Do You Have Parental Responsibility for Your Kids?
If you were married to your partner when your child was born, you have automatic Parental Responsibility. If you are not married and your child was born after 1st December 2003 and your name is on the birth certificate, you automatically have parental responsibility. If you are the biological father, you can still file for parental responsibility which gives you legal rights and responsibilities for your child.
Can You Make Decisions Concerning Their Upbringing?
With parental responsibility you have the right to be involved in all major decisions in your child life. This can be anything that significantly affects their upbringing such as education, medical treatment or religion. If your ex has residence of your children, she can take them out of the country for up to one month without your permission. If she wants to take them for longer or move abroad permanently, she will need your consent. If you have serious concerns about her taking them out of the country, then you can apply for an order to stop it.
When Does Parental Responsibility End?
Your parental responsibility and child support continues until your child leaves school or further education, which can be as young as 16 or finish when they are 19 and at university.
Finding out about your rights and responsibilities as a father is important so that you know what you are entitled to and what you need to do. If you can keep relations civil and handle the details with your ex then this can be better but, if not, you will have to go through the legal system to clarify things. Your ex has no right to stop you seeing your children and with a little bit of compromise and willingness you can both come to an agreement that is best for your children.

I received a text only a week ago that stated that my ex wife and my daughter had decided that I’m to no longer see her anymore??
My reasoning for my daughter saying what she did is how you would say childish as she is 13 years old..

What can I do?
I am in an abusive relationship with someone with a history of mental health, self harm and hospitalisation. This was hidden from me until 3 years after marriage. My wife is highly vindictive, controlling, abusive and bullying which I can now see is learned behaviour from how her mother treats her father.
I am 100% certain that if I leave, my wife will use our young child as a weapon. I will never be allowed to see our child and my wife will try to cause as much devastation to me as possible. In her mind, that is how she 'wins' if anyone ever crosses her. It does not matter that she or others might also suffer as a consequence; what matters is only the destruction of the opposition. My wife is obviously happy to launch nuclear weapons and has no consideration for the consequences; the problem with her nuclear war tactics (mentally and emotionally speaking) is that nuclear fallout lasts for a hundred years and I am not sure I can ever get past it.
My wife is hateful and cruel many times a day, and I can see she takes pleasure at some level in the acts at the time, although there might be regret at some level later (which she will absolve internally by inflicting more hurt to make herself feel better, in control and like the 'winner' again). She tells me 'if the house is better', 'if the garden is nicer', 'if we go on more holidays', 'if we have a better car', then things will be better. Her family are of the same opinion. My view is that the lack of more, bigger, better things are not the answer, but a symptom of the problem.
The choice I have is simple:
- Stick around and be the emotional punchbag instead of our very young child; or,
- Leave and never see my child again.
I love my child more than anything and would die for them. I feel tremendous responsibility towards them for putting them in this position and can't leave a small child to deal with this alone. Her family have admitted that my wife has a history of using those closest to her as her emotional punchbag. My wife says I am the reason for all her problems and why she is unhappy. I know if I leave, this will just fall to our 2 year old child.
I have been to ongoing counselling to survive this situation. I have tried to suggest couples therapy several times, but it is met with an angry "we don't need counselling; you need counselling! You're the one with the problem! If you don't like it, pack your bags and leave!".
Her family (led by her mother and her sister, who also shows the same emotionally broken and harmful behaviours) have demonstrated with previous family members that anyone who 'crosses' another family member at the end of a relationship will 'pay the price' and be metaphorically attacked (even if that relationship split w
Me and my ex partner split up almost exactly 10 years today. We were not married but were living at my house. She left and took both of my children with her. I’ve had weekend access and 1 evening a week as I was in full time employment ever since. My daughter who is now 18 has been living with me for almost 2 years now since her mother dropped her at my doorstep. And since April, due to COVID I have been left unemployed and shielding at the height of the pandemic. Now my son who is almost 12 has been staying with me for the last 2 months wants to reside with me permanently also and is refusing to go back to his mother until COVID is over as he doesn’t feel safe at her address. Yesterday his mother turned up on my doorstep yet again and refused to leave without our son with her, still he refuses to leave with her, and she threatened me with calling the police and child services.

I try to work things out with the mother, because both of us have parential responsibilities, but she is ignoring the cause .So up on contacting the nursery, I was told by the manager that they were instructed by mom not to give me any progress reports only newsletters.

Currently in court trying to get access to see my son, name on birth certificate among other things. The ex has stopped contact for what is now the third time since my son was born in September 2018. He is not n
Firstly, once the court is over and if my name is on the birth certificate if the ex denies contact again can I force her to let me see my son? Could I get the police to come to her house and get her to hand the child over if I have a copy court order and what would be my assigned visitation days?
Secondly, if this pattern continues can I take the matter back to court? If the matter goes back to court what ramifications could she face? Could there be sanctions or possible jail time?

Child support wants 8,735 in arrears went to court twice about it nothing changed they did not care.
She could just simply stop me seeing my son and of course now has turned him against me and lied about everything made me out to be dead for 3 years until I went back on facebook he saw me.

My children currently live in Germany with their mother and are looking to return to England, I thought great, I will be able to see them more but she has decided to live almost 3 and a half hours away in Norfolk - she is suggesting that she will meet me half way every other weekend. Knowing whats she is like, she has only done this to limit my access to my children and ensure as much CSA as possible. Do I have any rights at all to prevent her moving this far away when she returns to the UK and can she refuse to bring them half way. What are my rights here?

I did every night feed from birth until she was 13 month old and my ex partner end relationship and im kept from my daughter and because she used messages I sent asking on update on my daughter it got used as harassment by her allowing her lagal aid and im just wanting to see my own daughter and I have to represent myself against a trained solicitor wheres this fair on us dads .
I run my own business, so my time isn’t as flexable as hers and we are now at a crossroads, where If I can’t comit to dropping him off and picking him up then I am not to have him.

She has another child and uses the same excuse that she can’t pick him up or agree to a meeting point because of him (he’s 2)

Now our issue is his work because our daughter lives with me they have no obligation to give him time off for her appioments as they believe it is my responsibility to deal with her care needs they keep telling him I have soul custady which I have never claimed for I have residential as my daughter stays with me most of the time but stays over night with him twice a weeks. I was under the impression I'm Scotland if he signed the birth certificate and pays for her he had 50% rights towards our daughter. His work are refusing to give him time off because they he never been to court for joint custody we are confused about what rights he has as a father as lawyer has told us I have residential and we have never claimed for soul custody which are completely different.

I used to have my son on a week end from Friday to Sunday but sometimes only Saturday night all depending on what work shift I was in.... now my sons mother has cut my contact down to only seeing my boy on a Sunday for a few hours... basically she has done this because she don’t like me having my boy around my partner.... my partner has done nothing wrong for this to happen.. when I first got with my partner I used to get abuse saying if I didn’t end it I weren’t seeing my son etc.. then tried to get me to go back to her which I declined.... at that point she did have child services involved which they told her she can’t do that.... and soon as child services closed the case the games started to get played again.. had my son on the week end as usual then returned him home to later on getting a message saying my partner better not be playing mammy to my son... me confused replying what you talking about... so apparently he said he was with mammy and daddy.... he had only ever called my partner Mam once which we corrected him.... bare in mind he had only just turned 3 year old. And he was hearing my partners little boy call her mam... my partner is no danger to my boy one single bit... we all had a great bond which in some cases that doesn’t happen.... it has now been a few month of me only seeing my boy only on a Sunday and it’s breaking everything completely... when I loose my boy he looks at me as to say “where you been” disappointed etc... me and my boy had an amazing bond and he used to love spending week ends with me sometimes was hard to get him back home because he wanted to stay.... but now I have had people tell me she is telling my boy that her partner is his dad... this is destroying everything... I have 8&11 year old. Separated with their mother a year ago. We have been on and off for the last five years, this was because I found it hard to detach with my children. To call the story short. My ex thinks she calls the short every time I have to succumb to her demands. I have tried to be civil but I feel there is some alienation of some sorts that I don’t want to go into details of it. Now, there have been so many occasions where she wouldn’t be at home when I drop children off. She tells the children to lie to me that she is inside the house. Three occasions I have text her over the phone that I will not drop children off without an adult present at home. She will then say to me that they are older enough to stay at home until she comes home. I never did but I will wait until I’m sure she at home. The last time I dropped them off she told the kids to pick up keys outside of the house and go inside. She said she was in the bath and that was why she left keys for them to get inside the house. I waited two hours and drove them back to my house which take an hour. I refused to pick them from their house now. I told my ex that I will only pick them up and drop them off at the designated area because I can’t drop them off without an adult present. She said to me that I should either pick them up from home or forget seeing my kids. What do I do?

What really happens is not do pi k and fluffy. Court orders or flounce, mother continues to play difficult allowing you to see child one week and stopping the next. As the child gets older, mum decreases contact In order to get dad to spend more money in court. The court do not warn mum off they resume previous court order. Mum then alienates the child from dad. At the point of the child reaching 14 years old complete alienation takes place. This puts dad into a corner wee more costly court fees takes place. Breaking him financially. Only to result in child's wishes being the overall ruling that she doesn't want to see dad. Parental alienation completed. Court rules reduced contact and thus is supported by social services as they do not consider parental alienation as a harming strategy that occurs over a long period by mum against the child and father.
The benefits in favour of mum for following this process is that the dad becomes financially stretched through court processes. Emotionally pressured by not seeing the child as visitation is decreased. Upon the court ruling child Maintanence is increased as the no contact rule awards mum full benefit.
The law is an ass. Social see ices harm more children then they help. Dad's are treated like 17 century slaves to the system.

He suffers from depression and she is quoting concern over this as a reason for denying overnight stays. In reality, she has control issues and has been looking for any reason to gain control over his time with his daughters.
Firstly, can she use depression as a legitimate reason? There is no evidence of neglect or abuse...
Secondly, he has concerns that when he goes to collect them for the weekend stay, she will have placed them with a friend and won't let him take them at all. Would he be able to call the police in this situation? What could he do?
The ex has informed my daughter if she doesnt take the exact high school courses her mother wants she will enforce that she can no longer live with me.

I have no contact with my son for last 4 months nearly and I will not and dont want to speak to my ex partner.
I have been told although he has finished college this year he is returning to college in Sept to do further courses.
When does child maintenance stop having to be paid and what courses qualify for this to being paid still?
I have had him as per agreement with CSA and Ex regarding shared care but now as not having him for 4 months as he no longer wants anything to do with his farther apparently now claiming for no shared care.
My understanding is shared care is 1 - 50 (ish nights per year) so surely I have already qualified for this so why should payment now increase?
I'm in desperate need for some help regarding my set of triplets. Myself & the mother split up back in MArch & for the first 6 weeks I was going the house 3 evenings per week after work to help bath the kids, put them to bed & help tidy up. My son wears glasses and a few weeks ago I collected his new ones, he gets two pairs. his mother demanded both pairs to be kept at hers, I disagreed and kept a pair back, much to her annoyance that i defied her.
she has asked at every drop off and I've managed to avoid the situation.
Then on Sunday i was asked again, only this time the daughter was hanging from her arm getting very vocal and becoming quite brash, to be honest she was talking that much it became white noise and i couldn't hear the original conversation. Like what ? had I missed something? The daughter continued to mouth off until the mother told her to shut up and take our son inside. The tone changed immediately they were out of the way. she snapped, if your'e being petty over a pair of glasses, i'll be petty. you can take me to court for access to your son quickly slamming the door on me.
I expected a battle at some point but over glasses, maybe i was slightly petty but also why shouldn't i have a pair they didn't cost anything to either of us. This was more about me defying her.
I messaged the next day hoping to make a bit of peace knowing full well she would not see reason. several messages between us, none abusive but her more angry than me, she turned the reason from being the glasses to how i spoke to the daughter, I denied this but knew which way it was going. I have been in touch with my sons school and they were ok with me seeing him to make sure he is ok and understands. i didn't bad mouth the mother although she often does this to him.
My last message was to try and keep the peace knowing deep down i was wasting my time. i had no reply but knew she would be planning something else to get at me.

My son is currently in prison and me and my partner see all three children Regularly. The brother of my daughter in law has just told us he had got our oldest grandchild living with him and that he plans to go for full custody of her. He said that he has got permission for her to stay with him for 28 days then he has a meeting with social services to make this a permanent arrangement. My son is unaware of all this would he need to be consulted and give permission before this all goes ahead?

My Ex Partner (not married) left me suddenly a few months before the birth of our baby. Refused to make any contact with me until last week when she asked for Child Support through the CSA. I am not on the birth certificate and she has no intention of letting me see her.
I have read conflicting advice where sometimes it has said if im not on the Birth Certificate then I have no legal right to pay CSA. Is this the case?

Where do I stand on this, I just feel that she us hiding things from e in regards to my kids
i've seperated from my partner and we are due to have our baby in just under two months. She is extremely controlling and will readily feed me false information in order to get the outcome she wants. she has told me that the baby must take her surname and that her lawyer has advised her that is the case, however, the solicitor i saw, the citizens advice and the info on the government website would suggest that it isn't cut and dry and that we must be in agreement about it. we werent married or anything but they all told me that didnt matter in relation to surnames.

We are currently living with his parents as we are trying to save some money for house deposit. He is worried if he would go to court, the court won’t grand him to have his daughter every other weekend as we don’t own/have our own house. He is worried the court won’t let him have her over night or would side with the mother.

Is he lives 80 miles from me and my youngest who is 15 has Aspergers and anxiety. Moving her away from the town she has always known will be too hard for her. It's been a hard decision but I think that the best solution will be for my ex to become the main Carer ( we share parenting 60:40) and she stays here in her familiar settings and I commute up to see her every other weekend and maybe more. I know she will want to stay here.

I split up with my ex almost a year ago and have struggled with contact ever since. In October last year we can to an arrangement where I have contact 5 nights out of every 14 which I think was fair considering I practically raised my son alone for the first 2 years of his life.

I even had to get a loan out to pay for the court order to see my kids, which am now already paying back at a pound a month because I cannot afford to make the agreed repayments.....due to being on a low income and that fact that child support payments are just too high for what I can afford.
With this lasted news that now they want me to give more! I feel that I I I cannot go on anymore I cant bear the thought of not being able to have them stay over with me at the weekends anymore because I can no longer afford a place to live.

Anyway i stayed with her and tried to do the right thing, tried to make it work, happy families etc but the ungrateful lazy cow just made my life a misery and nothing i did was good enough. She complained about having to stay at home all day with a newborn baby while i got up at 5am to go out in the freezing cold and do a days work. I think we envied each others' situation. She was irrational, violent, abusive and i feared for the safety and wellbeing of our baby when she would lose her temper, no joke. We were better off apart but the final straw was when she tried to stop me going on my best friends stag do (as best man). She tried to make me choose between them or her and i chose my friends. Yes, i am still single while they are all now married near enough and i probs wont see them ever again but better to have loved and lost than live with the psycho the rest of your life!
So stressful times followed, we split and i was thankful to be rid of her tbh but my girl was caught in the middle unfortunately and i wanted to be a good dad still.
One day i went to collect my daughter from the station, halfway between where we live (30 miles away) and she suggested i start giving her childcare money even though when my daughter is with me, she doesnt need it. So she phoned the police and tried to stop me taking her home! Is that blackmail or using my daughter as a tool or what?!
i have been lucky in a way, having 50/50 care for last year or so with thanks to my parents. It was a good routine for all i think as i wasnt missing out on too much as she now lives 60 miles away.
Anyway now my ex has found a job, wants to put daughter into nursery which is fine i guess but dont have much of a say. It means i cant have her for a week at a time like i did because apparently she needs to take a fulltime space at nursery and if i wanted to carry on like before, id have to pay for a weeks worth of childcare every other week so she could be with me rather than at nursery, which would mean her paying for a weeks nursery for no reason. That is half my weekly wage and i am not entitled to any kind of help. That is not an option. I dont have much choice but to see her only on weekends now, but is it fair for my ex to demand payment if i want to have my daughter for an extra day or two which fall on her 'nursery' days?? On top of maintenance?? Surely she is paying it anyway with the benefits and free childcare? it just doesnt seem right to me that i should have to pay extra to see my daughter when my time with her has already been reduced. If i dont, she stays in nursery. It feels like blackmail again??
I know there are guys out there with bigger problems and who dont get to see their children at all, and my heart goes out to you. But

Since my ex and I separated 3 years ago I have been doing all of the collecting and dropping off of our son. I stood my ground the once and suggested that she should pick him up as he is both of ours and didn't think i should be doing all the driving she only did it the once and punished me for it (and my son) by stopping me from seeing him for a month so I never asked again through fear the same would happen again. She says I left the home and area so it's me that should be doing everything, I moved back to my home town 45 minutes away about 40 miles. ( I left due to financial, psychological and emotional abuse). Does anyone know if she is in the right or is she entitled to help with lifts??
Another question is that I pay her child maintenance but she still asks for monies for activities nursery fees ect, is this covered in child maintenance?

I parted from ex 3 years ago due to her suffering from female covert/shy narcissistic personality disorder and her being unfaithful . We have 4 year old son together. I moved 50 miles away to be closer to my family and have since travelled 400 round trip each month for him to stay with me every other weekend.
I've always paid child maintaince and helped out with swimming lessons taken him to Portugal and other trips away he is my world. I have a new partner and daughter and brought a new home together but my ex just takes away my weekends as she pleases so we can never plan anything which usually cost me money on tickets on things we have planned and keeps us all on tender hooks not knowing if he's aloud to come abroad with us or weekend breaks that cost us hundreds of pounds in flights and changing dates. We get constant abuse and psychological projection. She has had a number of failed partners since me but as recently met someone new and has stopped me from seeing him on both my weekends going a month without seeing him due to me getting engaged, it appears that every new thing i do with moving forward in my life eg home, engagement, daughter ect she punishes me and more importantly our son I believe his emotional needs are not being met by her as she messes with his head some of the things he tells us are really upsetting.

I am trying to find out if there is any way of having some form of rights or parental responsibility for 2 children who are not biologically mine. I have fathered my boy (6 1/2yrs) since he was 1, and my daughter (nearly 4yrs) since birth. My ex partner conceived my daughter when we temporarily broke up for 3 months, which ended up as me being the father of 2 kids who weren't mine. my son's biological father is on his birth certificate but not allowed access by the courts, there is no name down as father on my daughters birth certificate.
I have regular contact with children since me and their mother broke up 1 1/2 yrs ago. and in all but legal and biological sense, I am their father and love them as my children.
There is a current situation where I may (but hopefully not) have to get child services involved. So I am trying to find out where I stand if the worst happened and if the mother refuses me contact. Any help, info or direction would be greatly appreciated.
Up until this month I have always had my kids 2 nights a week every week and let the mother know 3 weeks in advance.
Now my eldest has just started school and she is refusing to allow me to have them through the week and only to have them at the weekends. She knows that in my line of business I generally work most weekends (She works for the same company) and her saying that I can only have them on a weekend means I potentially can only have 1 in 4 weekends.
Her argument is that she wants the kids to be in a routine Sunday to Thursday for school, which I agree with but she won't allow them to stop at mine during that time. Restricting how much time I can spend with our kids.
I've argued that I would ensure any routine she would be following from school finishing (homework, tea, bath and bed etc) I would ensure this is followed too and that, they would be picked up on time and dropped off at school on time (I live about 30/45 minutes away from their school, as the mother moved away).
What advice can you give me? I'm seeking citizens advice help tomorrow.

I have been there for my daughter ever since she was born and paid child maintencance, bought her presents as well. Done everything a dad would do. Now my ex tells me that she's living in a shared home with other mother's which i believe it's an institute and will not tell me where. I am looking for some answers on the following issues. My ex wife who am divorced to has my 8 year old daughter living with her and she has a residence order through court. We have a contact order on when I chat to my daughter on the phone or FaceTime during the week and weekend. My ex runs fitness classes during the week at local park in north east England were she works most nights and my daughter gets left with different friends each night plus her new boyfriends mum. I have been there for my boys from day one, my first son was demanding and his mum couldn't cope so we have a very close bond, I worked and had a very well paid job, I paid for EVERYTHING that's how it was. Second son was born and this was different, mum bonded with this son straight away which was good. My partner has not been able to see his son for 6 years and has not paid child maintence because of this. He would provide anything his son needs and would pay if he seen his son.
He has been to court twice and got access but his ex partner still stopped him, remarried and moved with no forwarding address.
The csa is saying he is in a lot of arrears and they are now trying to take a lot from his weekly wage.
This seems really unfair as he misses his son greatly, done everything in his power to his him but due to his ex moving and marrying, is not able too and has not been able to for a long time.

Right my ex got pregnant on purpose so i would never leave her, My daughter was born on 03/03/03 i was not allowed at the birth ? i was not allowed to be with my daughter on my own ? very strange all round as i am an amazing guy i think and i would of been the best, caring, generous, loving father my little girl could ever have wanted, My ex ran off with one of my so called friends 9 months into my daughters life and i was no longer allowed to see her. My son's (ex) partner is the current owner, please explain how can she be legally excused & demean her current responsibility, furthermore she has now acquired yet another animal?
She has since sneakily moved away with their two children but has completely abandoned her animals, that my son because of his current work commitment can't possibly look after 24/7.

6 months ago the family home was sold by mutual consent and equity divided. Whilst it was going through I agreed with my ex wife not to keep turning up to see my son and that once the house had been sold we would solve the problem. She has always maintained to me that she thinks it's important that our son sees his father but would never 'force him' to see me. Following the equity divide a couple of months ago I tried to arrange to see my son but was told once again he didn't want to see me... again no reason as to why. My ex wife would not even tell me where to find him now on a weekend so I can see him. I love my son dearly and it breaks my heart as I know deep down we do have a lovely bond and the thought of not seeing him grow up is very upsetting. I don't believe for a minute that not seeing me is his decision totally which is very frustrating to say the least. I have no idea where he is living other than a town which they privately rent in although I do know what school he goes to. CSA has always been paid by me etc.
I would like to know where I stand in seeing him and if my son at the age of 7 can make that decision himself and if indeed he can be forced into attending court?

My husbands ex wife has always made my husband feel she can stop him seeing his daughter at anytime. Once I made friends with her the situation was a lot easier, my family and I have accepted my step daughter like a daughter as we didn't want her feeling different when she came to us. Long story cut very short my partner and his ex split when their son was very young.

Contact order was granted after a long fight, went okay wish despite control and eventually broke down.
No contact since may, a message per day or every other day asking how child is has been maintained to TRY and maintain some level of communication all of which was ignored. We no longer have a solicitor as cannot physically afford it anymore!!!
SO MY QUESTION IS:
where do we stand legally, when child has moved house (he's three) with mother and new daddy. She refused to give us this information, and only comfort we had was knowing he attended local nursery. Just found out that child has been removed from the nursery and we are royally stuck.

I have a 10 old daughter from a previous relationship. We split up when she was one. We have always been amicable, my daughter would ordinarily see him every other weekend.
I relocated last year, 75 miles from where he lives. We had a verbal agreement that I would meet him 25 miles away from my home to get my daughter to him on his wknds.
Which up until 8 weeks ago was not an issue, when he had a child with his new partner. His new partner threatened to.put my daughter in a taxi. He is now demanding that I take my daughter to him every weekend as he feels I should not have moved so far away.
I have told him we need to stick to the original agreement. He has refused to see my daughter because of this.
My question is, who's responsibility is it, when it comes to getting my child to her dad? Do I even have to meet him anywhere or should he fetch and drop her off at my door?

I am writing on behalf of my partner who has two children from a previous marriage. However he was seeing them regularly every weekend and when he started his new job which consisted on a rota based shift pattern which meant as part of his contract conditions to work one weekend on and off. She didn't accept that he is obliged to work on a rota basis. Which she started being difficult by not letting him see the children on the weekends that he wasn't working. Prior to this they already had an legal agreement stating that he is allowed the children every weekend. He is paying child maintance and has paid for mediation on numerous occasions which she just ignores him and his family. She doesn't turn up to mediation either. She has completely cut him out of their lives and threatenes to phone the police if he try's to contact her.
He is currently in the court proceedings against her for access but as a legal action he has to go through the procedures before he can take her to court and obviously it's being able to afford constant court costs. The children's birthdays are soon and he would like to see them but obviously she's just trying to block him out of their life.

My question is how do I get access to my kids and what steps or procedures should I follow.

Myself and my wife have separated in January and upto now have seen my son 15 months old once a week for six hours.
I moved to family to give her the space she stated she needed...I have returned to the property today where we are joint tenants to get some personal belongings and has changed the lock.
She stated I have no rights to be there and that if there is anything I need she will get to me and also stated i should let her know I was coming.
This i know is not true of course and she has now stated that my belongings etc will be sent to her mums garage and to liaise with her - what are my rights around property being removed from house etc and can she do this ??
To this point I still haven't a clue how it's got to this only that she is possibly a narcissitic sociopath who in the end has used me and disregarded me out of her life oh yeah and a possible adulteress .

We have a 5 & 9 year old boys together & my step lad is 16 now.ive been living at me mums for a year , but before that was on sofa bed at x house in front room for a year.
She always said I can see them when I want and we still done things together as a family, witch was good for the kids .
I list me dad few years earlier and few months later she had a stroke at age 40 , and I hit the alcohol for few months as my head went didn't no how to handle it , but after while got myself together .

I have been unable to contact her directly as a month or so ago i was told that her phone was playing up and she couldn't receive calls or txt's from certain numbers!
After finding out about the admittance into hospital and not being told anything, I contacted a couple of her family members to find out what was going on and how and where my daughter was.
To cut a long story short, i was told not to contact them and to leave them alone to deal with the situation!
This occurred on Sunday, today is Wednesday and i still haven't heard anything from my daughter's mother or any of her family.
I would like to know if my daughter's mother still has the rights of my daughter's Primary Carer even though she is incapacitated in hospital. And does her family, who my daughter has been left with, have the right to refuse me contact????

He is saying he is by law entitled to have her for half of her 6 weeks holidays, 2 weeks in one go the 1 week a few weeks later. My daughter has been down there last summer for 2 weeks I decided to try it but when she went down again she cried to come home and he wouldn't let her, she became very anxious when she came back, she didn't want me to leave her even to go to the bathroom. This summer I am saying that 2 weeks is too long he can have her for one week at the start and one at the end.
Is it his right by law to have her for 3 weeks? And if he doesn't bring her back after a week is there anything I can do?

For context, my ex is in Brazil with my daughter. I have always been proud to pay generous support, but she is now actively stopping me from seeing my daughter. The truth is the only thing I can control in these circumstances is the money I give, but I am getting nothing back as a father.
The money I give equates to a large sum in Brazil, and is solely based on my UK wages. Are other factors, such as the average wage in Brazil relevant, or even the significant costs of flights to travel to see my daughter.
The truth is, I am happy to pay and support as things are, but I need leverage to make sure I get to see my daughter and be a dad, not just a bank.

Split with ex girlfriend at the beginning of pregency after a hard period of time whereby she was trying to stop me see my child from another relationship. She has always gone on about child payments and that she will require my work details to prove wage increases etc yet now after baby is born she's completely change direction saying she's not bothered and will except my monthly figure! I've always had an issues about this baby as soon as I had left she was or so I'm told my her in another relationship. After speaking to CMO and others I was advised to think about a perturnity test. When visiting the baby for second time I was asked by ex what was I going to do about child maintenance and I said that I was advised to create a family based agreement and request the test. I was asked to leave and now been told that I cannot see this child again and she doesn't want any money from me. Two questions, first can she stop me seeing the child? Secondly what happens if she refuses money off me ? I'm confused if this child is mine by her actions and the attempts to alienate me from everything. I feel I'm being taken for a ride! Many thanks
They are probably separating and moving out. Plans have been made without including me that we (2 adults & 2 kids) should then move in as he cannot bear to be alone in the house - he has never even tried to do it!!!
I have objected on account of needing a place to call my own, I work shifts and enjoy reasonable family privacy. His house is not big enough for this, and is literally only 200 yds from us.
My wife has insinuated that she will just take the kids anyway when the time comes. All very unreasonable in my opinion, and I have yet to find another person who disagrees with me.

I have recently had him for Christmas as we are now taking turns each year on who he stays with. Me my parents, sister, brother in law and nephew are all planning a holiday away next April. I have asked my ex's permission to take my son away too, in which she has replied he is not ready to be that far apart from me...
Now I never have any issues with my son at weekends. He never cries for his mum and is a very happy and outgoing boy. I just want to understand what my entitlement is to having him for longer than just my weekends, for example holidays, bank holidays? And what it is I can do as the only response I seem to get from my ex is "he is not ready". I have tried mitigating talks with her, however it just turns into crying and arguing. Never had this issue as of yet with my ex, but as I haven't backed down from my parenting duties and want the full experience of being able to have the freedom to enjoy my time with my son without any restrictions?

I was arrested and questioned social services were involved and to cut a long story short I was cleared of all accusation. The police and social services deciced it was mams opinion.
I never saw my son all of October due to this, I now see my son every other weekend Friday to Sunday night as I've always done.
I decided to go for extra access all I want is my son every other weekend Thursday after school to Tuesday morning when I drop him at school.

I was once in a relationship and we stop on very good terms. After a year and six months into our separation my ex girlfriend turned up one night in my house to discuss a possible rekindling our relationship which turned to be a lie. That very evening we had sex and she went the following morning.
I did not see nor hear from her until two after her baby was born and then invited me to her house to tell me something. By then I had already moved on with another women in my life which I was about to marry.
At the family house of my ex, she then told me I was the father of her child which initially I laughed over it thinking that was a joke but subsequent days with rhetoric convince me that she was serious. I became angry and upset and we did exchange some few words but later accepted responsibility and later she arranged for us to register the child together. Later provided child care facilities for my child.
Knowing that I have moved with my life, my ex decided to ban me from see the child and told me the child now has got a new father which was had to take because of then my immigration status I couldn't pursue this through the court thinking that will complicate my situation however, I tried as much as I can to keep in touch with the mum but didn't want to know.
I am married for 16 years with four kid, Now the child is 16 years in sixth form, I know where she attends school? Currently what I want is the child to know her biological father as the mum is hell bound to prevent the child from knowing the truth. I have asked my ex on numerous occasions to sit and discuss this issue as its not about us but the child.

As my partner lived in a one bedroom flat before we moved in together a year ago, he would visit his son at his exs home, but once we moved into a bigger place to provide a bedroom for his son, we have been bringing him back to our home for one week; every seven weeks. Brining his son home rather than staying there in the Channel Islands with him costs ALOT less, plus his son then has the chance to reconnect with his family over here.
For our last visit, we went to his exs country to stay for a week as there was an opportunity for my partner to work some evenings while we were there, making it more affordable.
My partners ex has out of the blue told him that he is not to bring his son back to our home for our next visit, and that he would only be able to see him if he stays over there. This is apparently because the last few times we have taken him home, he has been very distressed and has taken weeks to settle back into a routine (which she has never mentioned, and hasn't seemed to be a problem before now), and that she can't trust my partner to not take the child home, although she has absolutely no evidence to back this claim up and no reason to believe that we wouldn't return him home.
We have already booked our flights, made arrangements with other family members, and have been planned a birthday party for him when he is over visiting (which should be in two weeks time).
We simply cannot afford to stay there to visit, as he cost of a hotel alone is £200+, solely for my partner.
We never have any problems with his son while he is with us and the only bad behaviour he shows has been learnt from his mum (swearing, certain behaviours), and he is always our only priority while he is with us, which goes without saying.
Where does my partner stand, and what can he do now? She has threatened to call the police and have my partner arrested for kidnap if we cross the border.
The problem is, he has been told there is a £60 signing on fee and then it's £30 per hour, add the £35 train ticket and it's going to cost £125 to see his daughter for an hour. He is on minimum wage, is there anyway to avoid these costs or at least get help with them?

My boyfriend has a 12 month old son where the mum only lets him see him every other week for like an hour or so... He would like to be more involved( she left him as soon as she found out she was pregnant...) he is not on the birth certificate although it is very clear he is the dad, the little one just looks like him! He pays her a fair amount of money every month because he wants his son to be well cared for! It is all emotionally very straining for him and he does not know what to do in order to get parental rights and to be actually put on the birth certificate! Two weeks ago she asked me to have them again for 7 days so she could go on holiday with her partner. Because I'm out of work and living with my parents I explained that I couldn't afford to have them. Each family event when we have child, as agreed in order, such as holidays, new year celebrations etc we get a call from CSA asking AGAIN to review salary and for proof of wage as mum called again. She does this when she knows we are enjoying quality time with daughter and either with family friends or on vacation (3rd time) She argues about everything and anything and we have resorted to reducing contact to factual essential communication only though she still manages to create a storm and go mental.
Is there a way we can avoid harassment from CSA when they see payments are made regularly and know we have always been co-operative with them and mother. We hope they have records that each time they have been asked to contact us we have either been on holiday (with child) or have had family visiting for special event? There is no doubt mother is psychologically troubled but how can they still do their job but avoid constantly harassing out family during special moments?

My issue is that my little girl is nearly 2, I have always been a big and active part of her life, having her usually 10-14 days a month..usually I'd pick her up on the train and bring her back to mine, my daughter lives 70 miles away with her mother. The journey usually would cost around £80 altogether to pick her up and then take her back a week later.. But about 2 months ago when she was staying with me I couldn't afford to take her home, due to my hours been cut at work.. I told her mum This which then resulted in her giving me a lot of abuse along the lines of me not being fit enough to look after our child and how she doesn't trust me to have her if I can't get her home.. This is the only time in two years I have asked her mum to pick her up. In the first place I never agreed to doing all the travelling but just went with it as I wanted to see my daughter.. Since then she hasn't allowed me to see my little girl, I've been up on two occasions and she won't let me near her, I've messaged her countless times to try finding out how my little girl is with no response..the only.response ive actually received off her at all was one saying we needed to go to mediation, after researching that it doesn't look like it will do us any good..
Long story short I want access to my daughter. Not only is this breaking my heart not being able to see her grow, but I cannot begin to imagine the effects it will be having on her, going from seeing me every other week for 5-7 days at a time, to not at all! She won't have a clue who I am..

I am moving back down to coventry as that is where home is for me but is also 300 miles each way.
I tried to work out an agreement with the mother about 1 week a month until he is old enough to go to school and then bank holidays and half of his school holidays.
She is not willing to negotiate and is tellIng me the most she will agree to is a weekend a month. This is as good as giving me no time at all as it takes 12 hours for a return journey and 12 hours back, so effectively it will be pointless aswell as financial unviable.
I was present on registration of birth and have payed (with proof) an agreed maintenance between us both.
What can I do?

I have an agreement to pay my ex £300 per month for my 4 children, I am allowed access whenever I want but it normally amounts too 2 nights a week.
I have no arguement with paying this amount for my children, however.. She lives with an unemployed man he has access to his child from a previous relationship and they have 1 child between them! 6 kids under that roof including my 4.. Now not to complicate things she has 1 more on the way! That'll be 7!!!
I know my money for my kids is not going on my kids and I'm providing for 4 soon to be 5 other people in that house!!
How is this fair on my kids! I'd rather give them the money or buy them things! Is put it into a savings account! Anything other than seeing it not go on them!!

This is because he mis-behaved at nursery , he thought he was the Incredible Hulk and the nursery in my view over reacted and contacted my ex at work and explained their concerns of his behaviour .
In turn my ex phoned me and blamed me for his behaviour at nursery , and stopped contact instantly .
Every single I have had my son since he was 1 year and now he is 4 .. He has a 6 year old brother from my previous relationship in which he has a very close bond with .
I am on the birth certificate and I know have rights .
But she is so hard to talk to and refuses to listen ..

My wife and I have 3 brilliant kids. Unfortunately we split up after 16years and both have new relationships. I have ended up moving abroad and we agreed I woukd see the kids once a month over a weekend and coukd keeo in touch via Skype. I bought all three a tablet each each, set up a skype account for each and told them they could contact me.when.they wanted to. Granted I may jot be there all the time but when I hear the call I'll answer. My wife and i agreed they woukd call me at least twice a week, on a sunday and wednesday. I also in neteeen received.messages from my two eldest and also a call from them. As my daughter tried to call me and couldn't get hold of me she got upset and my wife found it difficult to deal with. So she threatened that should the kids try and contact me on days not agreed upon that she would remove skype from their tablets. She is now doing so and thus disabeling the kids to contact.me.on their terms and.also stopping me from contacting them when I want or messaging.them.when I'd like...
Is there anything i can do about this?

This is my first post and I need your help.
Me and my ex partner have been split for almost 3 years after things not working out. We have 2 boys together (4 and 3).
The reason for this post is my ex keeps messaging, calling and facetiming me regarding my eldest's behavior. At home he seems to be a very angry boy, hitting and throwing a huge tantrum every other day, which results in her contacting me to calm him down. When he is with me I never see this side of him, don't get me wrong he'll have his moments but I nip it on the bud and lasts no longer than 5 minutes, its nothing like i hear or see on the phone.
It has got to the stage where she says she can no longer cope with him, countless times she's told me this now (Over a year) and it gets so far and she changes her mind. Last night it happened again but went further than usual, i ended up going round there to talk about him actually coming home with me. The way she explained how he is was like she was talking about a completely different little boy! We both agreed it would be best for him to come with me but she wanted to sleep on it first before she made the final decisions. As you can imagine this morning she had changed her mind again which made me fairly upset. Its been going on for over a year now with no sign of his behavior changing at home.
Personally I feel its his way of getting attention, are youngest i feel gets it all from her. She baby's him still and also maybe because my eldest looks like me and the youngest looks like her is the reason for it, i don't know.
I Just feel he is not happy at home, I need help. What right as a father do I have to say enough is enough, he is living with me?

As I am paying out of my salary that was at my request and not a court order, can I stop the payments?
My child's Mother has requested to know where we are staying when I have him at the weekend... I am just wondering if this is a legal right she has, or whether whilst he is with me, this kind of thing isn't a legal obligation on my part?

connection with your child, the nature of the application (which may stand you in good stead because of your job which forces you to work away). It will also take into account the nature of the application and/or whether the application might be harmful in any way to your child. Should the resident parent object then it is likely it will go to a full hearing. I hope this helps.

I am on the mortgage with my father as my wife was unable to obtain a mortgage with her credit and debt history. I do not care who gets the house to be honest as I have two children who obviously are my first priority. My concern is that as my wife does not work more than 15 hours a week and has outstanding debts her money does not cover anywhere near the money she will need to keep the mortgage so I am guessing we will need to sell the house.
As it is a joint mortgage with my father I when we sell the house will the equity be split three ways or will I get half and have to split that half with my wife and my father gets a whole half? I have obviously paid for the house myself and my fathers name was on the mortgage to help us get onto the property ladder.
I want to look at the best way for my children as this is going to be hard enough, I just wish I could pay the mortgage the child support and everything but unfortunately cannot.

Right now we have joint custody and if I make 60000 and she makes 30000 then I minus 30000 from my 60000 and pay support on the remaining 30000. But why if she stays home to raise someone elses baby I have to suffer and pay more? It was not my choice.

i want to be her full time father just like i am now. i dont want to have her over weekends of whatever. niether do i want my daughter being uprooted and live with her mom at her nans, she wont even have her own bedroom. i realy need help. my daughters mom has already had the police out to me because i wouldnt let her leave with my daughter, but these stupid police offers told me my daughter is better off with her mom, what do they know !?

As I am on both of their birth certificates, does this fall into the category of an everyday decision that I have no say in, or is it an issue I have a right to make a joint decision about. Quite frankly I think it is disgusting to leave them with a 13 year old, he may well be a mature young lad but I don't think any 13 year is equipped to deal with emergency situations and I think they are easily distracted and don't fully understand the responsibility of looking after young children. Their danger radar is non existent. That's just my opinion, would appreciate others thoughts so I know if I'm just worrying for no reason. Thanks guys
you wont be breaking any laws if you obtain your son as I have asked this information in the past directly from the police...It does however reflect badly on you as even though you are his father it classes as kidnap. this is not an offence punishable by law and your child's mother would have to take you to court to acquire contact just as you would if it was the other way around. If the police have failed you as they have me I understand your wanting to protect your child I cannot condone any course of action you might take but just know that you are breaking no laws as long as you are on his BC
Firstly are you on the birth certificate? Secondly has your gf gone abroad, or do you know where she is living? My advice would be to contact a family solicitor (ie Emery Johnsson) if you're like me and unable to afford the costs you should go to your local court and enquire about self representation and obtaining a contact order...this is easier to enforce if you are aware of how to contact your partner
My argument to date is, his ex works minimum hours, and the eldest has just announced that he is going to defer his college course till September 2015!!
Does this mean that theoretically he stops paying the equivilant of CSA FOR 12 mths, as the eldest has chosen this route, unfortunately he has never had a job as of yet, and I struggling with the whole set up!

I met my partner when she was 6months pregnant the child is not mine. The biological father was not around until my son was born but was not interested in baby just getting between me and my partner and only saw baby once every so often when he could be bothered but then he stopped and he started threatening violence upon us so we got the police involved. Baby is now 7months old only seen biological father 5times and my partner has never received anything from him he is not on birth certificate and I have been bringing baby up as my own. Now only yesterday he says he wants access and is threatening with court me and my partner are scarred because we don't want him around as he is violent and a heavy drinker what rights does he have and what can we do?

I have not seen my children in 6 years (they chose not to see me) and I believe my 19 year old dropped out of her college course from fall 2013 - spring 2014. I continued to pay child support, as I believed she was in school, but have suspicions she wasn't.
Is there anyway I can find out if she did in fact go to school? Or on what date she dropped out? Keep in mind she is an adult and the college won't provide me with that information.
I'm not even a father yet but will be I a few weeks all being well. My ex partner decided she wanted to be a single mother as soon as the test went positive and insists we will never be a family, hard enough but she is now making all kinds of threats. Baby due October and she has already frozen me out of the rest of the pregancy, only talks becuause I gave her £1000 cash for a midwife and send food every week, but now she is taking about taking the baby to America for a month when it's six months old and then for six months or more when it's a year old for her work. She doesn't want me to complain and just go with the flow saying I can visit for a week or two if I'm behaving like an adult. I know she needs my consent but im not sure i can stop her as the fight it would cause would make the future working relationship impossible, but this seems totally unreasonable, i'll have missed a 1/3 the my child life by the time is 18 months old. I try calling my but no answer, I try texting her, she don't reply back most times & when she does she says not this week. What do I do? Where do I go? I really dont want to go to court for this but she is being so stubbon about everything i think i have to.
She keeps telling me that she is doing this to better my daughters future, but surly she dosnt have to go all the way to u.s to do this and take her away from my father.
Hopefully, if it does go to court they will see that aswell.
She now wants to move out and take our 2 year old son with her, I still love her and have said we should go to counselling to see if we can work out our differences but I guess she just wants out.

My partner has 3 kids, 18, nearly 16 and 5 years. His eldest son lives either at ours or wherever he can get a bed (his mom has said he cant stop there cos she gets no money for him) his second eldest does stay with his mom, and his daughter lives with her grandmother (moms side) and has been for 9 months now. Dad has tried to gain custody of his daughter but mom keeps lying to prevent it. He pays maintenance every week via standing order, yet she doesnt give the kids anything, nor provide clothes etc, we do that on top. She tells the kids the dad doesnt provide. Should he have to pay the mom if she doesnt have the children? Dad is obvoulsy getting really down now, as this has been going on for nearly 3 years, and its getting worse! I dont know how else to help him. I dislike my ex, I dont speak to him and discussions take place via text. He has messed me about over momney too etc etc, however, I have never once retaliated, so this bugs me cos I just cant understand why my partners ex cant just grow up and put the kids first!
