My Ex-Wife Will Not Let Me See My Children
If children live with one parent and the other parent is not happy with the amount of time that they get to spend with the children that parent may want to apply to the court for a Child Arrangements Order. It is always best to try to reach an agreement without having to go to court but, if that is not possible, an application can be made to the court. To apply to the court for a Child Arrangements Order form C100 should be used.
I Have a Contact Order but My Ex-Partner is Not Complying with It
If the court has already granted a Child Arrangements Order but one of the parents is not complying with it the other parent may apply to the court for an Enforcement Order and / or for an order that the person who has breached the Child Arrangements Order provides financial compensation to the other parent. Under an Enforcement Order the parent who has breached the Child Arrangements Order may be ordered to carry out unpaid work. Financial compensation may be appropriate if one parent lost or wasted money because the Child Arrangements Order was breached. Form C79 should be used when applying for an Enforcement Order or for financial compensation.
I Need a Warning Notice to be Attached to My Contact Order
The courts can only grant an Enforcement Order, or order financial compensation, in respect of a Child Arrangements Order if the Child Arrangements Order contains a warning notice. This notice tells all parties to the Child Arrangements Order what might happen if they do not comply with it. Since 8th December 2008 all Child Arrangements Orders have a warning notice attached automatically. If a person wants to apply for an Enforcement Order in respect of a Contact Order made before 8th December 2008 they must first apply to the court for a warning notice to be attached to it – this is done using Form C78.

I Want My Children to Come and Live With Me
It is still common for children to live with their mother when their parents' relationship breaks down. However, there is no law which says that this is what must happen. If a parent wants the court to make an order that the children should live with them they can use form C100 to apply for a Child Arrangements Order.
I Want to Apply to Have Parental Responsibility for My Children
Fathers do not automatically have Parental Responsibility for their children. They may not have it if, for example, they were not married to the child's mother when it was born and did not register the birth jointly with the mother. If the father and mother reach an agreement that the father should have Parental Responsibility the father can apply for a Parental Responsibility Agreement using form C(PRA1). Step-fathers can apply using form C(PRA2). If it is not possible to reach an agreement about Parental Responsibility an application can be made for a Parental Responsibility Order using form C1.
I'm Worried that My Ex-Wife is Going to Take My Children Abroad
There may be cases where one parent is worried that the other parent is going to do something, which may not be harmful in itself. However, it may be something that impacts on the other parent's relationship with the children. For example, the children's mother may have relatives abroad and the father is worried that the children will be taken abroad to live permanently. The court may be asked to make a Prohibited Steps Order using Form C100. If an order is made the parent will be prevented from carrying out the particular act without first getting the court's permission.

Forms are easy to fill in and easly accesable in family court -didnt see any in county court so must be printed online Legal aid was avaliable just prepare for 4 hearings and being blamed..much harsh on single mothers who are in temp council hosuing as if im.guilty it takes 10 years to house and end the welfare problem and their right to work an such families.

I have asked for her consent and his passport verbally and via a written letter and she has refused and says i should take her to court. I have got the C100 form ready but before I file it I was wondering if I need to attend or offer to attend an MIAM? When we went through court earlier this year I attended an MIAM but not within the last four months. My ex refused on grounds of me being unreasonable. I can't see anything in the C100 exemption from MIAM section about holidays and I don't want to spend the money on filing the C100 for it to be sent back for not being filled out properly.

I have been split up with my ex for about 4-6 months and have been trying to get regular access to my 3 year old little girl, at first I tried things her way which consisited of the mother coming with me and my little girl to do family things: soft play areas meals etc, in the time since we've split I have tried to take an overdose (no tablets went into mouth) and been verbally abusive by text to my ex and was diagnosed with depression at the time, I'm over the worst of it now. as I have only seen my little girl 10 hours in the last 5 weeks and before then it could vary between 8 hours or 10 mins on a weekly basis, we tried mediation which my ex requested supervised visits by someone she trust (basically her or her mother), I know my behaviour has been erratic but I requested unsupervised visit therefore mediation failed, I don't want to go through the courts as it would be lengthy and costly process (money doesn't matter when it comes to seeing my little girl but I haven't got much at the moment), I am a just a hardworking guy with no crinmal record no drug or alcohol problems my name is on the birth certificate and never missed a maintence payment yet I made to feel like a horrible person by my ex only because I want to see my little girl, Im currently living with my mum and my brother in a council house which I hope to buy in the coming months hence why I don't want it to go to court, thinking of applying for joint access but any advice or help would be grateful

So my questions are...what rights does my partner have in stopping his son from seeing/staying at her ex husbands house (without the mum) ?

I made contact with my son via email and the following day the police paid me a visit to give me a warning, that if I continued to make contact, it could lead to harassment charges. I have not had a court order or any restraining orders , nor have we been to court. There is no violence or aggression at all. I was unfaithful during our separation and this has been her reaction. Now that we have brought a house in London our disposible income is smaller and we want to bring the kids down to stay with us some weekends as this works out to be more affordable (they have stayed in London with us in the past during school holidays and this has never been an issue). The kids have their own bedrooms at our house which i've just started setting up and decorating in their chosen wallpaper etc. and last time we spoke to them they were excited about coming to the new house. We would of course go and collect them from Nottingham so their mother wouldn't have to drive them anywhere. All of a sudden this has become an issue for her and she has started saying that it's my husband's own fault for moving away and he can only see the children if he comes to Nottingham.
We don't want to lose contact with the children but can't afford to keep spending out on hotels etc. If we can't resolve this between ourselves does anyone know whether a contact order would allow us to have the children in our home rather than the hotel?

I have suggested on numerous occasions that i would like to have my daughter stay during the week and i will.drop her at school the following morning, however i am flat refused. I have been in and out of court last 3 years after my ex did a runner with my son & got a order which I could not contact her.
I got a order in place by the judge and said to be amicable in relation to our son. Which she has not been.
The order was a minimum contact order was set in 2014 & she has not moved on the minimum contact. I have no holidays etc with him. Back in March this year she stopped contact for no reason. I tried mediation to resolve it which she refused to take part. So I have taken the c100 to court and awaiting a new court date.

I am named on the birth certificate of my 18 day old son and therefore have parental responsibility which means I get a say in the parts of my son's life such as education, religion and travel etc.
I am an atheist, However, my ex is adamant that she is raising my son as a Christian and will be getting him baptised and taking him to church on Sundays.

My partner decided to leave without notice 6 months ago and took our boys (both under 5) with her and moved back to Middlesbrough, a 2hr drive away from Manchester. It was 6 weeks before I managed to visit them. I came close to calling the police the moment I came home and they were all gone and I wished I had done now.
Gave her the benefit of the doubt and thought our minor issues would be resolved if she had space away. She put kids in school etc and me gullibly
thinking come the summer she'd see sense and return. Unfortunately not!
I had regular contact visiting kids there on my 4 days off and was regularly bringing them back here. However, things have deteriorated hugely the past fortnight and she demands a legal document is in place now before I can take kids again. Tried to reason with her that il' see kids in M'Boro in her presence but she is being vindictive and stupidly stubborn.

From reading up on this FANTASTIC website I have sent her Parental Responsibility letter and form and told her if she refuses to co-operate I have rights to go down the court route via an Interim Contact Order, but not told her of my main objective of a Residence Order.
My Questions are:
1/ If she does co-operate, How long does it take for me to get PR? Which this site tells me I need before I pursue a Contact Order.
2/ And then how long to get a Contact Order? Every day is a struggle as I think Mediation will be no good as she wants to remain there and I want the boys returned here.
3/ A problem I think is that my name is not on the older child's birth certificate. Would this go against me?
4/ REALISTICALLY, How likely am I to get my boys back? There are loads of mitigating circumstance that would take all day to explain here.

sorry to hear about the unfit mother, socialworks finest again. I knew a guy who was fighting for his little boy because his ex had a serious drug addiction and was refused as social work saw her as fit. That friend now has his son after she crashed the car she was driving on drugs. Died andthe childs spleen was ruptured. If shes only alcoholic she will look like a angel. Social work really need to get a grip and stop protecting women
The ex partner was horrible towards her which causes many problems and was not understanding made things worse . So after many things I had enough and had kick ex partner out with my babys . I had no choice I put up with this for two years .

So, my husband and I separated for a while, because he was seeing someone else. This someone else feel pregnant, but my husband had already moved back with me when she had told him. Since then she has made his life very difficult. Since the baby was born she has given him restricted access, only really allowing him to see the baby at her house. Or at his mothers, but the agreement was never to be around me or at our home. This was for 4 hours once a week. My husband has tried everything he can to see his daughter, without hefty fees of solicitors or court. But she is dictating every time. They work for the same company and have even spoken to a lady in HR that apparently used to deal with family law, but this has got him no further. Within the divorce I was ordered to clear an old business debt fixed to the family home. The order didn't give dates or time scales just stated it was my debt and as long as I made annual contributions to this debt I was complying with this order.

it took me 2 days to come to terms with what happened, then found out she cleaned our joint bank account including the overdraft.
Her family cut off communication links completely and so I had to go down the legal route.
Mediation was a waste of time as she didn't even bother acknowledging then so I am now apply to the courts filling in the C100 form.
my query is, she might be staying at her mother's but knowing her crafty family, they might put her official address in one of her brothers, who lives in a 1 bedroom flat just so that she would score favourably for rehousing showing overcrowding etc.
Also, if she does use an alias address, can she claim that she never received the mediation forms and ergo, any summons from the court because I am not certain of her actual address, I'm worried they are purposely trying to delay things in the hope to say that I have left it soo late! How can we go around the uncertainty of contacting the respondent problem by the courts?

August 2012 -- she gave a birth to a child (I didn't know that the child was born and she now tells me she didn't inform me because she believed I was not his father);
February 2013 -- she applies for simplified divorce, in her application form she ticked "NO" when asked if there are "children of the marriage". As I knew nothing about the child, I agreed to go through the simplified divorce;
April 2013 -- divorce granted;
March 2015 -- I have found she has a child, the DNA confirmed I am a father.
Could you please comment on the fact that my ex-wife lied in her divorce application that there are no "children of the marriage". What are the possible consequences for her? Can the fact that she lied help me in my court proceedings for a contact order with my child?

Apparently I got banned from seeing my son but is he still let me see him.
She then got a restraining order against me but continued to see me when it suited her..
It's at the stage now where I have done a prison sentence for breaching my restraining order.
Now she won't let any of my family see him and they have tried going to court to get access but she never turns up because apparently she hasn't received the letters.
The police have informed me that there is nothing to say I am banned from seeing my son so can I still get access whilst a restraining order for me not to contact his mum is still in place?? Please help
notice about the consequences if anyone subject to the contact order fails to comply with the requirements of the order. In the first instance it might be worth reminding your ex of this and if she doesn't comply you will have to take it back to court. A letter from a solicitor may work. If not then it may be necessary to bring the matter back to court and to bring enforcement proceedings. I hope this helps.
I obtained a contact order in 2013 to see my son, but at the time he wasnt in school and I was working night shifts so the contact order stated that I saw him on various days at various times during the day, as well as overnight at least one weekend a month and alternate xmas and birthday. since then my son has started full time school and I am in full time employment from 8-5 Monday to Friday, therefore the times stated in the order were no longer possible, so I agreed mutually with my ex partner that I would have my son every other weekend. This arrangement worked well for a few months up until last Christmas when it was my turn to have my son. My Ex refused to allow me to collect him and since then has refused to allow any contact. I am now in the situation where I need to go back to court to obtain further contact but im not sure if I need to apply for another separate contact order or an enforcement order on the original contact order and an amendment on some of the previously agreed times of contact as my Ex partner is breaching parts of the original order. Any advice would be greatly appreciated.

I feel that she and her new man , want me totally out of there lives along with our baby .
I've accepted the decept (although this hurt) ,as my main goal is to see our baby as much as possible.
Our baby has the right to see both parents as much as possible .
I feel that going to mediation will fail and then a lengthy court proceeding will not only upset myself but also affect our baby as well , as when I eventually get to see him regularly , he will not be use to me and may upset him for a while.
I don't understand that you hear about all those dads out there, that have nothing to do with there kids.
Yet like ourselves there are dads that Truly care about there's and only have there best interest at heart , no child should be deprived of bonding with there dad.
I would seem that she is not thinking in the best interest of our child , but of bitterness from out failed marriage.
New partners can come and go ......but fathers are for life.

My daughter is in need of braces, my ex has not paid a dime into maintenance in over 4 years. How and what forms do I need to fill out so that he can be responsible for partially paying what needs she has? I have been pushed back and forth by MEP Alberta because he was living in 3 provinces at the same time living off of 3 different women at 3 different residences. He has now settled down in Regina Saskatchewan. I now have a maintenance file in Saskatchewan but no one bothered to tell me that my case file was moved there. Its been a nasty run around for 4 years. Please help.

I keep requesting 50/50 week on week off, I am in a new relationship but not living under the same roof at present and we have 5 kids we are caring for my 3 year old son and 11 year old daughter and my partners 15, 17 and 20 year old, I am living with my eldest daughter her partner and my 2 grandchildren, as we have not done property settlement and I can not do anything until everything is settled. All kids get on,and love being together and this happends when I have access with my kids, everyone are really happy, but now my exwife is whispering awful things in my 3 year old ears about my current partner and her kids and me, she is telling him not to like anyone, and saying we are not allowed near him and to hate us all!
I also have porblems where my ex has made several false reports to the police and trying to get an AVO on me, all cases have been award to me in courts but it has cost me a fortune, so everytime I pick kids up and drop off I have someone with me or I always try to drop at school and child care so I am no where near her

Could you please reply to that below urgently as I need to file and serve a Statement in support of my C78 Application that I had to make in Harrogate County Court further to attempts toward same in York since September 2013 - you did confirm receipt of items I attached to my Application - but were they sent or copied to York from whom I have not had a response and a probable further Eleven years before my Son & I see each other again.
Is there an example of such a letter available for me to peruse?
Within procedure, am I expected to compile an up to 30 sheet statement, in the manner that I had to in 2003/4 or would a shorter Statement be more appropriate referring to events since JAYNE T* had Contact Ordered for my Son & I stopped for sole reason that my Son wished his Granddad a happy 90th Birthday from my Vodafone, followed by numerous hearings at the High Court at the Hague and Court of Rotterdam that became adjourned after my ex JAYNE T* would arrive without her Lawyers or not at all and the hearing adjourned and adjourned, increasing my costs in my continued attempts toward attaining Justice? Every Contact Order made in England & Wales and the Netherlands was Breached by ex Jayne Temple – generally her behaviour unopposed by the Court.
Because I do not know if the items I sent with my C78 Application to Harrogate have been sent to York or not for the attention of Her Honour Judge F*, I am unsure whether or not to include them again along with requirement of Statement in Support of C78 Application.
LK refused to provide to District Judge W*, the copy of letter I received from Rotterdam that confirmed my Son and ex back in York at * M*, H* - I am repeating myself, so please reply with requested information urgently please.

When I phoned his new school, they would not discuss one of there pupils with me, said I would have to ask his mother who has subsequently changed her phone number
Than 8 week 4 hours and then it's up to me and my ex sort out but my ex is not let me have my son for more then 4 hours when It was order that things move on when the 8 week was over I've asked my ex loads of times and she keep saying no and giving me a hard time I've had to get the police to them 3 times now to get them tell them to stop making trouble

This happened Nov2013.I have seen my son5 and daughter4 twice since.
She has changed her phone number and makes contact impossible.
My daughter was 4 on 9th February and my ex would not allow me to see her. . .
Even at her mothers house across the road!
I used to meet them from school,so they knew i wanted to see them,but have stopped because threats of harassment. . .What can i do??
He wants the boys to live with him and for me to see them when he is able to bring them back to the uk, i have refused.
I have no problem with him having contact with the children but when he has them for he refuses to bring them back unless i go to spain to pick them up, the problem with this is he is quite abusive when i dont do as im told , and has also threatens me with court. I have 3 other children from a past relationship so i have to live them with my family until i can come back this causes problems with my 3 other children.
The babies father has no experience with toddlers and even tho he has been abusive to me he has never shown signs of this with the boys but i'm still afraid to send them all the time in case he does. On top of this his mother has ordered me to let her have them for 1 weekend every month, if i don't she cried down the phone saying i'm taking them away, i wouldn't have a problem with them going if she did not change their routine so now my 2 year old who was out of bottles and potty trained has now gone back to bottles and is wetting himself, so it has made things hard for me having to retrain him everytime he comes back. I also feel i dont get enough time with my 1 year old to potty train him too, and now he is showing signs that he is un happy.
Please help as i don't know what to do any more my children are so unsettled.
2weeks ago my ex. Stopped answering her phone, I have sent texts messages, skype messages, my parents have also tried to get through to her but to no avail.
I am 200 miles away and feel even if I went down there she would not open the door to speak to me.
Rang Family Matters , they tried to arrange a mediation meeting but she refused. So far she has not given a reason for her actions.
Now at a loss as to which way to turn, depressed and missing my son terribly.
