

Carlos , i feel you my friend . There are many of us dads who are going through what you are going through . I cannot concentrate on work , feel like just ending it all but i know i have to pull through . Our daughters will one day know the truth about their fathers and their mothers will have a lot to answer for . Our children are our inspiration in life when they are taken from us what do we have left ? I do not know how some women can be so cruel and selfish . They do not only punish us but they punish our children to , why - because we are good loving men , that appears to be our crime .

Hi,
I would really appreciate some help please. My ex partner and I were together for 10yrs, never married. We lost our first daughter (still born) some years ago, we then ended up planning and having IVF treatment for our second. It was successful, the day after she found out she was pregnant she ended the relationship. I was with my daughter and ex in hospital when she was born and stayed with them for a week as they had to both stay in. It was always the case I'd stil be on the birth certificate and be a part of my daughters life, even though the ex didn't want to try and sort things given we had a daughter that we had both planned.

A couple weeks after she was born I had a call at work from her saying she had registered my daughters birth without me, we were both due to go a week later together. Since then she has sold her house and moved away, she won't let me know where they are living. I only had phone contact at the time, mostly text, to try sort things out, in the end she got me arrested for sending many Tx to sort contact, she ignored most, hence the number I sent in frustration, I had a caution for harassment, never been in trouble ever before!! there are no issues, court orders, violence, abuse etc .. Also only then had e mail as contact. I have seen my daughter only a few times since she was born, had to meet in some pub for a couple hours only, she wouldn't let me see her from November to February, so missed her all of Xmas, was not allowed to see her Father's Day, even though it was planned and also my birthday last week, she canceled access last minute, this is along with many other occasions I have asked to see her and it was planned and she let me down. The couple times I saw her this summer, I was able to bring her back to where I live for the day. She has now stopped all contact again, this time ignoring all of my emails and family's requests to see my daughter. I have now lost my job through all of this and feel my life's gone to ruin. I'm getting desperate.

All I want is to see my daughter, to have regular consistent contact and to also be on the birth certificate. I have called the c/advice, Police, Social services, spoke to a solicitor for advice, called the many numbers I have found on the Internet, mediators ( she ignores all requests to attend by me ) all to no avail. With my current situation, I can't even afford a solicitor, who tells me it would cost thousands to sort contact out with my daughter at court. I'm a nervous wreck.

I find it hard to believe in this day and age, if you don't have thousands for a solicitor you can lose your children and the mother is within the law to just hide away with your children and nobody wants to do anything about it.

Why should I just walk away from my baby daughter? It's killing me.
SeparatedDads Editor 13/08/2015 at 12:32 pm
You would really have to apply through the courts and if you are on a low income you may not have to pay for the court orders, so this will help. Also, as suggested in the article you can self-litigate which cuts down on court costs. Many parents are having a good amount of success when taking this route, if their cases are prepared properly. With regards to not having an address for your son, you will need to apply via the court form C4 which is an application for an order for disclosure of a child's whereabouts. For any other advice, our Separated Dads Facebook page may help give extra advice and support. Wishing you the best of luck.

I had the same issues however after much deliberation she always held the ace card out of Court. However I took her to Court when my daughter was 6 years old she is now 10 years old and am now going back to Court as my Daughter has made a request to reside with her Farther. The Mother tried to instegate such a Parental program with the Child the tables have somwhat turned againest the Mother. Fight for your Daughter never ever give up think of yourself as a Navy Seal you never Give up. Regards John.

Hi there,
I have ended up living in Scotland whilst my child lives near London in England. We (my wife and I) never planned on moving to Scotland but after 18 months of being made homeless and jobless we were eventually homed in Scotland due to my wife's parents already living there. I admit to not having much contact with my son but as you can imagine being homeless and jobless equate to being penniless as well. The mother of my son has now moved house and not given me the new address. She has blocked my sons friendship on Facebook so I have no way of contacting him. I really would like contact to be reinstated with my son. I have never harmed my son in any way yet the last words the mother said was that he was suicidal. His last words to me were "Looking forward to seeing you dad"
Too nice for my own 25/07/2015 at 12:35 pm
My partner of 9 years, mother to 6 children all under 12, the younger 3 are biologically mine, but all 6 call me dad, one is severely autistic, has cheated on us and moved out to live with another man. Neither of us has close family in this country, so I solely looked after all 6 kids to date (she moved out 7 months ago). I had to give up my job and alter my life to become a single dad. And because she always ran the finances and everything to do with the house and family, I am clueless on all of that, so I still rely on her supporting us financially with the promise that she will change rent, child benefit etc to my name..
She is now black mailing me into allowing her to take our children to live with her and her new partner for at least half a week, and because I refuse to allow my biological 3 to go with her, she is threatening to not give me money and to force take them too..
I am already distraught to have lost her to another man, and now it seems that I am about to lose my children to him too..
I am very disappointed with the government for withdrawing legal aid, I have called hundreds of solicitors, family mediation centres, legal advice groups, citizen advice bureau and many other organisations such as coram and gingerbread.. All with no avail..
I really don't know what to try anymore nor who to turn to?
If anyone can help me, I will be ever so grateful.
I have also applied for several part time jobs so that I can afford to pay a solicitor or at least the court fees (if I ever manage to fill in the c100 form) even mediation is not free and she has refused to attend anyway..
Please help, any advice will be a bonus as I am approaching the giving up point..

How do I self litigate to the court to get access to see my son

Thanks
SeparatedDads Editor 04/06/2015 at 11:33 am
@T - I'm glad you find the websites useful. There is not much more I can add to the article, except to say that if your ex is being difficult, then you would need to take it through the courts if you wanted to apply to gain more access to your daughter. You can self-litigate, a lot of parents are having good success this way, if they prepare their case well. Our Separated Dads Facebook page may also be useful and if you scroll down some of the previous comments, there are a couple on self-litigation which should help.

Firstly thanks for this really comprehensive website it's been really helpful. My daughter is now 10 and I have been separated from her mother since she was about a year old. I left her for another woman who I've been with since then and he and we are expecting a baby. My contact with my daughter has always been strained and under the mothers terms. She allows contact but it is limited to taking her out for the day and she can have an overnight with but only if I come to town (I live in London an hour away) and she stays with me at my mothers house. Christmas is a strain as I have her Boxing Day but my ex refuses my new partner to come in contact with my daughter (for no valid reason than this is the woman I left her for) so this breaks up my whole family christmas. My ex has a new partner who she has been living with for about 18 months but she still imposes this rule. Recently I asked if my daughter could come for an overnight at my home on London and have implored her to consider my daughter but it falls on deaf ears. She also manipulates my daughter into saying she doesn't want to meet my partner or come to see me but when I'm alone with my daughter she says this is not true and she only says this not to get in trouble when her mother is observing our phone conversations. Now my new baby is due and I fear the two siblings will have little to no contact which is sad. I have mentioned mediation but I know that my ex won't budge on her demands. Recently I bought my daughter a phone as calling her at home was not working (the phone was never answered) my ex bought her a new chip and changed her number without telling me. She also does not let her see my side of the family who have only ever supported her. She has also taken my daughter on holiday with her new partner without telling me several times do I have a say in this or not? Please I need some help.

Hi I haven't had any sleep for days I've had a few issues with my sons mother I was a heavy drinker and commited domestic violence a few year back but had all that sorted out signed off from probation and social services nearly 4 years ago in that space of that time I have had my son every weekend and every school holiday and week ago on Sunday he was acting up saying he didn't want to go home cos her partner was putting him in the passage and shutting the door and making him stand there for being naughty so I told her I didn't like it is this fair or am I missing the point (in my eyes it's child abuse) anyway I received a message stating I am not allowed any contact with him and wasn't sure of any avenues to go down wether to contact social services about it or what, I have took all the legalities of what to do about contact so thanks for that
SeparatedDads Editor 23/04/2015 at 1:49 pm
@ummaryam - regardless of where he is living, it doesn't mean that your ex doesn't want to see his son. If he takes it to court then as the article suggests you can use a McKenzie friend and self-litigate if you can't afford the legal fees. However, the courts are likely to suggest that if you can't sort out contact between yourselves then you try mediation first. However, mediation is voluntary and if you would rather the court decide whether your ex has contact, then you can refuse. See article; Mediation: What is it and is it For Me? whichI hope this helps.

SeparatedDads Editor 24/03/2015 at 12:18 pm
@juder - yes, you can apply for a Specific Issue order, that might allow you to take your child if your ex cannot look after him. In order to be granted this, you may on the other hand need to prove that your ex is an alcoholic or has a drink problem, if you can. The courts don't like tit-for-tat mud-slinging between couples, so be careful how you approach this.
juder 20/03/2015 at 11:07 pm
My ex brought a case against me,saying I had taken our son from her care without consent (I'm on birth certificate ). She lied in her statement saying I was violent and used drugs. In fact her older children handed my son to me because she's an alcoholic and had a relapse. The court ordered a fact finding Mission and asked her to present evidence of my alleged abuse. She could not do so,they gave her 4 chances to do this statement. My question is,can I get that order that prevents me fro taking my son away if she drinks again removed?

@Phranc - you should not be denied contact to your son. You can use a McKenzie friend for advice, if you self-litigate, see article Using a McKenzie Friend in Court, whichYou may also find our Separated Dads Facebook page helpful as many dads have been through similar issues as yourself regarding being denied access and have after several attempts been successful. I hope this helps.

Hello there,
I was arbitrarily refused access to see my son (who is four) due to his mother deciding that this should be so. I'm a medically retired psychiatric nurse. After thirty four years service I was diagnosed with post traumatic stress disorder. The reasons for this were manifold (including two suicides whilst I was on duty). I was in charge during the second tragedy. In both cases both my self and the nursing team were praised for what we did in the subsequent coroner's courts.

I have been convalescing in Southern Ireland since 18/12/2014 at my mother's home. I have kept in regular (daily) phone contact with my son by phone ever since. I am now in a much better psychological place than before leaving England. My son was never neglected by me when he stayed with me. This is in no doubt. He begs to see me again when I talk to him. It hurts him. He pleads.

Tonight I spoke with his mother, and asked to see my son on my return. This was met with some derision of my mental state. She says that they are are going on holiday with her parents to the Isle of Wight in May of this year. She has told me previously that her father was extremely disparaging of me. I suspect that this may have been in front of my son. I am on an income of £840 per month (NHS pension). My rent is £630 in the UK. I cannot afford a solicitor.

My decline in mental health happened after he was taken from me. Not before. My pain now is not due to the depression that I have mentioned, but the further pain that he is suffering. This is not about me, though.

I will keep in touch.

Thanks for listening.

i have now been seperated from my ex wife for 10 months, which i did not want. I have 3 children with her the youngest is 5 and loldest is 11, she met someone else, was asked to leave the family home, and within 3 weeks this guy was there. Things have been a mess as i am currently living with parents and have been only seeing the children every other weekend and sometimes in the week on an evening. During the last 10 months i have had concernes with the childrens wellbeing and so has the school. Was told to contact the social services which i did. my ex has stopped me seeing the children on a few occasions but recently thing are getting out off hand and has stopped me again when i go to pick them up. i would try mediation but know she would not attend i feel the only cause of action is to apply to the courts for and order to see them on set weekends, everyother 1 night of the week i dont have them and part off the hollidays. do you think this is the right cause of action to take.

And contact orders on 6 pm firday to sunday 6pm...

Al most every year she takes my son out the UK without following the court orders...I never had the chance to take my outside the UK as priscribed by the family court....I have been deprived of my right in having regular contacts with my son....emotional black mail...the list goes on....before she got her stay in the UK as a legal citizen ....she use the welfare state ....taking me to a number of courts...in which she was not entitled to welfare benefits....I had to pay in full all legal expense.

She obtained UK residents by deceit and still giving me problems. What must I do....[removed]

this is a continuation of the post below:
or unpredictable but I feel that the fathering instinct in most men, especially if they have had, at some stage, a loving relationship with the mother, is extremely strong. it seems to me that the law is now (through negligence) very much on the side of women in this respect. Court cost are prohibitive and mothers who are seeking to bring up there children without giving access to their ex, know this. I speak as a woman who during her lifetime has seen some of the more rampant and unproductive effects of woman's liberation. It wasn't intended for this. Children need the love and input of both parents who put aside their differences for the sake of their children.
Unfortunately I think this site is mostly visited by fathers and not by the mothers who might be enlightened a little by some of these comments that have been posted.

My baby boy was taken from me at 3 mnths old. My wife left the marital home but returned two days later when I realised she was intending to separate. This was 15 mnths ago. I manage to see him now for a couple of hours on a Sunday. Weeks have missed and no access given on Christmas day or New Year. Ive missed everything of him growing up. I just want to die. This is no way for my son to grow up. Im a mess due to remaining at work t pay the bills and contributions (cash in hand to mother ) for over a year till I finally broke down-mainly with the constant pain from not knowing where and who my son is with, as well as the breakup of my family, added to the fact I have no friends I can turn to, Im homeless and spend many a night sleeping in my car. Over the period I have been accused of wife beating with ss involved and police charge awaiting court for 1 Assault 2 On line harassment (intent to cause fear and alarm) I just want to die. Ill go to jail I couldn't handle that as Im not a strong person dogged by self confidence issues and severe depression for many years. I am a natural father despite being scared to hold a baby before I held him whilst the maternity staff looked after my wife who was in trouble after birth. From then I have been a caring loving father who has doted on my wee champion since I saw his 20 wk scan. I cant stop crying at the mention of him and the hurt of it all is just too much. I feel Im going insane despite being prescribed antidepressants and zopiclone. I am a complete mess who can only now use alcohol to get through the night after work till Dec23...I drank every day thru the holidays because I had no more work to distract me. Now I have no money....I feel its inevitable Illl do something to myself if I cant get help

Hello I could really use some advice please if possible.
In September 14 after months of provable harassment and emotional blackmail with regular use of my two daughters as a weapon i finally snapped and slapped my ex twice she promptly had me charged, a non molestation order put in place and I have been given 60 hours community service and a fine. I moved from my home town because my ex and her family saw fit to ruin my good name as both her and her mother both work in the local supermarket the majority of my small town now think I am a woman beater even though even the police report stated there were no visible marks on her they have told people I really badly beat her up so I have been branded a woman beater in my own town ( the shame and the stares became too much ), stopped from seeing the youngest 2 of my three daughters as my oldest is to a different mother. I really have no clue where to get help to get access I work part time live with my new partner and her daughter so I don't really have any sort of disposable income and getting back into well paid work is near impossible as I now having had to give up my job and move away (I had a minor break down after being served in front of my boss while in work) i now have a criminal record so most employers won't give me a second glance. Not seeing my girls is eating me alive inside every day and my close family have also been stopped from seeing the girls... what am I meant to do??? Please help me if you can.

We have a profoundly deaf & registered blind daughter, her former husband walked out on her and their two children aged, boy 5 & girl 2 now aged 14 & 11. He has been very abusive on face book and on face to face meetings, he has not been to see the children for over a year.
We as grandparents want to give them a holiday to remember to the USA in August 2015 some thing their mother will never be able to do, and have asked him to sign a form giving his permission for us to act as their guardians over these dates. He has not acknowledged receipt of the form and not responded to text messages from our daughter or his son.
Our only advice has been to take him to court at a cost of £2,000(?) to have removed from him this power over the children which prevents them from going abroad (without their mother).
Do the children have any options to take control of this part of their lives which he denies them.

for the time upto the start of phoebiie {my daughter} joining nursary i had regular contact consisting of three days , wednesday . fri , and saturday , my time with her then got cut for no apparent reason to a sturday 9am/4pm and a wednesday 1pm/5pm and was told never to go to her school as i wasnt welcome .
this obviously had an immensed effect on my life but accepted it and as usual did as i was told , since this happend phoeibies mother has tryed her hardest to goad / push me to looseing my temper but to no evail, the last situation was bonfire night , this is the last occasion i had any contact with my daughter , the incident was in my eyes minor but she saw it as enough to stop all contact .
she has taken phoebie abroad twice without botheriing to tell me, she put phoeibie in a cresh that is still ongoing instead of letting me look after her , its so frustrateing as i can do nothing to stop it .
any help or advice is greatly appreciated about what to do or any other way than court , or if court is the only option what should i be doing top repare myself ,.

Hoping someone can help me go in the right direction...

I have been separated from the Mother of my Child (5) for 3 years now.
For the last two years, she has declined over night stays with my Son. She only allows me to see him on Saturdays, which entails an hour journey to pick him up for 10:00am, and her request is that I have him back before 6:45 for his 7:00pm 'apparent' bedtime!! So that's 4 hours travelling and 5 or so hours bonding time. I pay CSA to her every month for my Son's needs, I also pay for travel to see my Son. She has recently moved address and is not willing to tell me where my Son is now living, but yet I give her money! Can I refuse CSA payments until she shares this information. Surely I have legal rights to know this information.

I do have contact with my Son's school, off my own back as she does not tell me a thing. Missed his Nativity play last year because she told me the day before, clearly knowing I wouldnt be able to make it due to not enough notice for work! So I have made my own dealings with the school for them to send me weekly newsletters and regular updates on my Son's progress.

There was even one time, that the trains were delayed in bringing my Son home, she moaned about it over the phone a number of times saying I was lying, she threatened to call the police, for what reason I do not know! So I ended up forwarding her the live train information.

I have kept all her messages, printed out in a folder. I have receipts of what I do for my Son, travel, gifts etc, anything that has relevance to my Son.

She took my Son holiday this year, without even talking to me about it. Yet, I went on Holiday this year also, asked my Son if he would like to go on Holiday with Daddy and he was happy to be potentially going away and spending time with his Father. So when it came to asking his mother, she declined at first instance without even considering it.

She has also blocked my number from calling her. So if and when I do have my son, should there be emergency, I am unable to contact her yet it will probably be my fault for not informing her!! Not quite sure how that logic works!

I try my absolute best to stand by my Son, but keep on getting backed into a corner by his Mother! But I am not going to give up! Thats not me! He is also my Son. Not just her Son.

Thank you for this article, it is really beneficial to know. It does seem that so many areas of law are under enormous pressure. So this knowledge is greatly appreciated.

Immensely grateful for this posting. Is another reason for the upsurge in LIPs because society is getting more unequal?
